which was referred to the <committee-name committee-id="HPW00">Committee on Transportation and Infrastructure</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title 23, United States Code, to establish a grant program for States that establish specific standards for education and training programs concerning civilian and law enforcement encounters during traffic stops and other in-person encounters, and for other purposes.</official-title></form><legis-body id="HB297A4BB624A479BBD9F2F82A3D2CB58" style="OLC"><section id="H2594D9DC7DFB4828A9B8697599E028DB" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Driver and Officer Safety Education Act</short-title></quote>.</text></section><section id="HD7503FCB0FA74F9A9090159C46CDAB69"><enum>2.</enum><header>Grant program for States meeting minimum standards for educational and training programs concerning law enforcement practices during traffic stops and other in-person encounters</header><subsection id="H67E3CAFFA9A3426FAECAF254D662F72E"><enum>(a)</enum><header>Increase in authorization levels</header><text display-inline="yes-display-inline">Section 4001(a)(3) of the FAST Act is amended by—</text><paragraph id="H9915F8D873C24E26BE6E9039F0098AD9"><enum>(1)</enum><text>striking paragraphs (D) and (E); and</text></paragraph><paragraph id="HE9E73821DC494AB8986C86A84709A37C"><enum>(2)</enum><text>inserting after paragraph (C) the following:</text><quoted-block style="OLC" id="H8FD9D223E7494112BF3AC6619F486FA9" display-inline="no-display-inline"><paragraph id="HA062EE443F5340F2ADEE2DDB2CD9C5AD"><enum>(D)</enum><text display-inline="yes-display-inline">$288,660,000 for fiscal year 2019; and</text></paragraph><paragraph id="H46933AAC35EE409596A892ABDDB5F163"><enum>(E)</enum><text>$291,618,000 for fiscal year 2020.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H3B42C004C08843569A8D9BE42EB858D2"><enum>(b)</enum><header>Grant program</header><text display-inline="yes-display-inline">Section 405 of title 23, United States Code is amended—</text><paragraph id="H62147B07BA9340558579A2DAEEB3E58B"><enum>(1)</enum><text>in subsection (a)(1), by striking <quote>13</quote> and inserting <quote>12.74</quote>;</text></paragraph><paragraph id="HCC4872B451534CFDB50203972E9ED210"><enum>(2)</enum><text>in subsection (a)(2), by striking <quote>14.5</quote> and inserting <quote>14.21</quote>;</text></paragraph><paragraph id="HEF1322A255F74188AA3C0D3518A72D34"><enum>(3)</enum><text>in subsection (a)(3), by striking <quote>52.5</quote> and inserting <quote>51.45</quote>;</text></paragraph><paragraph id="H0EF7AE364CF74DDBB047453A010D6892"><enum>(4)</enum><text>in subsection (a)(4), by striking <quote>8.5</quote> and inserting <quote>8.33</quote>;</text></paragraph><paragraph id="HBB70DEE0549648838AC468ED623E07FE"><enum>(5)</enum><text>in subsection (a)(5), by striking <quote>1.5</quote> and inserting <quote>1.47</quote>;</text></paragraph><paragraph id="HDF5FAE709FEB496FAF5A5D89104AEAAD"><enum>(6)</enum><text>in subsection (a)(6), by striking <quote>5</quote> and inserting <quote>4.9</quote>;</text></paragraph><paragraph id="H0D9CC1DA5F954473BA6EEE4075AFB99A"><enum>(7)</enum><text>in subsection (a)(7), by striking <quote>5</quote> and inserting <quote>4.9</quote>;</text></paragraph><paragraph id="HEB89C3B649FB4BB6848FAF923945C1F3"><enum>(8)</enum><text>by redesignating paragraphs (8) through (10) of subsection (a) as paragraphs (9) through (11);</text></paragraph><paragraph id="H85B4F469CFCD43BEB29585E29B50314B"><enum>(9)</enum><text>by inserting after subsection (a)(7) the following:</text><quoted-block style="USC" id="H3E4C399B4AD747F48F98F98B15331E4C" display-inline="no-display-inline"><paragraph id="HE0BDAD76BEC642FFA7C31A57B1830EA9"><enum>(8)</enum><header>Commuter safety education</header><text display-inline="yes-display-inline">In each fiscal year, 2 percent of the funds provided under this section shall be allocated among States that implement commuter safety education programs (as described in subsection (i)).</text></paragraph><after-quoted-block>; </after-quoted-block></quoted-block></paragraph><paragraph id="H7DB803CAD8A84122B319DFCC837F44C0"><enum>(10)</enum><text>in subsection (a)(9), as so redesignated, by—</text><subparagraph id="H20EA010FF65E4D0985979658BA58CF53"><enum>(A)</enum><text>striking <quote>through (7)</quote> and inserting <quote>through (8)</quote>; and</text></subparagraph><subparagraph id="H8A0C99659D8848E481770A5E75278990"><enum>(B)</enum><text>striking <quote>through (h)</quote> and inserting <quote>through (i)</quote>; and</text></subparagraph></paragraph><paragraph id="H7CAB3FFCCDAA41FDA1A5FB13C84773C2"><enum>(11)</enum><text>by inserting at the end the following:</text><quoted-block style="USC" id="H036208637FEC4C29B805845A5A642219" display-inline="no-display-inline"><subsection id="H72B92D2A2E174F249825B3627B6B4E8B"><enum>(i)</enum><header>Commuter safety education</header><paragraph id="HD76245E4420C46CAA19AA892E52CEDAA"><enum>(1)</enum><header>General authority</header><text display-inline="yes-display-inline">Subject to the requirements under this subsection, the Secretary of Transportation shall award grants to States that enact a commuter safety education program.</text></paragraph><paragraph id="H96DF213EDC1D4D188736400EEEE22B11"><enum>(2)</enum><header>Federal share</header><text display-inline="yes-display-inline">The Federal share of the costs of activities funded using amounts from grants awarded under this subsection may not exceed 80 percent for each fiscal year for which a State receives a grant.</text></paragraph><paragraph id="H58FEBF42F2AA4AE3B024697BB7BD34EB"><enum>(3)</enum><header>Eligibility</header><text display-inline="yes-display-inline">To be eligible for a grant under this subsection, a State shall enact a law or adopt a program that requires the following:</text><subparagraph id="HBFF564F2B6DD4EE4A1A2FC853279DBCF"><enum>(A)</enum><header>Driver education and driving safety courses</header><text display-inline="yes-display-inline">Inclusion, in driver education and driving safety courses provided to individuals by educational and motor vehicle agencies of the State, of instruction and testing concerning law enforcement practices during traffic stops and other in-person encounters, including information on—</text><clause id="H6471D012885C4B2FB5A07623297BCF74"><enum>(i)</enum><text display-inline="yes-display-inline"> the role of law enforcement and the duties and responsibilities of peace officers;</text></clause><clause id="H4E23857D2F4C4F809CFBC05DBE6B64D1"><enum>(ii)</enum><text>an individual’s legal rights concerning interactions with peace officers;</text></clause><clause id="HDF87F526413C430E85985FFE40B62F61"><enum>(iii)</enum><text display-inline="yes-display-inline">best practices for civilians and peace officers during such interactions;</text></clause><clause id="H0A04CDB80213475EAD218069586FDE85"><enum>(iv)</enum><text>laws regarding questioning and detention by peace officers, including any law requiring an individual to present proof of identity to a peace officer;</text></clause><clause id="H7340ECCB0A2147D18DE6C29AFB062C8D"><enum>(v)</enum><text>the consequences for an individual’s or officer's failure to comply with those laws; and</text></clause><clause id="HEA6232FC81F34306A661E7AF0CB2B8EB"><enum>(vi)</enum><text>how and where to file a complaint against or a compliment on behalf of a peace officer.</text></clause></subparagraph><subparagraph id="HF6A179FFD3A84FE3AFCFBD781633151A"><enum>(B)</enum><header>Peace officer training programs</header><text display-inline="yes-display-inline">Development and implementation of a training program, including instruction and testing materials, for peace officers and reserve law enforcement officers (other than officers who have received training in a civilian course described in subparagraph (A)) pertaining to proper interaction with civilians during traffic stops and other in-person encounters.</text></subparagraph></paragraph><paragraph id="HB2C6D2000F264D079F35EE9679A74DE1"><enum>(4)</enum><header>Allocation of grant funds</header><text display-inline="yes-display-inline">For each fiscal year, funds made available to carry out this subsection for such fiscal year shall be apportioned to a covered State in an amount determined by multiplying—</text><subparagraph id="H8257A460EAC74150865A91DB6AF3792D"><enum>(A)</enum><text display-inline="yes-display-inline">the amount made available to carry out this subsection for the fiscal year; by </text></subparagraph><subparagraph id="H8C059BE975E5414EBDA63F099B83657F"><enum>(B)</enum><text>the ratio that the amount of funds apportioned to each such State under section 402 for such fiscal year bears to the total amount of funds apportioned to all such States under section 402 for such fiscal year.</text></subparagraph></paragraph><paragraph id="H3382EFFDDF184D818D97CE0A6AFD4C9B"><enum>(5)</enum><header>Covered State</header><text display-inline="yes-display-inline">In this subsection, a <quote>covered State</quote> means—</text><subparagraph id="HAF98921673164AD2A090C8C9FB3C70A1"><enum>(A)</enum><text display-inline="yes-display-inline">a State that the Secretary determines is enforcing and carrying out the law or program described in paragraph (3); and</text></subparagraph><subparagraph id="HDD6119F1174249AABE521EB12D77F448"><enum>(B)</enum><text display-inline="yes-display-inline">a State that qualifies pursuant to paragraph (6)(A).</text></subparagraph></paragraph><paragraph id="H66753072D32A4DE79769FC8C83211628"><enum>(6)</enum><header>Special rule for certain States</header><subparagraph id="H89726729F27645C18962A312A7F65354"><enum>(A)</enum><header>Qualifying State</header><text display-inline="yes-display-inline">A State qualifies pursuant to this subparagraph if—</text><clause id="HCB90508C410C434391AE10AB1237EA05"><enum>(i)</enum><text display-inline="yes-display-inline">the Secretary determines such State has taken meaningful steps toward the full implementation of a law or program described in paragraph (3); </text></clause><clause id="H7C48FEF6227B4B41B968341A2F43F761"><enum>(ii)</enum><text display-inline="yes-display-inline">the Secretary determines such State has established a timetable for the implementation of such law or program; and</text></clause><clause id="HAD86556304374226B4C1288D9B52D0BD"><enum>(iii)</enum><text>subject to subparagraph (C), such State has received a grant pursuant to this subsection for a period of no more than 2 years.</text></clause></subparagraph><subparagraph id="H2796971A9E934D7B9F4E02FF5C2B88AD"><enum>(B)</enum><header>Withholding</header><text>With respect to a State that qualifies pursuant to subparagraph (A), the Secretary shall—</text><clause id="H245F641579554D409C722F991EFA8DDD"><enum>(i)</enum><text>withhold 50 percent of the amount that such State would otherwise receive if such State were a State described in paragraph (5)(A); and</text></clause><clause id="H16DB0D41C65445C9A59363E5DE8E8D31"><enum>(ii)</enum><text>direct any such amounts for distribution among the States described in paragraph (5)(A).</text></clause></subparagraph><subparagraph id="H7418BC0923C24E55A59AFE79E07D5D1E"><enum>(C)</enum><header>Waiver</header><text display-inline="yes-display-inline">Upon the request of a State, the Secretary may waive or modify the 2-year period described in subparagraph (A)(iii) if the Secretary determines that such a waiver would be equitable due to exceptional or uncontrollable circumstances.</text></subparagraph></paragraph><paragraph id="H0899A1C360EE48D38349C010D03FB315"><enum>(7)</enum><header>Use of grant amounts</header><text display-inline="yes-display-inline">Grant funds received pursuant to this subsection may be used—</text><subparagraph id="H633FE679A1D24A50A152E4BBFE6207B3"><enum>(A)</enum><text display-inline="yes-display-inline">for the production of educational materials and training of staff for driver education and driving safety courses and peace officer training described in paragraph (3); and</text></subparagraph><subparagraph id="H92A616004BA24DD9BF038C63786E3032"><enum>(B)</enum><text>for the implementation of the law described in paragraph (3).</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section><section id="HC58BD2AF47C74EEF937A387EC18CC77D"><enum>3.</enum><header>Effective date</header><text display-inline="no-display-inline">The amendments made by section 2(b) shall take effect on the first day of the fiscal year that begins after the date of enactment of this Act.</text></section></legis-body></bill>
