R. 1641</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20210308">March 8, 2021</action-date><action-desc><sponsor name-id="L000562">Mr. Lynch</sponsor> (for himself and <cosponsor name-id="B001306">Mr. Balderson</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HPW00">Committee on Transportation and Infrastructure</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title 23, United States Code, to include a payment and performance security requirement for certain infrastructure financing, and for other purposes.</official-title></form><legis-body id="H29891D70E83A44B9ACDC651F58F16C86" style="OLC"><section id="HA2D00B4923ED4C73B58B3538A2BF349C" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Promoting Infrastructure by Protecting Our Subcontractors and Taxpayers Act</short-title></quote>.</text></section><section id="H6325D20766734EF2AE5B05BE5CACA69A"><enum>2.</enum><header>Federal requirements for TIFIA eligibility and project selection</header><subsection id="HF2F7974E9D0346CE8B41FED38F4F55C1"><enum>(a)</enum><header>In general</header><text>Section 602(c) of title 23, United States Code, is amended by adding at the end the following:</text><quoted-block id="H95EC3C584C4B483FB932527109EF30C0" style="OLC"><paragraph id="H9F8FF0CF73A34D91982E234B223D3F6D"><enum>(3)</enum><header>Payment and performance security</header><subparagraph id="H9BB0F7A0AA814325979CB9A53F0CD11E"><enum>(A)</enum><header>In general</header><text>The Secretary shall ensure that the design and construction of a project carried out with assistance under the TIFIA program shall have appropriate payment and performance security, regardless of whether the obligor is a State, local government, agency or instrumentality of a State or local government, public authority, or private party.</text></subparagraph><subparagraph id="HA2E8010A7B0E48C9841EBCD72887A548"><enum>(B)</enum><header>Written determination</header><text>If payment and performance security is required to be furnished by applicable statute or regulation, the Secretary may accept such payment and performance security requirements applicable to the obligor if the Secretary has made a written determination that the Federal interest with respect to Federal funds and other project risk related to design and construction is adequately protected.</text></subparagraph><subparagraph id="HBC067775C7AC4E37AB9FD5AF80662E2F"><enum>(C)</enum><header>No determination or applicable requirements</header><text>If a determination under this paragraph has not been made or there are no payment and performance security requirements applicable to the obligor, the security under section 3131(b) of title 40 shall be required.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HF1AE94CBBAE44545B72FD41DCC84E480"><enum>(b)</enum><header>Applicability</header><text>The amendments made by this Act shall apply with respect to any contract entered into on or after the date of enactment of this Act.</text></subsection></section></legis-body></bill>
