Maloney of New York</sponsor> (for herself, <cosponsor name-id="N000002">Mr. Nadler</cosponsor>, and <cosponsor name-id="V000081">Ms. Velázquez</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HPW00">Committee on Transportation and Infrastructure</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title 49, United States Code, to prohibit certain helicopter flights over major cities with high population densities, and for other purposes.</official-title></form><legis-body id="H910C4C87CDB247A6B0172454D659A8D0" style="OLC"><section id="HBEA3B092B0EF406FAAA9ED6D13DA7F75" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Improving Helicopter Safety Act of 2021</short-title></quote>.</text></section><section id="HE9C8EBB242AA4F818AE3DA684B6188B8" section-type="subsequent-section"><enum>2.</enum><header>Prohibition on certain flights over major cities</header><subsection id="H69726DF1DC0F4A42AA198E3429FD3C46"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/447">Chapter 447</external-xref> of title 49, United States Code, is amended by adding at the end the following:</text><quoted-block style="USC" id="H93AE9254CDA345DB940DF25EF12E4B42" display-inline="no-display-inline"><section id="H526F564804744476965D33C333F81111"><enum>44741.</enum><header>Prohibition on certain flights over major cities</header><subsection id="H829C74B9BA0A4072982D982DC93541A9"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 60 days after the date of enactment of this section, no person may operate a civil rotorcraft in covered airspace except as provided for under subsection (b).</text></subsection><subsection id="H95855E95A9434EE58C7AA36C1091314C"><enum>(b)</enum><header>Exceptions</header><paragraph id="H5161D6C406024445BFB0B9F46E362C5B"><enum>(1)</enum><header>Public health and safety</header><text>The prohibition in subsection (a) shall not apply to a flight carried out for purposes of public health and safety, including—</text><subparagraph id="HDD35169F2FB44379875350F42DC52E4E"><enum>(A)</enum><text display-inline="yes-display-inline">law enforcement;</text></subparagraph><subparagraph id="H21D107E49F204DDD88615663668B45C0"><enum>(B)</enum><text>emergency response;</text></subparagraph><subparagraph id="HD0799C7BF8C543FBA22F6A2A5A8209EF"><enum>(C)</enum><text>disaster response;</text></subparagraph><subparagraph id="H4E2913A36176459E94DC6EED54D19F76"><enum>(D)</enum><text>the provision of medical services; and</text></subparagraph><subparagraph id="H52D394AF219F470BA33E75BA7E8F1A7C"><enum>(E)</enum><text>providing other services for the benefit of the general public, including flights carried out for research or for official purposes by a news organization.</text></subparagraph></paragraph><paragraph id="H08B6660758AC4B61AB5CE7BF7A5E417B"><enum>(2)</enum><header>Infrastructure maintenance</header><text display-inline="yes-display-inline">The prohibition in subsection (a) shall not apply to a flight carried out for purposes heavy-lift operations in support of construction and infrastructure maintenance.</text></paragraph></subsection><subsection id="H034E371D39854CE29B2E2986BC7D5660"><enum>(c)</enum><header>Covered airspace defined</header><text display-inline="yes-display-inline">In this section, the term <quote>covered airspace</quote> means the airspace directly over any city with a population over 8 million people and with a population density of over 25,000 people per square mile, including the airspace over any waterways considered within the limits of such city.</text></subsection></section><after-quoted-block>. </after-quoted-block></quoted-block></subsection><subsection id="H2349AC8C195A4E9C89C426EEBDA30FC4"><enum>(b)</enum><header>Conforming amendment</header><text>The table of sections for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/447">chapter 447</external-xref> of title 49, United States Code, is amended by adding at the end the following:</text><quoted-block style="USC" id="HEE42567B2C4E4CAC8DAFB11967470A72" display-inline="no-display-inline"><toc regeneration="no-regeneration"><toc-entry level="section">44741. Prohibition on certain flights over major cities.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="HBE6783BCE93C4A4B8E05883048AD7332"><enum>3.</enum><header>Helicopter flight routes for major cities and surrounding areas</header><text display-inline="no-display-inline">Not later than 90 days after a city initially meets the requirements to be covered by the prohibition in section 44741 of title 49, United States Code (as added by section 2), the Administrator of the Federal Aviation Administration shall issue or update such regulations as are necessary to carry out the requirements of such section.</text></section><section id="HF2F6180CB9074397872291671AD0033D"><enum>4.</enum><header>Technical corrections</header><subsection id="H6DEB10F32FEF44D3BE34AAEB68AEE5BF"><enum>(a)</enum><header>Section 44737</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/447">Chapter 447</external-xref> of title 49, United States Code, is amending by redesignating the second section 44737 (as added by section 581 of the FAA Reauthorization Act of 2018) as section 44740.</text></subsection><subsection id="H484CA68ADAF14DA3958F79A7E5379EAC"><enum>(b)</enum><header>Analysis</header><text display-inline="yes-display-inline">The analysis for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/447">chapter 447</external-xref> of title 49, United States Code, is amended—</text><paragraph id="H198F7B304C1E416684DBE47A8BA9D500"><enum>(1)</enum><text display-inline="yes-display-inline">by striking the item relating to the second section 44737 (as added by section 581 of the FAA Reauthorization Act of 2018); and</text></paragraph><paragraph id="H0B36E1D76F974B19AB4AC27E4B2A39C0"><enum>(2)</enum><text>by inserting after the item relating to section 44739 the following new item:</text><quoted-block style="USC" id="HE7DEAA4B69D142F99FF7DB3D070569C0" display-inline="no-display-inline"><toc regeneration="no-regeneration"><toc-entry level="section">44740. Special rule for certain aircraft operations.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H86EC4BF64EF545BDAB9A8BC95E9012B1"><enum>(c)</enum><header>Special rule for certain aircraft operations</header><text display-inline="yes-display-inline">Section 44740 of title 49, United States Code, (as redesignated by subsection (a)) is amended—</text><paragraph id="H0966DAD61977405EBFEDE8705892A9F3"><enum>(1)</enum><text>in the heading, by striking the period at the end;</text></paragraph><paragraph id="H71E817DA1155469A814DD6D1681851B8"><enum>(2)</enum><text>in subsection (b)(1), by striking <quote>(1)</quote> the second time it appears; and </text></paragraph><paragraph id="H79C2C2F8A05B413A88A46DA3CE01950E"><enum>(3)</enum><text>in subsection (c)(2), by adding a period at the end.</text></paragraph></subsection></section></legis-body></bill>
