which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Children’s Online Privacy Protection Act of 1998.</official-title></form><legis-body id="H1824AC57FC8F41DEA82691DCB98ADE40" style="OLC"><section id="H5F94620C732E4A09B9D74D44AE9C6BB0" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Preventing Real Online Threats Endangering Children Today Act</short-title></quote> or the <quote><short-title>PROTECT Kids Act</short-title></quote>.</text></section><section id="H4E47B9A5331B4B49851B2EE6DA3BF997"><enum>2.</enum><header>Amendments to the Children's Online Privacy Protection Act of <enum-in-header>1998</enum-in-header></header><text display-inline="no-display-inline">The Children's Online Privacy Protection Act of 1998 (<external-xref legal-doc="usc" parsable-cite="usc/15/6501">15 U.S.C. 6501</external-xref> et seq.) is amended—</text><paragraph commented="no" id="H9F38EDB59AD44F128D58C503A40552B9"><enum>(1)</enum><text>by inserting <quote>, including a service provided through a mobile application,</quote> after <quote>online service</quote> each place it appears;</text></paragraph><paragraph id="H4791ED0F42C8489D9CC7463B8476ECA0"><enum>(2)</enum><text>in section 1302—</text><subparagraph id="HEAEB7A39061E44AA8EF7E570377EDF9E"><enum>(A)</enum><text>in paragraph (1), by striking <quote>age of 13</quote> and inserting <quote>age of 16</quote>;</text></subparagraph><subparagraph id="H42BD5D385FE04B33931D630E210C2849"><enum>(B)</enum><text>in paragraph (8)—</text><clause id="H79A178A4C4BA41CA93B967E7A847ACFC"><enum>(i)</enum><text>in the matter preceding subparagraph (A), by inserting <quote>including a service provided through a mobile application</quote> after <quote>collected online</quote>;</text></clause><clause id="H73A79B9349EE4F418EA896AA38011761"><enum>(ii)</enum><text>by redesignating subparagraphs (F) and (G) as subparagraphs (H) and (I), respectively; and</text></clause><clause id="H2E2DDC88CD734693A42C9DBC04F192DF"><enum>(iii)</enum><text>by inserting after subparagraph (E) the following:</text><quoted-block display-inline="no-display-inline" id="H152EC8F5A03C476D9E42E2D2837C558E" style="OLC"><subparagraph id="H787240A1CA3E46A89ECCDAE15B9639B0"><enum>(F)</enum><text display-inline="yes-display-inline">precise geolocation information;</text></subparagraph><subparagraph id="H2FB33FBD5E7343AB9DA765D63575401D"><enum>(G)</enum><text>biometric information;</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></clause></subparagraph><subparagraph commented="no" id="HB9163E8681FD470C8F9C014A678D2AC8"><enum>(C)</enum><text>by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="H950977A572B14FBFAAE95014ED16CA3B" style="OLC"><paragraph commented="no" id="H4D6C68D66BC04D92922721A126AFB643"><enum>(13)</enum><header>Mobile application</header><text display-inline="yes-display-inline">The term <term>mobile application</term> means a software program that runs on the operating system of—</text><subparagraph commented="no" id="H4D6AAF8CAEFF412DBEEA8A5A07666CE3"><enum>(A)</enum><text>a mobile telephone;</text></subparagraph><subparagraph commented="no" id="H55A2AE0F108A4A489ECED6A8DC7C42E1"><enum>(B)</enum><text>a tablet computer; or</text></subparagraph><subparagraph commented="no" id="HEE66341BBC0841D08346B99897F0E3F9"><enum>(C)</enum><text>a similar portable computing device that transmits data over a wireless connection.</text></subparagraph></paragraph><paragraph id="H842B65E5C0E34B05B2157DF0565095B5"><enum>(14)</enum><header>Biometric information</header><text display-inline="yes-display-inline">The term <term>biometric information</term> means the record of any unique, immutable biological attribute or measurement generated by automatic measurements of a consumer’s biological characteristics, including fingerprints, genetic information, iris or retina patterns, facial characteristics, or hand geometry, that are used to uniquely and durably authenticate the identity of a consumer when such consumer accesses a physical location, device, system, or account.</text></paragraph><paragraph id="HF3933A01A5EF45188C13F035A5628237"><enum>(15)</enum><header>Precise geolocation information</header><text display-inline="yes-display-inline">The term <term>precise geolocation information</term> means historical or real-time location information, or inferences drawn from other information, capable of identifying the location of an individual or a consumer device of an individual with specificity sufficient to identify street level location information or an individual’s or device’s location within a range of 1,640 feet or less.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H3213501D9846478DA2F70D1B2935BE7C"><enum>(3)</enum><text>in section 1303(b)—</text><subparagraph id="H6C6B720D663147EF8085C22E43F8FE54"><enum>(A)</enum><text>in paragraph (1)—</text><clause id="H6D22DA81A83248C2A71697756C938EAE"><enum>(i)</enum><text>in subparagraph (A)(I), by inserting <quote>or mobile application</quote> after <quote>website</quote>; and</text></clause><clause id="HA19893606DB7408F8D53356F6B749CC7"><enum>(ii)</enum><text>in subparagraph (B)(ii), by striking <quote>use or maintenance in retrievable form, or future online collection</quote> and inserting <quote>collection or use</quote>; and</text></clause></subparagraph><subparagraph id="HF09B95D2EB2A4FE09EBD42D125285B45"><enum>(B)</enum><text>by amending paragraph (3) to read as follows:</text><quoted-block display-inline="no-display-inline" id="H0976C7EF9BA84B66A02DB1A06AD65CE9" style="OLC"><paragraph id="H01145380E1554F27AE223A0CF8DF78B4"><enum>(3)</enum><header>Continuation of service</header><text display-inline="yes-display-inline">The regulations shall—</text><subparagraph id="HFD3BCD302381477DB4244D81636C3768"><enum>(A)</enum><text>prohibit the operator of a website, online service, or mobile application from terminating service provided to a child whose parent has refused, under the regulations prescribed under paragraph (1)(B)(ii), to permit the operator's further collection or use of personal information from that child, or has required such operator to delete such information; and</text></subparagraph><subparagraph id="H50336F2233B540F1AD3916444397C6E6"><enum>(B)</enum><text display-inline="yes-display-inline">require the operator, upon request of a parent whose child has provided personal information to that website or, online service, including a service provided through a mobile application, upon proper identification of that parent, to delete any personal information collected from such child.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></section><section id="H2B5BA31FCA6D44488F79EBE192D5D375"><enum>3.</enum><header>Federal Trade Commission study</header><subsection id="H77ABC21300064813B4523DAD951DD76A"><enum>(a)</enum><header>In general</header><paragraph id="HE095A4E1CCD64C649E788FF93B277F95"><enum>(1)</enum><text>Not later than 2 years after the date of enactment of this Act, the Commission shall conduct a study on the knowledge standard found in section 1303(a)(1) of the Children’s Online Privacy Protection Act of 1998 (<external-xref legal-doc="usc" parsable-cite="usc/15/6501">15 U.S.C. 6501</external-xref> et seq.).</text></paragraph><paragraph id="H6BCC47DB65D240FCB24E7FA4AAC76FE3"><enum>(2)</enum><text>In conducting such study, the Commission shall—</text><subparagraph id="H9DCC9AD298C643459AE5EE6AE5250845"><enum>(A)</enum><text>consider whether the existing knowledge standard is still appropriate for accomplishing the goals of this Act;</text></subparagraph><subparagraph id="H358B873E19824ECEA3DE6EA19F7603D6"><enum>(B)</enum><text>consider the affect changing such knowledge standard will have on children’s online privacy, including whether it will increase or decrease such privacy;</text></subparagraph><subparagraph id="HE84A5C478C8E493C8BEFE9FE21BDED10"><enum>(C)</enum><text>consider the feasibility of complying with any change to such knowledge standard;</text></subparagraph><subparagraph id="HEB4C58047DD24198A99F964D57A4D281"><enum>(D)</enum><text>whether any Federal agency has studied such change; and</text></subparagraph><subparagraph id="H29CACFAE8312486B8117290A4B53E90F"><enum>(E)</enum><text>whether any think tank or privacy advocacy or digital rights group has studied such a change.</text></subparagraph></paragraph><paragraph id="H42DDA9296000462294AB33EF9A9D4614"><enum>(3)</enum><text>Based on the study, the Commission shall—</text><subparagraph id="HC102122F427041FA8824CB456DE855B1"><enum>(A)</enum><text>develop recommendations as to whether the knowledge standard should be changed;</text></subparagraph><subparagraph id="HDEE7B2DCD57740FDBBA5FFF681570ECC"><enum>(B)</enum><text>develop recommendations as to what the new knowledge standard should be, if appropriate;</text></subparagraph><subparagraph id="HC488460B7B7E41E99210C90AA389FAC9"><enum>(C)</enum><text>provide the basis for its recommendation to change the knowledge standard, if appropriate;</text></subparagraph><subparagraph id="H90059B4A43204EF79D26978A3BEB99D9"><enum>(D)</enum><text>cite examples of Federal agency studies on changing the knowledge standard; and</text></subparagraph><subparagraph id="H0E3B9D4A2CE044F89D2E42A9901503DA"><enum>(E)</enum><text>cite examples of think tank or privacy advocacy or digital rights group studies on changing the knowledge standard.</text></subparagraph></paragraph></subsection><subsection id="HD13B3D33A38741318B6053A107E2844D"><enum>(b)</enum><header>Report to Congress</header><text>Following completion of the study pursuant to subsection (a), the Commission shall report the results and recommendations to the Committee on Energy and Commerce of the House of Representatives and the Committee on Commerce, Science, and Transportation of the Senate.</text></subsection></section></legis-body></bill>
