which was referred to the <committee-name committee-id="HJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To provide for the reporting to State and local law enforcement authorities of cases in which the national instant criminal background check system indicates that a firearm has been sought to be acquired by a prohibited person, so that authorities may pursue criminal charges under State law, and to ensure that the Department of Justice reports to Congress on prosecutions secured against prohibited persons who attempt to acquire a firearm.</official-title></form><legis-body id="HBD7ACA03A5324DAF97DA074431F2EB06" style="OLC"><section id="H3403839F820644D8AC9EB29BE93C4757" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>NICS Denial Notification Act of 2021</short-title></quote>.</text></section><section id="H59F31B7948A04EDEAC575B7681B0E9ED"><enum>2.</enum><header>Reporting of background check denials</header><subsection id="H9DC170DF3EF04963953D626BDC0C0C98"><enum>(a)</enum><header>In general</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/44">Chapter 44</external-xref> of title 18, United States Code, is amended by inserting after <external-xref legal-doc="usc" parsable-cite="usc/18/925A">section 925A</external-xref> the following:</text><quoted-block display-inline="no-display-inline" id="HD4198530D6A5423380D303EAD806A562" style="USC"><section id="H5FA2E9E374D84F179C2074166D577686"><enum>925B.</enum><header>Reporting of background check denials to State authorities</header><subsection id="HFAD9C38264324FAE8263586B076FE908"><enum>(a)</enum><header>In general</header><text>If the national instant criminal background check system established under section 103 of the Brady Handgun Violence Prevention Act (<external-xref legal-doc="usc" parsable-cite="usc/18/922">18 U.S.C. 922</external-xref> note) provides a notice pursuant to section 922(t) of this title that the receipt of a firearm by a person would violate subsection (g) or (n) of section 922 of this title or State law, the Attorney General shall, in accordance with subsection (b) of this section—</text><paragraph id="HC626AF9624B949089C625FEF9E74A38E"><enum>(1)</enum><text>report to the law enforcement authorities of the State where the person sought to acquire the firearm and, if different, the law enforcement authorities of the State of residence of the person—</text><subparagraph id="H080DF6A142304615B3EBA548949F9EA0"><enum>(A)</enum><text>that the notice was provided;</text></subparagraph><subparagraph id="H3DE59053B9CF4B06839D06628199A827"><enum>(B)</enum><text>of the specific provision of law that would have been violated;</text></subparagraph><subparagraph id="H29C3E4C6B2E0416B8C917B4F32E8FBAE"><enum>(C)</enum><text>of the date and time the notice was provided;</text></subparagraph><subparagraph id="HA4F70A76625E4E0B87EFC040C1EFA1B1"><enum>(D)</enum><text>of the location where the firearm was sought to be acquired; and</text></subparagraph><subparagraph id="HAB2DEECC1ECC47CDB9C3C7C5BEF2822A"><enum>(E)</enum><text>of the identity of the person; and</text></subparagraph></paragraph><paragraph id="H3DD930FEA9634D70B4D657A6C3B792A2"><enum>(2)</enum><text>where practicable, report the incident to local law enforcement authorities and State and local prosecutors in the jurisdiction where the firearm was sought and in the jurisdiction where the person resides.</text></paragraph></subsection><subsection id="HEA5E513EAC194FA78119F00285906D87"><enum>(b)</enum><header>Requirements for report</header><text>A report is made in accordance with this subsection if the report is made within 24 hours after the provision of the notice described in subsection (a), except that the making of the report may be delayed for so long as is necessary to avoid compromising an ongoing investigation.</text></subsection><subsection id="HDC9494706C4E427098F2156706C0BE42"><enum>(c)</enum><header>Rule of construction</header><text>Nothing in subsection (a) shall be construed to require a report with respect to a person to be made to the same State authorities that originally issued the notice with respect to the person.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H85A129A3EF4A4C72BEB64643443DE671"><enum>(b)</enum><header>Clerical amendment</header><text>The table of sections for such chapter is amended by inserting after the item relating to section 925A the following:</text><quoted-block id="HF6B1E40EF71D498C992AC0D2372C8FD1" style="USC"><toc><toc-entry idref="H5FA2E9E374D84F179C2074166D577686" level="section">925B. Reporting of background check denials to State authorities.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="H1ECCD3FD681E429AB644636956975D6E"><enum>3.</enum><header>Annual report to Congress</header><subsection id="H80B33B78C0394BF6A5024EDF70B02E16"><enum>(a)</enum><header>In general</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/44">Chapter 44</external-xref> of title 18, United States Code, as amended by section 2(a) of this Act, is amended by inserting after section 925B the following:</text><quoted-block display-inline="no-display-inline" id="H88D1E8BE7B1C4E839AC081E8F437DF46" style="USC"><section id="H7ED14FE325B1489598E30213B4143D43"><enum>925C.</enum><header>Annual report to Congress</header><text display-inline="no-display-inline">Not later than 1 year after the date of the enactment of this section, and annually thereafter, the Attorney General shall submit to the Congress a report detailing the following, broken down by Federal judicial district:</text><paragraph id="HECFDD850E1B842E8A03B8445BA1A0D68"><enum>(1)</enum><text>With respect to each category of persons prohibited by section 922(g) from receiving or possessing a firearm who are so denied a firearm—</text><subparagraph id="HB1FC720EBE5B44F29E424D574AF3E9B3"><enum>(A)</enum><text>the number of cases referred to the Bureau of Alcohol, Tobacco, Firearms and Explosives;</text></subparagraph><subparagraph id="H892013EA66164600A119143FFB3D72FC"><enum>(B)</enum><text>the number of cases with respect to which an investigation was opened by a field division of the Bureau of Alcohol, Tobacco, Firearms and Explosives;</text></subparagraph><subparagraph id="H18C11AFF215C41578B7633C867E81488"><enum>(C)</enum><text>the number of arrests made; and</text></subparagraph><subparagraph id="HF94129AC42384E55AB03630B5DE2556D"><enum>(D)</enum><text>the number of convictions obtained by Federal authorities in connection with the denial.</text></subparagraph></paragraph><paragraph id="H5693EF92F2C14E349E6D29B0AEF80C70"><enum>(2)</enum><text>The number of background check notices reported to State authorities pursuant to section 925B (including the number of the notices that would have been so reported but for section 925B(c)).</text></paragraph></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HA58FA4CDBCC34635A1D7E51952FC8CEF"><enum>(b)</enum><header>Clerical amendment</header><text>The table of sections for such chapter, as amended by section 2(b) of this Act, is amended by inserting after the item relating to section 925B the following:</text><quoted-block id="HB6788C07C0984AA1832F5C274AA2F939" style="USC"><toc><toc-entry idref="H7ED14FE325B1489598E30213B4143D43" level="section">925C.
