which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title XIX of the Social Security Act to strengthen coverage under the Medicaid program for certain foster youth individuals.</official-title></form><legis-body id="H634CDF4D933B4A06AE2BAA68172450BA" style="OLC"><section id="HFD2C92BF5B3948D9B85DCB50F741A510" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Foster Youth Dental Act of 2021</short-title></quote>.</text></section><section id="H3F36FFCBD4FF4658A28E5E0DADFE6D0B"><enum>2.</enum><header>Strengthening coverage under the Medicaid program for certain foster youth individuals</header><subsection id="H183DDA2DA3D84970A803590EC77A0B29"><enum>(a)</enum><header>Expansion of EPSDT services to certain individuals aged 21–25</header><paragraph id="H6DCEE8BAFCC94BF88CF0F6A798A9DAF2"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Section 1905(a) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396d">42 U.S.C. 1396d(a)</external-xref>) is amended—</text><subparagraph id="HC4E46B69A14E40E59E5EBA11117DBEEB"><enum>(A)</enum><text>in paragraph (4)(B), by inserting <quote>(or, in the case of a specified individual (as defined in the matter at the end of this subsection), under the age of 26)</quote> after <quote>21</quote>; and </text></subparagraph><subparagraph id="HA11E294957B341699885C8682D6BD0C9"><enum>(B)</enum><text>by adding at the end the following new sentence: <quote>For purposes of paragraph (4)(B), the term <quote>specified individual</quote> means an individual who is in foster care under the responsibility of a State (or was in foster care under the responsibility of the State on the date of attaining 18 years of age or such higher age as the State has elected under section 475(8)(B)(iii) and was enrolled in a State plan under this title or under a waiver of a plan while in such foster care).</quote>.</text></subparagraph></paragraph><paragraph id="H5D1CF38A2FCC4872B677E3835D55DAA5"><enum>(2)</enum><header>Provision of information with respect to dental services</header><text>Section 1902(a)(43)(A) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396a">42 U.S.C. 1396a(a)(43)(A)</external-xref>) is amended—</text><subparagraph id="H9D136563F661409BB225FF58989362C8"><enum>(A)</enum><text>by inserting <quote>(or, in the case of a specified individual (as defined in the matter at the end of section 1905(a)), under the age of 26)</quote> after <quote>21</quote>;</text></subparagraph><subparagraph id="H8EA75ED92F2A4F3A9531E99DA21C3F9E"><enum>(B)</enum><text>by inserting <quote>(including dental services)</quote> after <quote>treatment services</quote>; </text></subparagraph><subparagraph id="H3B9E1CAFBD4F40E994919F1A4489C5DC"><enum>(C)</enum><text>by striking <quote>and the need</quote> and inserting <quote>, the need</quote>; and</text></subparagraph><subparagraph id="HDC1E98E799C74C20945BD0C11B35EB0F"><enum>(D)</enum><text>by striking the comma at the end and inserting <quote>, and the importance of maintaining good oral health,</quote>. </text></subparagraph></paragraph><paragraph id="HC26220A3DBFF4323A181DC0A7166EAB9"><enum>(3)</enum><header>Effective date</header><subparagraph id="H706F273554014059988B2168D06CC501"><enum>(A)</enum><header>Extension of coverage</header><text display-inline="yes-display-inline">The amendments made by paragraph (1) shall apply with respect to medical assistance furnished during calendar quarters beginning on or after the date that is 80 days after the date of the enactment of this Act.</text></subparagraph><subparagraph id="H77339FA280EB44EDBF844492F3E6D686"><enum>(B)</enum><header>Provision of information</header><text display-inline="yes-display-inline">The amendment made by paragraph (2) shall apply to information provided under section 1902(a)(43)(A) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396a">42 U.S.C. 1396a(a)(43)(A)</external-xref>) beginning with the first calendar quarter beginning on or after the date that is 80 days after the date of the enactment of this Act.</text></subparagraph></paragraph></subsection><subsection id="H6C38803C304243E1AB9A0135295C2004"><enum>(b)</enum><header>Incentive for the provision of dental services to certain individuals</header><paragraph id="H67FC1AEEE28A4F129E415FFD69A16060"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Section 1902(a) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396a">42 U.S.C. 1396a(a)</external-xref>) is amended—</text><subparagraph id="H5E865FB839B14914937B082D2696CEFD"><enum>(A)</enum><text>in paragraph (13)—</text><clause id="H0BADD979401345A6B0E6170B27216495"><enum>(i)</enum><text>in subparagraph (B), by striking <quote>and</quote> at the end;</text></clause><clause id="H467E89FE1D754C21811F92A030C470DC"><enum>(ii)</enum><text>in subparagraph (C), by adding <quote>and</quote> at the end; and</text></clause><clause id="H16622E251BF843E4AF66ECDE64905D67"><enum>(iii)</enum><text>by adding at the end the following new subparagraph:</text><quoted-block style="OLC" id="HA365ECD2A4EF40D6948CD7334557B0F4" display-inline="no-display-inline"><subparagraph id="HD41D4359B363463A8D3A9A23C5F2B78D"><enum>(D)</enum><text display-inline="yes-display-inline">for payment for dental services furnished on or after the first day of the first calendar quarter beginning on or after the date that is 80 days after the date of the enactment of this subparagraph by a dentist to a specified individual (as defined in the matter at the end of section 1905(a)) under the age of 26 at a rate not less than the specified average rate (as defined in subsection (tt)) for such services.</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></clause></subparagraph><subparagraph id="H7B58BB24960D42F49712E0A6662D53B1"><enum>(B)</enum><text>by adding at the end the following new subsection:</text><quoted-block style="OLC" id="H4F64D9216857456CA513C484129869FD" display-inline="no-display-inline"><subsection id="HFD2C17EA054045D5A4F134EF62E926B2"><enum>(tt)</enum><header>Specified average rate defined</header><paragraph id="HA8E7F17257304792A8690E5ACE1AA786"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">For purposes of subsection (a)(13)(D), the term <quote>specified average rate</quote> means, with respect to a dental service furnished in a State, the average of the contracted rates (as defined in paragraph (2)) in effect during the 5-year period ending on the date such service is so furnished—</text><subparagraph id="H3CFAB88B257B4D79939D3F9FD68E14E3"><enum>(A)</enum><text>for such service furnished in such State (as determined by the State); or</text></subparagraph><subparagraph id="H63D90D17D94B4E00B9BFDD51823C4DC2"><enum>(B)</enum><text>for such service furnished in the United States (as determined by the Secretary);</text></subparagraph><continuation-text continuation-text-level="paragraph">as selected by such State. </continuation-text></paragraph><paragraph id="H05BA201CD8FA4F0098CCB826DF58BDFD"><enum>(2)</enum><header>Contracted rate defined</header><subparagraph id="HD2E4000A906A469591EC2C407DF2F5AA"><enum>(A)</enum><header>In general</header><text>For purposes of paragraph (1), the term <quote>contracted rate</quote> means, with respect to a dental service, a rate in effect between a health insurance issuer offering group or individual health insurance coverage or a group health plan (as such terms are defined in section 2791 of the Public Health Service Act) and a dentist with a contractual relationship in effect with such issuer or plan (as applicable) for furnishing such service under such coverage or plan (as applicable) that represents the total amount payable (including cost sharing) under such coverage or plan (as applicable) for such service so furnished.</text></subparagraph><subparagraph id="H1DF1BA79361A435D84F11CCC296E0ACB"><enum>(B)</enum><header>Exclusion of self-insured group health plan rates</header><text>For purposes of subparagraph (A), the term <quote>contracted rate</quote> shall not include a rate described in such subparagraph that is in effect between a self-insured group health plan and a dentist.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H723B4BB04ED4415CB6259498D633EC0A"><enum>(2)</enum><header>Medicaid managed care plans</header><text display-inline="yes-display-inline">Section 1932(f) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396u-2">42 U.S.C. 1396u–2(f)</external-xref>) is amended—</text><subparagraph id="H9B0A958ABD86430E85297CEDDE3D0B4E"><enum>(A)</enum><text>in the header, by striking <quote><header-in-text level="subsection" style="OLC">primary care services</header-in-text></quote> and inserting <quote><header-in-text level="subsection" style="OLC">certain services</header-in-text></quote>; </text></subparagraph><subparagraph id="HBD731CA6EF9B4CCCAA185820A1316B9A"><enum>(B)</enum><text>by inserting <quote>or dental services</quote> after <quote>primary care services</quote>;</text></subparagraph><subparagraph id="HBEAB1A68E0E543A1821E66E0AE1358B3"><enum>(C)</enum><text>by striking <quote>section 1902(a)(13)(C)</quote> and inserting <quote>subparagraph (C) or (D), respectively, of section 1902(a)(13)</quote>; and</text></subparagraph><subparagraph id="HB5BF835192AF4DBABB55B3821D4E56C3"><enum>(D)</enum><text>by striking <quote>such section</quote> and inserting <quote>such subparagraph (C) or (D), as applicable</quote>.</text></subparagraph></paragraph><paragraph id="H0C45123B0ED24D7789CFF51CC4328A35"><enum>(3)</enum><header>Increased FMAP for increased expenses</header><text>Section 1905 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396d">42 U.S.C. 1396d</external-xref>) is amended by adding at the end the following new subsection:</text><quoted-block style="OLC" id="H985A7565A0EE475AA7E860E38B2A86BA" display-inline="no-display-inline"><subsection id="H5BEE5A11CCA1427AA1E60E20BCF03B85"><enum>(gg)</enum><header>Increased FMAP for additional expenditures for dental services</header><text display-inline="yes-display-inline">Notwithstanding subsection (b), with respect to the portion of the amounts expended for medical assistance for services described in section 1902(a)(13)(D) furnished on or after the first day of the first calendar quarter beginning on or after the date that is 80 days after the date of the enactment of this subsection furnished to an individual described in such section by a dentist that is attributable to the amount by which the minimum payment rate required under such section (or, by application, section 1932(f)) exceeds the payment rate applicable to such services under the State plan as of January 1, 2021, the Federal medical assistance percentage for a State that is one of the 50 States or the District of Columbia shall be equal to 100 percent. The preceding sentence does not prohibit the payment of Federal financial participation based on the Federal medical assistance percentage for amounts in excess of those specified in such sentence.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="HB5D616A581DB47E1B276915513F393EB" commented="no" display-inline="no-display-inline"><enum>(c)</enum><header>Outreach efforts for enrollment of former foster children</header><text>Section 1902(a) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396a">42 U.S.C. 1396a(a)</external-xref>) is amended—</text><paragraph id="H7F9C545EAD0945828B39388110D56E30" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text>in paragraph (85), by striking <quote>; and</quote> and inserting a semicolon;</text></paragraph><paragraph id="H16D27CC982104E01B586C13D467EFA73" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text>in paragraph (86), by striking the period at the end and inserting <quote>; and</quote>; and</text></paragraph><paragraph id="H16818DF9AA6D47939C33192FBA60786B" commented="no" display-inline="no-display-inline"><enum>(3)</enum><text>by inserting after paragraph (86) the following new paragraph:</text><quoted-block act-name="" id="H5CD38839D05E4000A2CC8543D3AC5F31" style="OLC"><paragraph commented="no" id="HC42E62702CB44C7AB273EF6A9CA7CAA8"><enum>(87)</enum><text>not later than 6 months after the date of the enactment of this paragraph—</text><subparagraph id="H1E94A663E7BF4E8C99D469880A1E8216"><enum>(A)</enum><text>establish an outreach and enrollment program, in coordination with the State agency responsible for administering the State plan under part E of title IV and any other appropriate or interested agencies, designed to increase the enrollment of individuals who are eligible for medical assistance under the State plan under paragraph (10)(A)(i)(IX) in accordance with best practices established by the Secretary; and</text></subparagraph><subparagraph id="H83A290E453224CB2A6330B0E70AA2B60"><enum>(B)</enum><text>establish an outreach program to dentists practicing in such State to encourage enrollment by such dentists in such plan as participating providers under such plan.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H0A53E0A18D454E45A9071CECD6284424"><enum>(d)</enum><header>Providing for immediate eligibility for former foster youth</header><text display-inline="yes-display-inline">Section 1002(a)(2) of the SUPPORT for Patients and Communities Act (<external-xref legal-doc="public-law" parsable-cite="pl/115/271">Public Law 115–271</external-xref>) is amended by striking <quote>January 1, 2023</quote> and inserting <quote>the date of enactment of the Foster Youth Dental Act of 2021</quote>. </text></subsection></section></legis-body></bill>
