which was referred to the <committee-name committee-id="HPW00">Committee on Transportation and Infrastructure</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title 23, United States Code, to increase accessible transportation for individuals with disabilities.</official-title></form><legis-body id="H34B8AC9FD481460A98D2531E4A3B87CC" style="OLC"><section id="H487819B578CC43358BF340F0441629A6" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Disability Access to Transportation Act</short-title></quote>. </text></section><section id="HDF34805383814A27A1533CD80E60A73B"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text><paragraph id="HD42717C110D1456A98A216D136B0B0EB"><enum>(1)</enum><text display-inline="yes-display-inline">According to the Centers for Disease Control and Prevention, 1 in 4 U.S. adults has a disability.</text></paragraph><paragraph id="HAFBFC8D098AC483E9CBFBFB4956983DB"><enum>(2)</enum><text>Section 2(b) of the Americans with Disabilities Act (<external-xref legal-doc="usc" parsable-cite="usc/42/12101">42 U.S.C. 12101</external-xref>) recognized that individuals with disabilities face discrimination when using transportation services and sought to provide <quote>a clear and comprehensive national mandate for the elimination of discrimination against individuals with disabilities</quote>.</text></paragraph><paragraph id="H48FDAEAD236847D39B3F744993E3A257"><enum>(3)</enum><text>30 years after the enactment of the Americans with Disabilities Act, individuals with disabilities continue to face systemic discrimination and a lack of accessible transportation options.</text></paragraph><paragraph id="H63F9E4BA0B684781A52BAB88950BA8AB"><enum>(4)</enum><text display-inline="yes-display-inline">Transportation is a core component of independent living; without the ability to easily move from one location to another, especially to drop a child off at day care, arrive at work on time, or run basic errands, true community living is impossible.</text></paragraph><paragraph id="H61A745CE65CE42008E3C751F129605F9"><enum>(5)</enum><text>Technology is changing the way the transportation industry provides services.</text></paragraph><paragraph id="H1BEFDA02AA5248DF9FB43CC041F577BF"><enum>(6)</enum><text display-inline="yes-display-inline">As technology continues to change the way people move from one place to another, the transportation sector, including Federal agencies, local transit systems, and private entities must innovate and provide services in a way that empowers individuals with disabilities to travel independently in their communities.</text></paragraph></section><section id="H696C76A9C5C043C98C123A81790E5909"><enum>3.</enum><header>One-stop paratransit pilot program</header><subsection id="HF9EBE078D5EC492C8D42EC1F1D412F42"><enum>(a)</enum><header>In general</header><text>Not later than 6 months after the date of enactment of this Act, the Secretary of Transportation shall establish a one-stop paratransit pilot program.</text></subsection><subsection id="HA5D5BF0376034C56975CADD8C6B0C6B3"><enum>(b)</enum><header>Purpose</header><text>The purpose of the pilot program under this section is to develop or expand paratransit programs carried out pursuant to the ADA to provide for 1 stop of at least 15 minutes outside of the vehicle during a paratransit trip to prevent long wait times between multiple trips that unduly limit an individual’s ability to complete essential tasks.</text></subsection><subsection id="HA6692D67E59748B7A97B5C51BBE42CB1"><enum>(c)</enum><header>Eligible entities</header><paragraph id="HC1522CCF419C4AB4B3598BBFF3997830"><enum>(1)</enum><header>In general</header><text>An entity eligible to participate in the pilot program is a transit agency that agrees to track and share information as the Secretary requires, including—</text><subparagraph id="H57F766421A6444DBAA214E4B58D7D6AE"><enum>(A)</enum><text>number of ADA paratransit trips conducted each year;</text></subparagraph><subparagraph id="H340F12EA5FE64D8EB3078E8939E5D4ED"><enum>(B)</enum><text>requested time of each paratransit trip;</text></subparagraph><subparagraph id="H4AD474E9D57F4D1A8033646CA7329AA3"><enum>(C)</enum><text>scheduled time of each paratransit trip;</text></subparagraph><subparagraph id="HC2A110C42E5A46F196961C4E330269FA"><enum>(D)</enum><text>actual pickup time for each paratransit trip;</text></subparagraph><subparagraph id="H8264F10139D14D8BA8AF7E8C0C7B824B"><enum>(E)</enum><text>average length of a stop in the middle of a ride as allowed by this section;</text></subparagraph><subparagraph id="H3CE8BE15EB5D47F78E79C36297102744"><enum>(F)</enum><text>any complaints received by a paratransit rider; </text></subparagraph><subparagraph id="HFF6353F1444B431EA4A833B0A05AFC1F"><enum>(G)</enum><text>rider satisfaction with paratransit services; and</text></subparagraph><subparagraph id="HEEA0D8ECA956483B91820BC1FF5C565B"><enum>(H)</enum><text display-inline="yes-display-inline">after the completion of the pilot program, an assessment by the eligible entity of its capacity to continue a one-stop program independently.</text></subparagraph></paragraph><paragraph id="H09A4FEB6EC87476E96E20F950580CBA6"><enum>(2)</enum><header>Preference</header><text>The Secretary shall give preference to entities that—</text><subparagraph id="H28479E11DA3A4843877FD194BE3EB1E2"><enum>(A)</enum><text>have comparable data for the year prior to implementation of the pilot program that can be used by the Secretary and other organizations, such as nonprofit organizations and advocacy organizations, for research purposes; and</text></subparagraph><subparagraph id="H511FF9ACAC954097A47B5030EB8F6398"><enum>(B)</enum><text>plan to use agency personnel to implement the pilot program.</text></subparagraph></paragraph></subsection><subsection id="H09EA00E523824C8E97FBDE6CF3C2332F"><enum>(d)</enum><header>Application</header><text>To be eligible to participate in the pilot program, an eligible entity shall submit to the Secretary an application at such time, in such manner, and containing such information as the Secretary may require, including information on—</text><paragraph id="H3F1F2C459F974FDDBA1767814C23DF51"><enum>(1)</enum><text display-inline="yes-display-inline">locations the eligible entity intends to allow a stop at, if stops are limited, including—</text><subparagraph id="HCA3C3DDCFBDD46BB983FC135FD03A911"><enum>(A)</enum><text>childcare or education facilities;</text></subparagraph><subparagraph id="H4E7FA91E503F460AB5FF7B88A28DCCBA"><enum>(B)</enum><text>pharmacies;</text></subparagraph><subparagraph id="H8538C68F46DA43979E4ACEE793B1AE72"><enum>(C)</enum><text>grocery stores; and</text></subparagraph><subparagraph id="H363BFEB643E84FAE92E2B6E06E9A4EC9"><enum>(D)</enum><text>bank or ATM locations;</text></subparagraph></paragraph><paragraph id="H920C611D545C4CBE82A57B3BCE53C07A"><enum>(2)</enum><text>methodology for informing the public of the pilot program;</text></paragraph><paragraph id="H4FE46CF196A7430FB7EB7A580E1BAB84"><enum>(3)</enum><text>vehicles, personnel, and other resources that will be used to implement the pilot program; and</text></paragraph><paragraph id="HFDEDEB95335D4FF8AD2899A27B678844"><enum>(4)</enum><text>if the applicant does not intend the pilot program to apply to the full area under the jurisdiction of the applicant, a description of the geographic area in which the applicant intends the pilot program to apply.</text></paragraph></subsection><subsection id="H55D1D18AD5CB457E93C7871664661B80"><enum>(e)</enum><header>Selection</header><text>The Secretary shall seek to achieve diversity of participants in the pilot program by selecting a range of eligible entities that includes at least 5 of each of the following:</text><paragraph id="H59ECBF8058114325B2E502648F899BF0"><enum>(1)</enum><text display-inline="yes-display-inline">An eligible entity that serves an area with a population of 200,000 people or fewer.</text></paragraph><paragraph id="HE5FE56553FC345EAA7D7DE9B10EBD1AD"><enum>(2)</enum><text>An eligible entity that serves an area with a population of over 200,000 people.</text></paragraph><paragraph id="H0EBE239A30014075A8B34C99175E15E8"><enum>(3)</enum><text>An eligible entity that provides transportation for rural communities.</text></paragraph></subsection><subsection id="H51240420D918455BBDFF582EDB0E5898"><enum>(f)</enum><header>Report</header><text>Not later than 3 months after the conclusion of the first 15 pilot projects carried out under this section, the Secretary shall submit to Congress a report on the results of the program, including the feasibility of developing and implementing one-stop programs for all ADA paratransit services.</text></subsection><subsection id="H1498E2439D5C4FA08BFC67FBBCA08071"><enum>(g)</enum><header>Funding</header><paragraph id="H2F93BDE9532D40B0A46E13E50677C170"><enum>(1)</enum><header>Federal share</header><text display-inline="yes-display-inline">The Federal share of the total cost of a project carried out under this section may not exceed 80 percent. </text></paragraph><paragraph id="H3E88038D5E184B1BAF8691E5B7CD4F05"><enum>(2)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated to carry out this section $75,000,000 for each of fiscal years 2022 through 2026.</text></paragraph></subsection></section><section id="H247D3D2B9D3D4B28BC829C5098E5ED7C"><enum>4.</enum><header>Pedestrian facilities in the public right-of-way</header><subsection id="HB85A51FCFD214ED78248C5A2F3D04021"><enum>(a)</enum><header>In general</header><text>Not later than 180 days after the date of enactment of this Act, the Architectural and Transportation Barriers Compliance Board, pursuant to section 502(b)(3) of the Rehabilitation Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/29/792">29 U.S.C. 792(b)(3)</external-xref>), shall publish final accessibility guidelines setting forth minimum standards for pedestrian facilities in the public right-of-way, including shared use paths.</text></subsection><subsection id="HF85B8D64D8F141F28B5D41000F99995F"><enum>(b)</enum><header>Adoption of regulations</header><text>Not later than 180 days after the establishment of the guidelines pursuant to subsection (a), the Secretary shall issue such regulations as are necessary to adopt such guidelines.</text></subsection></section><section id="HFA8C57D72A2A47EDB8FDBC7B029B3959"><enum>5.</enum><header>Reporting accessibility complaints</header><subsection id="H8D4913360BD34730A4EC40A039469DE1"><enum>(a)</enum><header>In general</header><text>The Secretary of Transportation shall ensure that an individual who believes that he or she or a specific class of individuals has been subjected to discrimination on the basis of disability by a public entity may, by himself or herself or by an authorized representative, easily file a complaint with the Department of Transportation. Not later than 1 year after the date of enactment of this Act, the Secretary shall implement procedures that allow an individual to submit a complaint described in the previous sentence by phone, by mail-in form, and online through the website of the Office of Civil Rights of the Federal Transit Administration.</text></subsection><subsection id="HDC1E893BE757457E86D2612EB8938283"><enum>(b)</enum><header>Notice to individuals with disabilities</header><text>Not later than 18 months after the date of enactment of this Act, the Secretary shall require that each public transit provider and contractor providing paratransit services shall include on a publicly available website of the service provider, any related mobile device application, and online service—</text><paragraph id="H8F868910C68E49B3839B4B1F1A3D3462"><enum>(1)</enum><text>the telephone number, or a comparable electronic means of communication, for the disability assistance hotline of the Office of Civil Rights of the Federal Transit Administration;</text></paragraph><paragraph id="HBDD9FD0D571545D6A11059D37DBC9778"><enum>(2)</enum><text>notice that a consumer can file a disability-related complaint with the Office of Civil Rights of the Federal Transit Administration;</text></paragraph><paragraph id="HAC74FE7226994367A74447FFB514ACCA"><enum>(3)</enum><text>an active link to the website of the Office of Civil Rights of the Federal Transit Administration for an individual to file a disability-related complaint; and</text></paragraph><paragraph id="HA680B0421E6949A6BDCE915449F6B022"><enum>(4)</enum><text>notice that an individual can file a disability-related complaint with the local transit agency and the process and any timelines for filing such a complaint.</text></paragraph></subsection><subsection id="HC7AEE129F2F448E4B2E29CD5D6B4467F"><enum>(c)</enum><header>Investigation of complaints</header><text>Not later than 60 days after the last day of each fiscal year the Secretary shall publish a report that lists the disposition of complaints described in subsection (a), including—</text><paragraph id="H91ADB40DA1E34EA594239C113AA9F57F"><enum>(1)</enum><text>the number and type of complaints filed with Department of Transportation;</text></paragraph><paragraph id="HCEB582C6EB9F4317A2042E86FE91B1B4"><enum>(2)</enum><text>the number of complaints investigated by the Department;</text></paragraph><paragraph id="H292520838FDE43C3BC74033CBB9ED8F4"><enum>(3)</enum><text>the result of the complaints that were investigated by the Department including whether the complaint was resolved—</text><subparagraph id="H22230ADF64654361A5707BA47F2A7EAC"><enum>(A)</enum><text>informally;</text></subparagraph><subparagraph id="H5D471B8B2C11465A8ECF232D506E4BE2"><enum>(B)</enum><text>by issuing a violation through a noncompliance Letter of Findings; or</text></subparagraph><subparagraph id="H9EC36D84096643D1B1E593B395C1AB87"><enum>(C)</enum><text>by other means, which shall be described in detail; and</text></subparagraph></paragraph><paragraph id="H576A1A5D0EA24617A430F35995521492"><enum>(4)</enum><text>if a violation was issued for a complaint, whether the Department resolved the noncompliance by—</text><subparagraph id="HA84F233E8C204750A2A926F5C9C8049C"><enum>(A)</enum><text>reaching a voluntary compliance agreement with the entity;</text></subparagraph><subparagraph id="H303E3A42CF374C13B6F470E864D56827"><enum>(B)</enum><text>referring the matter to the Attorney General; or</text></subparagraph><subparagraph id="HDAF78998FB1B44C2995254381C76B1CD"><enum>(C)</enum><text>by other means, which shall be described in detail.</text></subparagraph></paragraph></subsection><subsection id="H8A58E7CD256B4870827DCE3DF545E78F" commented="no"><enum>(d)</enum><header>Report</header><text>Upon implementation of this section, the Secretary shall, to the extent practicable, issue a report composed of the information collected under this section for the preceding 5 years. </text></subsection></section><section id="H4E5CD00E67E345079911AF04000934F1"><enum>6.</enum><header>Accessibility data pilot program</header><subsection id="H32E418A7DC3A4DC1B2AB43BC2490DF75"><enum>(a)</enum><header>In general</header><text>Not later than 1 year after the date of enactment of this Act, the Secretary shall establish an accessibility data pilot program.</text></subsection><subsection id="H1BEBE6EA79494FBA8DAAF66B291952E0"><enum>(b)</enum><header>Purpose</header><text>In carrying out the pilot program, the Secretary shall develop or procure an accessibility data set and make that data set available to each eligible entity selected to participate in the pilot program to improve the transportation planning of such eligible entities by—</text><paragraph id="HCB6DA12CA89D4025BE3DC99077ECAA10"><enum>(1)</enum><text>measuring the level of access by multiple transportation modes, including transportation network companies, to important destinations, which may include—</text><subparagraph id="HB3971ED760314CC79F1A625A402F3021"><enum>(A)</enum><text>jobs, including areas with a concentration of available jobs;</text></subparagraph><subparagraph id="H8F1EBBACDDDB47D58E477E1A15EE84C7"><enum>(B)</enum><text>health care facilities;</text></subparagraph><subparagraph id="HB1742AE4B3054478B497C1DFC671AA31"><enum>(C)</enum><text>child care services;</text></subparagraph><subparagraph id="H57821B0E99B748BE8A0711B05B7400CC"><enum>(D)</enum><text>educational and workforce training facilities;</text></subparagraph><subparagraph id="HC50B90AC28054068AFB93450B0D9D940"><enum>(E)</enum><text>affordable housing;</text></subparagraph><subparagraph id="HEF8E3C3014CC400F9467A672C5E57F6E"><enum>(F)</enum><text>food sources; and</text></subparagraph><subparagraph id="H2990CF4047554DD295A4826777F00D66"><enum>(G)</enum><text>connections between modes, including connections to—</text><clause id="HE6A734E0E81D4D1B8FEBD02005D1B9F6"><enum>(i)</enum><text>high-quality transit or rail service;</text></clause><clause id="H60AFE423358E4A4E82EB5E1EE8D7AA4C"><enum>(ii)</enum><text>safe bicycling corridors; and</text></clause><clause id="H50E124CBB96F4036B9263B24E900FD3F"><enum>(iii)</enum><text>safe sidewalks that achieve compliance with applicable requirements of the ADA;</text></clause></subparagraph></paragraph><paragraph id="H3961C3F602F043289455BB3F5B96300A"><enum>(2)</enum><text>disaggregating the level of access by multiple transportation modes by a variety of population categories, which shall include—</text><subparagraph id="H89336A1B410F4E36B36114D79E9B5223"><enum>(A)</enum><text>low-income populations;</text></subparagraph><subparagraph id="HFE7ED7AC4A99482D8519EB401E38C1D5"><enum>(B)</enum><text>minority populations;</text></subparagraph><subparagraph id="H84BC94CDF02B43A39A75452F4E1FF9AB"><enum>(C)</enum><text>age;</text></subparagraph><subparagraph id="H88DC011DF32F4CA48199DBCC3103212B"><enum>(D)</enum><text display-inline="yes-display-inline">disability such as sensory, cognitive, and physical, including wheelchair users; and</text></subparagraph><subparagraph id="H7034D4ED988840D0834A7E87AF80102D"><enum>(E)</enum><text>geographical location; and</text></subparagraph></paragraph><paragraph id="H07AD1979B1EA45948B592C141EE88F15"><enum>(3)</enum><text>assessing the change in accessibility that would result from new transportation investments.</text></paragraph></subsection><subsection id="H5735F84709D2433E939A640F5D5E001A"><enum>(c)</enum><header>Eligible entities</header><text>An entity eligible to participate in the pilot program is—</text><paragraph id="H9F8FE2720BF5450E99103BEC8915A9AC"><enum>(1)</enum><text>a State;</text></paragraph><paragraph id="H0E339C4108964EEB8880A6EF8319E957"><enum>(2)</enum><text>a metropolitan planning organization; or</text></paragraph><paragraph id="H9CA1AF48778047C6AB0ACA45AD3AAFA7"><enum>(3)</enum><text>a rural transportation planning organization.</text></paragraph></subsection><subsection id="H10FE415D575A49D5A30B7BD96E0B0AC9"><enum>(d)</enum><header>Application</header><text>To be eligible to participate in the pilot program, an entity shall submit to the Secretary an application at such time, in such manner, and containing such information as the Secretary may require, including information relating to—</text><paragraph id="HD69365676BCA4260BBD87B2A3178B592"><enum>(1)</enum><text>previous experience of the eligible entity measuring transportation access or other performance management experience;</text></paragraph><paragraph id="HC5512C32132B49E5826DDA93510B0B38"><enum>(2)</enum><text>the types of important destinations to which the eligible entity intends to measure access;</text></paragraph><paragraph id="H4D79523890744C6C9D7F69CF9CE793CB"><enum>(3)</enum><text>the types of data disaggregation the eligible entity intends to pursue;</text></paragraph><paragraph id="HF60546E5FAC44B5481B7B681BF5CC757"><enum>(4)</enum><text>a general description of the methodology the eligible entity intends to apply; and</text></paragraph><paragraph id="HB9D175E6005B41809BD4269F14B58AD8"><enum>(5)</enum><text>if the applicant does not intend the pilot program to apply to the full area under the jurisdiction of the applicant, a description of the geographic area in which the applicant intends the pilot program to apply.</text></paragraph></subsection><subsection id="HC9A02CD386E14D5D9935FE2A9C849DF2"><enum>(e)</enum><header>Selection</header><paragraph id="H1AC7984647684338A7895A009C37D126"><enum>(1)</enum><header>In general</header><text>The Secretary shall seek to achieve diversity of participants in the pilot program by selecting a range of eligible entities that shall include—</text><subparagraph id="H837A4E9E04EB482AA96F02547F58E47C"><enum>(A)</enum><text>States;</text></subparagraph><subparagraph id="HDF3A4324A1F340D098DBE86776496A75"><enum>(B)</enum><text>metropolitan planning organizations that serve an area with a population of 200,000 people or fewer;</text></subparagraph><subparagraph id="HD4A42F9B3D064C2A9C6512FDE0CA61E1"><enum>(C)</enum><text>metropolitan planning organizations that serve an area with a population of over 200,000 people; and</text></subparagraph><subparagraph id="H0230400CD92F41F6A520BB9CD0482ECA"><enum>(D)</enum><text>rural transportation planning organizations.</text></subparagraph></paragraph><paragraph id="H9F566AD86CBE4F0A82933B4796524E39"><enum>(2)</enum><header>Inclusions</header><text>The Secretary shall seek to ensure that, among the eligible entities selected under paragraph (1) program participants represent—</text><subparagraph id="H6E07024B64FF48489321E8FB7052BEAB"><enum>(A)</enum><text>a range of capacity and previous experience with measuring transportation access; and</text></subparagraph><subparagraph id="H30D10C60A153467FABC20C520492A542"><enum>(B)</enum><text>a variety of proposed methodologies and focus areas for measuring level of access.</text></subparagraph></paragraph></subsection><subsection id="H686C1489262F41A68605355B7D102369"><enum>(f)</enum><header>Duties</header><text>For each eligible entity participating in the pilot program, the Secretary shall—</text><paragraph id="H7403259B96C84971AFD9A5F3487C1FAD"><enum>(1)</enum><text>develop or acquire an accessibility data set described in subsection (b); and</text></paragraph><paragraph id="H51FE7FBA1E6C4962999718E940D03377"><enum>(2)</enum><text>submit the data set to the eligible entity.</text></paragraph></subsection><subsection id="H1AAB8441F1FE45F6870C9CA7C5056CE3"><enum>(g)</enum><header>Methodology</header><text>In calculating the measures for the data set under the pilot program, the Secretary shall ensure that methodology is open source.</text></subsection><subsection id="H3EDBDDB7BAEB4FB08FD9D05136F1B7F9"><enum>(h)</enum><header>Availability</header><text>The Secretary shall make an accessibility data set under the pilot program available to—</text><paragraph id="H9F02136DE20146389567680B8F628D49"><enum>(1)</enum><text>units of local government within the jurisdiction of the eligible entity participating in the pilot program; and</text></paragraph><paragraph id="H982909DBB28F4C3A8D9AD603078E97BE"><enum>(2)</enum><text>researchers.</text></paragraph></subsection><subsection id="H6604B62F1EBB486FA45898C17F29AECE"><enum>(i)</enum><header>Report</header><text>Not later than 120 days after the last date on which the Secretary submits data sets to the eligible entity under subsection (f), the Secretary shall submit to Congress a report on the results of the program, including the feasibility of developing and providing periodic accessibility data sets for all States, regions, and localities.</text></subsection><subsection id="HA865DC9C419A49578B10DCC5DB7108CD"><enum>(j)</enum><header>Funding</header><text>The Secretary shall carry out the pilot program using amounts made available to the Secretary for administrative expenses to carry out programs under the authority of the Secretary.</text></subsection><subsection id="H1DE337ABB8194948972B3A0ACE194737"><enum>(k)</enum><header>Sunset</header><text>The pilot program shall terminate on the date that is 8 years after the date on which the pilot program is implemented.</text></subsection></section><section id="HE619551B2AEF4298B5DF9309C3DF7A0B" commented="no"><enum>7.</enum><header>Enhanced Mobility of Seniors and Individuals with Disabilities</header><text display-inline="no-display-inline">Section 5338(a)(2)(D) of title 49, United States Code, is amended by striking <quote>and $285,574,688 for fiscal year 2020</quote> and inserting <quote>$450,000,000 for fiscal year 2022, $463,500,000 for fiscal year 2023, $477,405,000 for fiscal year 2024, $491,727,150 for fiscal year 2025, and $506,478,965 for fiscal year 2026</quote>. </text></section><section id="H2C12E9D0DC874E1F9A2E4C60B156D39A"><enum>8.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act: </text><paragraph id="H892B8A0DD1AB4136AE276A7F995E3AA3"><enum>(1)</enum><header>ADA</header><text display-inline="yes-display-inline">The term <quote>ADA</quote> means the Americans with Disabilities Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/12101">42 U.S.C. 12101</external-xref> et seq.).</text></paragraph><paragraph id="H65C2FB5FB912477A9C93E1FF3DBF704C"><enum>(2)</enum><header>State</header><text display-inline="yes-display-inline">The term <quote>State</quote> means each of the several States, the District of Columbia, and any commonwealth, territory, or possession of the United States.</text></paragraph><paragraph id="HD607161C8B0A40A09580FDE88A960315" commented="no"><enum>(3)</enum><header>Transportation network company</header><text>The term <quote>transportation network company</quote>—</text><subparagraph id="HB11775A00B4D45EC86D88A69A5569539" commented="no"><enum>(A)</enum><text display-inline="yes-display-inline">means a corporation, partnership, sole proprietorship, or other entity, that uses an online-enabled application or digital network to connect riders to drivers affiliated with the entity in order for the driver to transport the rider using a vehicle owned, leased, or otherwise authorized for use by the driver to a point chosen by the rider; and </text></subparagraph><subparagraph id="H488662B684274EE19C8D0307A9B84983" commented="no"><enum>(B)</enum><text>does not include a shared-expense carpool or vanpool arrangement that is not intended to generate profit for the driver.</text></subparagraph></paragraph></section></legis-body></bill>
