which was referred to the <committee-name committee-id="HHA00">Committee on House Administration</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the National Voter Registration Act of 1993 to require the Postmaster General to provide State election officials with change of address information before a general election for Federal office, and for other purposes.</official-title></form><legis-body id="HDC673C58692249CEB20529D57F5A5497" style="OLC"><section id="HF193B11DA91743E5AE73DE37E219996F" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Updating Postal Data on Addresses for Trustworthy Elections Act</short-title></quote> or the <quote><short-title>UPDATE Act</short-title></quote>.</text></section><section id="HE33FE64777394FFB87180C3E67DD04BA"><enum>2.</enum><header>Change of address information provided to State election officials</header><subsection id="HC3002A29EB6747718F83321984228BE1"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 9 of the National Voter Registration Act of 1993 (<external-xref legal-doc="usc" parsable-cite="usc/52/20508">52 U.S.C. 20508</external-xref>) is amended by adding at the end the following new subsection: </text><quoted-block style="OLC" id="HCD1D9874EE2F4B98B0E1739521075FDA" display-inline="no-display-inline"><subsection id="HEFB1DB0FD0F34B36B08FD19E792D1CF8"><enum>(c)</enum><header>United States Postal Service change of address information</header><text display-inline="yes-display-inline">Not later than 90 days after the date of enactment of this subsection, and every 90 days thereafter, the Postmaster General of the United States Postal Service shall provide to the chief State election official of each State the change of address records available in the National Change of Address product maintained by the United States Postal Service.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H047504667BBD4A57964DF6AF5DDFB7EB"><enum>(b)</enum><header>Effective date</header><text display-inline="yes-display-inline">The amendment made by this section shall take effect on the date of enactment of this Act.</text></subsection><subsection id="HBE69CCCEB8B34ADBA45EF41934EE1093"><enum>(c)</enum><header>Authorization of appropriations</header><text display-inline="yes-display-inline">There is authorized to be appropriated to the Postmaster General of the United States Postal Service $600,000 to carry out the amendment made by this section.</text></subsection></section><section id="HFD841211179545F7A5CFB0210165F7D4"><enum>3.</enum><header>Payments to States for the maintenance of voter registration lists</header><subsection id="H26BA864AF13A49B7B6D018950EA668FE"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Election Assistance Commission shall make a payment to each eligible State for carrying out maintenance of each such State’s computerized voter registration list under section 303 of the Help America Vote Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/52/21083">52 U.S.C. 21083</external-xref>) and for carrying out programs under section 8 of the National Voter Registration Act of 1993 (<external-xref legal-doc="usc" parsable-cite="usc/52/20507">52 U.S.C. 20507</external-xref>) to ensure the accuracy of voter registration lists in the State.</text></subsection><subsection id="HD3D8AE500E0C4D39AF17F05FC99A7864"><enum>(b)</enum><header>Eligibility</header><text display-inline="yes-display-inline">A State is eligible to receive a payment under this section if the State submits to the Commission an application at such time, in such form, and containing such information and assurances as the Commission may require.</text></subsection><subsection id="H28158F87748E45578C5CDA87A0D030F1"><enum>(c)</enum><header>Amount of payment</header><paragraph id="HA1E5F9C18B1A4AF8BC695257951AB21E"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Subject to <internal-xref idref="H57D283618A874D549BAE91336D447754" legis-path="2.(c)(2)">paragraph (2)</internal-xref>, the amount of a payment made to a State under this section shall be equal to the product of—</text><subparagraph id="H5824586619CE4176BF24B758131CDCCB"><enum>(A)</enum><text display-inline="yes-display-inline">the total amount appropriated for such payments pursuant to the authorization under <internal-xref idref="H8D08603A571743A5A8629824758166CE" legis-path="2.(d)">subsection (f)</internal-xref>; and</text></subparagraph><subparagraph id="HD077D746B32F408387CC3AFAFDAD42AA"><enum>(B)</enum><text>the State allocation percentage for the State.</text></subparagraph></paragraph><paragraph id="H57D283618A874D549BAE91336D447754"><enum>(2)</enum><header>Minimum amount of payment</header><text display-inline="yes-display-inline">The amount of a payment made to a State under this section may not be less than—</text><subparagraph id="H9A59DB2709CC4DA0B029C7635D35E9BE"><enum>(A)</enum><text display-inline="yes-display-inline">in the case of any of the several States or the District of Columbia, one-half of 1 percent of the total amount appropriated for such payments; or</text></subparagraph><subparagraph id="H0D0854C286634BBBA1277158E3B867A9"><enum>(B)</enum><text display-inline="yes-display-inline">in the case of the Commonwealth of Puerto Rico, Guam, American Samoa, the United States Virgin Islands, and the Commonwealth of the Northern Mariana Islands, one-tenth of 1 percent of such total amount.</text></subparagraph></paragraph><paragraph id="HD9D5A8A208904D149915AC741A870B30"><enum>(3)</enum><header>Pro rata reductions</header><text display-inline="yes-display-inline">The Commission shall make such pro rata reductions to the allocations determined under <internal-xref idref="HA1E5F9C18B1A4AF8BC695257951AB21E" legis-path="2.(c)(1)">paragraph (1)</internal-xref> as are necessary to comply with the requirements of <internal-xref idref="H57D283618A874D549BAE91336D447754" legis-path="2.(c)(2)">paragraph (2)</internal-xref>.</text></paragraph></subsection><subsection id="HAAEE87AC308442A780D38856F2B5A3F3"><enum>(d)</enum><header>Continuing availability of funds after appropriation</header><text display-inline="yes-display-inline">A payment made to a State under this section shall be available to the State without fiscal year limitation.</text></subsection><subsection id="HAEA85C19D33742F4B40868492256A2E5" commented="no"><enum>(e)</enum><header>Definitions</header><text>In this section:</text><paragraph id="H7590137CC79A4CCB95B4A3E9BE9CAE18"><enum>(1)</enum><header>State</header><text display-inline="yes-display-inline">The term <term>State</term> means each of the several States, the District of Columbia, the Commonwealth of Puerto Rico, American Samoa, Guam, the United States Virgin Islands, and the Commonwealth of the Northern Mariana Islands.</text></paragraph><paragraph id="H598DEB94D8CC418FA0D9520F45CDCD60"><enum>(2)</enum><header>State allocation percentage</header><text>The term <term>State allocation percentage</term> means, with respect to a State, the amount (expressed as a percentage) equal to the quotient of—</text><subparagraph id="HF599C188D04245BFA64D922EC56E23BA" commented="no"><enum>(A)</enum><text>the voting age population of the State (as reported in the most recent decennial census); and</text></subparagraph><subparagraph id="H48345274E8F742FAABE5FA08C418A0AA" commented="no"><enum>(B)</enum><text>the total voting age population of all States (as reported in the most recent decennial census). </text></subparagraph></paragraph></subsection><subsection id="H8D08603A571743A5A8629824758166CE"><enum>(f)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated $25,000,000 for payments under this section.</text></subsection></section></legis-body></bill>
