R. 162</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20210104">January 4, 2021</action-date><action-desc><sponsor name-id="S001200">Mr. Soto</sponsor> introduced the following bill; which was referred to the <committee-name committee-id="HBA00">Committee on Financial Services</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the CARES Act to provide for repayment terms for mortgages in forbearance, and for other purposes.</official-title></form><legis-body id="H314C93956412411F95DB6758E316A799" style="OLC"><section id="HF6D6B8E4AA264828B59741DF796B6EA8" section-type="section-one"><enum>1.</enum><header>Repayment terms for mortgages in forbearance</header><subsection id="HB7BA0CCE9354484280EFFB469FC6639F"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The CARES Act (<external-xref legal-doc="public-law" parsable-cite="pl/116/136">Public Law 116–136</external-xref>) is amended by inserting after section 4022 the following:</text><quoted-block style="OLC" id="H36C0E39F7D5C43178461BF480E484CFF" display-inline="no-display-inline"><section id="HFE098E7D31E94D74AF19D2AB26D7E53D"><enum>4022A.</enum><header>Repayment terms for mortgages in forbearance</header><subsection id="H9AF369BAE0634B53BABDECC49CDAA49A"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">With respect to a federally related mortgage loan with respect to which a forbearance was granted during the COVID–19 emergency period (either pursuant to this Act or any other Federal law or voluntarily by the servicer of such mortgage loan), the servicer of such mortgage loan shall modify the borrower’s loan to extend the term for the same period as the length of the forbearance, with all payments that were not made during the forbearance distributed at the same intervals as the borrower’s existing payment schedule and evenly distributed across those intervals, with no penalties, late fees, additional interest accrued beyond the amounts scheduled or calculated as if the borrower made all contractual payments on time and in full under the terms of the mortgage contract in effect at the time the borrower entered into the forbearance, and with no modification fee charged to the borrower.</text></subsection><subsection id="HC08AD95EF05B4E8A98BEF93EDBEE1E5A"><enum>(b)</enum><header>Enforcement</header><text display-inline="yes-display-inline">The enforcement authority provided under the Real Estate Settlement Procedures Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/12/2601">12 U.S.C. 2601</external-xref> et seq.) shall apply to this section.</text></subsection><subsection id="HDD05C13459474FD59F1F154BA23A3210"><enum>(c)</enum><header>Definitions</header><text>In this section:</text><paragraph id="H6096421A6DE74A1D8AD55537D5CADA2A"><enum>(1)</enum><header>Federally related mortgage loan</header><text display-inline="yes-display-inline">The term <term>federally related mortgage loan</term> has the meaning given that term under section 3 of the Real Estate Settlement Procedures Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/12/2602">12 U.S.C. 2602</external-xref>).</text></paragraph><paragraph id="H934139568AB84DD1BB84088BADB07311" display-inline="no-display-inline"><enum>(2)</enum><header>Covid–19 emergency period</header><text display-inline="yes-display-inline">The term <term>COVID–19 emergency period</term> means the period between—</text><subparagraph id="H2C1762C657424B3BB675E9781B2A7C12"><enum>(A)</enum><text>March 13, 2020, the date on which the President declared a national emergency concerning the novel coronavirus disease (COVID–19) outbreak under the National Emergencies Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1601">50 U.S.C. 1601</external-xref> et seq.); and</text></subparagraph><subparagraph id="H5B2073C1E11F45B3BE2F6618AE83561F"><enum>(B)</enum><text>December 31, 2021.</text></subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H02CF3895A8CC43999009CAA06B92300F"><enum>(b)</enum><header>Clerical amendment</header><text>The table of contents for the CARES Act is amended by inserting after the item relating to section 4022 the following:</text><quoted-block style="OLC" id="HB350C3320CB74A6892205210F7A2CAC9" display-inline="no-display-inline"><toc regeneration="no-regeneration"><toc-entry level="section">Sec. 4022A.
