which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend titles XIX and XXI of the Social Security Act to provide for 12-month continuous enrollment of individuals under the Medicaid program and Children’s Health Insurance Program, and for other purposes.</official-title></form><legis-body id="H469868FA40F34DAF8F04DF2871D52F17" style="OLC"><section id="HAC40CEB0973C4E6BB67D78D7BDA8C83D" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Stabilize Medicaid and CHIP Coverage Act</short-title></quote>.</text></section><section id="HE19D065F37E14EE2BCD15D251D83340A"><enum>2.</enum><header>12-month continuous enrollment</header><subsection id="HD8A632D73B3841359A2004354FD42146"><enum>(a)</enum><header>Requirement of 12-Month continuous enrollment under Medicaid</header><text display-inline="yes-display-inline">Section 1902(e)(12) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396a">42 U.S.C. 1396a(e)(12)</external-xref>) is amended to read as follows:</text><quoted-block display-inline="no-display-inline" id="H60B2112F6F8247039808FFC79E7A5497" style="OLC"><paragraph id="HE821B31DE94B4B7EBFEBC725BE3A43D9"><enum>(12)</enum><header>12-month continuous enrollment</header><text display-inline="yes-display-inline">Notwithstanding any other provision of this title, a State plan approved under this title (or under any waiver of such plan approved pursuant to section 1115 or section 1915), shall provide that an individual who is determined to be eligible for benefits under such plan (or waiver) shall remain eligible and enrolled for such benefits through the end of the month in which the 12-month period (beginning on the date of determination of eligibility) ends.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H1AB7EC7BA7B24C6F937694F1D922BE4A"><enum>(b)</enum><header>Requirement of 12-Month continuous enrollment under CHIP</header><paragraph id="H282E772E601F4526BF37A9B3AB542010"><enum>(1)</enum><header>In general</header><text>Section 2102(b) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1397bb">42 U.S.C. 1397bb(b)</external-xref>) is amended by adding at the end the following new paragraph:</text><quoted-block id="H16EA28CFB39A40029E3F4EA276089697" style="OLC"><paragraph id="H8EC8719C299C4F9EBBD9178C8DC9716C"><enum>(6)</enum><header>Requirement for 12-month continuous enrollment</header><text display-inline="yes-display-inline">Notwithstanding any other provision of this title, a State child health plan that provides child health assistance under this title through a means other than described in section 2101(a)(2), shall provide that an individual who is determined to be eligible for benefits under such plan shall remain eligible and enrolled for such benefits through the end of the month in which the 12-month period (beginning on the date of determination of eligibility) ends.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="HE79707E7AF7F499FBFC48D82112FAB98"><enum>(2)</enum><header>Conforming amendment</header><text display-inline="yes-display-inline">Section 2105(a)(4)(A) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1397ee">42 U.S.C. 1397ee(a)(4)(A)</external-xref>) is amended—</text><subparagraph id="H86039B46D0A64D37AB57462BA19864FE"><enum>(A)</enum><text>by striking <quote>has elected the option of</quote> and inserting <quote>is in compliance with the requirement for</quote>; and</text></subparagraph><subparagraph id="H5BEDEF1188D741228615056FCBE63FC0"><enum>(B)</enum><text>by striking <quote>applying such policy under its State child health plan under this title</quote> and inserting <quote>in compliance with section 2102(b)</quote>.</text></subparagraph></paragraph></subsection><subsection id="H44EEAC25F468401E88F6B17379698BCD"><enum>(c)</enum><header>Effective date</header><paragraph id="H0797DFFC32C3448281719B18560932D0"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Except as provided in paragraph (2) or (3), the amendments made by subsections (a) and (b) shall apply to determinations (and redeterminations) of eligibility made on or after the date that is 18 months after the date of the enactment of this Act.</text></paragraph><paragraph id="H81B500D8D5FD4465A847F135B2B2EE45"><enum>(2)</enum><header>Extension of effective date for State law amendment</header><text>In the case of a State plan under title XIX or State child health plan under title XXI of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396">42 U.S.C. 1396</external-xref> et seq.; <external-xref legal-doc="usc" parsable-cite="usc/42/1397aa">42 U.S.C. 1397aa</external-xref> et seq.) which the Secretary of Health and Human Services determines requires State legislation (other than legislation appropriating funds) in order for the respective plan to meet the additional requirement imposed by the amendment made by subsection (a) or (b), respectively, the respective plan shall not be regarded as failing to comply with the requirements of such title solely on the basis of its failure to meet such applicable additional requirement before the first day of the first calendar quarter beginning after the close of the first regular session of the State legislature that begins after the date of enactment of this Act. For purposes of the previous sentence, in the case of a State that has a 2-year legislative session, each year of the session is considered to be a separate regular session of the State legislature.</text></paragraph><paragraph id="HF4617AE59F3D40069AA14BFB86CDE17F"><enum>(3)</enum><header>Option to implement 12-month continuous eligibility prior to effective date</header><text display-inline="yes-display-inline">A State may elect through a State plan amendment under title XIX or XXI of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396">42 U.S.C. 1396</external-xref> et seq.; <external-xref legal-doc="usc" parsable-cite="usc/42/1397aa">42 U.S.C. 1397aa</external-xref> et seq.) to apply the amendment made by subsection (a) or (b), respectively, on any date prior to the 18-month date specified in paragraph (1), but not sooner than the date of the enactment of this Act.</text></paragraph></subsection></section></legis-body></bill>
