which was referred to the <committee-name committee-id="HII00">Committee on Natural Resources</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To direct the Secretary of the Interior to establish a Parks, Jobs, and Equity Program to support job creation, economic revitalization, and park development for communities impacted by COVID–19.</official-title></form><legis-body id="H02A8114DA45E47C98BD78BE5D63A7FAA" style="OLC"><section id="H1B1A664FDFA64252A0ECE31A70C6B452" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Parks, Jobs, and Equity Act</short-title></quote>.</text></section><section id="H2CDAD293968048009C2D10073494BAF0"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="H61A6F2E739114E939E17EB529AB56C7E"><enum>(1)</enum><header>Eligible entity</header><text>The term <term>eligible entity</term> means—</text><subparagraph id="H19D50BC5DCCC4142982C705F0D63B7C6"><enum>(A)</enum><text>a city or town of a State or territory of the United States, or an Indian Tribe, that—</text><clause id="H58912337432C41B2A3BE89E0DD3C4037"><enum>(i)</enum><text display-inline="yes-display-inline">represents or otherwise serves a qualifying urban area; or</text></clause><clause id="H5581CDC0D95C435C9CD71B04AEBD94FE"><enum>(ii)</enum><text>has a population of 30,000 or more in the most recent census; </text></clause></subparagraph><subparagraph id="H7A6388B06EFD42B38933910C344A64EB"><enum>(B)</enum><text>a special purpose district serving—</text><clause id="HCD4A7FAB2E2144DAA13A35E0790EB1CE"><enum>(i)</enum><text>a qualifying urban area; or</text></clause><clause id="H6664F19ACB904D8C995947BF70F8E630"><enum>(ii)</enum><text>a city or town with a population of 30,000 or more in the most recent census and managing open space for public recreation; and</text></clause></subparagraph><subparagraph id="H142AEFA444A6415188BF8C8410B4F8F3"><enum>(C)</enum><text>the District of Columbia.</text></subparagraph></paragraph><paragraph id="H76C93F04F5544B198DEC5B7B3F23A8D9"><enum>(2)</enum><header>Indian Tribe</header><text display-inline="yes-display-inline">The term <term>Indian Tribe</term> has the meaning given that term in section 4 of the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/5304">25 U.S.C. 5304</external-xref>).</text></paragraph><paragraph id="HEDFCD6E998354C85B49F0348970FBDB7"><enum>(3)</enum><header>Low-income community</header><text>The term <term>low-income community</term> means any census block group in which 51 percent or more households have an annual income equal at or below 80 percent of the median income of the area in which the household is located, as reported by the Department of Housing and Urban Development.</text></paragraph><paragraph id="HAD69CC255AF441E6A7FDDA62E4A4ED86"><enum>(4)</enum><header>Parks, jobs and equity program</header><text>The term <term>Parks, Jobs, and Equity Program</term> means the program established under section 3(a).</text></paragraph><paragraph id="H06DDBD58ED3C45A2B0E66A985518E28B"><enum>(5)</enum><header>Poverty level</header><text>The term <term>poverty level</term> means the income poverty guidelines for the nonfarm population of the United States, as prescribed by the Office of Management and Budget.</text></paragraph><paragraph id="H4378F674F35A47A5A2E94F290D9CAAC0"><enum>(6)</enum><header>Qualifying urban area</header><text>The term <term>qualifying urban area</term> means an area identified by the Census Bureau as an area with a population of 30,000 or more in the most recent census.</text></paragraph><paragraph id="H840B4D2EED6640D6BA08065EAD385BEB"><enum>(7)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of the Interior.</text></paragraph></section><section id="H1FF140EF2DD249B3AA046A68FB304426"><enum>3.</enum><header>Grants authorized</header><subsection id="HCBF9DBF51E80423C89D6FC911EBB411A"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall establish the Parks, Jobs, and Equity Program to support park development and delivery of recreation services, and in so doing, help create or preserve jobs, and provide economic stimulus in communities impacted by COVID–19.</text></subsection><subsection id="H6E36F644001645CE8BCCD73828A4F426"><enum>(b)</enum><header>Funding</header><text display-inline="yes-display-inline">The Secretary, acting through the Parks, Jobs, and Equity Program, shall provide funding to States, territories, the District of Columbia, and Indian Tribes according to the following formula:</text><paragraph id="H8831E0FB470C4AEFBC7222D8C31A727D"><enum>(1)</enum><text display-inline="yes-display-inline">49 percent divided equally among the States. For the purposes of this paragraph, the District of Columbia and the territories of the United States shall collectively be treated as a single State and shall receive shares of apportionment in proportion to qualifying urban areas.</text></paragraph><paragraph id="H734A67DC05F44D8291A3BA6110F19BE0"><enum>(2)</enum><text display-inline="yes-display-inline">49 percent divided proportionally among States based on each State’s share of urban population, as defined by the Census Bureau, to the total urban population of the United States, based on the most recent census.</text></paragraph><paragraph id="H1CBA6D35E2AE49B4BE18C7A98F5A1819" commented="no"><enum>(3)</enum><text display-inline="yes-display-inline">2 percent for competitive grants to be awarded by the Secretary to Indian Tribes that qualify as an eligible entity.</text></paragraph></subsection></section><section id="HFD4C761E5CFA439E84DE7DFE4D0EC58E"><enum>4.</enum><header>Allocation</header><subsection id="HDCD5192F74324A6093777880C5BD999A" commented="no"><enum>(a)</enum><header>Amounts to States, Territories, and the District of Columbia</header><text display-inline="yes-display-inline">The Governor of a State or territory (or a designated liaison officer) or the Mayor of the District of Columbia shall distribute funds provided to the State, territory, or District of Columbia under this Act as follows:</text><paragraph id="HCB7A02290FBF48EB925B0ABB335B449F" commented="no"><enum>(1)</enum><text>Not less than 50 percent of funds shall be provided to eligible entities for eligible uses that benefit a low-income community.</text></paragraph><paragraph id="H7948808C19F04B56AF3D0C55BD39634F" commented="no"><enum>(2)</enum><text>Funds to eligible entities shall be not less than $50,000 and not more than $1,000,000.</text></paragraph><paragraph id="H1AACA825BDF34C04926E8D090343DF9B" commented="no"><enum>(3)</enum><text display-inline="yes-display-inline">Not more than 2.5 percent of funds may be used for administrative expenses of the State, territory, or the District of Columbia. </text></paragraph><paragraph id="HBD8C33A8D95E40D1B22F82FD677CB75F" commented="no"><enum>(4)</enum><text display-inline="yes-display-inline">Not more than 10 percent of funds provided to an eligible entity may be used for administrative expenses.</text></paragraph></subsection><subsection id="HF1B9914CEF93438E9EED9DF2807B33CF"><enum>(b)</enum><header>Amounts to Indian Tribes</header><paragraph id="H95D4C838E16741BA9D146A36AF53499F"><enum>(1)</enum><header>Amount</header><text display-inline="yes-display-inline">Grant amounts under this Act to an eligible Indian Tribe shall be not less than $50,000 and not more than $1,000,000.</text></paragraph><paragraph id="HB3E5435A461A487F9719989E9907D537" commented="no"><enum>(2)</enum><header>Administrative expenses</header><text display-inline="yes-display-inline">An Indian Tribe may not retain more than 10 percent of each grant received under this Act for administrative expenses.</text></paragraph></subsection><subsection id="H8B9ADB118CD34A62BBDB3B1578DB80E3"><enum>(c)</enum><header>Timing</header><paragraph id="HCC733F9C654F4BD5BD0C84AA708CFC21"><enum>(1)</enum><header>Distribution of funds</header><text>The Secretary shall distribute funds made available to carry out this Act not more than 45 days after such funds are made available to the Secretary.</text></paragraph><paragraph id="H465D09C2D596402B935A73110C927178"><enum>(2)</enum><header>Application procedures</header><text>The Governors or Executive Officers of States and territories and the governing body of each Indian Tribe shall—</text><subparagraph id="HFFC9E37F892B4DCEA80F13A2D810006A"><enum>(A)</enum><text>devise accelerated application procedures by which eligible entities may apply for funds under this Act;</text></subparagraph><subparagraph id="H0EB4C9D6FC044146B7A579DDA3E61877"><enum>(B)</enum><text>inform eligible entities and low-income communities about the opportunity to apply for funds under this Act, the application procedures by which eligible entities may apply for funds, and the eligible uses for funding;</text></subparagraph><subparagraph id="H5B0CB9BF79D549A5820283FA266FF5A1"><enum>(C)</enum><text>distribute funds to eligible entities not later than 180 days after distribution from the Secretary; and</text></subparagraph><subparagraph id="H581BCEAF1F454C54BEEB150434F3BF71" commented="no"><enum>(D)</enum><text>direct each eligible entity that receives funds under this Act to spend such funds not later than 2 years after the funds are made available to that eligible entity.</text></subparagraph></paragraph><paragraph id="H1B59F51B32A64BFBA0DD927029B82E2A"><enum>(3)</enum><header>Extension</header><text>Governors and Executive Officers of a State or territory and the governing body of an Indian Tribe may grant extensions of the deadlines in this subsection for not more than 180 additional days for good cause shown.</text></paragraph></subsection></section><section id="HDF414282765F4917B7ADCD4CC72ED701"><enum>5.</enum><header>Eligible uses</header><subsection id="HD395F9C0E45A4780AEAC29CFF29B0283"><enum>(a)</enum><header>In general</header><text>A grant recipient may use a grant awarded under this Act—</text><paragraph id="H521323AFC8234AA99B764848937A810A"><enum>(1)</enum><text display-inline="yes-display-inline">to acquire land or water that will be used to provide outdoor recreation opportunities to the public;</text></paragraph><paragraph id="HCA71F612A1F54E8EAF7A32D28235E2BB"><enum>(2)</enum><text>to develop or renovate outdoor recreational facilities that provide outdoor recreation opportunities to the public;</text></paragraph><paragraph id="H03236B31C5664254B359B02087BC9061"><enum>(3)</enum><text display-inline="yes-display-inline">to improve delivery of recreation services to the public (including supporting park personnel, training, recreation programming, and purchase of recreation equipment and supplies); and</text></paragraph><paragraph id="H4C3CF62202FC4B6BBCAF2874735A4D77"><enum>(4)</enum><text display-inline="yes-display-inline">to develop native event sites and cultural gathering spaces.</text></paragraph></subsection><subsection id="HD192CD83AA234BCBB24F8F76A9C786FD"><enum>(b)</enum><header>Priorities</header><text>Priority shall be given to projects that—</text><paragraph id="HD220C42AD7BA4503A1BCB7701E5F906A"><enum>(1)</enum><text display-inline="yes-display-inline">create or significantly enhance park and recreational opportunities for a community in a qualifying urban area that lacks parks and/or outdoor recreation areas within one-half mile or a 10-minute walk;</text></paragraph><paragraph id="H8AE9A256894A450FB75D12E2CF6D02D7"><enum>(2)</enum><text>improve outdoor recreation opportunities for high-need populations based on income, age, or other measures of vulnerability and need;</text></paragraph><paragraph id="H2CE1101F550949F79763BD5C92244546"><enum>(3)</enum><text display-inline="yes-display-inline">provide opportunities for employment or job training either in park construction or rehabilitation or delivery of recreation services;</text></paragraph><paragraph id="H3275BD9C20DB4C039B383B057C4AE9D9"><enum>(4)</enum><text>engage and empower underserved communities and youth; and</text></paragraph><paragraph id="H39E867B5CC2446EC9FB4D803DC57C495"><enum>(5)</enum><text>take advantage of coordination among various levels of government.</text></paragraph></subsection><subsection id="HBD1C0B7AA6C74A629AB9B7E81CBB221F"><enum>(c)</enum><header>Limitations on use</header><text>A grant recipient may not use grant funds for—</text><paragraph id="H593423B6FE204778A55BCEC9AC88D1F2"><enum>(1)</enum><text>maintenance activities;</text></paragraph><paragraph id="HE01449E04B8C4AB5934CD8308240F2A9"><enum>(2)</enum><text>facilities that support semiprofessional or professional athletics;</text></paragraph><paragraph id="HB70B2AD16BCD4DD39E2C48F19D073480"><enum>(3)</enum><text>indoor facilities such as recreation centers or facilities that support primarily nonoutdoor purposes;</text></paragraph><paragraph id="HAFA20C31A4434103B49027AD888C70AF"><enum>(4)</enum><text display-inline="yes-display-inline">activities that are not in accordance with Comprehensive State Plans under section 200305 of title 54, United States Code; or</text></paragraph><paragraph id="H676DE816DB2A4F7793BA5330D97581D5"><enum>(5)</enum><text>acquisition of land or interests in land that restrict access to specific persons.</text></paragraph></subsection></section><section id="H888D8B11DADA4399862D49A1356BB7EF"><enum>6.</enum><header>Reporting</header><subsection id="HCEE34154B7ED4D119C05C42FE65592BE"><enum>(a)</enum><header>Requirement</header><text display-inline="yes-display-inline">Each year that a State or Territory that receives a grant under this Act shall submit to the Secretary performance and financial reports that—</text><paragraph id="HB5DD732B82774DD4BBEE07A6B2BCEF33"><enum>(1)</enum><text display-inline="yes-display-inline">summarize the status of and activities conducted under each subgrant during the report period; and</text></paragraph><paragraph id="H2D96A187E382461C9AB3187A8344226F"><enum>(2)</enum><text display-inline="yes-display-inline">provide a description of each subgrant project’s accomplishments and impact during the report period, such as new park access opportunities, new recreation opportunities (facilities and services), jobs created, and other community benefits.</text></paragraph></subsection><subsection id="HA19158F4E4C84A70815036EB66BA10DA"><enum>(b)</enum><header>Availability to Congress</header><text>The Secretary shall make such reports submitted under subsection (a) available to the House Committee on Natural Resources and Senate Committee on Energy and Natural Resources.</text></subsection></section><section id="H1D1E537BDCA04A26B7DF809B94DDB62D"><enum>7.</enum><header>Authorization of appropriations</header><text display-inline="no-display-inline">There are authorized to be appropriated to the Secretary for the purposes of this Act, $500,000,000, to remain available until expended.</text></section></legis-body></bill>
