R. 1622</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20210308">March 8, 2021</action-date><action-desc><sponsor name-id="C001068">Mr. Cohen</sponsor> (for himself, <cosponsor name-id="D000623">Mr. DeSaulnier</cosponsor>, <cosponsor name-id="H000324">Mr. Hastings</cosponsor>, <cosponsor name-id="C001072">Mr. Carson</cosponsor>, <cosponsor name-id="P000604">Mr. Payne</cosponsor>, <cosponsor name-id="S001145">Ms. Schakowsky</cosponsor>, <cosponsor name-id="T000468">Ms. Titus</cosponsor>, <cosponsor name-id="M001160">Ms. Moore of Wisconsin</cosponsor>, <cosponsor name-id="G000586">Mr. García of Illinois</cosponsor>, <cosponsor name-id="G000559">Mr. Garamendi</cosponsor>, <cosponsor name-id="E000297">Mr. Espaillat</cosponsor>, <cosponsor name-id="P000523">Mr. Price of North Carolina</cosponsor>, <cosponsor name-id="R000576">Mr. Ruppersberger</cosponsor>, <cosponsor name-id="C001112">Mr. Carbajal</cosponsor>, <cosponsor name-id="P000597">Ms. Pingree</cosponsor>, <cosponsor name-id="K000375">Mr. Keating</cosponsor>, <cosponsor name-id="W000822">Mrs. Watson Coleman</cosponsor>, <cosponsor name-id="P000617">Ms. Pressley</cosponsor>, <cosponsor name-id="M001188">Ms. Meng</cosponsor>, <cosponsor name-id="K000380">Mr. Kildee</cosponsor>, <cosponsor name-id="M001137">Mr. Meeks</cosponsor>, <cosponsor name-id="C001080">Ms. Chu</cosponsor>, and <cosponsor name-id="N000002">Mr. Nadler</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HPW00">Committee on Transportation and Infrastructure</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To reduce the number of preventable deaths and injuries caused by underride crashes, to improve motor carrier and passenger motor vehicle safety, and for other purposes.</official-title></form><legis-body id="H8F2775D276F44BBA9E7F892F8C898BE4" style="OLC"><section section-type="section-one" id="H25A911ABBCA5400F9862434CC6F4712E"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Stop Underrides Act</short-title></quote>.</text></section><section section-type="subsequent-section" id="HCA9065743F344ADC9B8AC5D9B88B7F47"><enum>2.</enum><header>Findings and purposes</header><subsection id="HF23C27DB84F948FCA3DD41F06C8FDE8B"><enum>(a)</enum><header>Findings</header><text display-inline="yes-display-inline">Congress finds that—</text><paragraph id="H57787F9F028042638154B557BA34421E"><enum>(1)</enum><text>underride crashes involving passenger motor vehicles striking and traveling underneath a truck or trailer are a significant public health and safety threat;</text></paragraph><paragraph id="HB50D8FC62C0B4030A9C2BB3EC84C0C28"><enum>(2)</enum><text>the National Highway Traffic Safety Administration has reported that hundreds of preventable fatalities and life-threatening injuries have occurred as a result of underride crashes;</text></paragraph><paragraph id="HE43D958DB5494E79A657ADE0DED4E712"><enum>(3)</enum><text>the National Transportation Safety Board has recommended the installation of rear, side, and front underride guards on tractor-trailers and rear and side underride guards on single unit trucks to improve passenger motor vehicle safety; and</text></paragraph><paragraph commented="no" id="H5D50C09D7FAE4E17887357D8C1EEBE62"><enum>(4)</enum><text>this Act is introduced in the memory of the thousands of victims of underride crashes, including—</text><subparagraph commented="no" id="H35FFFC26D4524C199BE65A80B3DE666E"><enum>(A)</enum><text>Roya Christine Sadigh, AnnaLeah Karth, Mary Lydia Karth, Roderick Cota, Moonjohn Kim, Corey Moore, Gregg Williams, Guy Champ Crawford, Carl Hall, Michael Higginbotham, Sandra Maddamma, David Mathis, Mary Katherine Mathis, James Mooney, Christopher Weigl, Bill Zink, David Magnan, Jasen Swift, Samuel Sierra, Brittany McHargue, Christopher Samuel Padilla, Riley Hein, Erin Alexander, Jordan Hensley, Edward Hall, Leslie Rosenberg, Sophie Rosenberg, and Ally Davis;</text></subparagraph><subparagraph commented="no" id="HE805CA971D68426AB3564D1EE5FF11C7"><enum>(B)</enum><text>those whose catastrophic injuries dramatically changed their lives, including Julie Magnan, Nancy Meuleners, Joshua Rojas, Maiv Yang, Anita Plantage Bomgaars, and Michael B. Hawkins; and</text></subparagraph><subparagraph commented="no" id="HE30A38EE4D6B492BA06C2414442232B7"><enum>(C)</enum><text>those whose precious lives were cut far too short as a result of preventable underride crashes.</text></subparagraph></paragraph></subsection><subsection id="H10D5761915164A9281ACB501FD8F1D0B"><enum>(b)</enum><header>Purposes</header><text>The purposes of this Act are—</text><paragraph id="H52B63F243D4C485CBE3D8D0375EF2F9C"><enum>(1)</enum><text>to reduce the number of preventable deaths and injuries caused by underride crashes; and</text></paragraph><paragraph id="HA3F29D8F7DE4444F965EB69A90BF36F4"><enum>(2)</enum><text>to improve motor carrier and passenger motor vehicle safety.</text></paragraph></subsection></section><section id="H1509DA2310244E6AA1241EE9CC92E052"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">Section 30102(a) of title 49, United States Code, is amended—</text><paragraph id="H0D18CDC95E4E403086619AB500650838"><enum>(1)</enum><text>in the matter preceding paragraph (1), by striking <quote>chapter—</quote> and inserting <quote>chapter:</quote>;</text></paragraph><paragraph id="H8F41832CCBF642C68DA557821C46B9E0"><enum>(2)</enum><text>by redesignating paragraphs (1), (2), (3), (4), (5), (6), (7), (8), (9), (10), (11), (12), and (13) as paragraphs (2), (3), (4), (5), (7), (8), (9), (10), (11), (12), (15), (20), and (22), respectively;</text></paragraph><paragraph id="H1DA96CB601D64D4E893D137E73374CEB"><enum>(3)</enum><text>by inserting before paragraph (2) (as so redesignated) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HF177AA72745A4705A37333904A728603"><paragraph id="HB23A2A59EF2C44D98C1DADAF46079111"><enum>(1)</enum><text><term>comprehensive underride protection system</term> means all of the front underride guards, rear underride guards, or side underride guards, as applicable, installed on a motor vehicle.</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="HE9ED05409CAA41A58CD44C26649B0704"><enum>(4)</enum><text>by inserting after paragraph (5) (as so redesignated) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HE0F0C8736F0540D890AF4D33D79C0461"><paragraph id="H2CE6588261984D86B1C5D44D0C65AC1A"><enum>(6)</enum><text><term>front underride guard</term> means a device installed on or near the front of a motor vehicle that prevents or limits the distance that a vehicle struck by the vehicle with the device will slide under the front of the striking vehicle.</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="H4C8C02C74EEF4A8BA2B2D5D46B817829"><enum>(5)</enum><text>by inserting after paragraph (12) (as so redesignated) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H2E55A3095DE341A081D14845714F44FD"><paragraph id="H69AD92A9396547A38D253F20AC4EBFD1"><enum>(13)</enum><text><term>passenger motor vehicle</term> has the meaning given that term in section 32101.</text></paragraph><paragraph id="HE5523AA94B7647EDBC409FA0CF7ED26E"><enum>(14)</enum><text><term>rear underride guard</term> means a device installed on or near the rear of a motor vehicle that prevents or limits the distance that the front end of a vehicle striking the rear of the vehicle with the device will slide under the rear of the impacted vehicle.</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="H9E5458BAA39D449B9D9EEA95A32211EB"><enum>(6)</enum><text>by inserting after paragraph (15) (as so redesignated) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H8608DEEA3B614F6097D1A7E1727FB29D"><paragraph id="H6B1A5EA9034B435289BD80F1763D0E0C"><enum>(16)</enum><text><term>Secretary</term> means the Secretary of Transportation.</text></paragraph><paragraph id="HA7245C448226429DB3716A4D372B63D9"><enum>(17)</enum><text><term>semi-trailer</term> means a trailer, other than a pole trailer, which is designed to rest upon, or be carried by, a motor vehicle.</text></paragraph><paragraph id="H65AD14F0597E491FAA9B93BD8838BACC"><enum>(18)</enum><text><term>side underride guard</term> means a device installed on or near the side of a motor vehicle that prevents or limits the distance that the front end of a vehicle striking the side of the vehicle with the device will slide under the side of the impacted vehicle.</text></paragraph><paragraph id="H2DFEE066218B4754B496F67E62FDB097"><enum>(19)</enum><text><term>single unit truck</term> means a truck (excluding any attached trailer).</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="HEF6A43B4B13F4575ADFE6EAFAEAAEC14"><enum>(7)</enum><text>by inserting after paragraph (20) (as so redesignated) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HFE925A16ED514D8FB6F1596A41760F78"><paragraph id="H33EE422497304C83AF6FB34AC7273DBF"><enum>(21)</enum><text><term>trailer</term> means a vehicle, with or without motive power, that is designed—</text><subparagraph id="HF19663F92876452787A93E28FD7273D1"><enum>(A)</enum><text>to carry persons or property; and</text></subparagraph><subparagraph id="H0CCF952A5EFC4F838980B790391B62E5"><enum>(B)</enum><text>to be drawn by a motor vehicle.</text></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="H9CDBFA1EC3BF4CEDB296D5A53F899AF1"><enum>(8)</enum><text>by inserting <quote>The term</quote> after the paragraph designation in each of paragraphs (1) through (22) (as so redesignated); and</text></paragraph><paragraph id="HD457A8A06F06408DB58EAF82786CB088"><enum>(9)</enum><text>in each of paragraphs (1) through (22) (as so redesignated), by inserting a paragraph heading, the text of which is comprised of the term defined in the paragraph.</text></paragraph></section><section id="HFFAD809A0BB94131B06D6C3E7BACB3BE"><enum>4.</enum><header>Underride guard rulemaking</header><subsection id="HD65F712DAB4D4D679BE04421FA15F120"><enum>(a)</enum><header>In general</header><text>Subchapter II of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/301">chapter 301</external-xref> of title 49, United States Code, is amended by adding at the end the following:</text><quoted-block style="USC" display-inline="no-display-inline" id="HA69A056077AF4FBAA1C8817C9159E136"><section id="H2DC923875EEC4EE2B5E5B5A3DDD5330D"><enum>30129.</enum><header>Underride guards</header><subsection id="H886EE2C8457344C1B4A63EF628B0E926"><enum>(a)</enum><header>Rear underride guards</header><paragraph id="H437255D0C42544B5B206946A561FDB65"><enum>(1)</enum><header>In general</header><text>Not later than 1 year after the date of enactment of this section, the Secretary shall issue a final rule to require the installation of rear underride guards that meet the performance standards described in paragraph (2) on—</text><subparagraph id="HDCA83206187D462EAA1214E225C04CFF"><enum>(A)</enum><text>any trailer with a gross vehicle weight rating of 10,000 pounds or more that is manufactured on or after the effective date of the rule;</text></subparagraph><subparagraph id="H1DEC4019B747486A962728F3A44EFFD9"><enum>(B)</enum><text>any semi-trailer with a gross vehicle weight rating of 10,000 pounds or more that is manufactured on or after the effective date of the rule; and</text></subparagraph><subparagraph id="H76FC11646BED46B59D3BC72D68E4307F"><enum>(C)</enum><text>any single unit truck—</text><clause id="H603AFBFF5F48402293702635F0B37713"><enum>(i)</enum><text>the bottom of the carriage of which is greater than 22 inches above the ground;</text></clause><clause commented="no" id="H5197681984A44004B558EFD2E173180F"><enum>(ii)</enum><text>with a gross vehicle weight rating of 10,000 pounds or more; and</text></clause><clause id="H4849DC91B9314305A5027413E72EDFDC"><enum>(iii)</enum><text>that is manufactured on or after the effective date of the rule.</text></clause></subparagraph></paragraph><paragraph id="H72DA774F2BB84B4B92FD0E8CB3698C1C"><enum>(2)</enum><header>Performance standards</header><text>A rear underride guard shall be considered to meet the performance standard referred to in paragraph (1) if the rear underride guard is able to prevent intrusion from the body or frame of a vehicle described in that paragraph into the passenger compartment of a passenger motor vehicle that contacts the guard while traveling at 35 miles per hour, as verified through crash testing while attached to a trailer, after—</text><subparagraph id="H749AAB27220E49FE9555D63007075400"><enum>(A)</enum><text>an impact in which the passenger vehicle impacts the center of the rear of the trailer, semi-trailer, or single unit truck;</text></subparagraph><subparagraph id="H3D741032A2214E03B660A00C93E0ED73"><enum>(B)</enum><text>an impact in which 50 percent of the width of the passenger vehicle overlaps the rear of the trailer, semi-trailer, or single unit truck; and</text></subparagraph><subparagraph id="HA2DC445A4F894F97AA25DC54C9C23D06"><enum>(C)</enum><text>an impact in which 30 percent of the width of the passenger vehicle overlaps the rear of the trailer, semi-trailer, or single unit truck.</text></subparagraph></paragraph><paragraph id="H20E0C46314754C1DAC5C66E08AD18EA8"><enum>(3)</enum><header>Compliance date</header><text>Compliance with the rule issued by the Secretary under paragraph (1) shall be required beginning 1 year after the date on which the final rule is published in the Federal Register.</text></paragraph></subsection><subsection id="HAB59D71D62484022AF61A0D8D651A3F9"><enum>(b)</enum><header>Side underride guards</header><paragraph id="HA5BB9C5340624AD088BFCF9B0323DCB5"><enum>(1)</enum><header>In general</header><text>Not later than 1 year after the date of enactment of this section, the Secretary shall issue a final rule requiring the installation of side underride guards that meet the performance standards described in paragraph (2) on—</text><subparagraph id="HEBEA736572DF46B9BD09885E6FF3D0C4"><enum>(A)</enum><text>any trailer with a gross vehicle weight rating of 10,000 pounds or more that is manufactured on or after the effective date of the rule;</text></subparagraph><subparagraph id="H797B306D1379449299F35083967C5DB0"><enum>(B)</enum><text>any semi-trailer with a gross vehicle weight rating of 10,000 pounds or more that is manufactured on or after the effective date of the rule; and</text></subparagraph><subparagraph id="HC94E75489F5741A684802A3CB3B499C8"><enum>(C)</enum><text>any single unit truck—</text><clause id="H01C7EC85383948EEA9D998FDEC14245D"><enum>(i)</enum><text>the bottom of the carriage of which is greater than 22 inches above the ground;</text></clause><clause id="HE5BB0FFC5C1E45429C3E91C7902B268C"><enum>(ii)</enum><text>with a gross vehicle weight rating of 10,000 pounds or more; and</text></clause><clause id="HB9B38C07684346578712802DE6353A8B"><enum>(iii)</enum><text>that is manufactured on or after the effective date of the rule.</text></clause></subparagraph></paragraph><paragraph id="HC30E3747FA8C42828F14D622B15D43E5"><enum>(2)</enum><header>Performance standards</header><text>A side underride guard shall be considered to meet the performance standards referred to in paragraph (1) if the side underride guard is able to prevent intrusion from the body or frame of a vehicle described in that paragraph into the passenger compartment of a passenger motor vehicle that contacts the guard while traveling 35 miles per hour at any angle between 10 degrees and 90 degrees.</text></paragraph><paragraph id="H62B7ABEBC8834599BB29598D7742524E"><enum>(3)</enum><header>Compliance date</header><text>Compliance with the rule issued by the Secretary under paragraph (1) shall be required beginning on the date that is 1 year after the date on which the final rule is published in the Federal Register.</text></paragraph></subsection><subsection id="H7CEE78F0102347AFA906E7A0E33F98C8"><enum>(c)</enum><header>Front underride guards</header><paragraph id="H1D49BC9790724A399DFF4ADC4F414A95"><enum>(1)</enum><header>In general</header><text>Not later than 2 years after the date of enactment of this section, the Secretary shall issue a final rule requiring the installation of front underride guards on—</text><subparagraph id="H4FB66FBF56404B65AA2DCB722C254D47"><enum>(A)</enum><text>any semi-truck with a gross vehicle weight rating of 10,000 pounds or more that is manufactured on or after the effective date of the rule; and</text></subparagraph><subparagraph id="HA69F1FBA8A8540E2BF2CC2B8319F170A"><enum>(B)</enum><text>any single unit truck—</text><clause id="H47C88D77B31F4CA68078F3E02CB3AC97"><enum>(i)</enum><text>the bottom of the carriage of which is greater than 22 inches above the ground;</text></clause><clause id="H8911041D6BF147D0BFBDBB51E17E3CAB"><enum>(ii)</enum><text>with a gross vehicle weight rating of 10,000 pounds or more; and</text></clause><clause id="H7761B486DA6B4990B901F315C2D3F4AF"><enum>(iii)</enum><text>that is manufactured on or after the effective date of the rule.</text></clause></subparagraph></paragraph><paragraph id="HA1EC43FABA75451DA25B00F53480E6F0"><enum>(2)</enum><header>Compliance date</header><text>Compliance with the rule issued by the Secretary under paragraph (1) shall be required beginning on the date that is 1 year after the date on which the final rule is published in the Federal Register.</text></paragraph><paragraph id="H9AA8D5AC18EE474D904D35AD045A06B8"><enum>(3)</enum><header>Report</header><text>Not later than 1 year after the date of enactment of this section, the Secretary shall—</text><subparagraph id="H2A66B11D8EC64DE5999697D0B5874C4F"><enum>(A)</enum><text>complete research on equipping the vehicles described in paragraph (1) with a front underride guard to prevent trucks from overriding the passenger vehicle; and</text></subparagraph><subparagraph id="H8F6E3DD374924A158A4E126F3F9C70C8"><enum>(B)</enum><text>submit to the Committee on Commerce, Science, and Transportation of the Senate and the Committees on Transportation and Infrastructure and Energy and Commerce of the House of Representatives a report on the research described in subparagraph (A).</text></subparagraph></paragraph></subsection><subsection id="H9F52ED6E22544C88BFE9F25D84E3F713"><enum>(d)</enum><header>Inspection and repair requirements</header><paragraph id="H968CDB0813FE47F6AFCD7C5375958FAD"><enum>(1)</enum><header>Post-accident inspections</header><text>To ensure that all trailers, semi-trailers, and single unit trucks are maintained in safe and proper operating condition at all times, the Secretary shall require that any trailer, semi-trailer, or single unit truck involved in an accident (as defined in section 390.5 of title 49, Code of Federal Regulations (or a successor regulation)) undergo and pass an inspection described in appendix G to subchapter B of chapter III of title 49, Code of Federal Regulations (or successor regulations), to certify that all components of the trailer, semi-trailer, or single unit truck, as applicable, are in safe and proper operating condition.</text></paragraph><paragraph id="HA8058A9D7F9A4072B79B693160D286F1"><enum>(2)</enum><header>Pre-trip inspections</header><text>The Secretary shall require drivers—</text><subparagraph id="H115AAF22BE044E1A9288ACEB2AB15EE1"><enum>(A)</enum><text>to conduct a pre-trip inspection of the comprehensive underride protection system required under this section on their trailer, semi-trailer, or single unit truck—</text><clause id="HEE12E1EED9B24D0382370217126E347A"><enum>(i)</enum><text>to identify—</text><subclause id="H2B06B201D3BE4AC09BA890BDF73A19DD"><enum>(I)</enum><text>any metal perforated by rust or corrosion that compromises structural integrity;</text></subclause><subclause id="HCD9B6A76012B4245AE98593A7F81241D"><enum>(II)</enum><text>cracked welds;</text></subclause><subclause id="HD2DC1C7BC2524538B221F43EA9BFD76F"><enum>(III)</enum><text>cracked or fractured vertical members;</text></subclause><subclause id="HBD199490912B4C25A9C78974E93B9334"><enum>(IV)</enum><text>cuts and tears in any underride guard; and</text></subclause><subclause id="H2A7902916F054D4E8D65EE93DE9F41A3"><enum>(V)</enum><text>missing fasteners and loose fasteners; and</text></subclause></clause><clause id="H163C01E15F8341F4B41624E8EA38739C"><enum>(ii)</enum><text>to ensure the dimensional integrity of those guards;</text></clause></subparagraph><subparagraph id="H785B84224C6348B8A6011D5D63CAEF8B"><enum>(B)</enum><text>to include the results of the inspection described in subparagraph (A) in the driver vehicle inspection report; and</text></subparagraph><subparagraph id="H53714E9AF151407DBCF65BAE85236E75"><enum>(C)</enum><text>to complete any necessary repairs to, or replacement of, the underride protection system before the vehicle is operated.</text></subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H0FF4A80291404F5393EC54FDE9674943"><enum>(b)</enum><header>Clerical amendment</header><text>The chapter analysis for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/301">chapter 301</external-xref> of title 49, United States Code, is amended by striking the item relating to section 30128 and inserting the following:</text><quoted-block style="USC" id="HCA111AEF6C9040079D34B497F9073C55"><toc><toc-entry bold="off" level="section">30128. Vehicle rollover prevention and crash mitigation. </toc-entry><toc-entry bold="off" level="section">30129. Underride guards.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H53D96F3FC8614170ADADF831DE3F5A1B"><enum>(c)</enum><header>Rulemakings</header><text>The Secretary of Transportation shall amend—</text><paragraph id="H1102805B9967424E8F91BD9D773E80C7"><enum>(1)</enum><text>sections 396.11 and 396.13 of title 49, Code of Federal Regulations, in accordance with section 30129(d)(2) of title 49, United States Code (as added by subsection (a));</text></paragraph><paragraph id="HA640CD3666164171B2CC583291289799"><enum>(2)</enum><text>section 396.17 of title 49, Code of Federal Regulations, to include a requirement that motor carriers and intermodal equipment providers include an inspection of the comprehensive underride protection system (as defined in section 30102(a) of title 49, United States Code) of the commercial motor vehicle in a periodic inspection required under section 396.17 of title 49, Code of Federal Regulations;</text></paragraph><paragraph id="H500245A5F93A40A39D062F6422C34363"><enum>(3)</enum><text>section 392.7 of title 49, Code of Federal Regulations, to include the comprehensive underride protection system (as defined in section 30102(a) of title 49, United States Code) in the list of parts and accessories and components required to be in good working order under each of subsections (a) and (b) of section 392.7 of title 49, Code of Federal Regulations; and</text></paragraph><paragraph id="HEAA8BEBB3D434613A2CD7AB14EDCD550"><enum>(4)</enum><text>appendix G to subchapter B of chapter III of title 49, Code of Federal Regulations—</text><subparagraph id="H0C5D948345C546938D9721BE8C15553A"><enum>(A)</enum><text>by redesignating paragraphs 6 (relating to safe loading) through 14 (relating to motorcoach seats) as paragraphs 7 through 15, respectively; and</text></subparagraph><subparagraph id="H89F4CA2337F24B1291A7CC2F8AF41F84"><enum>(B)</enum><text>by inserting after paragraph 5 (relating to lighting devices) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H43216983F67B4D4FBFB6AC3720CD6E7A"><paragraph id="H23F4A8ADE7D645DF80FA83C218C6D886"><enum>6.</enum><header>Rear impact guards and rear end protection</header><text>Any trailer or semitrailer required under section 393.86 to be equipped with a rear impact guard or rear end protection—</text><subparagraph id="HB34ECE0D27CF46FD918629F5FA9E716E"><enum>(A)</enum><text>that does not meet the requirements under section 393.86;</text></subparagraph><subparagraph id="HDBECB0A4B153457AA3ED037CF7F656B2"><enum>(B)</enum><text>that—</text><clause id="H0E3E1A2874BE408E825DC4350A370843"><enum>(i)</enum><text>is missing; or</text></clause><clause id="H04EB78F7F75D4045B636AC15E4A5F525"><enum>(ii)</enum><text>has—</text><subclause id="HF9590A34A1F64C078A8BE15607D7B627"><enum>(I)</enum><text>any metal perforated by rust or corrosion that compromises structural integrity;</text></subclause><subclause id="HB6C901769EEF4A32BE26F799F215AB3F"><enum>(II)</enum><text>a cracked weld;</text></subclause><subclause id="HC10C94C8CC6D48109131E8AAF2151D02"><enum>(III)</enum><text>a cracked or fractured vertical member;</text></subclause><subclause id="H1F8590DEB09047DBB3779878A65CEF96"><enum>(IV)</enum><text>a cut or tear in any underride guard component; or</text></subclause><subclause id="HED0888BC03CE4BA298F608DF6B5C7695"><enum>(V)</enum><text>a missing fastener or a loose fastener; or</text></subclause></clause></subparagraph><subparagraph id="HB5E5127707834CD7A13BDDAB5F1139C5"><enum>(C)</enum><text>for which the dimensional integrity of the guard or protection is compromised.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection></section><section id="HFA04A9BA2097441D8C8333985DB16A5B"><enum>5.</enum><header>Research and periodic review of underride guard standards</header><subsection id="H7E17FD1D94BB4F7DA344C52F384D60A5"><enum>(a)</enum><header>Request for Proposals</header><text>As soon as practicable, the Secretary of Transportation (referred to in this section as the <term>Secretary</term>) shall issue a Request for Proposals for the design of 2 high-capacity rear underride barrier prototypes of a generic guard (with energy absorption and without energy absorption) to prevent underride crashes and protect motor vehicle passengers against severe injury at crash speeds of up to 65 miles per hour.</text></subsection><subsection id="HDCEEC8FB441F4AA68BBD643BA786E57C"><enum>(b)</enum><header>Evaluation</header><text>The Secretary shall—</text><paragraph id="H7FDCE91D30084079B5DFB8CAC67C9350"><enum>(1)</enum><text>evaluate the proposals received in response to the Request for Proposals issued pursuant to subsection (a); and</text></paragraph><paragraph id="HD98D100B47AC4877950533402351DCD9"><enum>(2)</enum><text>update the underride guard standards under section 30129 of title 49, United States Code (as added by section 4(a)), as appropriate, to provide the best underride protection that is technologically feasible.</text></paragraph></subsection><subsection id="H07D597D07D1A4D199414A6FF0570C7CD"><enum>(c)</enum><header>Periodic reviews</header><paragraph id="H5BF1902A25374A07AD84E749C2BEDB9D"><enum>(1)</enum><header>In general</header><text>Not later than 5 years after the underride guard standards are updated pursuant to subsection (b)(2), and every 5 years thereafter, the Secretary shall—</text><subparagraph id="HCCACCA75B4AF4733ADDCBD635B885B4B"><enum>(A)</enum><text>conduct a review of underride guard standards to evaluate the need for changes in response to advancements in technology; and</text></subparagraph><subparagraph id="HC019E7A4996F411599393ABE7D802C1E"><enum>(B)</enum><text>update the standards accordingly.</text></subparagraph></paragraph><paragraph id="HA040534589DB454291DBC0956FD6B89F"><enum>(2)</enum><header>Report</header><text>After each review conducted under this section, the Secretary shall submit to the Committee on Commerce, Science, and Transportation of the Senate and the Committees on Transportation and Infrastructure and Energy and Commerce of the House of Representatives a report on the results of the review.</text></paragraph></subsection></section><section id="H945B47D643524812A4BBB0F43962568A"><enum>6.</enum><header>Committee on Underride Protection</header><subsection id="HFD80EE32AE3A44C6B8F359C6D35FA5D5"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">The Secretary of Transportation shall establish the Committee on Underride Protection (referred to in this section as the <term>Committee</term>) to oversee the ongoing underride rulemaking process.</text></subsection><subsection id="H3062EC22FFCA4966A7958FB2FA84F698"><enum>(b)</enum><header>Representation</header><text>The Committee shall be composed of—</text><paragraph id="H8118D39893C24CB5AFD332B641067B1C"><enum>(1)</enum><text>1 representative of truck manufacturers;</text></paragraph><paragraph id="HFEAE81C8FA534D8A8A7B5D10DD9F6EF3"><enum>(2)</enum><text>1 representative of trailer manufacturers;</text></paragraph><paragraph id="H90BD7FDBB3774A29A5EA59B72C9CC7FF"><enum>(3)</enum><text>1 roadside inspector;</text></paragraph><paragraph id="H417B5B61E390422498C0B30DAFE56F0D"><enum>(4)</enum><text>1 motor vehicle engineer, who shall be a technician who works on motor vehicle safety improvements;</text></paragraph><paragraph id="H91518733762940D680FF6946641B4B31"><enum>(5)</enum><text>1 motor vehicle crash reconstructionist;</text></paragraph><paragraph id="HB772F33361C847CE85A1F3813109E95E"><enum>(6)</enum><text>2 representatives of consumer-oriented traffic safety organizations;</text></paragraph><paragraph id="H2F9822287C5943369996F2EE5E2CED19"><enum>(7)</enum><text>1 representative of the truck and auto insurance industry;</text></paragraph><paragraph id="H9C538F9CE77643D1B8C317C088C093F5"><enum>(8)</enum><text>1 law enforcement crash investigator;</text></paragraph><paragraph id="HEEF02271570946DF98116A580ADE8239"><enum>(9)</enum><text>1 emergency medical service provider;</text></paragraph><paragraph id="H09E22EF1C01F49FAAA425F6850516034"><enum>(10)</enum><text>1 public health or injury prevention professional; and</text></paragraph><paragraph id="H096629FC3077485989D63B4D32291095"><enum>(11)</enum><text>at least 4 people whose families have been impacted by an underride crash.</text></paragraph></subsection><subsection id="HC368C9A2C9EA4EB398268C3535CAE526"><enum>(c)</enum><header>Meetings</header><text>The Committee shall meet—</text><paragraph id="H241261E8CCBC40E9BDC7141B152F5F62"><enum>(1)</enum><text>until the final rules have been issued pursuant to section 30129 of title 49, United States Code (as added by section 4(a))—</text><subparagraph id="H2DB82C8AF8A744EC8ED3B33E67FB9DC3"><enum>(A)</enum><text>monthly, via conference call; and</text></subparagraph><subparagraph id="H5399DCC57B554EB9A7253E67B9E4A03A"><enum>(B)</enum><text>quarterly, in person, at the Department of Transportation headquarters; and</text></subparagraph></paragraph><paragraph id="HEDC58385E7C94264ABCF86B830B4BAA9"><enum>(2)</enum><text>subsequent to the issuance of the final rules described in paragraph (1), annually, at the Department of Transportation headquarters, to assess the status of underride crash protection.</text></paragraph></subsection><subsection id="H75B8C26298CF4301B6B65C39CB6E76C0"><enum>(d)</enum><header>Annual report</header><text>The Committee shall submit an annual report to the appropriate congressional committees that describes the progress made by the Secretary of Transportation in meeting the rulemaking deadlines set forth in section 30129 of title 49, United States Code (as added by section 4(a)).</text></subsection></section><section id="H19E0A69D9F334E29BCF6091974401765"><enum>7.</enum><header>Publication of victims of truck underride crashes</header><text display-inline="no-display-inline">The Secretary of Transportation shall—</text><paragraph id="H54E9F4471E8C48DFB2D5BED1E3CD1FCC"><enum>(1)</enum><text display-inline="yes-display-inline">publish data on victims of truck underride crashes on a publicly accessible website; and</text></paragraph><paragraph id="H7A60C679B5D742FABA327BCB5E357F29"><enum>(2)</enum><text display-inline="yes-display-inline">update the data described in paragraph (1) not less frequently than quarterly.</text></paragraph></section></legis-body></bill>
