R. 1645</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20210308">March 8, 2021</action-date><action-desc><sponsor name-id="M001156">Mr. McHenry</sponsor> introduced the following bill; which was referred to the <committee-name committee-id="HBA00">Committee on Financial Services</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Fair Credit Reporting Act to make improvements to the regulation of consumer reporting agencies and protect consumers, and for other purposes.</official-title></form><legis-body id="HC4F1E0FE50A044FF96BE801CCA518570" style="OLC"><section id="HFE7C157A0E56430F86B9BE5FA6662323" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Protecting Consumer Access to Credit Act</short-title></quote>.</text></section><section id="HE2E515C2CAEC4AC4BAA52E6744F4F760" section-type="subsequent-section"><enum>2.</enum><header>Cybersecurity supervision and examination of large consumer reporting agencies</header><subsection id="H0361A70746DB4D4690AA8B77B5B1FDB9"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Fair Credit Reporting Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1681">15 U.S.C. 1681</external-xref> et seq.) is amended by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="H1BDC9F6E8F7E44A5B2CCD5B53194FDB4" style="OLC"><section id="H4B5335BCDC154165904A07241121812A"><enum>630.</enum><header>Cybersecurity supervision and examination of large consumer reporting agencies</header><text display-inline="no-display-inline">Consumer reporting agencies described under section 603(p) shall be subject to cybersecurity supervision and examination by the Bureau.</text></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H764A9777953C44FB914ACCD5B07241E4"><enum>(b)</enum><header>Clerical amendment</header><text display-inline="yes-display-inline">The table of contents of the Fair Credit Reporting Act is amended by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="H72A382E4F1DF4D8BA3DA1C19DE91255F" style="OLC"><toc regeneration="no-regeneration"><toc-entry level="section">630. Cybersecurity supervision and examination of large consumer reporting agencies.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="H5FF49D901AE74695B105EEC336EDB558"><enum>3.</enum><header>Prohibition on the use of Social Security numbers</header><subsection id="HBBCDA1BCF3A44B57B2B575822581EE5F"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 605 of the Fair Credit Reporting Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1681c">15 U.S.C. 1681c</external-xref>) is amended by adding at the end the following:</text><quoted-block id="H493D66C0113E413B8FDD21335C342114" style="OLC"><subsection id="H7DA463113C864195A12A0936FF43C368"><enum>(i)</enum><header>Prohibition on the use of social security numbers</header><text>A consumer reporting agency described under section 603(p)—</text><paragraph id="H422FFC2F52D14CA5A23F82F1D4A697C7"><enum>(1)</enum><text>may not make any consumer report containing a social security number; and</text></paragraph><paragraph id="HB8F94BC04CBC48CFAB9965638C73E97C"><enum>(2)</enum><text>may not use the social security number of a consumer as a method to verify the consumer.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HB109E73C8A5D4FA2BE6EBAC8B6FEABCE"><enum>(b)</enum><header>Conforming amendment</header><text>Section 609(a)(1) of the Fair Credit Reporting Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1681g">15 U.S.C. 1681g(a)(1)</external-xref>) is amended by striking <quote>except that—</quote> and all that follows through <quote>(B) nothing</quote> and inserting <quote>except that nothing</quote>.</text></subsection><subsection id="H3EF1C1B5F9B8417C874D6F76E426B7FE"><enum>(c)</enum><header>Effective date</header><text>The amendments made by this section shall take effect on January 1, 2022.</text></subsection></section><section id="H4494D594F8DB443EA8B33247E43C8C80"><enum>4.</enum><header>Exclusion of paid medical debt</header><text display-inline="no-display-inline">Section 605(a) of the Fair Credit Reporting Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1681c">15 U.S.C. 1681c(a)</external-xref>) is amended, by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="HCBD4FD24F54043468B09348B3ED4CA26" style="OLC"><paragraph id="H50E52D7BB90C4294B9F787E7F6E7A8D2"><enum>(9)</enum><text display-inline="yes-display-inline">Paid debt arising from the receipt of medically necessary, non-elective medical services, products, or devices which from the date of payment, antedate the report by more than 1 year.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="HEDDCBE50DE1D4D469215F5880C41BD9D"><enum>5.</enum><header>Security freezes for protected consumers</header><subsection id="H481B55BA4AFB45238BB2E1FEBB3D6F43"><enum>(a)</enum><header>Placement of freeze</header><text display-inline="yes-display-inline">Section 605A(j)(2)(A) of the Fair Credit Reporting Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1681c-1">15 U.S.C. 1681c–1(j)(2)(A)</external-xref>) is amended to read as follows:</text><quoted-block display-inline="no-display-inline" id="H5476B73728FC4A1993FE8DFA92B64CA6" style="OLC"><subparagraph id="H611C1E6F8B104E1086C50C9B6F511D0F"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Upon receiving a direct request from a protected consumer’s representative, by mail, toll-free telephone, or secure electronic means, that a consumer reporting agency place a security freeze, and upon receiving sufficient proof of identification and sufficient proof of authority, the consumer reporting agency shall, free of charge, place the security freeze not later than 3 business days after receiving the request directly from the protected consumer’s representative.</text></subparagraph><after-quoted-block>. </after-quoted-block></quoted-block></subsection><subsection id="HB00AD837B8594685884616EE491693FF"><enum>(b)</enum><header>Removal of freeze</header><text display-inline="yes-display-inline">Section 605A(j)(4) of the Fair Credit Reporting Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1681c-1">15 U.S.C. 1681c–1(j)(4)</external-xref>) is amended—</text><paragraph id="H304CF46E39F148B2B85880417DCD6C86"><enum>(1)</enum><text>in subparagraph (A)(i), by inserting after <quote>Upon the direct request</quote> the following: <quote>, by mail or secure electronic means,</quote>;</text></paragraph><paragraph id="HF4903F4E31F646A6B1C796FBB4CCF22A"><enum>(2)</enum><text>in subparagraph (A)(ii), by inserting after <quote>Upon the direct request</quote> the following: <quote>, by mail or secure electronic means,</quote>; and</text></paragraph><paragraph id="H4660E116A2AE49CBB18F1CDE706EC55E"><enum>(3)</enum><text>in subparagraph (C)—</text><subparagraph id="H64B81D2C914C4A14A5BF08A438E6A0F2"><enum>(A)</enum><text>by striking <quote>not later than—</quote> and inserting the <quote>not later than 3 days business days after receiving the request directly from the protected consumer or protected consumer’s representative.</quote>; and</text></subparagraph><subparagraph id="HA2BE05098AB2408F8101F794488FE9A0"><enum>(B)</enum><text>by striking clauses (i) and (ii).</text></subparagraph></paragraph></subsection></section><section id="H29BD859E17E9463CA2ACE1B2383056D2"><enum>6.</enum><header>Public record data sources in consumer reports</header><text display-inline="no-display-inline">Section 605(d) of the Fair Credit Reporting Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1681c">15 U.S.C. 1681c(d)</external-xref>) is amended by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="H5AB02B524AD74EB1AD97CF22B8D4686E" style="OLC"><paragraph id="H711BA76F82A644E3A82D8D59AE20CC88"><enum>(3)</enum><header>Public record data</header><text display-inline="yes-display-inline">If a consumer reporting agency furnishes a consumer report that contains public record data, such consumer reporting agency shall include the source of such public record data in such report.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="H6F36B35BD94342438970A0E73FAE6B4C"><enum>7.</enum><header>Prohibition on including adverse information related to predatory mortgage lending</header><subsection id="H67A71B1BA06243D8BD4FFDBC30B765D3"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Fair Credit Reporting Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1681">15 U.S.C. 1681</external-xref> et seq.) is amended by inserting after section 605B the following:</text><quoted-block display-inline="no-display-inline" id="H92828AEF183B4007A09509B2EB1BD35F" style="USC"><section id="H9811C5CF75464B318AF795732C09F3C6"><enum>605C.</enum><header>Adverse information relating to predatory mortgage lending</header><subsection id="H48EDA78D38A64A8BB62915B53D59F4BE"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">A consumer reporting agency may not furnish any consumer report containing any adverse item of information relating to a covered residential mortgage loan (including the origination and servicing of such a loan, any loss mitigation activities related to such a loan, and any foreclosure, deed in lieu of foreclosure, or short sale related to such a loan), if the action or inaction to which the item of information relates—</text><paragraph id="HA41757BD8F2749D8B245AADB3E717DEC"><enum>(1)</enum><text display-inline="yes-display-inline">resulted from an unfair, deceptive, or abusive act or practice, or a fraudulent, discriminatory, or illegal activity of a financial institution, as determined by a court of competent jurisdiction; or</text></paragraph><paragraph id="H14166A05F59A4352BA8BF921E1E3A406"><enum>(2)</enum><text display-inline="yes-display-inline">is related to an unfair, deceptive, or abusive act or practice, or a fraudulent, discriminatory, or illegal activity of a financial institution that is the subject of a settlement agreement initiated on behalf of a consumer and that is between the financial institution and an agency or department of a local, State, or Federal Government.</text></paragraph></subsection><subsection id="HEB2CAA37C8194833A84EA853C30395E7"><enum>(b)</enum><header>Covered residential mortgage</header><text display-inline="yes-display-inline">In this section, the term <term>covered residential mortgage loan</term> means any loan made primarily for personal, family, or household use that is secured by a mortgage, deed of trust, or other equivalent consensual security interest on a dwelling (as defined in section 103(w) of the Truth in Lending Act), including a loan in which the proceeds will be used for—</text><paragraph id="H9E423869D2334F388D70AFD141635A1D"><enum>(1)</enum><text display-inline="yes-display-inline">a manufactured home (as defined in section 603 of the Housing and Community Development Act of 1974);</text></paragraph><paragraph id="H2DCD2C75F90A45239D18D4C50A11D243"><enum>(2)</enum><text display-inline="yes-display-inline">any installment sales contract, land contract, or contract for deed on a residential property; or</text></paragraph><paragraph id="H7F65CE50D2E64B2A9E635F835BD7071D"><enum>(3)</enum><text display-inline="yes-display-inline">a reverse mortgage transaction (as defined in section 103(cc) of the Truth in Lending Act).</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H582EC7A592A3401FBE96DC14ADAAE597"><enum>(b)</enum><header>Table of contents amendment</header><text display-inline="yes-display-inline">The table of contents of the Fair Credit Reporting Act is amended by inserting after the item relating to section 605B the following new item:</text><quoted-block display-inline="no-display-inline" id="HD55880C26B844808B4A530D6B843E0AC" style="OLC"><toc regeneration="no-regeneration"><toc-entry level="section">605C. Adverse information relating to predatory mortgage lending.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="H8281D8EB0E654B4EBA72EF161397156D"><enum>8.</enum><header>Prohibition on including adverse information when financial abuse has been determined</header><subsection id="H6D7B00747E2D4C0C848EA8CCB1F9886B"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Fair Credit Reporting Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1681">15 U.S.C. 1681</external-xref> et seq.), as amended by section 7, is further amended by inserting after section 605C the following:</text><quoted-block display-inline="no-display-inline" id="H94EB1DDFE19447FCBEB4DFAC3BE5EA0D" style="USC"><section id="H5E36369272074012A6F5174EA2A025EC"><enum>605D.</enum><header>Adverse information in cases of financial abuse</header><text display-inline="no-display-inline">A consumer reporting agency may not furnish a consumer report containing any adverse item of information about a consumer that resulted from intentionally abusive or harmful financial behavior if—</text><paragraph id="H03A5A6C14C064470BC2A1BD376D22DDE"><enum>(1)</enum><text display-inline="yes-display-inline">a court of competent jurisdiction, in a lawsuit that is not a class action lawsuit, has determined that the consumer is a victim of such intentionally abusive or harmful financial behavior;</text></paragraph><paragraph id="H013DB63DB78046C7ABAD5454D099FB4C"><enum>(2)</enum><text display-inline="yes-display-inline">such intentionally abusive or harmful financial behavior was conducted by a spouse, family or household member, caregiver, or person with whom such consumer had a dating relationship; and</text></paragraph><paragraph id="HA39D19B5B4EC46FD9135FCE8CCB55D06"><enum>(3)</enum><text display-inline="yes-display-inline">such consumer did not participate in or consent to such behavior.</text></paragraph></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H3009B9675F5C40D09FAB1623DF7455B7"><enum>(b)</enum><header>Table of contents amendment</header><text>The table of contents of the Fair Credit Reporting Act is amended by inserting after the item relating to section 605C the following new item:</text><quoted-block display-inline="no-display-inline" id="HF20C34826139424CB1EEFA549C2809D3" style="OLC"><toc regeneration="no-regeneration"><toc-entry level="section">605D. Adverse information in cases of financial abuse.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="H5992D9C228A64944AE75D297031A7B60"><enum>9.</enum><header>Prohibition on including adverse information when a student obligor is defrauded</header><subsection id="H3089E69192DF47708DDE4C454D79AAD3"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Fair Credit Reporting Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1681">15 U.S.C. 1681</external-xref> et seq.), as amended by section 8, is further amended by inserting after section 605D the following:</text><quoted-block display-inline="no-display-inline" id="HB891830213CE4DFABC75E4BA31368A16" style="USC"><section id="HD9BC45CA24694FF1AF5B5B980CEB92D4"><enum>605E.</enum><header>Adverse information in cases of a defrauded student obligor.</header><subsection id="H230DB1F726D44DD5A92A75E1310BF339"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">A consumer reporting agency may not furnish a consumer report containing any adverse item of information about a consumer that resulted from a private student loan obligation if—</text><paragraph id="HBA096B95847141A0B06B2B11EE6E9946"><enum>(1)</enum><text>such consumer is a student obligor with respect to such private education loan; and</text></paragraph><paragraph id="H188A39437B064E3DADB415DC51CBBFDC"><enum>(2)</enum><text display-inline="yes-display-inline">a court of competent jurisdiction, in a lawsuit that is not a class action lawsuit, has determined that such consumer is a victim of fraud with respect to such private education loan.</text></paragraph></subsection><subsection id="HFC352097D64D4BDF93CE675C79596781"><enum>(b)</enum><header>Private education loan defined</header><text display-inline="yes-display-inline">For the purposes of this section, the term <term>private education loan</term> has the meaning given the term in section 140(a) of the Truth in Lending Act.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H59703EE8DD7642CBBF5662EFC2BA670A"><enum>(b)</enum><header>Table of contents amendment</header><text>The table of contents of the Fair Credit Reporting Act is amended by inserting after the item relating to section 605D the following new item:</text><quoted-block display-inline="no-display-inline" id="HE2EE2935F7CC49B497FE2B8EC054C470" style="OLC"><toc regeneration="no-regeneration"><toc-entry level="section">605E. Adverse information in cases of a defrauded student obligor.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="H0343ADA81A4D43E484BCF540968ADD0E"><enum>10.</enum><header>Bureau list of credit reporting agencies</header><text display-inline="no-display-inline">The Bureau of Consumer Financial Protection shall maintain a list of credit reporting agencies in the United States and publish such list of the website on the Bureau of Consumer Financial Protection.</text></section><section id="H77F73F156C2B4DD490D28D94CA3D22E1"><enum>11.</enum><header>Study and report to Congress on use of non-traditional data in credit scoring</header><subsection id="H15F092C2FEEC436E8D09E50C49335895"><enum>(a)</enum><header>Study</header><text display-inline="yes-display-inline">The Bureau of Consumer Financial Protection shall carry out a study about the use of non-traditional data—</text><paragraph id="H168BFA732B7342B9B4D5BD263231D449"><enum>(1)</enum><text>by consumer reporting agencies when compiling and furnishing consumer reports; and</text></paragraph><paragraph id="H4BE5C68811674A678162652D2A7BBA8A"><enum>(2)</enum><text>by persons that create, maintain, or purchase credit scoring models used in making credit decisions.</text></paragraph></subsection><subsection id="H6747F380299045BE905C62089C0E09D8"><enum>(b)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than 18 months after the date of the enactment of this section, the Bureau of Consumer Financial Protection shall issue a report to the Committee on Financial Services of the House of Representatives and the Committee on Banking, Housing, and Urban Affairs of the Senate containing all findings and determinations, including any recommendations for any legislative or regulatory changes, made in carrying out the study required under subsection (a).</text></subsection><subsection id="H40901648689B4FDB9520A09351ED2C1C"><enum>(c)</enum><header>Definitions</header><text display-inline="yes-display-inline">For the purposes of this section, the terms <term>consumer reporting agency</term> and <term>consumer report</term> shall have the meanings given the terms in section 603 of the Fair Credit Reporting Act.</text></subsection></section></legis-body></bill>
