which was referred to the <committee-name committee-id="HJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Omnibus Crime Control and Safe Streets Act of 1968 to condition eligibility for grants under the Edward Byrne Memorial Justice Assistance Grant Program, and for other purposes.</official-title></form><legis-body id="HA0F027863B7346FFA1B59923A6E47C79" style="OLC"><section id="H3656972710434982BC0C103F29291BA0" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Workforce Justice Act of 2021</short-title></quote>.</text></section><section id="H4049FE7CB32849148C10CE6695F9386A"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text><paragraph id="H05E68503636F491EBD10AAC243158650"><enum>(1)</enum><text>There are an estimated 70,000,000 adults in the United States with an arrest or conviction history.</text></paragraph><paragraph id="HD78288F045CC495981319F8998FFC3C4"><enum>(2)</enum><text>Nearly 700,000 adults reenter their communities after incarceration every year.</text></paragraph><paragraph id="HC19984D7EBCD422AB34F19E59B088164"><enum>(3)</enum><text>Research shows that a conviction record reduces the likelihood of a job callback or offer by nearly 50 percent.</text></paragraph><paragraph id="H11E1E72265A44D289ED4338F9FDC2277"><enum>(4)</enum><text>Employment is a critical factor in successful community reentry and reduction of recidivism for adults with a conviction history.</text></paragraph><paragraph id="H81FFC5D956F84503B54C814D70A8E046"><enum>(5)</enum><text>After two years, nearly twice as many employed adults with criminal records avoided another interaction with the criminal justice system compared to their unemployed counterparts.</text></paragraph><paragraph id="H09A592CB674E43DFB4F80EF0E5D01945"><enum>(6)</enum><text>A study conducted by the Kellogg School of Management at Northwestern University found the turnover rate for employed adults with criminal records to be approximately 13 percent lower than individuals without criminal records. </text></paragraph></section><section id="H13CE0A1C70424DE7ACAC52164DEE4504"><enum>3.</enum><header>Eligibility for grants under the Byrne JAG program</header><subsection id="HC9036D99DD5E4E3E8AC05B6741BC79DB"><enum>(a)</enum><header>Eligibility for grants under the Byrne JAG program</header><text display-inline="yes-display-inline">Section 505(a) of the Omnibus Crime Control and Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/34/10156">34 U.S.C. 10156(a)</external-xref>) is amended—</text><paragraph id="H9C46CA895E0942C2867636DBCCD4C6B5" display-inline="no-display-inline"><enum>(1)</enum><text>in paragraph (1), by striking <quote>in paragraph (2)</quote> and inserting <quote>in paragraphs (2) and (3)</quote>; and</text></paragraph><paragraph id="H0EEAEFF2A0394920A39B029F0EFC7A3C"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" id="H5B28355947234E2F83442354C0358BFD" display-inline="no-display-inline"><paragraph id="H59A155BA92684C4B82147835C50CC992"><enum>(3)</enum><header>Eligibility</header><text display-inline="yes-display-inline">Beginning with the third fiscal year that begins after the date of the enactment of the Workforce Justice Act of 2021, to be eligible for an allocation under this section, a State shall have enacted and be implementing legislation that prohibits private employers from—</text><subparagraph id="HB46959FBB6814D4DAD6D0D30AD3CF209"><enum>(A)</enum><text>requiring an applicant to disclose whether the applicant has a criminal record; </text></subparagraph><subparagraph id="HC544B0F9CC1F4D50BBEBDD6006B9A78A"><enum>(B)</enum><text>inquiring about the criminal record of an applicant prior to a conditional offer of employment; and</text></subparagraph><subparagraph id="HC204D83A20164B35901193794A311E41"><enum>(C)</enum><text>conducting a criminal background check on an applicant prior to a conditional offer of employment.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="HD618043B785F4D819775A9EF5F28DE6F"><enum>(b)</enum><header>Reallocation of funds</header><text>Section 505(f) of the Omnibus Crime Control and Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/34/10156">34 U.S.C. 10156(f)</external-xref>) is amended—</text><paragraph id="H72EFDE54AE674BFDAA2F94B9101B1D89"><enum>(1)</enum><text>by amending the subsection heading to read as follows: <quote><header-in-text level="subsection" style="OLC">Reallocation</header-in-text></quote>; and</text></paragraph><paragraph id="H06269FE5652949AFB85CA12AD978DB84"><enum>(2)</enum><text>by inserting <quote>(including that a State is ineligible under subsection (a)(3))</quote> after <quote>receive funds under this subpart</quote>. </text></paragraph></subsection></section></legis-body></bill>
