R. 1666</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20210308">March 8, 2021</action-date><action-desc><sponsor name-id="W000826">Ms. Wild</sponsor> (for herself and <cosponsor name-id="T000467">Mr. Thompson of Pennsylvania</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HED00">Committee on Education and Labor</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Child Abuse Prevention and Treatment Act to require a study and report on State mandatory reporting laws.</official-title></form><legis-body id="HA4D1853A4EEC4C2EAC95F6EFAF16EE29" style="OLC"><section id="HB3F5BA0FAF254C6BB63BF7FC65950012" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Working to End Child Abuse and Neglect Act</short-title></quote> or the <quote><short-title>WE CAN Act</short-title></quote>.</text></section><section id="H9081B1D6E0754C0C8FF6ADF6A94C8637"><enum>2.</enum><header>Study and report on State mandatory reporting laws</header><text display-inline="no-display-inline">Section 110 of the Child Abuse Prevention and Treatment Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5106f">42 U.S.C. 5106f</external-xref>) is amended by adding at the end the following:</text><quoted-block id="HB6E40878DE0A462CB182254D187B8AE8" style="OLC"><subsection id="H5357D63CFA5241D1911498FFDD21E8CA"><enum>(e)</enum><header>Study and report on State mandatory reporting laws</header><paragraph id="HF9846BA33DDF4FBF93732184F8BE3DDF"><enum>(1)</enum><header>Study</header><text>The Secretary shall collect information on, and otherwise study, State laws for mandatory reporting of incidents of child abuse or neglect. Such study shall examine trends in referrals and investigations of child abuse and neglect due to differences in such State laws with respect to the inclusion, as mandatory reporters, of the following individuals:</text><subparagraph id="HFCDC896C17FB48F2BD2858137C47C97C"><enum>(A)</enum><text>Individuals licensed or certified to practice in any health-related field licensed by the State, employees of health care facilities or providers licensed by the State, who are engaged in the admission, examination, care or treatment of individuals, including mental health and emergency medical service providers.</text></subparagraph><subparagraph id="HC5B88138AA9A4A9D9998B4066F2F9A64"><enum>(B)</enum><text>Individuals employed by a school who have direct contact with children, including teachers, administrators, and independent contractors.</text></subparagraph><subparagraph id="HE2C01661F0134E51AE3E49FCBD80E1BB"><enum>(C)</enum><text>Peace officers and law enforcement personnel.</text></subparagraph><subparagraph id="H7D53A8672BCA42C5B820CCDFCE2F6F42"><enum>(D)</enum><text>Clergy, including Christian Science practitioners, except where prohibited on account of clergy-penitent privilege.</text></subparagraph><subparagraph id="HAF6232E7FC0C4217BBAA608AD4C2DD9A"><enum>(E)</enum><text>Day care and child care operators and employees.</text></subparagraph><subparagraph id="H16521B3F12454CCC83247F1568154B88"><enum>(F)</enum><text>Employees of social services agencies who have direct contact with children in the course of employment.</text></subparagraph><subparagraph id="HC52B795A74504C57A699527763AC2663"><enum>(G)</enum><text>Foster parents.</text></subparagraph><subparagraph id="H211CAC47B8B64AF891944096512E487E"><enum>(H)</enum><text>Court appointed special advocates (employees and volunteers).</text></subparagraph><subparagraph id="HC80BAF4A740B4111B1F818605FD9F7E3"><enum>(I)</enum><text>Camp and after-school employees.</text></subparagraph><subparagraph id="H12E69A498B844014A364C8B838B2DE66"><enum>(J)</enum><text>An individual, paid or unpaid, who, on the basis of the individual’s role as an integral part of a regularly scheduled program, activity, or service, accepts responsibility for a child.</text></subparagraph></paragraph><paragraph id="H9EC535BD8AF64B16A42514AC5E598343"><enum>(2)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than 4 years after the date of enactment of the <short-title>Working to End Child Abuse and Neglect Act</short-title>, the Secretary shall submit to the Committee on Health, Education, Labor, and Pensions of the Senate and the Committee on Education and Labor of the House of Representatives a report containing the findings of the study required by this subsection, including any best practices related to the inclusion, as mandatory reporters, of individuals described in paragraph (1).</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
