R. 167</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20210104">January 4, 2021</action-date><action-desc><sponsor name-id="G000553">Mr. Green of Texas</sponsor> introduced the following bill; which was referred to the <committee-name committee-id="HJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To prohibit the transfer of a firearm at a gun show by a person who is not a federally licensed firearms dealer.</official-title></form><legis-body id="H6C4E79F7B66D444B816346D4F4DF418E" style="OLC"><section id="H6A886707BCF54426B96EDD93C598FA03" section-type="section-one"><enum>1.</enum><header>Prohibition on transfer of a firearm at a gun show by a person who is not a federally licensed firearms dealer</header><subsection id="H8163471C867348D6BA1D2397D4A2B9E7"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 922 of title 18, United States Code, is amended by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="H8EE32E7B2CBB43E4859E0138379AA6F0" style="OLC"><subsection display-inline="no-display-inline" id="HF1D2F33438994ECE878200B1A9DAAAF0"><enum>(aa)</enum><paragraph commented="no" display-inline="yes-display-inline" id="HD62F5D0DC3234C329FC07C799B682E54"><enum>(1)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="HBD2C28BA2DDB4B6394FEDCA7635D88BD"><enum>(A)</enum><text>It shall be unlawful for a person to transfer a firearm at a gun show, unless the person is a licensed dealer.</text></subparagraph><subparagraph id="HE3522827B445428DBBD414DFCD8931A4" indent="up2"><enum>(B)</enum><text>Subparagraph (A) shall not apply to a transfer to a person licensed under this chapter.</text></subparagraph></paragraph><paragraph id="HCDDD74A0D34F4C3893CBE17D3680E2FF" indent="up1"><enum>(2)</enum><text>In paragraph (1), the term <term>gun show</term>—</text><subparagraph id="H42642535C4164918AAAE0D030D0D9B84"><enum>(A)</enum><text display-inline="yes-display-inline">means an event or function—</text><clause id="HCE010A6B894B4D1A8AA6695CDBCC4474"><enum>(i)</enum><text>held for the purpose of facilitating the commercial sale, transfer, or exchange of firearms; and</text></clause><clause id="H99850E8CE5FF45009758DA612D1FAA7C"><enum>(ii)</enum><text>at which a firearm is displayed, exhibited, offered for sale, transfer, or exchange, or is sold, transferred, or exchanged; and</text></clause></subparagraph><subparagraph id="H33FDD793645448ADBB5B708F12E92533"><enum>(B)</enum><text display-inline="yes-display-inline">includes the entire premises, including parking areas, used to facilitate the sale, transfer, or exchange of firearms at the event or function.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H3854C81EA1124D28820AF147AF519E98"><enum>(b)</enum><header>Penalties</header><text>Section 924(a) of such title is amended by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="HDA155EFCB7E441EB8158E0D32152B290" style="OLC"><paragraph id="HF4DACA275FF947EFA50ACDBFC6DBE0F1" indent="up1"><enum>(8)</enum><text display-inline="yes-display-inline">Whoever knowingly violates section 922(aa) shall be fined an amount equal to $10,000 multiplied by the number of firearms involved in the violation, imprisoned not less than 1 year and not more than 2 years, or both.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section></legis-body></bill>
