which was referred to the <committee-name committee-id="HWM00">Committee on Ways and Means</committee-name>, and in addition to the Committee on <committee-name committee-id="HIF00">Energy and Commerce</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title XVIII to provide for certain Medigap coverage for Medicare beneficiaries with end-stage renal disease, and for other purposes.</official-title></form><legis-body id="H7DA7BF8D9A2548A782031B0B8E07D0CB" style="OLC"><section id="H3C6567BF99894D2BA3BC9B0CA84DF258" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Jack Reynolds Memory Medigap Expansion Act</short-title></quote>. </text></section><section id="HFD0E74F859014D4881F80D16EE5F2DC9"><enum>2.</enum><header>Medigap coverage for beneficiaries with end-stage renal disease</header><subsection id="H66BBAF6AC320483487F70434592915C3"><enum>(a)</enum><header>Guaranteed availability of Medigap policies to all ESRD medicare beneficiaries</header><paragraph id="H98B14F546F384A659ADAFCDCB41B9981"><enum>(1)</enum><header>In general</header><text>Section 1882(s) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395ss">42 U.S.C. 1395ss(s)</external-xref>) is amended—</text><subparagraph id="H973287868E1D4F24AD414FB9F0670FA6"><enum>(A)</enum><text>in paragraph (2)—</text><clause id="H3996DCAA757549F389DB3F67B63C8E70"><enum>(i)</enum><text>in subparagraph (A), by striking <quote>is 65</quote> and all that follows through the period at the end and inserting the following:</text><quoted-block display-inline="yes-display-inline" id="HFCDB28464D3448BFAFD0A34E5B89AAD2" style="OLC"><text>is—</text><clause id="HE56EF3F1011D4971B9CC4B6A3BCCAACA"><enum>(i)</enum><text>65 years of age or older and is enrolled for benefits under part B; or</text></clause><clause id="H77DF3562E0B7413EB9E3F4B07089A2F1"><enum>(ii)</enum><text>is entitled to benefits under 226A(b) and is enrolled for benefits under part B.</text></clause><after-quoted-block>; and</after-quoted-block></quoted-block></clause><clause id="H45A2A58B43E245CDBFA9331F5F128E5D"><enum>(ii)</enum><text>in subparagraph (D), in the matter preceding clause (i), by inserting <quote>(or is entitled to benefits under 226A(b))</quote> after <quote>is 65 years of age or older</quote>; and</text></clause></subparagraph><subparagraph id="H9FEA03EAA6B142D9959907F35953377E"><enum>(B)</enum><text>in paragraph (3)(B)—</text><clause id="H8F043AD6C0E14D92824FE8A9DE078FED"><enum>(i)</enum><text>in clause (ii), by inserting <quote>(or is entitled to benefits under 226A(b))</quote> after <quote>is 65 years of age or older</quote>; and</text></clause><clause id="H90B6D454BD7949899DCB64FE5A89AE82"><enum>(ii)</enum><text>in clause (vi), by inserting <quote>(or under 226A(b))</quote> after <quote>at age 65</quote>.</text></clause></subparagraph></paragraph><paragraph id="H4D405D007D1847A7B6235C60F9626F58"><enum>(2)</enum><header>Effective date</header><text>The amendments made by paragraph (1) shall apply to Medicare supplemental policies effective on or after January 1, 2022.</text></paragraph></subsection><subsection id="HEC4052B0EA214E5CB550FD24113B00E1"><enum>(b)</enum><header>Additional enrollment period for certain individuals</header><paragraph id="H5508200AB66C420F8F5FB901BA06BBEE"><enum>(1)</enum><header>One-time enrollment period</header><subparagraph id="H95ADE9033B54435CBAA38F9A2A58732C"><enum>(A)</enum><header>In general</header><text>In the case of an individual described in paragraph (2), the Secretary of Health and Human Services shall establish a one-time enrollment period during which such an individual may enroll in any Medicare supplemental policy under section 1882 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395ss">42 U.S.C. 1395ss</external-xref>) of the individual’s choosing.</text></subparagraph><subparagraph id="HD8ECFEE6EC584C7DBF759EA4B609A298"><enum>(B)</enum><header>Enrollment period</header><text>The enrollment period established under subparagraph (A) shall begin on January 1, 2022, and shall end June 30, 2022.</text></subparagraph></paragraph><paragraph id="H8C3F4274F353475A946ED8DA7E8D833D"><enum>(2)</enum><header>Individual described</header><text>An individual described in this paragraph is an individual who—</text><subparagraph id="H81BA812902E34825937AA8D024DC0E43"><enum>(A)</enum><text>is entitled to hospital insurance benefits under part A of title XVIII of the Social Security Act under section 226A(b) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/426-1">42 U.S.C. 426–1(b)</external-xref>);</text></subparagraph><subparagraph id="HE92EA1A7C6904F5B8AA51AF2BC8ADB6E"><enum>(B)</enum><text>is enrolled for benefits under part B of such title XVIII; and</text></subparagraph><subparagraph id="HD76B1F58038A43A6893601F0DC4CEB5A"><enum>(C)</enum><text>would not, but for the provisions of, and amendments made by, subsection (a) be eligible for the guaranteed issue of a Medicare supplemental policy under paragraph (2) or (3) of section 1882(s) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395ss">42 U.S.C. 1395ss(s)</external-xref>).</text></subparagraph></paragraph></subsection></section><section id="HC90D243BFB9841978E475EE0189113A9"><enum>3.</enum><header>Allowing individuals with kidney failure to retain access to private insurance</header><subsection id="H7274F356373D4BEAB6BBF12B7AE3CB67"><enum>(a)</enum><header>In general</header><text>Section 1862(b)(1)(C) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395y">42 U.S.C. 1395y(b)(1)(C)</external-xref>) is amended—</text><paragraph id="H34B122B4866546E1B8F2B2188BD8BD8E"><enum>(1)</enum><text>in the last sentence, by inserting <quote>and before January 1, 2021</quote> after <quote>prior to such date</quote>; and</text></paragraph><paragraph id="H35401742A4A143348866382B1F37BFB4"><enum>(2)</enum><text>by adding at the end the following new sentence: <quote>Effective for items and services furnished on or after January 1, 2021 (with respect to periods beginning on or after the date that is 42 months prior to such date), clauses (i) and (ii) shall be applied by substituting <quote>42-month</quote> for <quote>12-month</quote> each place it appears.</quote>.</text></paragraph></subsection><subsection id="H241EB7FE4BD7442E84D9D9794A07519E"><enum>(b)</enum><header>Effective date</header><text>The amendments made by this subsection shall take effect on the date of enactment of this Act. For purposes of determining an individual’s status under section 1862(b)(1)(C) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395y">42 U.S.C. 1395y(b)(1)(C)</external-xref>), as amended by subsection (a), an individual who is within the coordinating period as of the date of enactment of this Act shall have that period extended to the full 42 months described in the last sentence of such section, as added by the amendment made by subsection (a)(2).</text></subsection></section></legis-body></bill>
