which was referred to the <committee-name committee-id="HBA00">Committee on Financial Services</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Fair Debt Collection Practices Act to safeguard access to information for consumers and to stop abusive debt litigation, and for other purposes.</official-title></form><legis-body id="H01D837788C8E43B39287F9EEBAF3085E" style="OLC"><section id="H2E0C5F9A28744B30892E908C7D53DEE7" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Securing Consumers Against Misrepresented Debt Act of 2021</short-title></quote> or the <quote><short-title>SCAM Debt Act</short-title></quote>. </text></section><section id="H0F3EA52E51884F6998BB839515DAE828" section-type="subsequent-section"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">Section 803 of the Fair Debt Collection Practices Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1692a">15 U.S.C. 1692a</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" id="H6B9D93389C7941B9A72DB8C6B67B4984" display-inline="no-display-inline"><paragraph id="HAD0F5FE017FD4D27B1B294DA4D66A90B"><enum>(9)</enum><text display-inline="yes-display-inline">The term <term>legal action</term> means any lawsuit or legal proceeding (including litigation, arbitration, enforcement of security interests, post-judgment actions, and mediation) pursued, taken, threatened, offered, or requested by debt collectors.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="H815D0BD425D24A29821B330E5694D650"><enum>3.</enum><header>False or misleading representations</header><text display-inline="no-display-inline">Section 807(11) of the Fair Debt Collection Practices Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1692e">15 U.S.C. 1692e(11)</external-xref>) is amended by striking <quote>legal action</quote> and inserting <quote>lawsuit</quote>.</text></section><section id="HEE625D28D3CA42B9A2049AF6EBC5BB2D"><enum>4.</enum><header>Validation of debts</header><text display-inline="no-display-inline">Section 809(a) of the Fair Debt Collection Practices Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1692g">15 U.S.C. 1692g(a)</external-xref>) is amended—</text><paragraph id="H6BCA24CDAFF1474A8592785103A89A78"><enum>(1)</enum><text>in the matter preceding paragraph (1), by striking <quote>the following information is contained in the initial communication or</quote>;</text></paragraph><paragraph id="HA6DC3A0635374701929E47DB68D965A3"><enum>(2)</enum><text>by amending paragraph (1) to read as follows:</text><quoted-block style="OLC" id="H37C8C23913A54525BE2BB935F6E9570F" display-inline="no-display-inline"><paragraph id="H74F6D87345004751A1A9AFB2BC2433E3"><enum>(1)</enum><text display-inline="yes-display-inline">an itemization of the amount of the debt that includes—</text><subparagraph id="HE3FF5DEB8F9C4AC5BA7DA8886EB165C0"><enum>(A)</enum><text>the total amount of the debt owed on the date of the notice;</text></subparagraph><subparagraph id="H4355C25F8A5C4F679F9392F30C80C6E2"><enum>(B)</enum><text display-inline="yes-display-inline">the most recent date of default on the debt; and</text></subparagraph><subparagraph id="HE4D8A1A28D024B0E8A6121B93338C88D"><enum>(C)</enum><text display-inline="yes-display-inline">the amount owed on the most recent date of default, the amount of any payments made since such date, and the amount of any interest or fees accrued on the debt since such date;</text></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="HB28DFAADD72F4EABB1491B1DC5635A9E"><enum>(3)</enum><text>by amending paragraph (2) to read as follows:</text><quoted-block style="OLC" id="HFA3A143DCA2F454BB1C50AA581865B56" display-inline="no-display-inline"><paragraph id="H0295EED32BEE441990B7944E5EE64255"><enum>(2)</enum><text display-inline="yes-display-inline">the name of the original creditor and, if different, the name of the creditor on the most recent date of default and the name of the current creditor to whom the debt is owed;</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="H12F6FAD09AD2435395C43FBB1BCE9831"><enum>(4)</enum><text>in paragraph (4)—</text><subparagraph id="H5090C36DF5FA43E78EAECCEE59BEE7C3"><enum>(A)</enum><text>by striking <quote>in writing</quote>; and</text></subparagraph><subparagraph id="H77079F21A24C47C4936349B7C7F77494"><enum>(B)</enum><text>by striking <quote>and</quote> at the end;</text></subparagraph></paragraph><paragraph id="H4A35C9D7DC634B3C9EB39C0158EB0DF0"><enum>(5)</enum><text>in paragraph (5)—</text><subparagraph id="H67C7C156379B47DDB85CDD828442585C"><enum>(A)</enum><text>by striking <quote>written</quote>; and</text></subparagraph><subparagraph id="H80F4060309A64FC1A6934384430AA2CF"><enum>(B)</enum><text>by striking the period at the end and inserting a semicolon; and</text></subparagraph></paragraph><paragraph id="H0CADE23F21BD4547B6127A623639C60F"><enum>(6)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" id="HF3AAD5CC6ADB49BE8EC8C4AF3F35C3ED" display-inline="no-display-inline"><paragraph id="H91C49F84B48E425693A16070F1063ED1"><enum>(6)</enum><text display-inline="yes-display-inline">the account number of the debt on the most recent date of default; and</text></paragraph><paragraph id="H48C834EDF3FA469F948EE39EA54B1DEB"><enum>(7)</enum><text display-inline="yes-display-inline">all methods that the consumer can use to contact the debt collector.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="H8C903A9069934983A484DA931732326E"><enum>5.</enum><header>Legal actions by debt collectors</header><text display-inline="no-display-inline">Section 811 of the Fair Debt Collections Practices Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1692i">15 U.S.C. 1692i</external-xref>) is amended—</text><paragraph id="HAB72F12C2F3947E79E4DFAE9B6023486"><enum>(1)</enum><text>by redesignating subsection (b) as subsection (c); and</text></paragraph><paragraph id="H0A718B392219438783BD6E93E0415D61"><enum>(2)</enum><text display-inline="yes-display-inline">by inserting after subsection (a) the following new subsection:</text><quoted-block style="OLC" id="HAC9DD8D1C8E644CF9E133563828CD820" display-inline="no-display-inline"><subsection id="H6F0FB5F55471470499A6DA53B42BE9B6" commented="no"><enum>(b)</enum><header>Requirements for debt collectors</header><text display-inline="yes-display-inline">A debt collector that takes legal action to collect or attempt to collect a debt shall comply with the following requirements:</text><paragraph id="H62F8BD42DC124ECFA8B8CE51179D9292" commented="no"><enum>(1)</enum><text display-inline="yes-display-inline">Provide the consumer written notice of the intent to take legal action, sent to the consumer’s last known address at least 30 days and not later than 60 days in advance of commencing the legal action, that shall include—</text><subparagraph id="H193BEEB7A55D43BE8A174AE6F716DDAE" commented="no"><enum>(A)</enum><text display-inline="yes-display-inline">all methods that the consumer can use to contact the debt collector; and</text></subparagraph><subparagraph id="H4612156D762F47019F88DA9ED01B8E2F" commented="no"><enum>(B)</enum><text display-inline="yes-display-inline">all information contained in the notice required under section 809(a) (excluding the information described in paragraphs (3), (4), and (5) of such section), updated to ensure correctness.</text></subparagraph></paragraph><paragraph id="H424088DD2D6E4DC4B89D13E6C17CB18B" commented="no"><enum>(2)</enum><text display-inline="yes-display-inline">In the initial pleading filed by a debt collector to commence a legal action to collect a debt, include—</text><subparagraph id="HBD3CABE12F5646628CF85FD397A97E14" commented="no"><enum>(A)</enum><text display-inline="yes-display-inline">all information contained in the notice required under section 809(a) (excluding the information described in paragraphs (3), (4), and (5) of such section), except any account numbers and any personally identifiable information, updated to ensure correctness;</text></subparagraph><subparagraph id="H55B08E53EF914D7595E085ED62E87C98" commented="no"><enum>(B)</enum><text display-inline="yes-display-inline">the last four digits of the account number of the original debt;</text></subparagraph><subparagraph id="H901F4306D0CD45299D31A0E73808825D" commented="no"><enum>(C)</enum><text display-inline="yes-display-inline">admissible documentary evidence of—</text><clause id="HA466151167E040C5AAA7805DBF52B390"><enum>(i)</enum><text display-inline="yes-display-inline">the written agreement, contract, or instrument creating the debt, if any, or other documents showing that the consumer agreed to the agreement, contract, or instrument creating the debt;</text></clause><clause id="H9C4EF88267914C77A55E62200AE7F548"><enum>(ii)</enum><text>any terms and conditions relevant to the debt;</text></clause><clause id="H5A08B5EEFE3B49B1979924B0728D70FF"><enum>(iii)</enum><text>that the consumer incurred the debt and the amount owed; and</text></clause><clause id="H99ECCE30E34F45E1B999AA9FE5FCA02C"><enum>(iv)</enum><text>that there is a chain of title of the ownership of debt and the right to collect the debt, including documents showing the date of each transfer of ownership of the debt and the identity of each owner of the debt; and</text></clause></subparagraph><subparagraph id="H33F3A83A510B49F28FD5405BE7AC6B7F"><enum>(D)</enum><text display-inline="yes-display-inline">a sworn affidavit stating—</text><clause id="H5C97D700E82E43498CFFFE84A8CD83E3"><enum>(i)</enum><text>that the applicable statute of limitations for collecting the debt has not expired and the date on which such statute of limitations expires; and</text></clause><clause id="HABF4909A1D0B46BF99335C617A8A0AD4"><enum>(ii)</enum><text>that the debt collector personally reviewed all applicable records and documents relating to the debt to be collected.</text></clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></legis-body></bill>
