which was referred to the <committee-name committee-id="HPW00">Committee on Transportation and Infrastructure</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title 49, United States Code, to expand and codify the transit oriented development planning grant program, and for other purposes.</official-title></form><legis-body id="H8B375EE2A5894712A9CFCAE439A141E2" style="OLC"><section id="H3D6BE9978AAE4C92BC706AE547CAC526" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Maximizing Our Redevelopment and Efficiency for Transit Oriented Development Act of 2021</short-title></quote> or the <quote><short-title>More TOD Act</short-title></quote>.</text></section><section id="HE53CD3796EB546F68512D6B62D48B16B" section-type="subsequent-section"><enum>2.</enum><header>Transit oriented development planning grant program</header><subsection id="H8A493D32FDE94EE5A40280DB1EE91774"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/53">Chapter 53</external-xref> of title 49, United States Code, is amended by inserting after <external-xref legal-doc="usc" parsable-cite="usc/49/5327">section 5327</external-xref> the following:</text><quoted-block display-inline="no-display-inline" id="H9F5B4DF4F3EB4C8CAC5929B47A111531" style="USC"><section id="HA023AD2BD9C74679AE34306DDAF54D7E"><enum>5328.</enum><header>Transit oriented development planning grant program</header><subsection id="H40764480156D4DDA9E173EB966FA42A4"><enum>(a)</enum><header>Definition</header><text>In this section the term <term>eligible project</term> means—</text><paragraph id="HBE81BB08723D4AED99CADC0B52AF7EF8"><enum>(1)</enum><text>a new fixed guideway capital project or a core capacity improvement project as defined in section 5309; or</text></paragraph><paragraph id="HE6B10778704A4E608CF92C71AD6069E2"><enum>(2)</enum><text>an existing fixed guideway system, or an existing station that is served by a fixed guideway system.</text></paragraph></subsection><subsection id="HBEC680F31B234A60A03ACBCF089D22A7"><enum>(b)</enum><header>General authority</header><text>The Secretary may make grants under this section to a State, local governmental authority, or metropolitan planning organization to assist in financing comprehensive planning associated with an eligible project that seeks to—</text><paragraph id="H5B4A779057FF4BE8B89704A80AAFB8D0"><enum>(1)</enum><text>enhance economic development, ridership, and other goals established during the project development and engineering processes or the grant application;</text></paragraph><paragraph id="HE10102DB12C24C8693E7FD5500A4BCD5"><enum>(2)</enum><text>facilitate multimodal connectivity and accessibility;</text></paragraph><paragraph id="H43DF4C0C3CBE4A15B9C0475A8F81EFE2"><enum>(3)</enum><text>increase access to transit hubs for pedestrian and bicycle traffic;</text></paragraph><paragraph id="H2D1ADF64802444B1962357B8A2EBA343"><enum>(4)</enum><text>enable mixed-use development;</text></paragraph><paragraph id="H8486408057324ED8ADF8FCFFC97EE09A"><enum>(5)</enum><text>identify infrastructure needs associated with the eligible project; and</text></paragraph><paragraph id="H2E468F0CBF4F4F64B540DEB656981E20"><enum>(6)</enum><text>include private sector participation.</text></paragraph></subsection><subsection id="H8B16B9DF82FD44A4AECED38409945057"><enum>(c)</enum><header>Eligibility</header><text>A State, local governmental authority, or metropolitan planning organization that desires to participate in the program under this section shall submit to the Secretary an application that contains at a minimum—</text><paragraph id="H835960BC0E2E4A66AF8090E934EDC7AB"><enum>(1)</enum><text>an identification of an eligible project;</text></paragraph><paragraph id="HF56E9AF1246D4A3BBC3A9BBB16CDF64C"><enum>(2)</enum><text>a schedule and process for the development of a comprehensive plan;</text></paragraph><paragraph id="H82BD6475498842F38BC67E1368931A39"><enum>(3)</enum><text>a description of how the eligible project and the proposed comprehensive plan advance the metropolitan transportation plan of the metropolitan planning organization;</text></paragraph><paragraph id="HC6C6561680D248ED9055DD9413CC501B"><enum>(4)</enum><text>proposed performance criteria for the development and implementation of the comprehensive plan;</text></paragraph><paragraph id="HE8B3DC67FD974A13B2A5668C8C71CBB8"><enum>(5)</enum><text>a description of how the project will reduce and mitigate social and economic impacts on existing residents and businesses vulnerable to displacement; and</text></paragraph><paragraph id="HC0A6599DF4004787A271244E7CFEE9ED"><enum>(6)</enum><text>identification of—</text><subparagraph id="H7026C01BC0BB4CD1AB1AF5C24140DFC7"><enum>(A)</enum><text>partners;</text></subparagraph><subparagraph id="H716C4AB06B5740BFA9C41C4987E70E6B"><enum>(B)</enum><text>availability of and authority for funding; and</text></subparagraph><subparagraph id="H157AC417DB54467BA17A2865460426A4"><enum>(C)</enum><text>potential State, local or other impediments to the implementation of the comprehensive plan.</text></subparagraph></paragraph></subsection><subsection id="HC2198BDFB5A143D49285A51B1AD12212"><enum>(d)</enum><header>Cost share</header><text>A grant under this section shall not exceed an amount in excess of 80 percent of total project costs, except that a grant that includes an affordable housing component shall not exceed an amount in excess of 90 percent of total project costs.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H5DBA436279BC467E8D8F813A8F2359BE"><enum>(b)</enum><header>Authorization of appropriations</header><text display-inline="yes-display-inline">Section 5338 of title 49, United States Code, is amended by adding at the end the following:</text><quoted-block style="USC" id="H3B0D2CC989CD4F29920ABAB02044F3A8" display-inline="no-display-inline"><subsection id="H98659F72AFAD499B9472F5B3001FF96A"><enum>(i)</enum><header>Transit oriented development planning grant program</header><text display-inline="yes-display-inline">There is authorized to be appropriated to carry out section 5328—</text><paragraph id="HC9FDD2F104E54B4485F5E78F4096CC0F"><enum>(1)</enum><text>$20,000,000 for fiscal year 2022;</text></paragraph><paragraph id="HE7F10A83C5A4438D998C9B085EC681CF"><enum>(2)</enum><text>$21,000,000 for fiscal year 2023;</text></paragraph><paragraph id="HD5972460E74B462FA693824D784DC49F"><enum>(3)</enum><text>$22,000,000 for fiscal year 2024;</text></paragraph><paragraph id="H1238218F2C3D44F189848951F756DE76"><enum>(4)</enum><text>$23,000,000 for fiscal year 2025; and</text></paragraph><paragraph id="HB887677195A743B190847544F3FEF00D"><enum>(5)</enum><text>$24,000,000 for fiscal year 2026.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H43F7267446FD47B5AB5913386FB86535"><enum>(c)</enum><header>Clerical amendment</header><text display-inline="yes-display-inline">The analysis for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/53">chapter 53</external-xref> of title 49, United States Code, is amended by inserting after the item relating to <external-xref legal-doc="usc" parsable-cite="usc/49/5327">section 5327</external-xref> the following:</text><quoted-block display-inline="no-display-inline" id="HD66D836390D3428AB5F07F8DED5C4340" style="USC"><toc regeneration="no-regeneration"><toc-entry level="section">5328.
