R. 1621</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20210308">March 8, 2021</action-date><action-desc><sponsor name-id="C001068">Mr. Cohen</sponsor> (for himself and <cosponsor name-id="A000377">Mr. Armstrong</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend section 3661 of title 18, United States Code, to prohibit the consideration of acquitted conduct at sentencing.</official-title></form><legis-body id="H87B52A9B7E61496BACC402E906185A59" style="OLC"><section section-type="section-one" id="H617F326924A443C38CAA045C51C807A3"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Prohibiting Punishment of Acquitted Conduct Act of 2021</short-title></quote>.</text></section><section id="H14A8DF98ECAB419F81B2E396E9DC98AE"><enum>2.</enum><header>Acquitted conduct at sentencing</header><subsection id="H9177587B28174490BDB1410D8CA1F2E2"><enum>(a)</enum><header>Use of information for sentencing</header><paragraph id="H419ADFEA84C3486AA946BAE7175A0457"><enum>(1)</enum><header>Amendment</header><text>Section 3661 of title 18, United States Code, is amended by inserting <quote>, except that a court of the United States shall not consider, except for purposes of mitigating a sentence, acquitted conduct under this section</quote> before the period at the end.</text></paragraph><paragraph id="H4455EE4C0E3D4ADE9C53F8B2634E5C17"><enum>(2)</enum><header>Applicability</header><text>The amendment made by paragraph (1) shall apply only to a judgment entered on or after the date of enactment of this Act.</text></paragraph></subsection><subsection id="H3A5AD4256DE841EB93788688AA0B25B6"><enum>(b)</enum><header>Definitions</header><text>Section 3673 of title 18, United States Code, is amended—</text><paragraph id="H26D09D3309CF4D87AA7105590634E337"><enum>(1)</enum><text>in the matter preceding paragraph (1), by striking <quote>As</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H4028FE1C6D524B25B8A3107B6EEC11E3"><subsection id="H70C20ADEA39B451E921C4909E79016D7"><enum>(a)</enum><text>As</text></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="HE2E279D1778448DB95A139484B451879"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H538CCB366A1248058AE1A4046A2E31A3"><subsection id="HCEEC5E8130864C95B77F59E5010047CB"><enum>(b)</enum><text>As used in this chapter, the term <term>acquitted conduct</term> means—</text><paragraph id="H78DF19938783465099BDA3B4E8BF499B"><enum>(1)</enum><text>an act—</text><subparagraph id="H3EAD06B5C31248C7B10D472334CA50EE"><enum>(A)</enum><text>for which a person was criminally charged and with regard to which—</text><clause id="HF41AE064FFFB47FD9294F82B939C3D82"><enum>(i)</enum><text>that person was adjudicated not guilty after trial in a Federal, State, or Tribal court; or</text></clause><clause id="H9F2E1001532D4B72A3B73C16F3C4B55D"><enum>(ii)</enum><text display-inline="yes-display-inline">any favorable disposition to the person in any prior charge was made, regardless of whether the disposition was pretrial, at trial, or post trial; or</text></clause></subparagraph><subparagraph id="HDE64EC2F27244E93B5F07CCCF3411D03"><enum>(B)</enum><text>in the case of a juvenile, that was charged and for which the juvenile was found not responsible after a juvenile adjudication hearing; or</text></subparagraph></paragraph><paragraph id="HDCF5BEA42A86493D88185FD87ECB9F3F"><enum>(2)</enum><text>any act underlying a criminal charge or juvenile information dismissed—</text><subparagraph id="HF9FA92481924482395ED65B0AC155FFA"><enum>(A)</enum><text>in a Federal court upon a motion for acquittal under rule 29 of the Federal Rules of Criminal Procedure; or</text></subparagraph><subparagraph id="HFC28A2D56C864D449815089D17EC848E"><enum>(B)</enum><text>in a State or Tribal court upon a motion for acquittal or an analogous motion under the applicable State or Tribal rule of criminal procedure.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section></legis-body></bill>
