R. 1739</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20210310">March 10, 2021</action-date><action-desc><sponsor name-id="G000559">Mr. Garamendi</sponsor> introduced the following bill; which was referred to the <committee-name committee-id="HAS00">Committee on Armed Services</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title 10, United States Code, to provide for veterinary care for retired military working dogs, and for other purposes.</official-title></form><legis-body id="H4008780BAA514E40A46666ACEB5AB565" style="OLC"><section id="H64A8BACD3424423CBCAF4E88C00B2087" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Support Our Military Working Dogs Act</short-title></quote>.</text></section><section id="HCCE1D819FED844FAA06817B7120894D1"><enum>2.</enum><header>Department of Defense provision of veterinary care for retired military working dogs</header><subsection id="HB898E90730D04ECD9726A73BB04299F8"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 994 of title 10, United States Code, is amended—</text><paragraph id="H9A8DB202D17943FB81E6B51882D87618"><enum>(1)</enum><text>in subsection (a);</text><subparagraph id="H1218E8505B3C4969ADD16E8B012A5FB3"><enum>(A)</enum><text>by striking <quote>establish and maintain a system to</quote>;</text></subparagraph><subparagraph id="H26EBEF619311430BBB87CAC421D862CD"><enum>(B)</enum><text>by striking <quote>for the veterinary care of</quote> and inserting <quote>veterinary care for</quote>; and</text></subparagraph><subparagraph id="H2D186E881E124D2A98017AFF7CC93803"><enum>(C)</enum><text>by striking the second sentence;</text></subparagraph></paragraph><paragraph id="HEB8ECBDA293340EF9C9161D8AE4113DF"><enum>(2)</enum><text>in subsection (b), by inserting <quote>that the Secretary of the military department concerned determines is suitable for adoption or is</quote> before <quote>adopted</quote>; and</text></paragraph><paragraph id="H44BFAB9862C54BAE93EEC89A92CBA38A"><enum>(3)</enum><text>in subsection (c), by striking <quote>the system authorized by</quote>. </text></paragraph></subsection><subsection id="H872157978D464A22884CFA492568EAF9"><enum>(b)</enum><header>Multi-Year agreements with other entities</header><text display-inline="yes-display-inline">Such section is further amended by adding at the end the following new subsection:</text><quoted-block style="USC" id="H1521687C142A4004A8E3481CB5CC7262" display-inline="no-display-inline"><subsection id="H2C9E7888F2E6417D8167C433D87A8012"><enum>(d)</enum><header>Acceptance and use of donated funds</header><paragraph commented="no" display-inline="yes-display-inline" id="HF57248DBA4154D9F9444F7BA4A087088"><enum>(1)</enum><text>The Secretary of Defense may accept donations of funds, gifts, and in-kind contributions for the purpose of providing long-term care for any military working dog adopted under section 2583 of this title. Any amount so accepted shall be available without further appropriation and without fiscal year limitation.</text></paragraph><paragraph id="HAAC609CAC39F4F5E8ABBEF225855D0AD" display-inline="no-display-inline" indent="up1"><enum>(2)</enum><text>The Secretary of Defense may enter into a multi-year agreement with a veterans service organization or appropriate nonprofit entity under which—</text><subparagraph id="H3643FF0D0EC8458FA1AB452C36545202"><enum>(A)</enum><text>the organization or entity may solicit and accept donations of funds on behalf of the Department of Defense pursuant to paragraph (1); and</text></subparagraph><subparagraph id="H85696F20FAE148C690D32FE7E986471C"><enum>(B)</enum><text>the organization or entity agrees to transfer any funds accepted pursuant to such an agreement to the Department of Defense.</text></subparagraph></paragraph><paragraph id="HFB1A7C4B8F954A8D8C3A67D0CB9C0545" indent="up1"><enum>(3)</enum><text display-inline="yes-display-inline">In this subsection, the term <quote>veterans service organization</quote> means an organization recognized by the Secretary of Veterans Affairs for the representation of veterans under section 5902 of title 38. </text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="H358966B694BE4F4796BCEFA8126134FE"><enum>3.</enum><header>Prohibition on charge for adoption of military animals</header><subsection id="HFF6FB30001BE4839A2F5F4302F3C26FA"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Subsection (d) of section 2583 of title 10, United States Code, is amended by striking <quote>may</quote> and inserting <quote>shall</quote>.</text></subsection><subsection id="HDE9C954A229D40E2AD2201531A1EC70A"><enum>(b)</enum><header>Technical amendment</header><text display-inline="yes-display-inline">Subsection (g)(2)(A) of such section is amended by inserting <quote>or</quote> after the semicolon. </text></subsection></section><section id="H5025F3270B8B46308331ACBBA26AAE0F"><enum>4.</enum><header>Clarification of research under Joint Trauma Education and Training Directorate and inclusion of military working dogs</header><subsection id="H02C3C20ABB864382962812FC4741D1D8"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Subsection (b) of section 708 of the National Defense Authorization Act for Fiscal Year 2017 (<external-xref legal-doc="public-law" parsable-cite="pl/114/328">Public Law 114–328</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/10/1071">10 U.S.C. 1071</external-xref> note) is amended—</text><paragraph id="H2DE58703D86B4FCABD5EA5FC8879B59D"><enum>(1)</enum><text>in paragraph (7), by striking <quote>of members of the Armed Forces</quote> and inserting <quote>with respect to both members of the Armed Forces and military working dogs</quote>; and</text></paragraph><paragraph id="H035F00F4B84D4A95B9B23EA05536FCA5"><enum>(2)</enum><text>by striking paragraph (9) and inserting the following new paragraph:</text><quoted-block style="OLC" id="HF9E9B05F6D3C4F8296749B573DD03D0E" display-inline="no-display-inline"><paragraph id="H4F8F7EC877A04206BA9387CF932D8CDE"><enum>(9)</enum><text display-inline="yes-display-inline">To inform and advise the conduct of research on the leading causes of morbidity and mortality of members of the Armed Forces and military working dogs in combat.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H1D61F09B632E4AE893809F2E114BE631"><enum>(b)</enum><header>Veterinarians in personnel management plan</header><text display-inline="yes-display-inline">Subsection (d)(1) of such section is amended—</text><paragraph id="HF8E2CBAC91A0401EA97FD914E6063B11"><enum>(1)</enum><text>by redesignating subparagraph (F) as subparagraph (G); and</text></paragraph><paragraph id="H72EAB55391814744967434AFA4A9B522"><enum>(2)</enum><text>by inserting after subparagraph (E) the following new subparagraph:</text><quoted-block style="OLC" id="H4775FC99AEC24BB19625181BC87003B0" display-inline="no-display-inline"><subparagraph id="H9B31A74B275741F69902F4E9C52D0258"><enum>(F)</enum><text display-inline="yes-display-inline">Veterinary care.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section></legis-body></bill>
