which was referred to the <committee-name committee-id="HJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/35/11">chapter 11</external-xref> of title 35, United States Code, to require the voluntary collection of demographic information for patent inventors, and for other purposes.</official-title></form><legis-body id="HD15C0BDD2C4A4A7A956D9832CAE69F54" style="OLC"><section id="HF04C5FB3EC15402E891CEA13EAEF1DFC" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Inventor Diversity for Economic Advancement Act of 2021</short-title></quote> or the <quote><short-title>IDEA Act</short-title></quote>.</text></section><section id="HB0C72BBF3B954394BA9C540F99FC321E"><enum>2.</enum><header>Collection of demographic information for patent inventors</header><subsection id="H06830D2F865B45E296C1E6565EDDA7AF"><enum>(a)</enum><header>Amendment</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/35/11">Chapter 11</external-xref> of title 35, United States Code, is amended by adding at the end the following:</text><quoted-block id="H6446000EB8834976A325456DDD428AB5" style="USC"><section id="H5AF475CD871C4976B6345AC2F0EE1B13"><enum>124.</enum><header>Collection of demographic information for patent inventors</header><subsection id="H337E584BF5CD49218C9D3FA706858554"><enum>(a)</enum><header>Voluntary collection</header><text>The Director shall provide for the collection of demographic information, including gender, race, military or veteran status, and any other demographic category that the Director determines appropriate, related to each inventor listed with an application for patent, that may be submitted voluntarily by that inventor.</text></subsection><subsection id="H992FA63B0CFD475CA5E1668EB9F3AC2F"><enum>(b)</enum><header>Protection of information</header><text>The Director shall—</text><paragraph id="H4F16D722FB4548BA94910084F0EC3D9A"><enum>(1)</enum><text>keep any information submitted under subsection (a) confidential and separate from the application for patent; and</text></paragraph><paragraph id="H2C6A641E26BC48138794839E3EA57932"><enum>(2)</enum><text>establish appropriate procedures to ensure—</text><subparagraph id="HC4A28D54D53D48858B5CD8966F4AC373"><enum>(A)</enum><text>the confidentiality of any information submitted under subsection (a); and</text></subparagraph><subparagraph id="HF5D5E84EC1384D968FBFF9B386D20684"><enum>(B)</enum><text>that demographic information is not made available to examiners or considered in the examination of any application for patent.</text></subparagraph></paragraph></subsection><subsection id="H6DE31435BF3E43619F94262A904B0CEE"><enum>(c)</enum><header>Relation to other laws</header><paragraph id="HC2B3196FC62B43B5B08746FA57BECF5B"><enum>(1)</enum><header>Freedom of information act</header><text>Any demographic information submitted under subsection (a) shall be exempt from disclosure under section 552(b)(3) of title 5.</text></paragraph><paragraph id="H243785E8F6104E638EFA0A95B5BDA1F5"><enum>(2)</enum><header>Federal information policy law</header><text>Subchapter I of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/44/35">chapter 35</external-xref> of title 44 shall not apply to the collection of demographic information under subsection (a).</text></paragraph></subsection><subsection id="HEBDE7AD3042E40FEBA9E765AE2D48252"><enum>(d)</enum><header>Publication of demographic information</header><paragraph id="H25229802B6E54268BEAB965421EFD41B"><enum>(1)</enum><header>Report required</header><text>Not later than January 31 of each year, the Director shall make publicly available a report that, except as provided in paragraph (3)—</text><subparagraph id="H852A78E06F1A4C72B7C95B1360F356B9"><enum>(A)</enum><text>includes the total number of patent applications filed during the previous year disaggregated—</text><clause id="H863C22D752C248C8BC185D85AC0C5FF0"><enum>(i)</enum><text>by demographic information described in subsection (a); and</text></clause><clause id="H12B019A0C4AD420EB602F0E9A74A1AFF"><enum>(ii)</enum><text>by technology class number, technology class title, country of residence of the inventor, and State of residence of the inventor in the United States;</text></clause></subparagraph><subparagraph id="H5510BFC312574EBABFB726FD8C2A7392"><enum>(B)</enum><text>includes the total number of patents issued during the previous year disaggregated—</text><clause id="H3F21327309524449BE095888EBCB2DE6"><enum>(i)</enum><text>by demographic information described in subsection (a); and</text></clause><clause id="HD0E7FD6C6B8C40BD9207B28BB0CC4129"><enum>(ii)</enum><text>by technology class number, technology class title, country of residence of the inventor, and State of residence of the inventor in the United States; and</text></clause></subparagraph><subparagraph id="HE929D1158E294087A07A7C4C938BCC9A"><enum>(C)</enum><text>includes a discussion of the data collection methodology and summaries of the aggregate responses.</text></subparagraph></paragraph><paragraph id="HB482BC1C84A5454DBA63ECBD1568BDFB"><enum>(2)</enum><header>Data availability</header><text>In conjunction with issuance of the report under paragraph (1), the Director shall make publicly available data based on the demographic information collected under subsection (a) that, except as provided in paragraph (3), allows the information to be cross-tabulated to review subgroups.</text></paragraph><paragraph id="HCC3A2A193A844167BDB3E496D814D6CF"><enum>(3)</enum><header>Privacy</header><text>The Director—</text><subparagraph id="H9332A1FC674E40EF9DDD080B723F2EB2"><enum>(A)</enum><text>may not include personally identifying information in—</text><clause id="H5D7596EB08984908B0EB4722864F6454"><enum>(i)</enum><text>the report made publicly available under paragraph (1); or</text></clause><clause id="H9E0BEE7D53B04451BDBBC85559E9DB76"><enum>(ii)</enum><text>the data made publicly available under paragraph (2); and</text></clause></subparagraph><subparagraph id="H571F9D84CB87439585D01C9D7592E0A4"><enum>(B)</enum><text>in making publicly available the report under paragraph (1) and the data under paragraph (2), shall anonymize any personally identifying information related to the demographic information collected under subsection (a).</text></subparagraph></paragraph></subsection><subsection id="HA7576D95F3614BBEBD93EBA80FB7F0D2"><enum>(e)</enum><header>Biennial report</header><text>The Director shall submit to Congress a biennial report that evaluates the data collection process under this section, ease of access to the information by the public, and recommendations on how to improve data collection.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H8EBD8E55999B46DCB757367BCC45F057"><enum>(b)</enum><header>Technical and conforming amendment</header><text>The table of sections at the beginning of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/35/11">chapter 11</external-xref> of title 35, United States Code, is amended by adding at the end the following:</text><quoted-block id="H51C04FCD8A104C9CAD0F53C4A2B09BA5" style="USC"><toc regeneration="no-regeneration"><toc-entry level="section">124. Collection of demographic information for patent inventors</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H020FE055F2074665AD88A298C275031B"><enum>(c)</enum><header>Deadline for biennial report</header><text>Not later than 2 years after the date of enactment of this Act, and every 2 years thereafter, the Under Secretary of Commerce for Intellectual Property and Director of the United States Patent and Trademark Office shall submit to Congress the biennial report required under section 124(e) of title 35, United States Code, as added by subsection (a).</text></subsection></section></legis-body></bill>
