<official-title display="yes">To authorize assistance for fair housing enforcement activities to respond to the COVID-19 pandemic, and for other purposes.</official-title>

<section id="HB9F84613F0904B41B3446979BF77F116" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Fair Housing Enforcement Emergency Act of 2021</short-title></quote>.</text></section> <section id="HCE36725E6D234303B303229B3DEF9EFA"><enum>2.</enum><header>Fair housing activities</header> <subsection id="HEA7705C97D3F4A97B5CA97FB8E434D67"><enum>(a)</enum><header>Definition of COVID-19 emergency period</header><text>For purposes of this section, the term <quote>COVID-19 emergency period</quote> means the period that begins upon the date of the enactment of this Act and ends upon the date of the termination by the Federal Emergency Management Agency of the emergency declared on March 13, 2020, by the President under the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/4121">42 U.S.C. 4121</external-xref> et seq.) relating to the Coronavirus Disease 2019 (COVID-19) pandemic.</text></subsection>
<subsection id="HC2E336F199924235AF0F9E9B4CA3AFAB"><enum>(b)</enum><header>FHIP; FHAP</header>
<paragraph id="H44169E043B194F138A2770F1A5BFB996"><enum>(1)</enum><header>Appropriations</header><text display-inline="yes-display-inline">Out of any money in the Treasury not otherwise appropriated, there is appropriated to ensure that fair housing organizations and State and local civil rights agencies have sufficient resources to deal with expected increases in fair housing complaints, to investigate housing discrimination, including financial scams that target protected classes, associated with or resulting from the COVID-19 pandemic, and during such pandemic, for contracts, grants, and other assistance—</text> <subparagraph id="H3ADE4BCBF7E2402E8F657980CEF001C6"><enum>(A)</enum><text display-inline="yes-display-inline">$39,740,000 for fiscal year 2021 for the Fair Housing Initiatives Program under section 561 of the Housing and Community Development Act of 1987 (<external-xref legal-doc="usc" parsable-cite="usc/42/3616a">42 U.S.C. 3616a</external-xref>), of which—</text>
<clause id="H8337DA799A8B465D82794D214E98FF67"><enum>(i)</enum><text display-inline="yes-display-inline">$8,740,000 shall be available for assistance under subsection (d) of such section 561 for education and outreach activities; </text></clause> <clause id="HA0360D3B4A804495A47FD4BF29FBDDB4"><enum>(ii)</enum><text display-inline="yes-display-inline">$18,500,000 shall be available for private enforcement initiatives under subsection (b) of such section 561;</text></clause>
<clause id="H58597220EA924FE584E52C1D1C35594A"><enum>(iii)</enum><text display-inline="yes-display-inline">$2,500,000 shall be available for an initiative to provide technical assistance and training to such organizations and entities regarding fair housing issues related to the COVID-19 pandemic; and</text></clause> <clause id="H1365AF547E1442B9A932CB61A4FF27C5"><enum>(iv)</enum><text display-inline="yes-display-inline">$10,000,000, which shall remain available until September 30, 2024, shall be available for the Office of Fair Housing and Equal Opportunity of the Department of Housing and Urban Development to carry out a national media campaign to educate the public of increased housing rights during COVID-19 emergency period, that provides that information and materials used in such campaign are available—</text>
<subclause id="H5E795E07E73F43D08792FD74D9745AED"><enum>(I)</enum><text>in the languages used by communities with limited English proficiency; and</text></subclause> <subclause id="H23449CB0F0E44248946A5170955B4055"><enum>(II)</enum><text display-inline="yes-display-inline">to persons with disabilities.</text></subclause></clause></subparagraph>
<subparagraph id="H2B4C27D619F74E6D9EAA718049D5A6A4"><enum>(B)</enum><text>$35,000,000 for fiscal year 2021 for the Fair Housing Assistance Program under the Fair Housing Act (<external-xref legal-doc="usc" parsable-cite="usc/42/3601">42 U.S.C. 3601</external-xref> et seq.).</text></subparagraph></paragraph> <paragraph id="H963A46E234154FFA933284DD3E71A90C"><enum>(2)</enum><header>Use of telephone and internet capabilities</header><text>Amounts made available by paragraph (1) may be used by such organizations and agencies to establish the capacity to and to carry out activities and services by telephone and online means, including for individuals with limited English proficiency and individuals with a disability in accordance with requirements under the Americans With Disabilities Act of 1990. </text></paragraph>
<paragraph id="H00F73C50AA1442ADAD3846AA845E3B79"><enum>(3)</enum><header>Priority for private enforcement initiatives and technical assistance</header><text display-inline="yes-display-inline">In entering into contracts for private enforcement initiatives under 561(b) of the Housing and Community Development Act of 1987 (<external-xref legal-doc="usc" parsable-cite="usc/42/3616a">42 U.S.C. 3616a(b)</external-xref>) using amounts made available by paragraph (1)(A)(ii) of this subsection and contracts for technical assistance and training using amounts made available by paragraph (1)(A)(iii), the Secretary of Housing and Urban Development shall give priority to applications from qualified fair housing enforcement organizations that have at least 2 years of fair housing testing experience.</text></paragraph> <paragraph id="H48B88776B33D4215B0AC4F13A5EC8077" display-inline="no-display-inline"><enum>(4)</enum><header>3-year grants</header><text display-inline="yes-display-inline">A grant for any grantee from any amounts made available by clause (i), (ii), or (iii) of paragraph (1)(A) shall be made for a 3-year period, subject to the request of the grantee, and the grantee shall receive an allocation of such grant amounts annually during such 3-year period.</text></paragraph></subsection></section>
