which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name>, and in addition to the Committee on <committee-name committee-id="HFA00">Foreign Affairs</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To assess and improve the competitiveness of American civilian nuclear commerce, to expedite Department of Energy review of certain nuclear technology exports, and for other purposes.</official-title></form><legis-body id="H533F47957F014E97899F41191A9711BF" style="OLC"><section id="H18A1CB2A53D64F40B3301E09C69531AF" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Strengthening American Nuclear Competitiveness Act</short-title></quote>.</text></section><section id="HC6E12CDA76F349D385591A466E0145A0"><enum>2.</enum><header>Competitiveness of nuclear commerce</header><subsection id="H0E8FC5E5913C441CB2BFDBA32BAD4C34"><enum>(a)</enum><header>Report</header><text>Not later than 180 days after the date of enactment of this Act, the Secretary of Energy shall develop and submit to Congress a report on United States civilian nuclear commerce.</text></subsection><subsection id="H32E6C52A1F3743B19B2F1A4CED72981B"><enum>(b)</enum><header>Consultation</header><text>In developing the report required under subsection (a), the Secretary of Energy shall consult with—</text><paragraph id="H67D4C8FBAB0A4185BF1A275236796F20"><enum>(1)</enum><text>the Secretary of State;</text></paragraph><paragraph id="H163E2F1578C84FC8ADE6E68894F8904E"><enum>(2)</enum><text>the Secretary of Commerce;</text></paragraph><paragraph id="H8C8AF5037655476892E91ABF2EE916F7"><enum>(3)</enum><text>the Administrator of the Environmental Protection Agency; and</text></paragraph><paragraph id="H1A2B63F9F19A42AF807AB4934F9397CD"><enum>(4)</enum><text>the Nuclear Regulatory Commission.</text></paragraph></subsection><subsection id="HD20C69B6C010425EB939328AC3BD1EAC"><enum>(c)</enum><header>Contents</header><text>The report required under subsection (a) shall include—</text><paragraph id="H70B5DFB0B5474DD2B1C7C316B2E26B74"><enum>(1)</enum><text>an assessment of—</text><subparagraph id="H3D12790781774155B9F231ACD98EB3C0"><enum>(A)</enum><text display-inline="yes-display-inline">legal and regulatory requirements and policies of, and commercial practices in, the United States with respect to the civilian nuclear industry of the United States;</text></subparagraph><subparagraph id="HFA6E0A9F1620449CA9E9BF1C09C62624"><enum>(B)</enum><text>the effects of such practices on such civilian nuclear industry in domestic and foreign commerce;</text></subparagraph><subparagraph id="HFDEDEC14EAFC490094F3BCBCC24F7E57" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text display-inline="yes-display-inline">the role of emerging United States nuclear technologies and applications of such technologies, including nonelectric applications of those technologies; and</text></subparagraph><subparagraph id="HF751F451584049E7806F4E447E234CD8" commented="no"><enum>(D)</enum><text display-inline="yes-display-inline">the effects of advanced manufacturing and construction methods for nuclear technologies on the costs of such technologies and the civilian nuclear industry of the United States;</text></subparagraph></paragraph><paragraph id="H3F0260C7851E4EE8AD55395B781C2FBB"><enum>(2)</enum><text display-inline="yes-display-inline">a comparison of the matters assessed in paragraph (1) with respect to the United States to an assessment of such matters as they apply with respect to foreign countries;</text></paragraph><paragraph id="H9BD93AF7E7B64B9AA39459E0EAB8C0BC"><enum>(3)</enum><text>recommendations to improve the competitiveness of United States civilian nuclear commerce; and</text></paragraph><paragraph id="HE072286858DB420385501BF970628998" commented="no"><enum>(4)</enum><text>recommendations relating to the application of section 170 of the Atomic Energy Act of 1954 (<external-xref legal-doc="usc" parsable-cite="usc/42/2210">42 U.S.C. 2210</external-xref>) with respect to advanced nuclear technologies.</text></paragraph></subsection></section><section id="H314D05061BA44F5FA243124A05D61643"><enum>3.</enum><header>Expediting nuclear technology exports</header><subsection id="H6D591820FC6D463BA25C041A70037A6C"><enum>(a)</enum><header>Expedited procedures</header><text>Section 57 of the Atomic Energy Act of 1954 (<external-xref legal-doc="usc" parsable-cite="usc/42/2077">42 U.S.C. 2077</external-xref>) is amended by adding at the end the following new subsection:</text><quoted-block id="H625B850AE0D94C45B8946937EEA6C0CD" style="OLC"><subsection id="H13127C16951747F2BEDF8B670C2AA32A"><enum>(f)</enum><header>Expedited procedures</header><paragraph id="HAF70BECE580E48FF8FCC16E83F3F76A4"><enum>(1)</enum><header>Establishment</header><text>In carrying out subsection b.(2), the Secretary of Energy shall establish procedures for expedited consideration of requests for authorizations regarding the transfer of a technology that involves a low-proliferation-risk reactor activity described in paragraph (2) of this subsection to a foreign country described in paragraph (3) of this subsection.</text></paragraph><paragraph id="H090A1EA3E5FA4BF3A3C539C8C4D3B77B"><enum>(2)</enum><header>Activities</header><text>A low-proliferation-risk reactor activity described in this paragraph is an activity that meets each of following criteria:</text><subparagraph id="HF926C77E10F2471EA304EAB4A94F308C"><enum>(A)</enum><text>The activity is listed in section 810.2(b) of title 10, Code of Federal Regulations, as in effect on the date of enactment of this Act.</text></subparagraph><subparagraph id="HAD9A6FF7A58040DC80DAFF5812BE8049" commented="no"><enum>(B)</enum><text>The activity is not an activity requiring a specific authorization pursuant to section 810.7(c) of such title, as in effect on such date.</text></subparagraph><subparagraph id="H53E876AA8F664BD29FDA9F9AF9399E8E"><enum>(C)</enum><text>The Secretary determines that the transfer (or retransfer) of a technology that involves the activity will not result in a significant increase of the risk of proliferation beyond such risk that exists at the time that the authorization is requested.</text></subparagraph></paragraph><paragraph id="H56DC9DEC160846F3AE94BF4DB3C39EBA"><enum>(3)</enum><header>Foreign countries</header><text>A foreign country described in this paragraph is a foreign country—</text><subparagraph id="HC3F52DBB4E944BABA161C1344F6766A1"><enum>(A)</enum><text>that is not a nuclear-weapon State, as defined by Article IX of the Treaty on the Non-Proliferation of Nuclear Weapons, signed at Washington, London, and Moscow on July 1, 1968, other than the United Kingdom or France; and</text></subparagraph><subparagraph id="H134F9E01EDD04F7B89520C3FB994262B"><enum>(B)</enum><text>with respect to which the Secretary determines under subsection b.(2) that a transfer to the country of a technology that involves a low-proliferation-risk reactor activity described in paragraph (2) of this subsection will not be inimical to the interest of the United States.</text></subparagraph></paragraph><paragraph id="H8C5708DE0F2346E8A4CAF47D7FB930EB"><enum>(4)</enum><header>Concurrence and consultation</header><text>The Secretary of Energy shall establish the procedures under paragraph (1) with the concurrence of the Department of State and after consultation with the Nuclear Regulatory Commission, the Department of Commerce, and the Department of Defense.</text></paragraph><paragraph id="H4F9710AA0CE14D02B3C3B3B5F3D29354"><enum>(5)</enum><header>Timing and availability</header><text>The procedures established under paragraph (1) shall—</text><subparagraph id="H29868C5615BA4A8495F055E2A5693F22"><enum>(A)</enum><text>ensure that each request is approved or denied by not later than 45 days after the later of—</text><clause id="HD300CC8233EB452FBA821C1522A339C2"><enum>(i)</enum><text>the date on which the foreign country transmits any required assurances to the Department of State; or</text></clause><clause id="HD04BEAD46AEC416188FECA25A835FF1A"><enum>(ii)</enum><text>the date on which the interagency review under subsection b. is completed; and</text></clause></subparagraph><subparagraph id="HCB48E8792286438D8951247708625CA1"><enum>(B)</enum><text>be publicly available.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H149BDD06C8944C1B9CD6A743C5431DA0"><enum>(b)</enum><header>Assurances</header><text>Section 57(b) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/2077">42 U.S.C. 2077(b)</external-xref>) is amended by inserting after <quote>mechanisms.</quote> the following new sentence: <quote>To the extent practicable, the Secretary of Energy shall continue to process such requests during such interagency review in a manner that enables the Secretary to make such determination as soon as practicable after the receipt of assurances by a foreign country to the Department of State, if any such assurances are required.</quote>.</text></subsection></section><section id="HE2E39284C08646AAA2F2D787506FC919"><enum>4.</enum><header>Licensing domestic nuclear projects in which United States allies invest</header><subsection id="H74DE29E329564E2F8EB0174C6A810A37"><enum>(a)</enum><header>In general</header><text>The prohibitions against issuing certain licenses for utilization facilities to certain corporations and other entities described in the second sentence of section 103 d. of the Atomic Energy Act of 1954 (42. U.S.C. 2133(d)) and the second sentence of section 104 d. of that Act (<external-xref legal-doc="usc" parsable-cite="usc/42/2134">42 U.S.C. 2134(d)</external-xref>) shall not apply to an entity described in subsection (b) of this section if the Nuclear Regulatory Commission determines that issuance of the applicable license to that entity is not inimical to—</text><paragraph id="H970ACB5109664F7DB0A3873FBD376A1B"><enum>(1)</enum><text>the common defense and security; or</text></paragraph><paragraph id="HA829D59205C148DC9D446EF35D7CF3D1"><enum>(2)</enum><text>the health and safety of the public.</text></paragraph></subsection><subsection id="HE73789A7C34545CEA35D92878B371380"><enum>(b)</enum><header>Entities described</header><text>An entity described in this subsection is a corporation or other entity that is owned, controlled, or dominated by—</text><paragraph id="HD8C6C78DA0224274A1515EA8C36AD143"><enum>(1)</enum><text>the government of—</text><subparagraph id="HC0A9B7D4B0594C7EBA4166B63770EEF9"><enum>(A)</enum><text>a country that is a member of the Group of Seven as of November 25, 2020, which includes the United Kingdom, Germany, Canada, Japan, France, and Italy; or</text></subparagraph><subparagraph id="H21EBF94089764DBE8B4BA4787F0FA369"><enum>(B)</enum><text>the Republic of Korea;</text></subparagraph></paragraph><paragraph id="H639E9708CBD749CBB96DDB49215F19B6"><enum>(2)</enum><text>a corporation that is incorporated in a country described in paragraph (1); or</text></paragraph><paragraph id="H859831C036D54A2881A978A38572DA98"><enum>(3)</enum><text>an alien who is a national of a country described in paragraph (1).</text></paragraph></subsection><subsection id="H674F1AA1A65E4CAE8740330EA3A41842"><enum>(c)</enum><header>Technical amendment</header><text>Section 103 d. of the Atomic Energy Act of 1954 (<external-xref legal-doc="usc" parsable-cite="usc/42/2133">42 U.S.C. 2133(d)</external-xref>) is amended, in the second sentence, by striking <quote>any any</quote> and inserting <quote>any</quote>.</text></subsection><subsection id="HE49A01DE7D644136A76F72A1EEA779BF"><enum>(d)</enum><header>Savings clause</header><text>Nothing in this section affects the requirements of section 721 of the Defense Production Act of 1950 (<external-xref legal-doc="usc" parsable-cite="usc/50/4565">50 U.S.C. 4565</external-xref>).</text></subsection></section><section id="H4084A81771DE4650B2090E6F38737DA0"><enum>5.</enum><header>Licensing considerations relating to use of nuclear energy for nonelectric applications</header><subsection id="HA472E18BB4B84F1BB20023269BA9EE5A"><enum>(a)</enum><header>In general</header><text>Not later than 1 year after the date of enactment of this Act, the Nuclear Regulatory Commission (in this section referred to as the <quote>Commission</quote>) shall submit to the Committee on Energy and Commerce of the House of Representatives and the Committee on Environment and Public Works of the Senate a report addressing any unique licensing issues or requirements relating to—</text><paragraph id="HA8CDA43FF6DA42F2907113337A5FD45F"><enum>(1)</enum><text>the flexible operation of advanced nuclear reactors, such as ramping power output and switching between electricity generation and nonelectric applications;</text></paragraph><paragraph id="H4A5B8241B8D540A993075DC7E26666AD"><enum>(2)</enum><text>the use of advanced nuclear reactors exclusively for nonelectric applications; and</text></paragraph><paragraph id="H3952445DA9CB4956B3BB0245100A8F30"><enum>(3)</enum><text>the collocation of advanced nuclear reactors with industrial plants or other facilities.</text></paragraph></subsection><subsection id="HA48003698D694B7DAC0C6BD7CE7D269C"><enum>(b)</enum><header>Stakeholder input</header><text>In developing the report, the Commission shall seek input from—</text><paragraph id="HA891FA897B61477393DF050CF59B7DDF"><enum>(1)</enum><text>the Secretary of Energy;</text></paragraph><paragraph id="H0CA3975F69E544D58700C3990938D52D"><enum>(2)</enum><text>the nuclear energy industry;</text></paragraph><paragraph id="H40C7369443E04E42B9F2DFA5736C604F"><enum>(3)</enum><text>technology developers;</text></paragraph><paragraph id="HD50142D74EF44353A7685B789F16C9CA"><enum>(4)</enum><text>the industrial, chemical, and medical sectors;</text></paragraph><paragraph id="HF5D90107091943458F6887F183D11DDD"><enum>(5)</enum><text>nongovernmental organizations; and</text></paragraph><paragraph id="H34FDFEC00D66495C96682F78417D547E"><enum>(6)</enum><text>other public stakeholders.</text></paragraph></subsection><subsection id="H6C339457B70C4325B108D1E2573B1544"><enum>(c)</enum><header>Contents</header><paragraph id="H3B5455B7914946419C43FA5BF7469D79"><enum>(1)</enum><header>In general</header><text>The report shall describe—</text><subparagraph id="HF82B011139DF44B1B55D7FF68BB7BB42"><enum>(A)</enum><text>any unique licensing issues or requirements relating to the matters described in paragraphs (1) through (3) of subsection (a), including, with respect to the nonelectric applications referred to in paragraphs (1) and (2) of that subsection, any licensing issues or requirements relating to the use of nuclear energy—</text><clause id="H8C6CE288D58340899CF962BAACA6AC06"><enum>(i)</enum><text>for hydrogen or other liquid and gaseous fuel or chemical production;</text></clause><clause id="H960B96D357AE407E9AE31CD50917BD19"><enum>(ii)</enum><text display-inline="yes-display-inline">for water desalination and wastewater treatment;</text></clause><clause id="HF92D7433463741B9B34E14C3C95444AE"><enum>(iii)</enum><text display-inline="yes-display-inline">for heat used in industrial processes;</text></clause><clause id="H9C42639D335E491194FD72C1A5376544"><enum>(iv)</enum><text display-inline="yes-display-inline">for district heating;</text></clause><clause id="H124C4DE41CF24993AD5FBC8166655BF8" commented="no"><enum>(v)</enum><text>in relation to energy storage;</text></clause><clause id="H166D9ABFC4144139808E68AE8B45B1B2"><enum>(vi)</enum><text display-inline="yes-display-inline">for industrial or medical isotope production; and</text></clause><clause id="H7FFFF460B0D54E1DABEBEC1EE8AFF195"><enum>(vii)</enum><text>other applications, as identified by the Commission;</text></clause></subparagraph><subparagraph id="HE3E4CD7DA360422788624EBAECC8D4D3"><enum>(B)</enum><text>options for addressing those issues or requirements—</text><clause id="HCFC1BB1050184D4FA14FA851F9D0C8F1"><enum>(i)</enum><text>within the existing regulatory framework;</text></clause><clause id="HD607808366FF450790407166F4F9114E"><enum>(ii)</enum><text>through the technology-inclusive, regulatory framework to be established under section 103(a)(4) of the Nuclear Energy Innovation and Modernization Act (<external-xref legal-doc="usc" parsable-cite="usc/42/2133">42 U.S.C. 2133</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/115/439">Public Law 115–439</external-xref>); or</text></clause><clause id="HA2434FD62C884C099EB714E0A972D28F" commented="no"><enum>(iii)</enum><text>through a new rulemaking;</text></clause></subparagraph><subparagraph id="H003A2FF049FF435B8C29E2614F7B6B89"><enum>(C)</enum><text>the extent to which Commission action is needed to implement any matter described in the report; and</text></subparagraph><subparagraph id="HD465C43ABA094712AFFBF27B473F8366"><enum>(D)</enum><text display-inline="yes-display-inline">cost estimates, proposed budgets, and proposed timeframes for implementing risk-informed and performance-based regulatory guidance for licensing advanced nuclear reactors for nonelectric applications.</text></subparagraph></paragraph></subsection></section><section id="HF4043ADD7B1E4E848A4C4E7B8606BDFB"><enum>6.</enum><header>Report on advanced methods of manufacturing and construction for nuclear energy projects</header><subsection id="H4DAB0CF894A845AB884707D0AEFD0849"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 180 days after the date of enactment of this Act, the Nuclear Regulatory Commission (in this section referred to as the <quote>Commission</quote>) shall submit to the Committee on Energy and Commerce of the House of Representatives and the Committee on Environment and Public Works of the Senate a report on manufacturing and construction for nuclear energy projects.</text></subsection><subsection id="H2C5CD914129A4E159CE2586B830A3701"><enum>(b)</enum><header>Stakeholder input</header><text>In developing the report, the Commission shall seek input from—</text><paragraph id="H1C55A0501A8C40CC9EEDA89F77EF8116"><enum>(1)</enum><text>the Secretary of Energy;</text></paragraph><paragraph id="HCF7C47BEA89C493FA542241E1AB965C4"><enum>(2)</enum><text>the nuclear energy industry;</text></paragraph><paragraph id="HB66A9A55CE9646798DDA2CE14C8C126A"><enum>(3)</enum><text>the National Laboratories;</text></paragraph><paragraph id="H119579C9B0074C97ACD72D827F576CBB"><enum>(4)</enum><text>institutions of higher education;</text></paragraph><paragraph id="H4ACE7EC0E0EA40DDA2B9C8DE489D7E1B" commented="no"><enum>(5)</enum><text>nuclear and manufacturing technology developers;</text></paragraph><paragraph id="H67A7CF67E6EC44F7AF1B7ED555BE55A3"><enum>(6)</enum><text>the manufacturing and construction industries;</text></paragraph><paragraph id="H36A4B755FC0E4BB3AF667153A8D08A93"><enum>(7)</enum><text>standards development organizations;</text></paragraph><paragraph id="HAAED62C3D7224523A46AEDBC65867803"><enum>(8)</enum><text>labor unions;</text></paragraph><paragraph id="HBD3A2060086A44EDBCB3EDE51B7AA884"><enum>(9)</enum><text>nongovernmental organizations; and</text></paragraph><paragraph id="HC23C1FA3ED67475EAD2FBCD552F622E9"><enum>(10)</enum><text>other public stakeholders.</text></paragraph></subsection><subsection id="H91AF801292AE45B2A57CD288D5C42E81"><enum>(c)</enum><header>Contents</header><paragraph id="HCDDE83A011B04102A74E33CE7D7E49CD"><enum>(1)</enum><header>In general</header><text>The report shall—</text><subparagraph id="H9B80E243E2B341568B5C2F4737C89A16"><enum>(A)</enum><text>examine any unique licensing issues or requirements relating to the use of—</text><clause id="HFDE3374435D740B1A574BDEE42335862"><enum>(i)</enum><text>advanced manufacturing techniques; and</text></clause><clause id="HEF6EBAAC1C4D4574B306881DE6CE3182"><enum>(ii)</enum><text>advanced construction techniques;</text></clause></subparagraph><subparagraph id="H056A2AEF54894D7B88DC2F13974CE58C"><enum>(B)</enum><text>examine—</text><clause id="H3EAC557D7E6B48B89A0E8F442CACE1C4"><enum>(i)</enum><text display-inline="yes-display-inline">the requirements for nuclear-grade components in manufacturing and construction for nuclear energy projects;</text></clause><clause id="H1D2E446F39434C66BAB2C37701024C0C"><enum>(ii)</enum><text>opportunities to use standard materials, parts, or components in manufacturing and construction for nuclear energy applications; and</text></clause><clause id="HFEFF4906960F4B0CAFB8788EDBD14ACF"><enum>(iii)</enum><text>opportunities to use standard materials that are in compliance with existing codes to provide acceptable approaches to support or encapsulate new materials that do not yet have applicable codes;</text></clause></subparagraph><subparagraph id="H700F41A97966495A929793CF6B3A2692"><enum>(C)</enum><text>identify safety aspects of advanced manufacturing processes and advanced construction techniques that are not addressed by existing codes and standards, so that generic guidance may be updated or created as necessary by the Commission;</text></subparagraph><subparagraph id="H703F13F793F54E44BEFB3D2FA97376AE"><enum>(D)</enum><text>identify options for addressing the issues, requirements, and opportunities examined under subparagraphs (A) and (B)—</text><clause id="H09070EB6E08E43EF81681432A8F67689"><enum>(i)</enum><text>within the existing regulatory framework; or</text></clause><clause id="H935665EED06D4AC8A76A16B24772D959"><enum>(ii)</enum><text>through a new rulemaking; and</text></clause></subparagraph><subparagraph id="H997618068E3E4F868C026F23EF84ABEA"><enum>(E)</enum><text>describe the extent to which Commission action is needed to implement any matter described in the report.</text></subparagraph></paragraph><paragraph id="H90024C7728C44DD8B9D753C233550AC5"><enum>(2)</enum><header>Cost estimates, budgets, and timeframes</header><text display-inline="yes-display-inline">The report shall include cost estimates, proposed budgets, and proposed timeframes for implementing risk-informed and performance-based regulatory guidance for advanced manufacturing and construction of nuclear energy projects.</text></paragraph></subsection></section><section id="H9AD61BC0BF474CB19D5DBE4FEE15FA63"><enum>7.</enum><header>Risk pooling program assessment</header><subsection id="HE07C64994EC74235A3552151AF6AFB9B"><enum>(a)</enum><header>Report</header><text>Not later than 1 year after the date of enactment of this Act, the Comptroller General shall carry out a review of, and submit to the Committee on Energy and Commerce of the House of Representatives and the Committee on Environment and Public Works of the Senate a report on, the Secretary of Energy’s actions with respect to the program described in section 934(e) of the Energy Independence and Security Act of 2007 (<external-xref legal-doc="usc" parsable-cite="usc/42/17373">42 U.S.C. 17373(e)</external-xref>).</text></subsection><subsection id="HAD73CF13A3D4483F8B523E13520FE939"><enum>(b)</enum><header>Contents</header><text>The report described in subsection (a) shall include—</text><paragraph id="HF18427EB6283480CAEB1ED124EAA848F"><enum>(1)</enum><text display-inline="yes-display-inline">an evaluation of the Secretary of Energy’s actions to determine the risk-informed assessment formula under section 934(e)(2)(C) of the Energy Independence and Security Act of 2007 (<external-xref legal-doc="usc" parsable-cite="usc/42/17373">42 U.S.C. 17373(e)(2)(C)</external-xref>); and</text></paragraph><paragraph id="H0D17760ADCC946DFAB64E7E63206685E"><enum>(2)</enum><text>a review of the Secretary of Energy’s methodology to collect information to determine and implement the formula.</text></paragraph></subsection></section></legis-body></bill>
