<section id="H8699D9873067437F951F89FD68DE65F7"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text> <paragraph id="HBC96D2AE2F8748E5A83904CE0465C0BD"><enum>(1)</enum><header>County</header><text>The term <term>County</term> means Clark County, Nevada.</text></paragraph>
<paragraph id="HE2004AA058EC46E9B9E3B08524D8BEBA"><enum>(2)</enum><header>Federal incidental take permit</header><text>The term <term>Federal incidental take permit</term> means an incidental take permit issued under section 10(a)(1)(B) of the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1539">16 U.S.C. 1539(a)(1)(B)</external-xref>) to— </text> <subparagraph id="H5C9EBDA66DD04BBA8D01384F5483BC7A"><enum>(A)</enum><text>the Nevada Department of Transportation;</text></subparagraph>
<subparagraph id="H50B352ABE9AC4C09BEB088F23690ADE9"><enum>(B)</enum><text>the County; or</text></subparagraph> <subparagraph id="HDEE0388909DE4033B32BF8874B2D46AB"><enum>(C)</enum><text>any of the following cities in the State:</text>
<clause id="HA6C388B8E7F04CC691977176368CB846"><enum>(i)</enum><text>Las Vegas.</text></clause> <clause id="H60B866201AE34E64832A94782011337A"><enum>(ii)</enum><text>North Las Vegas.</text></clause>
<clause id="H710D50F31E934BD1B4C8E4FC202C9CD1"><enum>(iii)</enum><text>Henderson.</text></clause> <clause id="HE557C056D1E14823B8278BB51EDD8B56"><enum>(iv)</enum><text>Boulder City.</text></clause>
<clause id="H8C67BB73657C41B199C2D45F655AA735"><enum>(v)</enum><text>Mesquite. </text></clause></subparagraph></paragraph> <paragraph id="H30833945CAC74310A1945912C71D2BBC"><enum>(3)</enum><header>Indian tribe</header><text>The term <term>Indian Tribe</term> has the meaning given the term in section 4 of the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/5304">25 U.S.C. 5304</external-xref>). </text></paragraph>
<paragraph id="HC86D45D7D95B4A9E8DBD58DA2F4C7D63"><enum>(4)</enum><header>Regional governmental entity; special account; unit of local government</header><text>The terms <term>regional governmental entity</term>, <quote>special account</quote>, and <quote>unit of local government</quote> have the meanings given the terms in section 3 of the Southern Nevada Public Land Management Act of 1998 (<external-xref legal-doc="public-law" parsable-cite="pl/105/263">Public Law 105–263</external-xref>; 112 Stat. 2344). </text></paragraph> <paragraph id="HB569214B58ED4B4DA3F0360D51D18A02"><enum>(5)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of the Interior.</text></paragraph>
<paragraph id="H8039D6A8AE0D4407875001FA789B4B15"><enum>(6)</enum><header>State</header><text>The term <term>State</term> means the State of Nevada.</text></paragraph> <paragraph id="H53ED469D8E764FD6BF4436D0A0832EE2"><enum>(7)</enum><header>Tribe</header><text>The term <term>Tribe</term> means the Moapa Band of Paiutes of the Moapa River Indian Reservation, Nevada.</text></paragraph></section>
<title id="H1AD21FB7290B4945BADDDE17444F4E4E"><enum>I</enum><header>Moapa Valley Tribal empowerment and economic development</header>
<section id="HB3270E11C65B4E2B9C8E767F6D92CE49"><enum>101.</enum><header>Transfer of land to be held in trust for the Moapa Band of Paiutes</header>
<subsection id="HD3AD1D18CC8F436DBB2CA156AFB46E69"><enum>(a)</enum><header>In general</header><text>Subject to valid existing rights, including rights-of-way for construction, maintenance, and operation of the Moapa Valley Water District facilities, as depicted on the map entitled <quote>Moapa Valley Water District–Facilities and Land Conveyances</quote> and dated November 13, 2019, and existing rights-of-way for electric generation, transmission, distribution, and supporting facilities, all right, title, and interest of the United States in and to the land described in subsection (b) shall be—</text> <paragraph id="H262E972AF67D49AAB478E79D42A543E4"><enum>(1)</enum><text>held in trust by the United States for the benefit of the Tribe; and</text></paragraph>
<paragraph id="H6C332A5A4BFD49A79B977FFCB300A65E"><enum>(2)</enum><text>part of the reservation of the Tribe.</text></paragraph></subsection> <subsection id="H055AE750BD674FAC846A66AA47030F06"><enum>(b)</enum><header>Description of land</header><text>The land referred to in subsection (a) is the approximately 41,055 acres of land administered by the Bureau of Land Management and the Bureau of Reclamation, as generally depicted on the map entitled <quote>Southern Nevada Land Management</quote> and dated February 22, 2021.</text></subsection>
<subsection id="HC972BC89DE8D45F5AD3B0811F63DDC4C"><enum>(c)</enum><header>Survey</header><text>Not later than 60 days after the date of enactment of this Act, the Secretary shall complete a survey of the boundary lines to establish the boundaries of the land taken into trust under subsection (a).</text></subsection> <subsection id="HFDA196B95E9447C5B9DE16B3D61E31B9"><enum>(d)</enum><header>Gaming</header><text>Land taken into trust under this section shall not be eligible, or considered to have been taken into trust, for class II gaming or class III gaming (as those terms are defined in section 4 of the Indian Gaming Regulatory Act (<external-xref legal-doc="usc" parsable-cite="usc/25/2703">25 U.S.C. 2703</external-xref>)).</text></subsection>
<subsection id="H365CC67A5DFB4ACE8461339F8FD48D6A"><enum>(e)</enum><header>Water rights</header>
<paragraph id="HAC553804039841429B1448C33D8E56B3"><enum>(1)</enum><header>In general</header><text>There shall not be Federal reserved rights to surface water or groundwater for any land taken into trust by the United States for the benefit of the Tribe under subsection (a).</text></paragraph> <paragraph id="H56CCF47E4D474D5B9A37B7A228D41E3B"><enum>(2)</enum><header>State water rights</header><text>The Tribe shall retain any right or claim to water under State law for any land taken into trust by the United States for the benefit of the Tribe under subsection (a).</text></paragraph></subsection></section>
<section id="H4991036D0088405F8380BF2472E49310"><enum>102.</enum><header>Tribal fee land to be held in trust</header>
<subsection id="HF62AE2B067D941028CF12632C1088884"><enum>(a)</enum><header>In general</header><text>All right, title, and interest of the Tribe in and to the land described in subsection (b) shall be—</text> <paragraph id="HCAE77E1E2A2A46689E54F955529D7EAE"><enum>(1)</enum><text>held in trust by the United States for the benefit of the Tribe; and</text></paragraph>
<paragraph id="HB7D399D7F623479B807C6FFE4D10F19B"><enum>(2)</enum><text>part of the reservation of the Tribe.</text></paragraph></subsection> <subsection id="H22960271F91C4C618EAB02E98FDDAE2B"><enum>(b)</enum><header>Description of land</header><text>The land referred to in subsection (a) is the approximately 200 acres of land held in fee by the Tribe as generally depicted on the map entitled <quote>General Land Status, Moapa Band of Paiutes</quote> and dated September 2012.</text></subsection>
<subsection id="H0D4B0CB21B6B4284B6F6250A0EE29165"><enum>(c)</enum><header>Survey</header><text>Not later than 180 days after the date of enactment of this Act, the Secretary shall complete a survey of the boundary lines to establish the boundaries of the land taken into trust under subsection (a).</text></subsection></section></title> <title id="H72D3C5CD0CAA4E6EA13E4BE105A64CCC"><enum>II</enum><header>Clark County, Nevada</header> <section id="H5D9089C44EA84371A7B955B784DA2A8D"><enum>201.</enum><header>Definition of public park under the Red Rock Canyon National Conservation Area Protection and Enhancement Act of 2002</header><text display-inline="no-display-inline">Section 102 of the Red Rock Canyon National Conservation Area Protection and Enhancement Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/16/460ccc-4">16 U.S.C. 460ccc–4</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/107/282">Public Law 107–282</external-xref>) is amended—</text>
<paragraph id="HC77FC44803FF4544A6B5AF4925E35EDA"><enum>(1)</enum><text>by redesignating paragraphs (1), (2), and (3) as paragraphs (2), (4), and (5), respectively;</text></paragraph> <paragraph id="HE7815365088249A18231CDCA30279C4D"><enum>(2)</enum><text>by inserting before paragraph (2) (as so redesignated) the following:</text>
<quoted-block style="OLC" display-inline="no-display-inline" id="H9D62B149C6B149BC9F57FB729A470924">
<paragraph id="H734413885EC44EE1813976C69C984F6E"><enum>(1)</enum><header>Associated supportive use</header><text>The term <term>associated supportive use</term> means a use that supports the overall function and enjoyment of a public park.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph> <paragraph id="HE82FC815B1AC4851A10D7C8372F8059E"><enum>(3)</enum><text>by inserting after paragraph (2) (as so redesignated) the following:</text>
<quoted-block style="OLC" display-inline="no-display-inline" id="H7D90738D40F84E35AEC335EDA9857651">
<paragraph id="HA176EF2361564030AF0F6BFB2C79BE28"><enum>(3)</enum><header>Public park</header><text>The term <term>public park</term> includes land developed or managed by a partnership between Clark County, Nevada, and a private entity for recreational uses and associated supportive uses, including uses that require a fee for admittance or use of property within the public park.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> <section id="H4B6FD3A6DEA54F5B8DA9D53ADA0F5926"><enum>202.</enum><header>Boundary adjustment to the Red Rock Canyon National Conservation Area</header><text display-inline="no-display-inline">Section 3(a) of the Red Rock Canyon National Conservation Area Establishment Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/16/460ccc-1">16 U.S.C. 460ccc–1(a)</external-xref>) is amended by striking paragraph (2) and inserting the following:</text>
<quoted-block style="OLC" display-inline="no-display-inline" id="H98026DE936F14C8F92432225858DB430">
<paragraph id="H24CC5E43B33F446DA84C7E3BE05427D7"><enum>(2)</enum><text>The conservation area shall consist of approximately 246,990 acres of land, as generally depicted on the map entitled <quote>Southern Nevada Land Management</quote> and dated February 22, 2021.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section> <section id="HD38899A88FD94524B517500774A53B34"><enum>203.</enum><header>Boundary adjustment to the Rainbow Gardens Area of Critical Environmental Concern</header> <subsection id="H9CFE5D13333141BC9BBF501BD0024EFF"><enum>(a)</enum><header>In general</header><text>The boundary of the Rainbow Gardens Area of Critical Environmental Concern, as amended under the Las Vegas Resource Management Plan of 1998, is modified to exclude approximately 390 acres of land, as generally depicted on the map entitled <quote>Rainbow Gardens ACEC Boundary Adjustment</quote> and dated November 13, 2019.</text></subsection>
<subsection id="H6187070A22FB483F9CCB517B4CEA7FC7"><enum>(b)</enum><header>Availability of map</header><text>The map described in subsection (a) shall be on file and available for inspection in the appropriate offices of the Bureau of Land Management.</text></subsection></section> <section id="HCC308C2F61E047B09EA5B540B26CA5FB"><enum>204.</enum><header>Land disposal and public purpose conveyances</header> <subsection id="HCC928F276B3A4A65970C8073707D8DAD"><enum>(a)</enum><header>Land disposal</header> <paragraph id="HBEE60FB3D0554C068B5C7162F4ADDF7A"><enum>(1)</enum><header>In general</header><text>Section 4(a) of the Southern Nevada Public Land Management Act of 1998 (<external-xref legal-doc="public-law" parsable-cite="pl/105/263">Public Law 105–263</external-xref>; 112 Stat. 2344; 116 Stat. 2007; 127 Stat. 3872) is amended, in the first sentence, by striking <quote>September 17, 2012</quote> and inserting <quote>November 23, 2020</quote>.</text></paragraph>
<paragraph id="H7B040D89C3BF46FBACB2CCB7F011161E"><enum>(2)</enum><header>Mineral interests</header><text>The following shall not constitute the unauthorized use of sand or gravel for purposes of the Southern Nevada Public Land Management Act of 1998 (<external-xref legal-doc="public-law" parsable-cite="pl/105/263">Public Law 105–263</external-xref>; 112 Stat. 2343) or the Clark County Conservation of Public Land and Natural Resources Act of 2002 (<external-xref legal-doc="public-law" parsable-cite="pl/107/282">Public Law 107–282</external-xref>; 116 Stat. 1994):</text> <subparagraph id="HA58B709670A341DF8769A2186469A618"><enum>(A)</enum><text>The movement of common varieties of sand and gravel on a surface estate acquired under the Southern Nevada Public Land Management Act of 1998 (<external-xref legal-doc="public-law" parsable-cite="pl/105/263">Public Law 105–263</external-xref>; 112 Stat. 2343) or the Clark County Conservation of Public Land and Natural Resources Act of 2002 (<external-xref legal-doc="public-law" parsable-cite="pl/107/282">Public Law 107–282</external-xref>; 116 Stat. 1994) by the owner of the surface estate for purposes including recontouring or balancing the surface estate or filling utility trenches on the surface estate. </text></subparagraph>
<subparagraph id="HFA28785C59C64C20AB8D8D7958724D3D"><enum>(B)</enum><text>The disposal of sand or gravel described in subparagraph (A) at an off-site landfill. </text></subparagraph></paragraph></subsection> <subsection id="H9BF7BCA224F94229AFF76765D30782ED"><enum>(b)</enum><header>Public purpose conveyances</header> <paragraph id="H6EBCFE57F9764D849473B3894F738ABC"><enum>(1)</enum><header>Definitions</header><text>In this subsection:</text>
<subparagraph id="HACB7254B864340638BC111FA73D97B6F"><enum>(A)</enum><header>Eligible entity</header><text>The term <term>eligible entity</term> means the State, a political subdivision of the State, a unit of local government, or a regional governmental entity in the County.</text></subparagraph> <subparagraph id="H23730F6E63D7426D8755FFF6D9B40DC0"><enum>(B)</enum><header>Federal land</header><text>The term <term>Federal land</term> means any Federal land in the County—</text>
<clause id="H4C3F57C532AC4D0487BC351039B5511A"><enum>(i)</enum><text>that is leased, patented, authorized as a right-of-way, or otherwise approved for use pursuant to the Act of June 14, 1926 (commonly known as the <quote>Recreation and Public Purposes Act</quote>) (44 Stat. 741, chapter 578; <external-xref legal-doc="usc" parsable-cite="usc/43/869">43 U.S.C. 869</external-xref> et seq.), the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1701">43 U.S.C. 1701</external-xref> et seq.), the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321</external-xref> et seq.), or any other applicable Federal law; </text></clause> <clause id="H7DC9C487819C404BBC1839BE61DED835"><enum>(ii)</enum><text>on which a permanent public facility has been or may be constructed; and</text></clause>
<clause id="HA5EC6A76F4B8449B95AB980A14652B7D"><enum>(iii)</enum><text>that is not—</text> <subclause id="H8E66D811EBBC40FFB8C547DCF9FB83A9"><enum>(I)</enum><text>under the jurisdiction of the National Park Service or the Department of Defense; or </text></subclause>
<subclause id="H63DC90F633204B8C9E885B71E5CA03F4"><enum>(II)</enum><text>managed as—</text> <item id="H643AD3158DFB4E78A633DEE5285554E2"><enum>(aa)</enum><text>a unit of the National Wildlife Refuge System;</text></item>
<item id="H8C94E3D13CA24EB68ECE372CF3F8357A"><enum>(bb)</enum><text>a component of the National Wilderness Preservation System; or </text></item> <item id="H6C7E4E49F59B4B99BC6604851E30307F"><enum>(cc)</enum><text>a component of the National Landscape Conservation System. </text></item></subclause></clause></subparagraph></paragraph>
<paragraph id="H08F17DA634AF465C9681359046DFA602"><enum>(2)</enum><header>Authorization for conveyance</header><text>Subject to valid existing rights and paragraph (4), on request by an eligible entity for the conveyance of a parcel of Federal land, the Secretary shall convey to the eligible entity by quitclaim deed, without consideration, terms, conditions, reservations, or stipulations, all right, title, and interest of the United States in and to the parcel of Federal land for any public purpose.</text></paragraph> <paragraph id="HB514FE03E0484FC1B14A974504CE4E52"><enum>(3)</enum><header>Map and legal description</header> <subparagraph id="H9F8B244E071645F89911C85EAD1BD199"><enum>(A)</enum><header>In general</header><text>Not later than 180 days after the date of a request by an eligible entity for a conveyance of Federal land under paragraph (2), the Secretary shall file a map and legal description of the parcel of Federal land to be conveyed under that paragraph.</text></subparagraph>
<subparagraph id="H6E42EEBAD7D04F51BBF1456FE0815078"><enum>(B)</enum><header>Effect; availability</header><text>Each map and legal description filed under subparagraph (A) shall—</text> <clause id="H9FAF97D3161048F6B1A07796B895A339"><enum>(i)</enum><text>have the same force and effect as if included in this Act; and</text></clause>
<clause id="HC95BDED8472C49668E3A1953F1DCE324"><enum>(ii)</enum><text>be on file and available for public inspection in the Las Vegas Field Office of the Bureau of Land Management.</text></clause></subparagraph> <subparagraph id="H3DE3B5FC447F4717A8DE82FB43F5748C"><enum>(C)</enum><header>Errors</header><text>The Secretary may correct any minor error in a map or legal description filed under subparagraph (A).</text></subparagraph></paragraph>
<paragraph id="HB8683FF77E554B97982AD3C785837506"><enum>(4)</enum><header>Reversion</header>
<subparagraph id="HDEA776842CE34BDE909C1ADAC4B14B18"><enum>(A)</enum><header>In general</header><text>As a condition of a conveyance under paragraph (2) and except as provided in subparagraph (B), the Secretary shall require that, if the parcel of the Federal land conveyed under that paragraph is no longer used for any public purpose for which the Federal land was conveyed, all right, title, and interest in and to the parcel of Federal land shall—</text> <clause id="HBA13086299804C4F87ACDD554B9DD12C"><enum>(i)</enum><text>revert to the United States; or</text></clause>
<clause id="H52696223BD374AC9AFD15DA5754E771A"><enum>(ii)</enum><text>on authorization by the Secretary, be disposed of by the eligible entity through a sale, lease, or other conveyance, in accordance with subparagraph (C).</text></clause></subparagraph> <subparagraph id="HCDD763E8B35C4946818E9E075CCF30D4"><enum>(B)</enum><header>Exception</header><text>The removal of sediment or minerals from a stormwater detention basin or from a parcel of Federal land conveyed under paragraph (2) shall be considered to be an authorized use.</text></subparagraph>
<subparagraph id="H0C41EEEFDAE64249B4AAC49B6D48EAFE"><enum>(C)</enum><header>Requirements for sale, lease, or other conveyance</header>
<clause id="H497190F792DB44DA803179A149A272D8"><enum>(i)</enum><header>Fair market value</header><text>The sale, lease, or other conveyance of a parcel of Federal land by an eligible entity under subparagraph (A)(ii) shall be for fair market value.</text></clause> <clause id="H94A976D7ECC4487386EB127E0AFCBE8C"><enum>(ii)</enum><header>Disposition of proceeds</header><text>Any gross proceeds received by an eligible entity from the sale, lease, or other conveyance of a parcel of Federal land under subparagraph (A)(ii) shall be deposited in the special account.</text></clause></subparagraph>
<subparagraph id="H7E66DC58B2904F4D8A18D45927DA762F"><enum>(D)</enum><header>Responsibility for remediation</header><text>If a parcel of Federal land reverts to the Secretary under subparagraph (A) and the Secretary determines that the Federal land is contaminated with hazardous waste, the eligible entity to which the Federal land was conveyed shall be responsible for remediation of the contamination of the parcel of Federal land.</text></subparagraph></paragraph> <paragraph id="H4BB0A0A5461F45548CAD81192393428B"><enum>(5)</enum><header>Applicable law</header><text>Any lease, patent, or real estate transaction for Federal land conveyed under paragraph (2) is affirmed and validated as having been completed pursuant to, and in compliance with, the Act of June 14, 1926 (commonly known as the <quote>Recreation and Public Purposes Act</quote>) (44 Stat. 741, chapter 578; <external-xref legal-doc="usc" parsable-cite="usc/43/869">43 U.S.C. 869</external-xref> et seq.), the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1701">43 U.S.C. 1701</external-xref> et seq.), and the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321</external-xref> et seq.), for the construction of public schools, fire stations, parks, community centers, law enforcement facilities, flood control facilities, and other public infrastructure.</text></paragraph>
<paragraph id="H6458DA986B2D4E5A8FA470A4A45890F2"><enum>(6)</enum><header>Payment of costs</header><text>The Secretary shall pay for any administrative and real estate transfer costs incurred in carrying out the conveyances of Federal land under paragraph (2) using amounts from the special account.</text></paragraph></subsection> <subsection id="HAF6CBBBA1F6E498D9032AA7E24927A89" commented="no"><enum>(c)</enum><header>Use of public-Private partnerships by units of local government for affordable housing</header> <paragraph id="H4CADFA5271FB46DAB340D5D68AC9994B"><enum>(1)</enum><header>Definitions</header><text>In this subsection:</text>
<subparagraph id="H7305BF877B0A4CF8845424E9A0778ECC"><enum>(A)</enum><header>Affordable housing</header><text>The term <quote>affordable housing</quote> means housing that serves individuals and families with a household income that does not exceed 120 percent of the area median income, including—</text> <clause id="H64842D2AB03F4539A019B3ADA6546F27"><enum>(i)</enum><text>in the case of homes for sale, homes that retain affordability for future buyers through the use of perpetual resale or deed restrictions; and</text></clause>
<clause id="H5F8ADBEDD0BF4C00906C6BDC6647D8A8"><enum>(ii)</enum><text>a manufactured home community, if the manufactured home community is managed by—</text> <subclause id="H6176CA7658024AA59339C6E3B07E3DDB"><enum>(I)</enum><text>a nonprofit organization; or </text></subclause>
<subclause id="HD51E44EB948E4334AD89481CDFF03420"><enum>(II)</enum><text>a resident-owned cooperative. </text></subclause></clause></subparagraph> <subparagraph id="HD16150E73D214BD38A736E1A62AAE038"><enum>(B)</enum><header>Covered land</header><text>The term <term>covered land</term> means any parcel of Federal land in the County that is—</text>
<clause id="HCB7DE0A96DCD4A65BA53C60B9C17120D"><enum>(i)</enum><text>acquired or conveyed by a unit of local government before, on, or after the date of enactment of this Act for public purposes; and</text></clause> <clause id="H4C9A7A1C2734411E8AF82D2BFECF3121"><enum>(ii)</enum><text>subject to reversion to the United States if the acquired or conveyed Federal land is no longer used for public purposes.</text></clause></subparagraph></paragraph>
<paragraph id="H29FCEAAF1157486BB78D14160A5AA744"><enum>(2)</enum><header>Use of covered land</header>
<subparagraph id="HD78045A3637D4FE98D056072AAB580D9"><enum>(A)</enum><header>In general</header><text>Any covered land may be developed, financed, used, and maintained for public purposes, including affordable housing, by any entity operating in the County that has entered into a contract with the applicable unit of local government providing for the use of the covered land by the entity.</text></subparagraph> <subparagraph id="H78F0BC06C609453E94366BDDEEC21BE8"><enum>(B)</enum><header>Exemption from notice of realty action requirement</header><text>If an entity seeks to use covered land for affordable housing purposes under subparagraph (A), the entity—</text>
<clause id="HEE708BC9B9ED4A8AA8C0DF72FFADBEC9"><enum>(i)</enum><text>shall not be required to comply with notice of realty action requirements with respect to the covered land; but</text></clause> <clause id="H9ED0A74C40134947B3EFB875799D702E"><enum>(ii)</enum><text>before using the covered land for affordable housing purposes, shall provide, for a period of not less than 14 days, adequate public notice of the use of the covered land.</text></clause></subparagraph>
<subparagraph id="HF6B70ABC44C0413EAFC64209D292683F"><enum>(C)</enum><header>Reversion</header><text>If covered land that is used for affordable housing purposes under subparagraph (A) ceases to be used for affordable housing or any other public purpose, all right, title, and interest in and to the covered land shall, at the discretion of the Secretary, revert to the United States. </text></subparagraph></paragraph> <paragraph id="HE9CB7563AED34A01B9A7E55DD831544B"><enum>(3)</enum><header>Acquisition of covered land for affordable housing purposes</header><text>On submission of an application to the Secretary by a unit of local government for the conveyance to the unit of local government of covered land for affordable housing purposes as authorized under section 7(b) of the Southern Nevada Public Land Management Act of 1998 (<external-xref legal-doc="public-law" parsable-cite="pl/105/263">Public Law 105–263</external-xref>; 111 Stat. 2349), not later than 90 days after the date of receipt of the application, the Secretary shall convey to the unit of local government, for consideration in an amount of not more than $1, all right, title, and interest of the United States in and to the covered land. </text></paragraph></subsection></section>
<section id="H0AD822E934E141ADA052A7ADAF3037AA"><enum>205.</enum><header>Revocation of Ivanpah Area of Critical Environmental Concern and establishment of special management areas</header>
<subsection id="H756222F90EDE4F44A69D0C0E8ED2DCF6"><enum>(a)</enum><header>Revocation of Ivanpah Area of Critical Environmental Concern</header><text>The designation by the Bureau of Land Management of the Ivanpah Area of Critical Environmental Concern in the State dated February 14, 2014, is revoked.</text></subsection> <subsection id="H1F4CA10FFCE34A22B0F9D0EF77C8D34E"><enum>(b)</enum><header>Establishment of special management areas</header><text>The following areas in the County are designated as special management areas:</text>
<paragraph id="HDD603D968FF04055A29D724A01F84CB2"><enum>(1)</enum><header>Stump springs special management area</header><text>Certain Federal land in the County administered by the Bureau of Land Management, comprising approximately 141,786 acres, as generally depicted on the map entitled <quote>Southern Nevada Land Management</quote> and dated February 22, 2021, which shall be known as the <quote>Stump Springs Special Management Area</quote>.</text></paragraph> <paragraph id="H34CBF29FF32249DE9A90F74E65FB4CAF"><enum>(2)</enum><header>Bird springs valley special management area</header><text>Certain Federal land in the County administered by the Bureau of Land Management, comprising approximately 39,282 acres, as generally depicted on the map entitled <quote>Southern Nevada Land Management</quote> and dated February 22, 2021, which shall be known as the <quote>Bird Springs Valley Special Management Area</quote>.</text></paragraph>
<paragraph id="HBDACD1FFFEEC453BA13FED6699B4724B"><enum>(3)</enum><header>Desert tortoise protective corridor special management area</header><text>Certain Federal land in the County administered by the Bureau of Land Management, comprising approximately 42,974 acres, as generally depicted on the map entitled <quote>Southern Nevada Land Management</quote> and dated February 22, 2021, which shall be known as the <quote>Desert Tortoise Protective Corridor Special Management Area</quote>, which shall take the place of and serve the purposes of the Ivanpah Area of Critical Environmental Concern revoked under subsection (a).</text></paragraph> <paragraph id="H2F8527549A5D43C2A65758546D739440"><enum>(4)</enum><header>Jean lake special management area</header><text>Certain Federal land in the County administered by the Bureau of Land Management, comprising approximately 2,669 acres, as generally depicted on the map entitled <quote>Southern Nevada Land Management</quote> and dated February 22, 2021, which shall be known as the <quote>Jean Lake Special Management Area</quote>.</text></paragraph>
<paragraph id="HB71CF8A5152E46928E444B2DCAC77FD2"><enum>(5)</enum><header>Gale hills special management area</header><text>Certain Federal land in the County administered by the Bureau of Land Management, comprising approximately 16,411 acres, as generally depicted on the map entitled <quote>Southern Nevada Land Management</quote> and dated February 22, 2021, which shall be known as the <quote>Gale Hills Special Management Area</quote>.</text></paragraph> <paragraph id="HBC80FEB8521043B7822CF4C3C6CE2F6D"><enum>(6)</enum><header>California wash special management area</header><text>Certain Federal land in the County administered by the Bureau of Land Management, comprising approximately 8,203 acres, as generally depicted on the map entitled <quote>Southern Nevada Land Management</quote> and dated February 22, 2021, which shall be known as the <quote>California Wash Special Management Area</quote>.</text></paragraph>
<paragraph id="HA951906AE44F41AB8FF96102109C0629"><enum>(7)</enum><header>Bitter springs special management area</header><text>Certain Federal land in the County administered by the Bureau of Land Management, comprising approximately 61,711 acres, as generally depicted on the map entitled <quote>Southern Nevada Land Management</quote> and dated February 22, 2021, which shall be known as the <quote>Bitter Springs Special Management Area</quote>.</text></paragraph> <paragraph id="HC1A766683BB141DF9D89485D6F700169"><enum>(8)</enum><header>Muddy mountains special management area</header><text>Certain Federal land in the County administered by the Bureau of Land Management, comprising approximately 32,250 acres, as generally depicted on the map entitled <quote>Southern Nevada Land Management</quote> and dated February 22, 2021, which shall be known as the <quote>Muddy Mountains Special Management Area</quote>.</text></paragraph>
<paragraph id="HA7C09CC116324E469B784290847D7651"><enum>(9)</enum><header>Mesa milkvetch special management area</header><text>Certain Federal land in the County administered by the Bureau of Land Management, comprising approximately 8,430 acres, as generally depicted on the map entitled <quote>Southern Nevada Land Management</quote> and dated February 22, 2021, which shall be known as the <quote>Mesa Milkvetch Special Management Area</quote>. </text></paragraph></subsection> <subsection id="H4374D185962D4826AD4C88303E1B2FF6"><enum>(c)</enum><header>Purposes</header><text>The purposes of a special management area designated by subsection (b) (referred to in this section as a <quote>Special Management Area</quote>) are—</text>
<paragraph id="HDAA5AD9BEEEA4AC1AAB76DA44F8940D5"><enum>(1)</enum><text>to provide for the conservation and recovery of the diversity of natural habitats and native species of plants and animals in the County covered by the Clark County Multiple Species Habitat Conservation Plan (including any amendments to the plan); and</text></paragraph> <paragraph id="H17D65621A1B64DD1870E4ED4861D8FD2"><enum>(2)</enum><text>to mitigate the impacts of—</text>
<subparagraph id="HEF4C2727B5704526AECB65D8BDCE8289"><enum>(A)</enum><text>any amendment to the applicable Federal incidental take permit, as required by sections 17.22(b)(1) and 17.32(b)(1) of title 50, Code of Federal Regulations (or successor regulations); and</text></subparagraph> <subparagraph id="H879EF6052A66463BA150C0BB5CF7C67F"><enum>(B)</enum><text>any amendments to the Clark County Multiple Species Habitat Conservation Plan under section 206.</text></subparagraph></paragraph></subsection>
<subsection id="H6E3605084626470180D464A74EFDF94B"><enum>(d)</enum><header>Management of special management areas</header>
<paragraph id="H62C079E8766E4729A092C5BD031B77C8"><enum>(1)</enum><header>In general</header><text>The Secretary shall manage each Special Management Area—</text> <subparagraph id="HAABFE463612F4969AF95C0E67CE08869"><enum>(A)</enum><text>in a manner that conserves, protects, and enhances the purposes for which the Special Management Area is established; and</text></subparagraph>
<subparagraph id="H0C5F52006461475D98CD49FA81F7282D"><enum>(B)</enum><text>in accordance with—</text> <clause id="H666316AB61C2477680645935C3BC1E41"><enum>(i)</enum><text>this section;</text></clause>
<clause id="HDB1F46A788EB447C8327796CDDB3CF35"><enum>(ii)</enum><text>the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1701">43 U.S.C. 1701</external-xref> et seq.); and</text></clause> <clause id="H5C58E664B0B447A8A8526A58CA1D99A6"><enum>(iii)</enum><text>any other applicable law.</text></clause></subparagraph></paragraph>
<paragraph id="H17B96FA49AFE4A74BAC3D93D9D3A9FAC"><enum>(2)</enum><header>Uses</header><text>The Secretary shall allow only uses of a Special Management Area that are consistent with the purposes for which the Special Management Area is established.</text></paragraph> <paragraph id="H4B54EAEEBCEE4BA4A246405629A56941"><enum>(3)</enum><header>Motorized vehicles; new roads</header> <subparagraph id="H15CFEF9B414C41C7BF807EA0D31F21C7"><enum>(A)</enum><header>Motorized vehicles</header><text>Except as needed for emergency response or administrative purposes, the use of motorized vehicles in the Special Management Areas shall be permitted only on roads and motorized routes designated for the use of motorized vehicles in the management plan developed under subsection (i)(1)(A).</text></subparagraph>
<subparagraph id="H9511CDA52CEB4BF2AB4BE0D3C61129CC"><enum>(B)</enum><header>New roads</header><text>No new permanent or temporary roads or other motorized vehicle routes shall be constructed within the Special Management Areas after the date of enactment of this Act. </text></subparagraph></paragraph></subsection> <subsection id="HC6DC6327D2DE47EC9CB49DE6F7912751"><enum>(e)</enum><header>Map and legal description</header> <paragraph id="H68F1E575B48B49F3AC0348ECB908F4AF"><enum>(1)</enum><header>In general</header><text>As soon as practicable after the date of enactment of this Act, the Secretary shall prepare and submit to the Committee on Energy and Natural Resources of the Senate and the Committee on Natural Resources of the House of Representatives a map and legal description of each Special Management Area.</text></paragraph>
<paragraph id="H50E41594827F4A46921E19D042DFB89B"><enum>(2)</enum><header>Effect</header><text>A map or legal description filed under paragraph (1) shall have the same force and effect as if included in this Act.</text></paragraph> <paragraph id="HA7E2B2B92DF5419D9180575905A899AE"><enum>(3)</enum><header>Corrections</header><text>The Secretary may correct minor errors in a map or legal description filed under paragraph (1), if, before making a proposed correction, the Secretary submits to the County the proposed correction for review and approval.</text></paragraph>
<paragraph id="HCE411D0C85C743B587E86F306DC54B58"><enum>(4)</enum><header>Public availability</header><text>A copy of each map and legal description filed under paragraph (1) shall be on file and available for public inspection in the Las Vegas Field Office of the Bureau of Land Management.</text></paragraph></subsection> <subsection id="HE826F8B52F35454FBCA0961FF0C6BA98"><enum>(f)</enum><header>Incorporation of acquired land and interests</header><text>Any land or interest in land that is acquired by the United States within a Special Management Area shall—</text>
<paragraph id="H359F0CAC7BE44B3F95AB89F2054E6DC3"><enum>(1)</enum><text>become part of the Special Management Area in which the acquired land or interest in land is located;</text></paragraph> <paragraph id="HA1CF083C75994B22848D55ACACC8AEDF"><enum>(2)</enum><text>be withdrawn in accordance with subsection (g); and</text></paragraph>
<paragraph id="H2D2E3962F5134E958C3E1E87266F49F1"><enum>(3)</enum><text>be managed in accordance with—</text> <subparagraph id="HF45067A7550B4190934021BAC18A540F"><enum>(A)</enum><text>this section;</text></subparagraph>
<subparagraph id="H37A02102A2E6473A8EA36EF35AD34B38"><enum>(B)</enum><text>the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1701">43 U.S.C. 1701</external-xref> et seq.); and</text></subparagraph> <subparagraph id="HEFF3F64A533B4E6995E746E60C36CFF2"><enum>(C)</enum><text>any other applicable law (including regulations).</text></subparagraph></paragraph></subsection>
<subsection id="H863D5C8817EF461D903E5633767AC18B"><enum>(g)</enum><header>Withdrawal</header><text>Subject to valid existing rights, and to rights-of-way for construction, maintenance, and operation of the Moapa Valley Water District facilities depicted on the map entitled <quote>Moapa Valley Water District–Facilities and Land Conveyances</quote> and dated November 13, 2019, all Federal land within the areas described in subsection (b) are withdrawn from—</text> <paragraph id="H7833F9B2B38A4F5E96AA60E53ECA0735"><enum>(1)</enum><text>all forms of entry, appropriation, and disposal under the public land laws;</text></paragraph>
<paragraph id="H39C784B2FE584CF8835AC1857187B619"><enum>(2)</enum><text>location, entry, and patent under the mining laws; and</text></paragraph> <paragraph id="HCF74C11D00934C82ADEB32CC11662006"><enum>(3)</enum><text>operation of the mineral leasing, mineral materials, and geothermal leasing laws.</text></paragraph></subsection>
<subsection id="HA760F28C2B974130AF134C1D16022588"><enum>(h)</enum><header>Cooperative management agreement</header><text>Not later than 1 year after the date of enactment of this Act, the Secretary shall enter into a cooperative management agreement with the County that provides for the joint management of the Special Management Areas by the Secretary and the County, in accordance with—</text> <paragraph id="HBC66A8896C73459C8E6F4DF1C0EC965B"><enum>(1)</enum><text>this section;</text></paragraph>
<paragraph id="H34ABAB5E06E3492BA3E020155E7345BF"><enum>(2)</enum><text>the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1701">43 U.S.C. 1701</external-xref> et seq.); and</text></paragraph> <paragraph id="H8EC9501BD1A64F8ABCC2A852DB4960A1"><enum>(3)</enum><text>any other applicable Federal law.</text></paragraph></subsection>
<subsection id="H3ED128B4EAB745A4B486BDD16DDD049A"><enum>(i)</enum><header>Management plan</header>
<paragraph id="HAB97C366B4C848F8B3B72A5481AB4995"><enum>(1)</enum><header>In general</header><text>As soon as practicable, but not later than 1 year, after the date on which the County is issued an amended Federal incidental take permit in accordance with section 206, the Secretary and the County shall—</text> <subparagraph id="H69037B955CBD45DAB8FAD80319BB940E"><enum>(A)</enum><text>develop a comprehensive cooperative management plan for the long-term protection and management of the Special Management Areas; and</text></subparagraph>
<subparagraph id="HA19EC03D9AEE41BD8482C65FBE4D7915"><enum>(B)</enum><text>amend the 1998 Las Vegas Resource Management Plan to incorporate the provisions of the management plan for the Special Management Areas developed under subparagraph (A).</text></subparagraph></paragraph> <paragraph id="H0102CFDB6E7447B8888DA87C417494F5"><enum>(2)</enum><header>Interim management</header><text>During the period beginning on the date of enactment of this Act and ending on the date on which the management plan developed under paragraph (1)(A) and the amendment to the 1998 Las Vegas Resource Management Plan required under paragraph (1)(B) take effect, the Secretary shall not authorize the use of the Federal land described in subsection (b) for any activity contrary to the purposes described in subsection (c), including—</text>
<subparagraph id="HDFA02F55DAD144018F2733F8813879EA"><enum>(A)</enum><text>disposal;</text></subparagraph> <subparagraph id="H8C0CFDA5EA38424E89AC13A2BE5E8FFD"><enum>(B)</enum><text>rights-of-way;</text></subparagraph>
<subparagraph id="HA62B252F1E5B4A8EA9E003282D2B11B9"><enum>(C)</enum><text>leases, including utility-scale solar energy facilities;</text></subparagraph> <subparagraph id="H1EFA104F984B4689B0623E242C2DB645"><enum>(D)</enum><text>livestock grazing;</text></subparagraph>
<subparagraph id="HCE0369346B2748839BDB8F539844AB5D"><enum>(E)</enum><text>infrastructure development; and</text></subparagraph> <subparagraph id="H22C8C04EFF754E3D975AA223F8330902"><enum>(F)</enum><text>mineral entry.</text></subparagraph></paragraph></subsection>
<subsection id="H05F90211AA8A4D57AB506DA225FFB27B"><enum>(j)</enum><header>Transportation and utility corridors</header>
<paragraph id="H5DC4641F1D9A4C8B9EA384F87994A90E"><enum>(1)</enum><header>In general</header><text>Consistent with this subsection, the management plan for the Special Management Areas developed under subsection (i)(1)(A) shall establish provisions, including avoidance, minimization, and mitigation measures, for ongoing maintenance of public utility and other rights-of-way in existing designated transportation and utility corridors within a Special Management Area.</text></paragraph> <paragraph commented="no" id="HD348086CE41D4160BCA4D28CDA3BBBA6"><enum>(2)</enum><header>Effect</header><text display-inline="yes-display-inline">Nothing in this section—</text>
<subparagraph id="HF7481560A0BE40C4B226AE9015D3B7D0" commented="no"><enum>(A)</enum><text>affects the existence, use, operation, maintenance, repair, construction, reconfiguration, expansion, inspection, renewal, reconstruction, alteration, addition, relocation improvement funding, removal, or replacement of any utility facility or appurtenant right-of-way within an existing designated transportation and utility corridor within a Special Management Area; </text></subparagraph> <subparagraph id="H997F7E55BD2C4FF486C4EEABDA60552C" commented="no"><enum>(B)</enum><text>precludes the Secretary from authorizing the establishment of a new utility facility right-of-way within an existing designated transportation and utility corridor within a Special Management Area—</text>
<clause commented="no" id="HD9572EB3AEF040D69595D2CB322DF16A"><enum>(i)</enum><text>in accordance with— </text> <subclause id="H32BB7C6A38C047BA9F5FDFCF4CF2EE38" commented="no"><enum>(I)</enum><text>the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321</external-xref> et seq.); and</text></subclause>
<subclause id="H1E10AC3D8C354B5D8FF492CA9975A92B" commented="no"><enum>(II)</enum><text>any other applicable law; and </text></subclause></clause> <clause commented="no" id="HF225441E9FC54F9D84C83E5C85D8A454"><enum>(ii)</enum><text>subject to such terms and conditions as the Secretary determines to be appropriate; or</text></clause></subparagraph>
<subparagraph commented="no" id="H8D065C9C7261460494E569C11FC449B3"><enum>(C)</enum><text>prohibits access to, or the repair or replacement of, a transmission line within a right-of-way grant within a Special Management Area issued before the date of enactment of this Act.</text></subparagraph></paragraph></subsection> <subsection id="HD2B8F8BE22EF4B83BB712412C89F63AC"><enum>(k)</enum><header>Effect</header><text>Nothing in this section prevents or interferes with—</text>
<paragraph id="HB7D37431C98C42B99B640848F1AF1B10"><enum>(1)</enum><text>the construction or operation of the Ivanpah Valley Airport authorized under the Ivanpah Valley Airport Public Lands Transfer Act (<external-xref legal-doc="public-law" parsable-cite="pl/106/362">Public Law 106–362</external-xref>; 114 Stat. 1404); or</text></paragraph> <paragraph id="H0F0B1AB7BCD0447CB7E0200FAE047C21"><enum>(2)</enum><text>the Airport Environs Overlay District authorized under section 501(c) of the Clark County Conservation of Public Land and Natural Resources Act of 2002 (<external-xref legal-doc="public-law" parsable-cite="pl/107/282">Public Law 107–282</external-xref>; 116 Stat. 2008) and section 3092(i) of the Carl Levin and Howard P. <quote>Buck</quote> McKeon National Defense Authorization Act for Fiscal Year 2015 (<external-xref legal-doc="public-law" parsable-cite="pl/113/291">Public Law 113–291</external-xref>; 127 Stat. 3875). </text></paragraph></subsection></section>
<section id="H9ABF7794D90F4A08B9ABE77F5F5F6298"><enum>206.</enum><header>Relationship to the Clark County Multiple Species Habitat Conservation Plan</header>
<subsection id="HBF4A9BFAFBAF4A73BD1A260D3F9D38F4"><enum>(a)</enum><header>Extension of habitat conservation plan</header><text>On receipt from the County of a complete application for an amendment to the applicable Federal incidental take permit, as required by sections 17.22(b)(1) and 17.32(b)(1) of title 50, Code of Federal Regulations (or successor regulations), and an amended Clark County Multiple Species Habitat Conservation Plan which incorporates the Special Management Areas established by section 205(b) and the provisions of the management plan required under section 205(i)(1)(A), the Secretary shall, in accordance with this Act, the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321</external-xref> et seq.), the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1531">16 U.S.C. 1531</external-xref> et seq.), and any other applicable Federal environmental laws—</text> <paragraph id="H4EFF1A32E47845BBB6A91F2148B8BE0C"><enum>(1)</enum><text>credit approximately 353,716 acres of the land conserved and designated as Special Management Areas under section 205(b), as depicted on the map entitled <quote>Southern Nevada Land Management</quote> and dated February 22, 2021, as mitigation to fully or partially offset, as determined by the Secretary using the best available scientific and commercial information, additional incidental take impacts resulting from development of additional land within the County covered under the existing Clark County Multiple Species Habitat Conservation Plan or to be covered through an amendment to the Clark County Multiple Species Habitat Conservation Plan and Federal incidental take permit; and </text></paragraph>
<paragraph id="HD5900E92705642058DBA3F5955C8567C"><enum>(2)</enum><text>extend the Clark County Multiple Species Habitat Conservation Plan and Federal incidental take permit for the maximum authorized duration, as determined by the Secretary.</text></paragraph></subsection> <subsection id="HA1A34AFF53B746B5A5C2C48D5CC8FCF3"><enum>(b)</enum><header>Federal permit issuance criteria</header><text>Before amending the Clark County Multiple Species Habitat Conservation Plan and extending the Federal incidental take permit under subsection (a), the Secretary shall ensure that the Federal incidental take permit issuance criteria required in sections 17.22(b)(2), 17.32(b)(2), and 222.307(c)(2) of title 50, Code of Federal Regulations (or successor regulations), are met.</text></subsection>
<subsection id="H84BB432593EC4B5B951993D02B711E34"><enum>(c)</enum><header>Effect</header><text>Nothing in this Act otherwise limits, alters, modifies, or amends the Clark County Multiple Species Habitat Conservation Plan.</text></subsection></section> <section id="HC64916CCB986447AA68A832BE3F14401"><enum>207.</enum><header>Designation of Maude Frazier Mountain</header> <subsection id="H2DB339637ED346428236210E56501043"><enum>(a)</enum><header>In general</header><text>The peak of Frenchman Mountain in the State located at latitude 36°10′45″ N, by longitude 114°59′52″ W, shall be designated as <quote>Maude Frazier Mountain</quote>.</text></subsection>

<paragraph id="HE57E663BE70F471086D7CA6AC37BD084"><enum>(1)</enum><header>In general</header><text>The Federal land conveyed under subsection (b) shall be subject to valid existing rights. </text></paragraph> <paragraph id="HBBFD162B157B46F782D6A4FBD4327D7F"><enum>(2)</enum><header>Administrative authority</header><text>The Secretary shall continue to have administrative authority over the Federal land conveyed under subsection (b) after the date of the conveyance.</text></paragraph></subsection>

<paragraph id="H3C5104395A5E47B787627BF2B3495948"><enum>(1)</enum><header>In general</header><text>If the Federal land conveyed under subsection (b) ceases to be used for the public purpose for which the Federal land was conveyed, the Federal land shall revert to the United States, at the discretion of the Secretary, if the Secretary determines that reversion is in the best interest of the United States.</text></paragraph> <paragraph id="H377C47D7F3E840D99531BD3A6759F7D0"><enum>(2)</enum><header>Responsibility of City</header><text>If the Secretary determines under paragraph (1) that the Federal land should revert to the United States and that the Federal land is contaminated with hazardous waste, the City shall be responsible for remediation of the contamination of the Federal land.</text></paragraph></subsection></section>
<section id="H497EB00995EE45EA8F1C882ED96989FF"><enum>402.</enum><header>City of Mesquite, Nevada, conveyance for the protection of the Virgin River watershed</header>
<subsection id="H33B643AE322049E1A34E477BE64F2A7F"><enum>(a)</enum><header>Definitions</header><text>In this section:</text> <paragraph id="H9681C74805B14E7D9F3715F849165EA3"><enum>(1)</enum><header>City</header><text>The term <term>City</term> means the city of Mesquite, Nevada.</text></paragraph>
<paragraph id="HEEA4543E8B6E4F819C136AA6F564C2A3"><enum>(2)</enum><header>Federal land</header><text>The term <term>Federal land</term> means the approximately 250 acres of Federal land, as generally depicted on the Map.</text></paragraph> <paragraph id="H65F67B3E5D564F06B16631784E2E0697"><enum>(3)</enum><header>Map</header><text>The term <term>Map</term> means the map entitled <quote>City of Mesquite, River Park</quote> and dated November 13, 2019.</text></paragraph></subsection>
<subsection id="H2E3689A5CFC14AD796C283567A1EB3B5"><enum>(b)</enum><header>Authorization of conveyance</header><text>Notwithstanding the land use planning requirements of sections 202 and 203 of the Federal Land Policy and Management Act of 1976 ( <external-xref legal-doc="usc" parsable-cite="usc/43/1712">43 U.S.C. 1712</external-xref>, 1713), on request of the City, the Secretary shall convey to the City, without consideration, all right, title, and interest of the United States in and to the Federal land for use by the City in developing and implementing a watershed management plan for the Virgin River watershed, subject to the provisions of this section.</text></subsection> <subsection id="H1CBCF924FAAD408E88F4F24C2C3A5AA4"><enum>(c)</enum><header>Map and legal descriptions</header> <paragraph id="H5F54DD512F7941AE88674DFCAC269E3E"><enum>(1)</enum><header>In general</header><text>As soon as practicable after the date of enactment of this Act, the Secretary shall prepare final legal descriptions of the Federal land to be conveyed under subsection (b). </text></paragraph>

<subsection id="H928EB3DB21C548258D5BA0930F7EE24E"><enum>(a)</enum><header>Authorization of conveyance</header><text>Notwithstanding the land use planning requirements of sections 202 and 203 of the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1712">43 U.S.C. 1712</external-xref>, 1713), on request of the County, the Secretary shall convey to the County, without consideration, all right, title, and interest of the United States in and to the following parcels of Federal land, subject to the provisions of this section:</text> <paragraph id="H42D162BA969B46E384AB6C01B4D98E07"><enum>(1)</enum><header>Mount charleston public safety complex</header><text>The approximately 16-acre parcel of Federal land generally depicted as Parcel A on the map entitled <quote>Mount Charleston Public Safety Complex</quote> and dated November 13, 2019, and the 1.5-acre parcel of Federal land depicted on the map entitled <quote>Parcel for Lee Canyon Fire Station</quote> and dated November 13, 2019, for police and fire facilities.</text></paragraph>
<paragraph id="H6DB5F46B611B4ECFB60A258879EA1DA4"><enum>(2)</enum><header>Public safety training facilities</header><text>The approximately 123 acres of Federal land, as generally depicted on the map entitled <quote>Metro Parcels</quote> and dated November 13, 2019, for public safety training facilities.</text></paragraph></subsection> <subsection id="HFDC1FD184E26477A970043EB9CA07B6E"><enum>(b)</enum><header>Payment of costs</header><text>As a condition of the conveyance under subsection (a), the County shall pay any costs relating to any land surveys and other associated costs of conveying the parcels of Federal land under subsection (a).</text></subsection>

<paragraph id="HF55675EE620B480FAD972ABDCC35EF6E"><enum>(3)</enum><header>Map</header><text>The term <term>Map</term> means the map entitled <quote>Moapa Valley Water District–Facilities and Land Conveyances</quote> and dated November 13, 2019.</text></paragraph></subsection> <subsection id="H98E8F55F3D3947DDBD3BCF544DF35912"><enum>(b)</enum><header>Authorization of conveyance</header> <paragraph id="HA960B922F6D3454186CE159EA919AE7A"><enum>(1)</enum><header>In general</header><text>Notwithstanding the land use planning requirements of sections 202 and 203 of the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1712">43 U.S.C. 1712</external-xref>, 1713) and subject to paragraph (2), on request of the District, the Secretary shall convey to the District, without consideration, all right, title, and interest of the United States in and to the Federal land for the construction, operation, and maintenance of critical water conveyance infrastructure necessary to supply water to the communities of Logandale, Overton, Glendale, and Moapa, Nevada.</text></paragraph>
<paragraph id="H3B7DFFBDAC26433E9CA084FE03F9305D"><enum>(2)</enum><header>Limitation</header><text>If any parcel of Federal land authorized for conveyance under paragraph (1) is subject to transfer for the benefit of the Tribe under section 101(a), the interest in the parcel of Federal land to be conveyed to the District under paragraph (1) shall be in the form of a right-of-way for construction, maintenance, and operation of critical water conveyance infrastructure.</text></paragraph></subsection> <subsection id="H4A0A494F0318419C8A2929D77285D8E0"><enum>(c)</enum><header>Map and legal descriptions</header> <paragraph id="H08430A911AF14B5B826920FB4B86BE56"><enum>(1)</enum><header>In general</header><text>As soon as practicable after the date of enactment of this Act, the Secretary shall prepare final legal descriptions of the Federal land to be conveyed under subsection (b). </text></paragraph>

<subclause id="H537587D5BEB34930A310902FB2AAF7EF"><enum>(II)</enum><text>is not freestanding.</text></subclause></clause></subparagraph> <subparagraph id="H6F61782D6DDF4586B8D10A660486DC44"><enum>(B)</enum><header>Fair market value</header><text>Any land sold, leased, or otherwise conveyed under subparagraph (A) shall be for not less than fair market value.</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph>
<subparagraph id="H1C9A9F0F5BB04A089FB2411C338A2A01"><enum>(B)</enum><text>in subparagraph (C), by inserting <quote>and applicable State law</quote> before the period at the end; </text></subparagraph></paragraph> <paragraph id="HB70AD4AE07CA44B18C0782759E2CB891"><enum>(2)</enum><text>by striking paragraph (3) and inserting the following:</text>

<subparagraph id="HA3FFEFB762A04012AE69F69C7562C240"><enum>(B)</enum><text>for any other use by the City, by providing to the Secretary—</text> <clause id="HB3AB76F1299F4C998050C69CA61DFC7D"><enum>(i)</enum><text>written notice of the election; and</text></clause>
<clause id="H750599C434A54CCFA307F5B08A86BEF2"><enum>(ii)</enum><text>consideration in an amount equal to the fair market value of the land retained, which shall be subject to disposition in accordance with paragraph (2)(D).</text></clause></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph> <paragraph id="H5F3D5B302DE94F8CA387BDF8D830F9BA"><enum>(3)</enum><text>in paragraph (5)(A), by striking <quote>or reserved for recreation or other public purposes under paragraph (3)</quote> and inserting <quote>, reserved for recreation or other public purposes under paragraph (3)(A), or retained by the City under paragraph (3)(B)</quote>. </text></paragraph></subsection></section></title>

<subsection id="H7C3DEAB553724EEF9453763D587F37EC"><enum>(a)</enum><header>Establishment</header><text>Subject to valid existing rights, and to rights-of-way for the construction, maintenance, and operation of Moapa Valley Water District facilities, as depicted on the map entitled <quote>Moapa Valley Water District–Facilities and Land Conveyances</quote>, the following areas of Federal land administered by the Bureau of Land Management in the State are established as off-highway vehicle recreation areas:</text> <paragraph id="H4EF20A30B917435AA24081091A10294B"><enum>(1)</enum><header>Laughlin off-highway vehicle recreation area</header><text>The approximately 18,304 acres of Federal land, as generally depicted on the map entitled <quote>Southern Nevada Land Management</quote> and dated February 22, 2021, to be known as the <quote>Laughlin Off-Highway Vehicle Recreation Area</quote>.</text></paragraph>
<paragraph id="H417335C187AA43ACB0EF83F2EE1A5FF9"><enum>(2)</enum><header>Logandale trails off-highway vehicle recreation area</header><text>The approximately 21,756 acres of Federal land, as generally depicted on the map entitled <quote>Southern Nevada Land Management</quote> and dated February 22, 2021, to be known as the <quote>Logandale Trails Off-Highway Vehicle Recreation Area</quote>.</text></paragraph> <paragraph id="HDB8C0E77E9AC4B55A8606748FBFD66B5"><enum>(3)</enum><header>Nelson hills off-highway vehicle recreation area</header><text>The approximately 42,756 acres of Federal land, as generally depicted on the map entitled <quote>Southern Nevada Land Management</quote> and dated February 22, 2021, to be known as the <quote>Nelson Hills Off-Highway Recreation Area</quote>.</text></paragraph>
<paragraph id="HBEB98677CF9049E5B5D7E680F0234497"><enum>(4)</enum><header>Sandy valley off-highway vehicle recreation area</header><text>The approximately 39,040 acres of Federal land, as generally depicted on the map entitled <quote>Southern Nevada Land Management</quote> and dated February 22, 2021, to be known as the <quote>Sandy Valley Off-Highway Vehicle Recreation Area</quote>. </text></paragraph></subsection> <subsection id="H659BAF9715C84A07A602B34B1127C1B4"><enum>(b)</enum><header>Purposes</header><text>The purposes of each off-highway vehicle recreation area established by subsection (a) (referred to in this section as an <term>off-highway vehicle recreation area</term>) are to preserve, protect, and enhance for the benefit and enjoyment of present and future generations—</text>
<paragraph id="HDB643B5E107B498AAD01F4A615FB361B"><enum>(1)</enum><text>off-highway vehicle use;</text></paragraph> <paragraph id="H80EAF8B3655943999DD1037A3DD3CB56"><enum>(2)</enum><text>other activities as the Secretary determines to be appropriate; and</text></paragraph>
<paragraph id="H44E3039D14DC432CB102A2E56B3C8E67"><enum>(3)</enum><text>the scenic, watershed, habitat, cultural, historic, and ecological resources of the off-highway vehicle recreation areas.</text></paragraph></subsection> <subsection id="H5D00CBA61047419793D97D5B5637ACB3"><enum>(c)</enum><header>Management plans</header> <paragraph id="HA1DCAB3691464582B79BA8DDF2D97E08"><enum>(1)</enum><header>In general</header><text>Not later than 2 years after the date of enactment of this Act, in accordance with applicable law, the Secretary shall develop a comprehensive plan for the long-term management of each off-highway vehicle recreation area.</text></paragraph>
<paragraph id="H128CBA84DF5643F089D6D341C475286A"><enum>(2)</enum><header>Consultation</header><text>In developing the management plans under paragraph (1), the Secretary shall consult with—</text> <subparagraph id="HA74C12167C5542539A800A5066A703E7"><enum>(A)</enum><text>appropriate State, Tribal, and local governmental entities; and</text></subparagraph>
<subparagraph id="H241E4DED05B1467E8A6991B5886B9742"><enum>(B)</enum><text>members of the public.</text></subparagraph></paragraph></subsection> <subsection id="H5F79C6619AFE44C38F815CDD158275C2"><enum>(d)</enum><header>Management</header><text>The Secretary shall manage the off-highway vehicle recreation areas—</text>
<paragraph id="HF2F6E248F7AF4C96A6141748DB87FD0E"><enum>(1)</enum><text>to support the purposes described in subsection (b); and</text></paragraph> <paragraph id="HDBEE89B0A1BC4B5DA460A331177DC6AB"><enum>(2)</enum><text>in accordance with—</text>
<subparagraph id="H57BED6FFA6304F3F9692E0195266AB77"><enum>(A)</enum><text>the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1701">43 U.S.C. 1701</external-xref> et seq.);</text></subparagraph> <subparagraph id="HCA527DEA4FE945EF9E4D5C27E3F0AA92"><enum>(B)</enum><text>this section; and</text></subparagraph>
<subparagraph id="H0487235BB3BA4057829901E1D9447258"><enum>(C)</enum><text>any other applicable law (including regulations).</text></subparagraph></paragraph></subsection> <subsection id="H4A14D4359D84474DA00181D57957F855"><enum>(e)</enum><header>Motorized vehicles</header> <paragraph id="H9AA96FD3034C4AC1B1D9509FCC4844BB"><enum>(1)</enum><header>In general</header><text>Except as needed for administrative purposes or to respond to an emergency, the use of motorized vehicles in the off-highway vehicle recreation areas shall be permitted only on roads and trails designated for the use of motorized vehicles by the applicable management plan under subsection (c).</text></paragraph>
<paragraph id="H7A09A94013414DC6B969B2584ED4A200"><enum>(2)</enum><header>Interim management</header><text>During the period beginning on the date of enactment of this Act and ending on the date on which the management plan under subsection (c) for an off-highway vehicle recreation area takes effect, the use of motorized vehicles in the off-highway vehicle recreation areas shall be permitted in accordance with the applicable land use plan.</text></paragraph> <paragraph id="HACE6FAB23754494683EBE855C294D9AE"><enum>(3)</enum><header>Effect of subsection</header><text>Nothing in this subsection prevents the Secretary from closing an existing road or trail to protect natural resources or public safety, as the Secretary determines to be appropriate.</text></paragraph></subsection>
<subsection id="H7E5F794C847945A6A97B5F8DD8319684"><enum>(f)</enum><header>Transportation and utility corridors</header><text display-inline="yes-display-inline">Nothing in this section—</text> <paragraph id="H97524E0127454584A1F494878DEE54AF" commented="no"><enum>(1)</enum><text>affects the existence, use, operation, maintenance, repair, construction, reconfiguration, expansion, inspection, renewal, reconstruction, alteration, addition, relocation improvement funding, removal, or replacement of any utility facility or appurtenant right-of-way within an existing designated transportation and utility corridor within an off-highway vehicle recreation area; </text></paragraph>
<paragraph id="H625BEFA171C842958F7C9335BB0B24E3" commented="no"><enum>(2)</enum><text>precludes the Secretary from authorizing the establishment of a new utility facility right-of-way within an existing designated transportation and utility corridor within an off-highway vehicle recreation area—</text> <subparagraph commented="no" id="H5454BDE2FECA42D8BF7199FB985F81C0"><enum>(A)</enum><text>in accordance with— </text>
<clause id="HB61CA57F6FE5466B852C0598DDBFC426" commented="no"><enum>(i)</enum><text>the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321</external-xref> et seq.); and</text></clause> <clause id="HDE126642AEDF4A7986AF07F9CC93F5FC" commented="no"><enum>(ii)</enum><text>any other applicable law; and </text></clause></subparagraph>
<subparagraph commented="no" id="HC0B97221BF1C48B6990E683DEFF54DE6"><enum>(B)</enum><text>subject to such terms and conditions as the Secretary determines to be appropriate; or</text></subparagraph></paragraph> <paragraph commented="no" id="H48254CB599B44330963513AA72FD8C1A"><enum>(3)</enum><text>prohibits access to, or the repair or replacement of, a transmission line within a right-of-way grant within an off-highway vehicle recreation area issued before the date of enactment of this Act.</text></paragraph></subsection>
<subsection id="H3B4AA4E80FB6494594A1F7C639A00BD9"><enum>(g)</enum><header>Withdrawal</header><text>Subject to valid existing rights, all Federal land within the boundaries of an off-highway vehicle recreation area, together with any land designated as the <quote>Nellis Dunes Off-Highway Vehicle Recreation Area</quote> under section 3092(j)(3)(A) of <external-xref legal-doc="public-law" parsable-cite="pl/113/291">Public Law 113–291</external-xref> (<external-xref legal-doc="usc" parsable-cite="usc/16/460aaaa">16 U.S.C. 460aaaa(3)(A)</external-xref>), is withdrawn from—</text> <paragraph id="HEE88A9D7DD8B4F10B0458A54CB3BD2BB"><enum>(1)</enum><text>all forms of appropriation or disposal under the public land laws;</text></paragraph>
<paragraph id="H994CBC72CBE449179F81BA428BAD6AAC"><enum>(2)</enum><text>location, entry, and patent under the mining laws; and</text></paragraph> <paragraph id="HCA13C3CDF53D4DF6860B05D7A1CBD327"><enum>(3)</enum><text>operation of the mineral leasing, mineral materials, and geothermal leasing laws.</text></paragraph></subsection>
<subsection id="H6D8B0F2B960B477EBAE56AC1604CD702"><enum>(h)</enum><header>Maps and legal descriptions</header>
<paragraph id="H5645E7D0C80B428A9A826DBE1A8B4148"><enum>(1)</enum><header>In general</header><text>As soon as practicable after the date of enactment of this Act, the Secretary shall finalize the legal description of each off-highway vehicle recreation area.</text></paragraph> <paragraph id="H7810834B99E047ECA2C939AB52E3587C"><enum>(2)</enum><header>Errors</header><text>The Secretary may correct any minor error in—</text>
<subparagraph id="H2C34B048241E4F2CB3477658A4E4FE1C"><enum>(A)</enum><text>a map referred to in subsection (a); or</text></subparagraph> <subparagraph id="H3C5DD556E32C40AA933F3CFF52277994"><enum>(B)</enum><text>a legal description under paragraph (1).</text></subparagraph></paragraph>
<paragraph id="HC8471C4961BF48CAAE5F4B4C96D58ED6"><enum>(3)</enum><header>Treatment</header><text>The maps and legal descriptions referred to in paragraph (2) shall—</text> <subparagraph id="H8E3BA64C0FD043F59392A5884A5B9515"><enum>(A)</enum><text>be on file and available for public inspection in the appropriate offices of the Bureau of Land Management; and</text></subparagraph>
<subparagraph id="H9099094C75CA4E29BD7BC08E6C792DE4"><enum>(B)</enum><text>have the same force and effect as if included in this Act, subject to paragraph (2).</text></subparagraph></paragraph></subsection></section> <section id="H8E736E928B884BFEB27022D2108B6868"><enum>702.</enum><header>Water infrastructure conveyances for public purposes</header> <subsection id="HA77AA9A5285A4387983A9A0C3E072107"><enum>(a)</enum><header>Definitions</header><text>In this section:</text>
<paragraph id="H54132A1F7CD64206A1E8F58EA249F1DE"><enum>(1)</enum><header>Federal land</header><text>The term <term>Federal land</term> means the approximately 2,495 acres of Federal land, as generally depicted on the Map.</text></paragraph> <paragraph id="H207402002A0A44F1ACBE24A2C7210930"><enum>(2)</enum><header>Map</header><text>The term <term>Map</term> means the map entitled <quote>Section 702 Water Infrastructure Conveyances for Public Purposes</quote> and dated December 3, 2020. </text></paragraph></subsection>
<subsection id="H5ADBCEC564884D37A52D97C64B1A86A7"><enum>(b)</enum><header>Authorization of conveyance</header><text display-inline="yes-display-inline">Notwithstanding section 203 of the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1713">43 U.S.C. 1713</external-xref>) and subject to valid existing rights, on receipt of a request from a public water agency that provides wholesale or retail water service in the County, the Secretary shall convey to the public water agency, without consideration, all right, title, and interest of the United States in and to the Federal land for the construction, operation, and maintenance of critical water conveyance infrastructure necessary to supply water to the communities serviced by the public water agency. </text></subsection> <subsection id="H772ADD2527C141278642011C579D76D5"><enum>(c)</enum><header>Map and legal description</header> <paragraph id="HB404B5650CD54E8990D1C5D59D4A1877"><enum>(1)</enum><header>In general</header><text>As soon as practicable after the date of enactment of this Act, the Secretary shall prepare a final legal description of the Federal land to be conveyed under subsection (b).</text></paragraph>
<paragraph id="H7DF66A2E16B24E939B1A0D66F85FAE96"><enum>(2)</enum><header>Corrections</header><text>The Secretary may correct any minor errors in the Map or the legal description prepared under paragraph (1).</text></paragraph> <paragraph id="H8B2E6431F2D0412788E54BD888888631"><enum>(3)</enum><header>Availability</header><text>The Map and the legal description prepared under paragraph (1) shall be on file and available for public inspection in the appropriate offices of the Bureau of Land Management.</text></paragraph></subsection>
<subsection id="H2820919288454279B78114E7D07948A3"><enum>(d)</enum><header>Reversion</header>
<paragraph id="HB741EA924F71427B8736E935CFF276A8"><enum>(1)</enum><header>In general</header><text>If the Federal land conveyed under subsection (b) ceases to be used for the public purpose for which the Federal land was conveyed, as described in subsection (b), the Federal land shall revert to the United States, at the discretion of the Secretary, if the Secretary determines that reversion is in the best interest of the United States.</text></paragraph> <paragraph id="H57AB4353B38A4AA4BF372A054432A9A5"><enum>(2)</enum><header>Responsibility of public water agency</header><text>If the Secretary determines under paragraph (1) that the Federal land should revert to the United States and that the Federal land is contaminated with hazardous waste, the public water agency shall be responsible for remediation of the contamination of the Federal land. </text></paragraph></subsection>
<subsection id="H4E2FD14220A54DEFAB21F5A80D714EAB"><enum>(e)</enum><header>Effect of section</header><text>Nothing in this section—</text> <paragraph id="H5544187CDF5D4FC2AE383DDC034796F6"><enum>(1)</enum><text>permits any public water agency to obtain title to Federal land for the purpose of constructing the groundwater development project referred to in the right-of-way numbered N–78803; or</text></paragraph>
<paragraph id="H8008835A982644168F5C1A556D42F1E7"><enum>(2)</enum><text>affects the right, interest, or authority of the National Park Service to manage the Lake Mead National Recreation Area.</text></paragraph></subsection></section> <section id="H8856FAF01DA44D1D82DA9381599DBCDD"><enum>703.</enum><header>Lower Las Vegas Wash weirs</header> <subsection id="HFE326585A2FE44639BFB9CAB015C2228"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Subject to valid existing rights and all applicable laws, the Secretary shall complete construction of the 6 erosion control weirs on the lower Las Vegas Wash within the Lake Mead National Recreation Area that are unfinished as of the date of enactment of this Act, as identified in the study of the Federal Highway Administration entitled <quote>2010 Lower Las Vegas Wash Planning Study</quote>.</text></subsection>
<subsection id="H90A4AE5791014926BBF107BAE8D03AFB"><enum>(b)</enum><header>Deadline</header><text display-inline="yes-display-inline">The Secretary shall complete construction of the weirs described in subsection (a) by not later than 8 years after the date of enactment of this Act.</text></subsection></section> <section id="H07C0BA52118C43CC966E928686546860"><enum>704.</enum><header>Critical flood control facilities</header><text display-inline="no-display-inline">The Secretary shall amend the Las Vegas Resource Management Plan dated 1998 to allow for the design and construction of flood control facilities in the Coyote Springs Desert Tortoise Area of Critical Environmental Concern, as described in the most-recent update of the Las Vegas Valley Master Plan for Flood Control Facilities developed by the Regional Flood Control District, as generally depicted on the map attached to that update entitled <quote>Regional Flood Control District Master Plan Facilities in the Coyote Springs Area of Critical Environmental Concern</quote>.</text></section>
<section id="H93871620960A4FE8B0BD9A22564B607A"><enum>705.</enum><header>Maximizing education benefits</header>
<subsection id="H66FFAA5F464045518C2ACBAF1D6AD6C8"><enum>(a)</enum><header>Nevada System of Higher Education</header><text>Section 3092(h)(2) of <external-xref legal-doc="public-law" parsable-cite="pl/113/291">Public Law 113–291</external-xref> (127 Stat. 3874) is amended—</text> <paragraph id="H26E8B4DA88F0422FB2C90E820796474B"><enum>(1)</enum><text>in subparagraph (B)(i)(II), by striking <quote>purposes; and</quote> and inserting the following: </text>
<quoted-block style="OLC" display-inline="yes-display-inline" id="H68CF2818F9EE4B098D9830D3C7BD162E"><text>purposes, subject to the condition that the Board of Regents may—</text> <item id="H4562FC29E9484F9384892DC4B612503E"><enum>(aa)</enum><text>enter into 1 or more public-private partnerships or agreements (including a lease or conveyance), with respect to the Federal land, with any individual or entity for the commercial or residential development of all, or any portion of, the Federal land, to the extent that the development is consistent with the educational and research purposes of the System (including any use intended to generate financial support for those purposes); and</text></item>
<item id="H262A63A3CF1E465D838A3A24B42881F6"><enum>(bb)</enum><text>impose restrictions on the Federal land in accordance with those purposes; and</text></item><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph> <paragraph id="H86701C575C45490D900C264DF755D47E"><enum>(2)</enum><text>in subparagraph (C), by striking <quote>The System</quote> and inserting <quote>Subject to subparagraph (B)(i)(II), the System</quote>.</text></paragraph></subsection>
<subsection id="HADCC5F1C2C5C4580BE98C4657FA81724"><enum>(b)</enum><header>Nevada State College at Henderson</header><text>Section 704(b)(3) of the Clark County Conservation of Public Land and Natural Resources Act of 2002 (<external-xref legal-doc="public-law" parsable-cite="pl/107/282">Public Law 107–282</external-xref>; 116 Stat. 2015) is amended by striking subparagraph (A) and inserting the following:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="HCBA0BAAE40FE4E789C27AE5DC176FEED"> <subparagraph id="H866CBA95E7CB40679F3B12CE6B79C1B4"><enum>(A)</enum><header>In general</header><text>The College and the City may—</text>
<clause id="H06DF10406B3A40A88BCAFF5702021169"><enum>(i)</enum><text>use the land conveyed under paragraph (1) for any purpose relating to the establishment, operation, growth, or maintenance of the College, including any use that may generate financial support for such a purpose; and</text></clause> <clause id="H2111B1A3AFF2407B891F7D4BCF9F3B8A"><enum>(ii)</enum> <subclause commented="no" display-inline="yes-display-inline" id="H548CDC58EF5B4CF7B860AF2BA5C9493B"><enum>(I)</enum><text>enter into 1 or more public-private partnerships or agreements (including a lease or conveyance), with respect to the conveyed land, with any individual or entity for the commercial or residential development of all, or any portion of, the land; and</text></subclause>
<subclause id="H61FCFE08AD774835AD49861051750D8E" indent="up1"><enum>(II)</enum><text>impose such other restrictions on the conveyed land as the College and the City determine to be appropriate.</text></subclause></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section> <section id="H4DFBB0719A8748ABA5D981550CB7DCFD" commented="no" display-inline="no-display-inline"><enum>706.</enum><header>Jurisdiction over fish and wildlife</header><text display-inline="no-display-inline">Nothing in this Act affects the jurisdiction of the State with respect to the management of fish or wildlife on any Federal land located in the State.</text></section></title>
