which was referred to the <committee-name committee-id="HHM00">Committee on Homeland Security</committee-name>, and in addition to the <committee-name committee-id="HJU00">Committee on the Judiciary</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To ensure operational control of the southwest border, and for other purposes.</official-title></form><legis-body id="H56134213E7D849E9B9FAECC9258D49AB" style="OLC"><section id="HF3FB7B328E9349839213BF755EE651A0" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Border Visibility and Security Act</short-title></quote>.</text></section><section id="H75829C77237E463D966DA1DD527A8840"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="HFCBF15FDB0B347FDB5EE1E4442D25A43"><enum>(1)</enum><header>Commissioner</header><text>The term <quote>Commissioner</quote> means the Commissioner of U.S. Customs and Border Protection.</text></paragraph><paragraph id="H3974C48B33D040DC949B91D28869C34A"><enum>(2)</enum><header>Operational control</header><text display-inline="yes-display-inline">The term <quote>operational control</quote> has the meaning given such term in section 2(b) of the Secure Fence Act of 2006 (<external-xref legal-doc="usc" parsable-cite="usc/8/1701">8 U.S.C. 1701</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/109/367">Public Law 109–367</external-xref>).</text></paragraph><paragraph id="H43FA0FA6573C4FC1BB152C3B6C36451F"><enum>(3)</enum><header>Secretary</header><text>The term <quote>Secretary</quote> means the Secretary of Homeland Security.</text></paragraph><paragraph id="HD747684C2C5247D681C545B5E5FA4FC1"><enum>(4)</enum><header>Situational awareness</header><text>The term <quote>situational awareness</quote> has the meaning given such term in section 1092(a)(7) of the National Defense Authorization Act for Fiscal Year 2017 (<external-xref legal-doc="public-law" parsable-cite="pl/114/328">Public Law 114–328</external-xref>).</text></paragraph></section><section id="H1566DD41D70F48C4A364E2210A5B1353"><enum>3.</enum><header>Strengthening the requirements for border security technology along the southern border</header><text display-inline="no-display-inline">Section 102 of the Illegal Immigration Reform and Immigrant Responsibility Act of 1996 (division C of <external-xref legal-doc="public-law" parsable-cite="pl/104/208">Public Law 104–208</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/8/1103">8 U.S.C. 1103</external-xref> note) is amended—</text><paragraph id="HDE4912429BFC43F9B7AA1D4BCCB41FB6"><enum>(1)</enum><text>in subsection (a)—</text><subparagraph id="HF0F996D6CAB64C1C8A210F443CD82ED1"><enum>(A)</enum><text>by inserting <quote>and border technology</quote> before <quote>in the vicinity of</quote>; and</text></subparagraph><subparagraph id="H50C46B93E9EE4B47A28B27708EBE93BA"><enum>(B)</enum><text>by striking <quote>illegal crossings in areas of high illegal entry into the United Sates</quote> and inserting <quote>, impede, and detect illegal activity and entry into the United States</quote>;</text></subparagraph></paragraph><paragraph id="HC5051376C74B4892BBA5039E4A90BB5F"><enum>(2)</enum><text>in subsection (b)—</text><subparagraph id="H716BA51505024532AB1054210AFAAD19"><enum>(A)</enum><text>in the heading by striking <quote><header-in-text level="subsection" style="OLC">road improvements</header-in-text></quote> and inserting <quote><header-in-text level="subsection" style="OLC">navigable roads</header-in-text></quote>; and</text></subparagraph><subparagraph id="HB7474D3CEA604D23B3D0D2D51481DE5E"><enum>(B)</enum><text>by adding at the end the following new paragraph:</text><quoted-block id="HC5AA3E958F6E47968E8ACD859B5E1E77" style="OLC"><paragraph id="H59FB032A1D6D46ECB60EB61BEF4DACBF"><enum>(5)</enum><header>Additional navigable roads along the southwest border</header><subparagraph id="H332B14AD9BAE4DF09E3F22D39F5F6A92"><enum>(A)</enum><header>Navigable road defined</header><text>In this subsection, the term <quote>navigable road</quote> means a contiguous, navigable road.</text></subparagraph><subparagraph id="HBD7967B1250642919AEDD3E9662DDD71"><enum>(B)</enum><header>Navigable roads</header><text display-inline="yes-display-inline">In carrying out subsection (a), the Secretary of Homeland Security shall construct a navigable road along not less than 700 miles of the southwest border where most practical and effective to gain operational control of the southwest border.</text></subparagraph><subparagraph id="H28566B5D100B4ABFBBD845175A8B6FBF"><enum>(C)</enum><header>Priority areas</header><text>In carrying out this paragraph, the Secretary of Homeland Security shall—</text><clause id="H12BAC057B1C54D1BBC37601D678A62BA"><enum>(i)</enum><text>identify the 700 miles, or other mileage determined by the Secretary, along the southwest border where a navigable road would be most practical and effective in deterring smugglers and aliens attempting to gain illegal entry into the United States; and</text></clause><clause id="HE3C3FD6277A84C859D8AAEBF251897FE" commented="no"><enum>(ii)</enum><text>not later than December 31, 2021, complete construction of a navigable road along the miles identified under clause (i).</text></clause></subparagraph><subparagraph id="HD55173C56DDF46F2B2A3ABEA6381F9C9"><enum>(D)</enum><header>Consultation</header><clause id="H9653E18661754E13B9B7832B0A22FF8A"><enum>(i)</enum><header>In general</header><text>In carrying out this paragraph, the Secretary of Homeland Security shall consult with the Secretary of the Interior, the Secretary of Agriculture, States, local governments, Indian Tribes, and property owners in the United States to minimize the impact on the environment, culture, commerce, and quality of life for the communities and residents located near the sites at which navigable roads are to be constructed.</text></clause><clause id="H2357468619AA4AA7881E75498B3C8293"><enum>(ii)</enum><header>Savings provision</header><text>Nothing in this subparagraph may be construed to—</text><subclause id="HA60E93A136DD49C9B3A4A58E46D88ECE"><enum>(I)</enum><text>create or negate any right of action for a State, local government, Indian Tribe, or other person or entity affected by this subsection; or</text></subclause><subclause id="HB5F75E158623491C87B9F63DC4CECB35"><enum>(II)</enum><text>affect the eminent domain laws of the United States or of any State.</text></subclause></clause></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H869DAA10839847BBA695C644A66CB3EC"><enum>(3)</enum><text>in subsection (c)(1), by inserting <quote>and, pursuant to subsection (d), the installation, operation, and maintenance of technology,</quote> after <quote>barriers and roads</quote>; and</text></paragraph><paragraph id="H48E587398BD44B96B9C36E0FC036795A"><enum>(4)</enum><text>by adding at the end the following new subsections:</text><quoted-block id="H0E1B5A88BF1D4DDABEC0367E86BD7120" style="OLC"><subsection id="HB2458AA1C4074866B9B1287C03A9008B"><enum>(e)</enum><header>Installation, operation, and maintenance of technology</header><paragraph id="H61E15E37DC474707B34443F8B406976A" commented="no"><enum>(1)</enum><header>In general</header><text>Not later than January 20, 2022, the Secretary of Homeland Security, in carrying out subsection (a), shall deploy the most practical and effective technology available along the United States border for achieving situational awareness and operational control of the border.</text></paragraph><paragraph id="HCB21C62D88E04E0891A5989517FC5959"><enum>(2)</enum><header>Technology defined</header><text>In this subparagraph, the term <quote>technology</quote> includes border surveillance and detection technology, including—</text><subparagraph id="H7ECA0B9C8B864FD58767D5F4867670C2"><enum>(A)</enum><text>radar surveillance systems;</text></subparagraph><subparagraph id="H0F6D83C4331A4515974D478051BD0C24"><enum>(B)</enum><text>Vehicle and Dismount Exploitation Radars (VADER);</text></subparagraph><subparagraph id="HE46D792AFBAD4CE49DD5A95AA75B5C5F"><enum>(C)</enum><text>3-dimensional, seismic acoustic detection and ranging border tunneling detection technology;</text></subparagraph><subparagraph id="H9A00318A87224756B6161C77973FB05B"><enum>(D)</enum><text>sensors;</text></subparagraph><subparagraph id="HE35825B56CE84B7EBF1F117B2AC69961"><enum>(E)</enum><text>unmanned cameras;</text></subparagraph><subparagraph id="HB0E69BB1922C4E33B25AD44D66D4F428"><enum>(F)</enum><text>man-portable and mobile vehicle-mounted unmanned aerial vehicles; and</text></subparagraph><subparagraph id="HE132F2BD979644CC93D9DAB582B291BF"><enum>(G)</enum><text>any other devices, tools, or systems found to be more effective or advanced than those specified in subparagraphs (A) through (F).</text></subparagraph></paragraph></subsection><subsection id="H965316CBDB9A421CAB81279501467BAC"><enum>(f)</enum><header>Definitions</header><text>In this section, the term <quote>situational awareness</quote> has the meaning given the term in section 1092(a)(7) of the National Defense Authorization Act for Fiscal Year 2017 (<external-xref legal-doc="public-law" parsable-cite="pl/114/328">Public Law 114–328</external-xref>).</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="HEA7FEB2EE2B24B0CA1CD86014BA2F4C2"><enum>4.</enum><header>Comprehensive southern border strategy</header><subsection id="HEC18D20535BA4B5F9DB57E38F44ABA01"><enum>(a)</enum><header>In general</header><text>Not later than 12 months after the date of the enactment of this section, the Secretary shall submit to the Committee on Homeland Security of the House of Representatives and the Committee on Homeland Security and Governmental Affairs of the Senate a comprehensive Southern border strategy.</text></subsection><subsection id="HFE0823CA57084A00A92FE0300A37B3D2"><enum>(b)</enum><header>Contents</header><text>The strategy submitted under subsection (a) shall include—</text><paragraph commented="no" id="H3454C03EEF3542C1A95B3F75796C247D"><enum>(1)</enum><text>a list of known physical barriers, technologies, tools, and other devices that can be used to achieve and maintain situational awareness and operational control along the southern border;</text></paragraph><paragraph id="HA5769F8C55C8440DBABCE6AE9E93DF15"><enum>(2)</enum><text>a projected per mile cost estimate for each physical barrier, technology, tool, and other device included on the list required under paragraph (1);</text></paragraph><paragraph id="H007D4ECDCE344254A18B5279F6D634F3"><enum>(3)</enum><text>a detailed account of which type of physical barrier, technology, tool, or other device the Department believes is necessary to achieve and maintain situational awareness and operational control for each linear mile of the southern border;</text></paragraph><paragraph id="H6B06C1BDD7794CD4859275233235894A"><enum>(4)</enum><text>an explanation for why such physical barrier, technology, tool, or other device was chosen to achieve and maintain situational awareness and operational control for each linear mile of the southern border, including—</text><subparagraph id="H563503933E984E77882BE2D324FFBB73"><enum>(A)</enum><text>the methodology used to determine which type of physical barrier, technology, tool, or other device was chosen for such linear mile;</text></subparagraph><subparagraph id="HC136259FED5E49F2AD4D9ECC312035AE"><enum>(B)</enum><text>an examination of existing manmade and natural barriers for each linear mile of the southern border; and</text></subparagraph><subparagraph id="HB3C3ADA7D6954B169C1B9300E29C21DA"><enum>(C)</enum><text>the information collected and evaluated from—</text><clause id="H2563A31DE929442C8299F2EE792EAAD6"><enum>(i)</enum><text>the appropriate U.S. Customs and Border Protection Sector Chief;</text></clause><clause id="H26F026FA4B2C4D4FBC1443DF44AC4AAF"><enum>(ii)</enum><text>the Joint Task Force Commander;</text></clause><clause id="H80D2E421A6BC471BB93821778BDAA329"><enum>(iii)</enum><text>the appropriate State Governor;</text></clause><clause id="H93580E3074C14D11A057B8CA8EF6DFE5"><enum>(iv)</enum><text>local law enforcement officials;</text></clause><clause id="HA238F3488F16431893E9552351A03705"><enum>(v)</enum><text>private property owners; and</text></clause><clause id="H50C8DEE4B636427EA28EC16F61A4B6DF"><enum>(vi)</enum><text>other affected stakeholders;</text></clause></subparagraph></paragraph><paragraph id="H6B5AAEC47D1142058F71FC883D357B10"><enum>(5)</enum><text>a per mile cost calculation for each linear mile of the southern border given the type of physical barrier, technology, tool, or other device chosen to achieve and maintain operational control for each linear mile; and</text></paragraph><paragraph id="HFAD129A19A484E35BBB62AEB1967F040"><enum>(6)</enum><text>a cost justification for each time a more expensive physical barrier, technology, tool, or other device is chosen over a less expensive option, as established by the per mile cost estimates required in paragraph (2).</text></paragraph></subsection></section><section id="H8B921936481F47B8A0424AB702169AC6"><enum>5.</enum><header>Eradication of cane along the Rio Grande river</header><subsection id="HBE8D2E6E9C134BB89B40647DA8CC598A"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary of Homeland Security shall take such actions as may be necessary, including through cooperation with appropriate Federal and State agencies, to permanently eradicate the cane, or Arundo donax, that grows along the Rio Grande river.</text></subsection><subsection id="H45A0157B945F4DD4BB98656423C28ED3"><enum>(b)</enum><header>Prohibition on additional funding</header><text display-inline="yes-display-inline">No additional funds are authorized to be appropriated to carry out this section. This section shall be carried out using amounts otherwise authorized.</text></subsection></section><section id="H35605FBC893C47E09FBD88743518E197"><enum>6.</enum><header>Funding</header><subsection id="H0C3CF94694B14DD79D0AE54B16CD1E7E"><enum>(a)</enum><header>Use of certain forfeited criminal proceeds for border security measures</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, any illegally obtained profits resulting from any criminal drug trafficking enterprise led by Joaquin Archivaldo Guzman Loera (commonly known as <quote>El Chapo</quote>), which are criminally forfeited to the United States Government as a result of the conviction of Mr. Guzman Loera in Federal district court, shall be reserved for security measures along the border between the United States and Mexico, including to carry out this Act and the amendments made by this Act, for the purpose of furthering the Nation’s security.</text></subsection><subsection id="HA031A472394748AFA1A9847261DD501A"><enum>(b)</enum><header>Use of forfeited criminal proceeds of other convicted cartel members</header><text>Notwithstanding any other provision of law, any funds that are criminally forfeited to the United States Government as the result of a felony conviction in a Federal district court of a member of a drug cartel—an individual engaging in a continuing criminal enterprise involving knowingly and intentionally distributing a controlled substance, intending and knowing that such substance would be unlawfully imported into the United States from a place outside of the United States—shall be reserved for security measures along the border between the United States and Mexico, including to carry out this Act and the amendments made by this Act, for the purpose of furthering the Nation’s security.</text></subsection></section></legis-body></bill>
