which was referred to the <committee-name committee-id="HAS00">Committee on Armed Services</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title 10, United States Code, to direct the Secretary of Defense to make certain limitations on the transfer of personal property to Federal and State agencies, and for other purposes.</official-title></form><legis-body id="H64D5D562161B4F06B447F7F2DFDE2413" style="OLC"><section id="H420ABFD74D494A27BA68E40BB463DBCB" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Stop Militarizing Law Enforcement Act</short-title></quote>.</text></section><section id="H98C128BE51824AAA8A9041E2C3BDB7E0"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress makes the following findings:</text><paragraph id="H55DA92A7222F4F748F00AA938B0ECDC1"><enum>(1)</enum><text display-inline="yes-display-inline">Under section 2576a of title 10, United States Code, the Department of Defense is authorized to provide excess property to local law enforcement agencies. The Defense Logistics Agency, administers such section by operating the Law Enforcement Support Office program.</text></paragraph><paragraph id="H3C7D35275A8042C0A641AFD4B6C325A7"><enum>(2)</enum><text>New and used material, including mine-resistant ambush-protected vehicles and weapons determined by the Department of Defense to be <quote>military grade</quote> are transferred to Federal, Tribal, State, and local law enforcement agencies through the program.</text></paragraph><paragraph id="H345145E856C642DC89DEEE9C9B3C0644"><enum>(3)</enum><text>As a result local law enforcement agencies, including police and sheriff’s departments, are acquiring this material for use in their normal operations.</text></paragraph><paragraph id="H1EF5B78AAAFC4E0AAB15EE37A7627C7F"><enum>(4)</enum><text display-inline="yes-display-inline">As a result of the wars in Iraq and Afghanistan, military equipment purchased for, and used in, those wars has become excess property and has been made available for transfer to local and Federal law enforcement agencies.</text></paragraph><paragraph id="H2A59A99A8C05456B8B1F242BEFA56438"><enum>(5)</enum><text display-inline="yes-display-inline">In Fiscal Year 2017, $504,000,000 worth of property was transferred to law enforcement agencies.</text></paragraph><paragraph id="H72A2F85D9202406D9798B9C669DA0DFB"><enum>(6)</enum><text display-inline="yes-display-inline">More than $6,800,000,000 worth of weapons and equipment have been transferred to police organizations in all 50 States and four territories through the program.</text></paragraph><paragraph id="H1A5CD33C5DA94A73945583169EBAD101"><enum>(7)</enum><text>In May 2012, the Defense Logistics Agency instituted a moratorium on weapons transfers through the program after reports of missing equipment and inappropriate weapons transfers.</text></paragraph><paragraph id="H29B13FF738BB4084B53C76A40B0523DD"><enum>(8)</enum><text>Though the moratorium was widely publicized, it was lifted in October 2013 without adequate safeguards.</text></paragraph><paragraph id="H0F406BE638F04E76AF30936E72CA67DA"><enum>(9)</enum><text display-inline="yes-display-inline">On January 16, 2015, President Barack Obama issued Executive Order 13688 to better coordinate and regulate the Federal transfer of military weapons and equipment to State, local, and Tribal law enforcement agencies.</text></paragraph><paragraph id="H74A6CCC07D1342CFA97F4B5C2A4E3337"><enum>(10)</enum><text>In July, 2017, the Government Accountability Office reported that the program’s internal controls were inadequate to prevent fraudulent applicants’ access to the program.</text></paragraph><paragraph id="H5E06F1714F7441D98F8A2A2B5B9CED65"><enum>(11)</enum><text>On August 28, 2017, President Donald Trump rescinded Executive Order 13688 despite a July 2017 Government Accountability Office report finding deficiencies with the administration of the 1033 program.</text></paragraph><paragraph id="HF5F65F40A7544A25BC1C988FE7590197"><enum>(12)</enum><text>As a result, Federal, State, and local law enforcement departments across the country are eligible again to acquire free <quote>military-grade</quote> weapons and equipment that could be used inappropriately during policing efforts in which people and taxpayers could be harmed.</text></paragraph><paragraph id="H75C67215964E4669A811CE023D1E7F63"><enum>(13)</enum><text display-inline="yes-display-inline">The Department of Defense categorizes equipment eligible for transfer under the 1033 program as <quote>controlled</quote> and <quote>un-controlled</quote> equipment. <quote>Controlled equipment</quote> includes weapons, explosives such as flash-bang grenades, mine-resistant ambush-protected vehicles, long-range acoustic devices, aircraft capable of being modified to carry armament that are combat coded, and silencers, among other military grade items.</text></paragraph></section><section id="HD7F35781B699491FA699253BB6C5AB29"><enum>3.</enum><header>Limitation on Department of Defense transfer of personal property to local law enforcement agencies</header><subsection id="HFE8AC791D6A240828200CC18DB84E7CC"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 2576a of title 10, United States Code, is amended—</text><paragraph id="H89746BBBA1014C208E01ED73F571C1B0"><enum>(1)</enum><text>in subsection (a)—</text><subparagraph id="H666D32409F144FF8A581AAD61240F3BB"><enum>(A)</enum><text>in paragraph (1)(A), by striking <quote>counterdrug, counterterrorism, `disaster-related emergency preparedness, and border security activities</quote> and inserting <quote>counterterrorism</quote>; and</text></subparagraph><subparagraph id="HFF8933E5999F45BABC706415F38A65FF"><enum>(B)</enum><text>in paragraph (2), by striking <quote>, the Director of National Drug Control Policy,</quote>;</text></subparagraph></paragraph><paragraph id="HE85D5AFBEACF47DE8D7477E078385333"><enum>(2)</enum><text>in subsection (b)—</text><subparagraph id="H3CEDFFCFDDB34021BB847C49CB18A2E6"><enum>(A)</enum><text>in paragraph (5), by striking <quote>and</quote> at the end;</text></subparagraph><subparagraph id="HF05BC647B8294BB18291EBC406E44216"><enum>(B)</enum><text>in paragraph (6), by striking the period and inserting a semicolon; and</text></subparagraph><subparagraph id="HE1DC1A52A6A740B3A2F8CA0C580F792E"><enum>(C)</enum><text>by adding at the end the following new paragraphs:</text><quoted-block display-inline="no-display-inline" id="HA923B42FAD5C4B769BCE7E8023068DBB" style="USC"><paragraph id="HE35CAC1DA27044E1906599461BB340CD"><enum>(7)</enum><text>the recipient submits to the Department of Defense a description of how the recipient expects to use the property;</text></paragraph><paragraph id="H9356FCA77E604E0EB1A501A76EF80956"><enum>(8)</enum><text>the recipient certifies to the Department of Defense that if the recipient determines that the property is surplus to the needs of the recipient, the recipient will return the property to the Department of Defense;</text></paragraph><paragraph id="H4E43A5F4EF8141E0A1A26C90E74FFD5C"><enum>(9)</enum><text>with respect to a recipient that is not a Federal agency, the recipient certifies to the Department of Defense that the recipient notified the local community of the request for personal property under this section by—</text><subparagraph id="H96EAB7D7565D40019DAA7AC8607A2089"><enum>(A)</enum><text>publishing a notice of such request on a publicly accessible Internet website;</text></subparagraph><subparagraph id="HF812D9C3B4614B26A69AF4D9197A5BB4"><enum>(B)</enum><text>posting such notice at several prominent locations in the jurisdiction of the recipient; and</text></subparagraph><subparagraph id="H78AE820527A44615955040D5522DAA90"><enum>(C)</enum><text>ensuring that such notices were available to the local community for a period of not less than 30 days; and</text></subparagraph></paragraph><paragraph id="H1E94F8B9CB8C43F28C52908814C383DC"><enum>(10)</enum><text display-inline="yes-display-inline">the recipient has received the approval of the city council or other local governing body to acquire the personal property sought under this section.</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="HAFE1E6323D0B40008900BBE1D7EA856F"><enum>(3)</enum><text>by striking subsections (d) and (e);</text></paragraph><paragraph id="H275793E4FC46438CAE1D5A4BB4087620"><enum>(4)</enum><text>by redesignating subsections (f) and (g) as subsections (o) and (p), respectively; and</text></paragraph><paragraph id="H21FF05DFD0FE429D9E1A71028E16112B"><enum>(5)</enum><text>by inserting after subsection (c) the following new subsections:</text><quoted-block display-inline="no-display-inline" id="H53FEE5AEDC7F4CCF80686BDA032B9F1A" style="USC"><subsection id="HE70E9CEB3CAE45E9B7F30DC2C09C34FF"><enum>(d)</enum><header>Annual certification accounting for transferred property</header><paragraph commented="no" display-inline="yes-display-inline" id="H818795A6EA564B3092FA37FE77162874"><enum>(1)</enum><text>For each fiscal year, the Secretary shall submit to Congress certification in writing that each Federal or State agency to which the Secretary has transferred property under this section—</text><subparagraph id="HFF5182C086AA4B22889EED6A8549E933" indent="up1"><enum>(A)</enum><text display-inline="yes-display-inline">has provided to the Secretary documentation accounting for all controlled property, including arms and ammunition, that the Secretary has transferred to the agency, including any item described in subsection (f) so transferred before the date of the enactment of the Stop Militarizing Law Enforcement Act; and</text></subparagraph><subparagraph id="HD60F64C5178C43CCB3EFB7C70E09977A" indent="up1"><enum>(B)</enum><text>with respect to a non-Federal agency, carried out each of paragraphs (5) through (8) of subsection (b).</text></subparagraph></paragraph><paragraph id="H565F0F0CEA014E9396256DE0FE505EB4" indent="up1"><enum>(2)</enum><text>If the Secretary cannot provide a certification under paragraph (1) for a Federal or State agency, the Secretary may not transfer additional property to that agency under this section.</text></paragraph></subsection><subsection id="HF20AAD22EDA54C73ACAC25934222465F"><enum>(e)</enum><header>Annual report on excess property</header><text>Before making any property available for transfer under this section, the Secretary shall annually submit to Congress a description of the property to be transferred together with a certification that the transfer of the property would not violate this section or any other provision of law.</text></subsection><subsection id="H868336302FF74630881C2748782B2726"><enum>(f)</enum><header>Limitations on transfers</header><paragraph commented="no" display-inline="yes-display-inline" id="H1FBC18E2A3604F27B910635F6347E72A"><enum>(1)</enum><text display-inline="yes-display-inline">The Secretary may not transfer to Federal, Tribal, State, or local law enforcement agencies the following under this section:</text><subparagraph id="H3BE0169DA6BA402A8529060F7F21C365" indent="up1"><enum>(A)</enum><text display-inline="yes-display-inline">Controlled firearms, ammunition, bayonets, grenade launchers, grenades (including stun and flash-bang), and explosives.</text></subparagraph><subparagraph id="HC5CDD95B24344950909E46EACD0D398E" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">Controlled vehicles, highly mobile multi-wheeled vehicles, mine-resistant ambush-protected vehicles, trucks, truck dump, truck utility, and truck carryall.</text></subparagraph><subparagraph id="H81E065C21786431E809BE5AD50F2CFF9" indent="up1"><enum>(C)</enum><text>Drones that are armored, weaponized, or both.</text></subparagraph><subparagraph id="H91431E4B0100453491F5778FD946A136" indent="up1"><enum>(D)</enum><text>Controlled aircraft that—</text><clause id="HC2A70BCDE60D4BCBBE190E91D0484CFC"><enum>(i)</enum><text>are combat configured or combat coded; or</text></clause><clause id="H4DBF888D3A9D41D791B81658C56E959E"><enum>(ii)</enum><text>have no established commercial flight application.</text></clause></subparagraph><subparagraph id="HA9C090F747A842429D8DD191C04A9ED0" indent="up1"><enum>(E)</enum><text>Silencers.</text></subparagraph><subparagraph id="HAECB87C2D6894A1CA2CAD349CD46FA24" indent="up1"><enum>(F)</enum><text>Long-range acoustic devices.</text></subparagraph><subparagraph id="H5ADCB0D4A97243838B4C24719B452951" indent="up1"><enum>(G)</enum><text>Items in the Federal Supply Class of banned items.</text></subparagraph></paragraph><paragraph id="HF4B7049F812842DF8996CBFA18420FC4" indent="up1"><enum>(2)</enum><text>The Secretary may not require, as a condition of a transfer under this section, that a Federal or State agency demonstrate the use of any small arms or ammunition.</text></paragraph><paragraph id="HD49959620592404FA833873B92E7E475" indent="up1"><enum>(3)</enum><text>The limitations under this subsection shall also apply with respect to the transfer of previously transferred property of the Department of Defense from one Federal or State agency to another such agency.</text></paragraph><paragraph id="HD4716D7EBF564B5F94D5DB42C4642447" indent="up1"><enum>(4)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="H020F8D5552C64E059C817D3ABCA321FC"><enum>(A)</enum><text>The Secretary may waive the applicability of paragraph (1) to a vehicle described in subparagraph (B) of such paragraph (other than a mine-resistant ambush-protected vehicle), if the Secretary determines that such a waiver is necessary for disaster or rescue purposes or for another purpose where life and public safety are at risk, as demonstrated by the proposed recipient of the vehicle.</text></subparagraph><subparagraph id="H66811551D2B64961883F65AE9E709A7A" indent="up1"><enum>(B)</enum><text>If the Secretary issues a waiver under subparagraph (A), the Secretary shall—</text><clause id="HCA29C707538947CFA01D84C8D0AD94E3"><enum>(i)</enum><text>submit to Congress notice of the waiver, and post such notice on a public Internet website of the Department, by not later than 30 days after the date on which the waiver is issued; and</text></clause><clause id="HDE4E20C7EE2841318BF0C1D24C1D4230"><enum>(ii)</enum><text>require, as a condition of the waiver, that the recipient of the vehicle for which the waiver is issued provides public notice of the waiver and the transfer, including the type of vehicle and the purpose for which it is transferred, in the jurisdiction where the recipient is located by not later than 30 days after the date on which the waiver is issued.</text></clause></subparagraph></paragraph><paragraph id="HFB5FA4DDB050428DAB2C5274CD1B6A72" indent="up1"><enum>(5)</enum><text>The Secretary may provide for an exemption to the limitation under subparagraph (D) of paragraph (1) in the case of parts for aircraft described in such subparagraph that are transferred as part of regular maintenance of aircraft in an existing fleet.</text></paragraph><paragraph id="HD8749CFDA5A24B509D014BB5E0AC325E" indent="up1"><enum>(6)</enum><text>The Secretary shall require, as a condition of any transfer of property under this section, that the Federal or State agency that receives the property shall return the property to the Secretary if the agency—</text><subparagraph id="H98942DD990D6489DA4BC68263C01B3C1"><enum>(A)</enum><text>is investigated by the Department of Justice for any violation of civil liberties; or</text></subparagraph><subparagraph id="H29EEEB8B942148A5A1CA3C42053F37E8"><enum>(B)</enum><text>is otherwise found to have engaged in widespread abuses of civil liberties.</text></subparagraph></paragraph></subsection><subsection display-inline="no-display-inline" id="H83D63AB2FC3C4A7CB3CC91A65C6C61C7"><enum>(g)</enum><header>Conditions for extension of program</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, amounts authorized to be appropriated or otherwise made available for any fiscal year may not be obligated or expended to carry out this section unless the Secretary submits to Congress certification that for the preceding fiscal year that—</text><paragraph display-inline="no-display-inline" id="HFA6C7909313A42B987A79CB3CB31E2F0"><enum>(1)</enum><text display-inline="yes-display-inline">each Federal or State agency that has received controlled property transferred under this section has—</text><subparagraph id="H5EA7160F6B244C10BD512B7A093E8F8C"><enum>(A)</enum><text>demonstrated 100 percent accountability for all such property, in accordance with paragraph (2) or (3), as applicable; or</text></subparagraph><subparagraph id="HDA37E4FE75594CF8A7D5F5EB13226509"><enum>(B)</enum><text>been suspended from the program pursuant to paragraph (4);</text></subparagraph></paragraph><paragraph display-inline="no-display-inline" id="H4EB1CEBB497541D994C843A8B291D864"><enum>(2)</enum><text display-inline="yes-display-inline">with respect to each non-Federal agency that has received controlled property under this section, the State coordinator responsible for each such agency has verified that the coordinator or an agent of the coordinator has conducted an in-person inventory of the property transferred to the agency and that 100 percent of such property was accounted for during the inventory or that the agency has been suspended from the program pursuant to paragraph (4);</text></paragraph><paragraph display-inline="no-display-inline" id="H60A87ED9F268449197F246B297284CBE"><enum>(3)</enum><text display-inline="yes-display-inline">with respect to each Federal agency that has received controlled property under this section, the Secretary of Defense or an agent of the Secretary has conducted an in-person inventory of the property transferred to the agency and that 100 percent of such property was accounted for during the inventory or that the agency has been suspended from the program pursuant to paragraph (4);</text></paragraph><paragraph display-inline="no-display-inline" id="H9B4868772E4043B288E8011821D0375F"><enum>(4)</enum><text>the eligibility of any agency that has received controlled property under this section for which 100 percent of the property was not accounted for during an inventory described in paragraph (1) or (2), as applicable, to receive any property transferred under this section has been suspended;</text></paragraph><paragraph display-inline="no-display-inline" id="H95D7EFC9ACC041CCBDB67E13329DAE60"><enum>(5)</enum><text>each State coordinator has certified, for each non-Federal agency located in the State for which the State coordinator is responsible that—</text><subparagraph id="H6C2DFDC78E0D42B9B6DEA6255F521A35"><enum>(A)</enum><text>the agency has complied with all requirements under this section; or</text></subparagraph><subparagraph id="H0D4173B8C2EE417A85C8F8BF7FF4ADDE"><enum>(B)</enum><text>the eligibility of the agency to receive property transferred under this section has been suspended; and</text></subparagraph></paragraph><paragraph display-inline="no-display-inline" id="H44127F59B7804DF59A03B3D1EFD79034"><enum>(6)</enum><text>the Secretary of Defense has certified, for each Federal agency that has received property under this section that—</text><subparagraph id="H044145C8F41A4EC98B039C3DF122B0AF"><enum>(A)</enum><text>the agency has complied with all requirements under this section; or</text></subparagraph><subparagraph id="H871ECE8ACEF44AA3A0D1D42838EDB611"><enum>(B)</enum><text display-inline="yes-display-inline">the eligibility of the agency to receive property transferred under this section has been suspended.</text></subparagraph></paragraph></subsection><subsection id="HF81EB879B6C84A4CB35C8E58A43BBDBC"><enum>(h)</enum><header>Prohibition on ownership of controlled property</header><text>A Federal or State agency that receives controlled property under this section may never take ownership of the property.</text></subsection><subsection id="H63596A6262C84943A40708C3C1127C63"><enum>(i)</enum><header>Notice to Congress of property downgrades</header><text>Not later than 30 days before downgrading the classification of any item of personal property from controlled or Federal Supply Class, the Secretary shall submit to Congress notice of the proposed downgrade.</text></subsection><subsection id="HB9B4AE141F9E41E7A8359EA9B422133E"><enum>(j)</enum><header>Notice to Congress of property cannibalization</header><text>Before the Defense Logistics Agency authorizes the recipient of property transferred under this section to cannibalize the property, the Secretary shall submit to Congress notice of such authorization, including the name of the recipient requesting the authorization, the purpose of the proposed cannibalization, and the type of property proposed to be cannibalized.</text></subsection><subsection id="HFCC4963BCAEF4F27B4E731928E6CDA6F"><enum>(k)</enum><header>Quarterly reports on use of controlled equipment</header><text>Not later than 30 days after the last day of a fiscal quarter, the Secretary shall submit to Congress a report on any uses of controlled property transferred under this section during that fiscal quarter.</text></subsection><subsection id="H2E7F98B852774688A49AC79E64EDC752"><enum>(l)</enum><header>Reports to Congress</header><text>Not later than 30 days after the last day of a fiscal year, the Secretary shall submit to Congress a report on the following for the preceding fiscal year:</text><paragraph id="HAF9153CE83054338AF8E027326EDB08D"><enum>(1)</enum><text>The percentage of equipment lost by recipients of property transferred under this section, including specific information about the type of property lost, the monetary value of such property, and the recipient that lost the property.</text></paragraph><paragraph id="H44662A4648924B01AB570D8B0F98CA5C"><enum>(2)</enum><text>The transfer of any new (condition code A) property transferred under this section, including specific information about the type of property, the recipient of the property, the monetary value of each item of the property, and the total monetary value of all such property transferred during the fiscal year.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="HD822E6448FEA478E8A1777E54D3FEC59"><enum>(b)</enum><header>Effective date</header><text>The amendments made by subsection (a) shall apply with respect to any transfer of property made after the date of the enactment of this Act.</text></subsection></section></legis-body></bill>
