R. 1591</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20210303">March 3, 2021</action-date><action-desc><sponsor name-id="R000577">Mr. Ryan</sponsor> (for himself and <cosponsor name-id="R000585">Mr. Reed</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To establish the United States Chief Manufacturing Officer in the Executive Office of the President with the responsibility of developing a National Manufacturing Strategy to revitalize the manufacturing sector, spur economic growth, and expand United States competitiveness, and for other purposes.</official-title></form><legis-body id="HB76AD7B162D74F1EA43A9005F4D4D7B8" style="OLC"><section id="H5C3B51F873DF4C97ACCE3118856787BA" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Chief Manufacturing Officer Act</short-title></quote>.</text></section><section id="HCEC7DD75B6B54196B8072F480978341B"><enum>2.</enum><header>Findings; sense of Congress</header><subsection id="HECB1C153D3D04BADBD40D5C73C3F928D"><enum>(a)</enum><header>Findings</header><text>The Congress finds the following:</text><paragraph id="H9C599091EE2246FB83FD037672DD6262"><enum>(1)</enum><text>The manufacturing sector consists of establishments that are primarily engaged in the transformation of materials, substances, or components into products.</text></paragraph><paragraph id="H57157599D9164AC499897D0EA5872673"><enum>(2)</enum><text>A healthy, innovative manufacturing base plays a central role in the United States economy and national defense.</text></paragraph><paragraph id="HB0DDA5B1848D432C9E1EA246608EF05F"><enum>(3)</enum><text>The Federal Government supports manufacturing in a variety of ways; support for manufacturing-related activities are dispersed across several agencies in the executive branch.</text></paragraph><paragraph id="H673C2F8C11E44B7098FD862D64E57103"><enum>(4)</enum><text display-inline="yes-display-inline">Manufacturing employment, output, and exports are impacted by a myriad of factors including the state of infrastructure and transportation, tax policies, environmental and other business regulations, trade policies, innovation ecosystems, workforce development, and education initiatives. Legislation and executive actions can have unintended impact on the growth of manufacturing in the United States.</text></paragraph><paragraph id="HE81932950B154E13A8943384CDEAF1DA"><enum>(5)</enum><text>Manufacturers account for 11 percent of the total gross domestic product output in the United States, employing 8 percent of the workforce. Total output from manufacturing is more than 2 trillion dollars. There are nearly 13 million manufacturing employees in the United States, with an average annual compensation of about $85,000.</text></paragraph><paragraph id="H12BD735CF67C4B5580D04BB2B761DAA1"><enum>(6)</enum><text>Given that 99 percent of manufacturing firms are small and medium size enterprises with a predominantly local employment footprint, workforce development programs must be rooted in local circumstance and requirements.</text></paragraph></subsection><subsection id="HE7A61AE9C2784182AA3CFC663DFBC776"><enum>(b)</enum><header>Sense of Congress</header><text>It is the sense of Congress that a well-designed National Manufacturing Strategy would benefit the United States economy in several important ways, including the following:</text><paragraph id="H23B5ABE932A7425E8AF568577C617424"><enum>(1)</enum><text>A revitalized manufacturing sector would enable the United States to increase its economic growth from domestic and export production.</text></paragraph><paragraph id="H91ADA7A134DE481D9B856E28F940244F"><enum>(2)</enum><text>Manufacturing jobs continue to pay higher wages and benefits than non-manufacturing jobs. Average domestic wages would rise in response to growing manufacturing output.</text></paragraph><paragraph id="H735A332CA12F40CC87F0D53E31998B17"><enum>(3)</enum><text>Manufacturing industries undertake two-thirds of private-sector research and development, which fuels the innovation that serves as a primary engine of economic growth. A growing manufacturing sector would help lay the foundations for future economic expansion.</text></paragraph><paragraph id="HA2F188EA3CC74B6B9392478126ECC1F3"><enum>(4)</enum><text>The United States would expand its long-standing leadership in advanced manufacturing technologies with Federal investments in manufacturing research and development, education, and workforce training.</text></paragraph><paragraph id="HB21E4D6E8EB6498E81E7FC9247B6662C"><enum>(5)</enum><text>There exists a longstanding connection between domestic manufacturing, national defense, and homeland security. A strong and innovative manufacturing industry will maintain the technical superiority of the United States military and secure supply chain integrity.</text></paragraph></subsection></section><section id="H2A191702C9794BAFB8329D5401CD57C0"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="H28671E3CAD7644D4BE7B07AA4BB47AFD"><enum>(1)</enum><header>Agency</header><text>The term <term>agency</term> has the meaning given that term in section 551 of title 5, United States Code.</text></paragraph><paragraph id="HD3CDC65AEE43456BAEC0E776ACDC0172"><enum>(2)</enum><header>Institution of higher education</header><text>The term <term>institution of higher education</term> has the meaning given that term in section 101 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1001">20 U.S.C. 1001</external-xref>).</text></paragraph><paragraph commented="no" id="H78D7BD6DD78243EFB766DC41C15EE3D8"><enum>(3)</enum><header>National Manufacturing Strategy; Strategy</header><text display-inline="yes-display-inline">The terms <term>National Manufacturing Strategy</term> and <term>Strategy</term> mean the National Manufacturing Strategy described in subsection (d).</text></paragraph><paragraph id="H913FABA489664FFB961A7D780F46D964"><enum>(4)</enum><header>Small business</header><text>The term <term>small business</term> means a company that has fewer than 500 employees.</text></paragraph><paragraph id="H550B86087F8241578E2425E489FF8513"><enum>(5)</enum><header>Nonprofit organization</header><text>The term <term>nonprofit organization</term> means an organization that is described under <external-xref legal-doc="usc" parsable-cite="usc/26/501">section 501(c)</external-xref> of the Internal Revenue Code of 1986 and exempt from tax under section 501(a) of such Code.</text></paragraph><paragraph id="H1BDDF17FFCE8443DA0E64F6F300D3454"><enum>(6)</enum><header>State</header><text>The term <term>State</term> means each of the several States, the District of Columbia, each commonwealth, territory, or possession of the United States, and each federally recognized Indian Tribe.</text></paragraph><paragraph id="H0033EFB68AD24AAA940D399BE02ECBC3"><enum>(7)</enum><header>State educational agency</header><text>The term <term>State educational agency</term> has the meaning given that term in section 8101 of the Elementary and Secondary Education Act (<external-xref legal-doc="usc" parsable-cite="usc/20/7801">20 U.S.C. 7801</external-xref>).</text></paragraph></section><section id="H148FC59A18824AC495A57D1BDA50CBE0"><enum>4.</enum><header>United States Chief Manufacturing Officer</header><subsection id="H0D37D95049AB40DBB548AEEF731D5D68"><enum>(a)</enum><header>Appointment</header><paragraph id="H7152C0518769449EBABEF35CE691259C"><enum>(1)</enum><header>In general</header><text>Not later than 6 months after the date of the enactment of this Act, the President shall appoint a United States Chief Manufacturing Officer (referred to in this section as the <quote>Chief Manufacturing Officer</quote>).</text></paragraph><paragraph id="HF27791BBAE6A409AB3EFC04A89B5CE38"><enum>(2)</enum><header>Qualifications</header><text>The President shall select the Chief Manufacturing Officer from among individuals who have basic qualifications and expertise in manufacturing technology and policy.</text></paragraph><paragraph id="HA3958CD420EC4020B13F656040C300F9"><enum>(3)</enum><header>Reporting</header><text>The position of Chief Manufacturing Officer shall be in the Executive Office of the President and shall report to the President through the Chief of Staff.</text></paragraph><paragraph id="HA433A077F45F41FF94A668F8EC2A1631"><enum>(4)</enum><header>National economic council</header><text>The Chief Manufacturing Officer shall be a member of the National Economic Council.</text></paragraph></subsection><subsection id="HF35399784A204334A38B055A968F54A8"><enum>(b)</enum><header>Pay</header><text display-inline="yes-display-inline">The annual rate of pay for the Chief Manufacturing Officer shall be level II of the Executive Schedule rate of pay (subchapter II of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/53">chapter 53</external-xref> of title 5, United States Code) commensurate with the qualifications and expertise of the individual appointed to be such Officer.</text></subsection><subsection id="H4805CF8532AE4F61AE0BE17E45BC3608"><enum>(c)</enum><header>Duties</header><text>The duties of the Chief Manufacturing Officer are as follows:</text><paragraph id="H7A60D90DAC164F868A1B3D06EE794D90"><enum>(1)</enum><text>To advise the President on policy issues that affect the workforce and economic activity of the manufacturing sector including science, technology, trade, tariffs, currency, and procurement policies.</text></paragraph><paragraph commented="no" id="H11CD148826CB470BA8790C17C2A6C659"><enum>(2)</enum><text>To deliver the National Manufacturing Strategy.</text></paragraph><paragraph id="H81C5B03BD8A744EE8B00A25DC59D50C8"><enum>(3)</enum><text display-inline="yes-display-inline">To convene interagency working groups to align Federal policies to drive implementation of the National Manufacturing Strategy, including collaboration among the Departments of Education, Labor, Energy, Commerce, and Defense, the Environmental Protection Agency, National Science Foundation, Small Business Administration, and other agencies.</text></paragraph><paragraph id="HA32A5589D3F24A0390CF646FD89E8EA6"><enum>(4)</enum><text>To evaluate the effectiveness of existing measures designed to improve innovation, productivity, energy efficiency, economic growth, cybersecurity, and manufacturing industries’ contribution to national security.</text></paragraph><paragraph id="H4C32F384BF6A462FB358662425D86B40"><enum>(5)</enum><text>To propose studies and policy experiments, in cooperation with agencies and the manufacturing industry, to determine effective measures to advance technological innovation and productivity in manufacturing in the United States.</text></paragraph><paragraph id="HB38D7DBDC6DD4C17A27715666D5DAFAF"><enum>(6)</enum><text>To propose studies and policy experiments, in cooperation with agencies and the manufacturing industry, to determine effective measures to improve environmental sustainability within the manufacturing industry.</text></paragraph><paragraph id="HF9DBF35E19AF4D3AB809AF52937091C9"><enum>(7)</enum><text display-inline="yes-display-inline">To connect manufacturing support programs across the United States to make them more efficient, focused, and easier to use.</text></paragraph><paragraph id="H80C1D9B075644DA7828A79D9B5034E92"><enum>(8)</enum><text>To identify opportunities to improve the efficiency of grant opportunities that affect the manufacturing workforce.</text></paragraph><paragraph id="HA35C51030E014CBEA5139A5D01E2EE09"><enum>(9)</enum><text display-inline="yes-display-inline">To assess Federal loan programs to ensure greater access to capital for small businesses that are manufacturers.</text></paragraph><paragraph id="HDA10F9C34ED8434E996F84509524F350"><enum>(10)</enum><text>To examine and improve tax incentives for manufacturing companies in relation to increasing support for investment in—</text><subparagraph id="H4B41033EDC8F455FBD958DB6D26E8FCF"><enum>(A)</enum><text>workforce training; and</text></subparagraph><subparagraph id="HFC582316B3D9407891DEA20128A89102"><enum>(B)</enum><text display-inline="yes-display-inline">productivity and systems improvements, including smart supply chain management technology and cybersecurity measures.</text></subparagraph></paragraph><paragraph id="H90ED4E25479141F88422B2908889058D"><enum>(11)</enum><text>To foster the use of best practices for manufacturing, information technology, and cybersecurity by identifying and encouraging their use across all Federal Government programs and throughout the procurement process.</text></paragraph><paragraph id="H94DCF43E4FF64690BA29C36EA95F7AD0"><enum>(12)</enum><text>To encourage the creation of joint initiatives by State and local governments, regional organizations, private companies, institutions of higher education, nonprofit organizations, and Federal laboratories to encourage technology transfer, to stimulate innovation, and pursue targeted workforce development to promote an environment ready for investments in manufacturing-related industries.</text></paragraph><paragraph id="HAA4EE72A42B24A15AB47F3C6F4EFF406"><enum>(13)</enum><text>To participate in discussions among companies that manufacture in the United States on topics of interest to the manufacturing industry and workforce, including discussions regarding emerging and advanced technologies.</text></paragraph><paragraph id="H5E153416C3E643CD940D6FB0DCF5816F"><enum>(14)</enum><text>To work with the manufacturing industry to identify needs, challenges, and opportunities across the manufacturing sector which, if addressed, could make a significant contribution to improving the ability of manufacturers in the United States to compete successfully in international markets.</text></paragraph><paragraph id="HE0E1CAADEE054264B321F2BA05FDF886"><enum>(15)</enum><text>To carry out ongoing competitive analysis of the manufacturing policies of the governments of other countries, alongside their industrial structures and labor conditions, to help identify factors that successfully support the development of strong manufacturing industries.</text></paragraph><paragraph id="HDEFFC27AA25140AA9687684C15DBED2B"><enum>(16)</enum><text>To analyze legislative and agency proposals to assess and advise on their potential direct and indirect impact on the manufacturing industry.</text></paragraph><paragraph id="H097E7A08C5664FBC87DD6B577A2EB184"><enum>(17)</enum><text display-inline="yes-display-inline">To work with agencies and the Director of the Office of Management and Budget in the development of manufacturing-related elements of the President’s annual budget request to Congress.</text></paragraph><paragraph id="HBE85A7012E3B4C15A7C3373C3F64449B"><enum>(18)</enum><text>To identify and share best practice activities designed to help support struggling manufacturing enterprises to review business plans, improve competitiveness, and manage issues like succession planning to avoid closures and retain jobs.</text></paragraph><paragraph id="H5DB15D4C1B3F42DE94331FB3113B2E5B"><enum>(19)</enum><text display-inline="yes-display-inline">To assist States in their economic development plans for manufacturing, in their efforts to encourage manufacturing enterprises to retain manufacturing facilities within the United States, and to foster the domestic retention of facilities and jobs.</text></paragraph><paragraph id="HD24134ADF4B949AFA5AC345A7C0C2574"><enum>(20)</enum><text>To support communities negatively impacted by the closure or relocation of manufacturing facilities by promoting efforts to create an environment and workforce equipped to attract advanced manufacturing enterprises.</text></paragraph><paragraph id="H870D2F0C145B43B6A636F7E9B706B1ED"><enum>(21)</enum><text>To promote and grow the Network for Manufacturing Innovation Program established under section 34 of the National Institute of Standards and Technology Act (<external-xref legal-doc="usc" parsable-cite="usc/15/278s">15 U.S.C. 278s</external-xref>).</text></paragraph><paragraph id="H2EFF842524BB434BA7710D209779D7B6"><enum>(22)</enum><text>To review the effectiveness of and identify shortcomings in existing statutes and policies focused on promoting the domestic use of federally funded research and development in manufacturing technology.</text></paragraph><paragraph id="H4F42F2ED4C03485A9844250FCA73106A"><enum>(23)</enum><text>To identify and evaluate changes to existing statutes and policies and to recommend legislation and policies to more effectively ensure the domestic use of federally funded research and development in manufacturing technology and to recover such investments from profits realized as a result of offshore manufacturing of systems or components utilizing federally funded technologies or their derivatives.</text></paragraph><paragraph id="H7AFC4439868349DBAB43A3847E562D65"><enum>(24)</enum><text>To work with appropriate agencies, State and local governments, regional organizations, institutions of higher education, nonprofit organizations, and private companies to stimulate interest in manufacturing careers.</text></paragraph><paragraph id="H4FF417A25E0646BC87368C1F88693BFA"><enum>(25)</enum><text>To enhance public perception of manufacturing careers, encouraging participation of public and private organizations, State educational agencies, and institutions of higher education in the annual celebration of manufacturing industries on national Manufacturing Day.</text></paragraph><paragraph id="HAB6EF6FEEACF41E287E575618A159490"><enum>(26)</enum><text>To coordinate with activities under the Foreign Investment Risk Review Modernization Act of 2018 (<external-xref legal-doc="public-law" parsable-cite="pl/115/232">Public Law 115–232</external-xref>) and the Committee on Foreign Investment in the United States to ensure the protection of sensitive emerging United States manufacturing-related technologies.</text></paragraph><paragraph id="HA3C8BB571FEC4FEB909AC68EC641FE1C"><enum>(27)</enum><text>To perform such other functions or activities as the President may assign.</text></paragraph></subsection><subsection id="H2748A33744BA4B8F9F1D3E57EB4C0E01"><enum>(d)</enum><header>National manufacturing strategy</header><paragraph id="H21B9B8B98BE048298B5B8DC2450C4037"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 1 year after the date of the enactment of this Act, and every 2 years thereafter, the Chief Manufacturing Officer shall submit the National Manufacturing Strategy to the President and Congress. The Strategy shall contain a summary of the current state of manufacturing in the United States and comprehensive strategies to—</text><subparagraph id="HB1A5140D5C4A4001ACA5B1B109EB85ED"><enum>(A)</enum><text>work across Federal and State government agencies to produce a coherent integrated strategy and plans;</text></subparagraph><subparagraph id="HF4ED4FDBE2CE4015B297934E6071B504"><enum>(B)</enum><text>identify and address the anticipated workforce needs of the manufacturing sector, recognizing that this sector includes diverse industries competing in different operating environments;</text></subparagraph><subparagraph id="H04CC33710ACE40A08FD68FCFF2F74580"><enum>(C)</enum><text>work with industry experts to strengthen education initiatives, and shape training and certificate programs that can be adapted to reflect local circumstances;</text></subparagraph><subparagraph id="H6B70CBF6569C420B8A6EE8B128678908"><enum>(D)</enum><text display-inline="yes-display-inline">create or improve manufacturing training programs and appropriate career paths into manufacturing jobs, to expand opportunities for all, and, in particular, the participation of veterans, the unemployed, women, and other underrepresented groups;</text></subparagraph><subparagraph id="H1EC37F4F63F64AAE8DC8B382C75E42AE"><enum>(E)</enum><text>promote the development of quality control and other technical standards;</text></subparagraph><subparagraph id="HF1B569E830BF41DD9966899192AC8C8C"><enum>(F)</enum><text>maintain reliable physical and telecommunication infrastructure and identify and advocate for future infrastructure requirements;</text></subparagraph><subparagraph id="H29026092EB9943A59575B43F4D4CB42D"><enum>(G)</enum><text>analyze manufacturing technology needs, monitor technology developments, and analyze threats to and opportunities for the manufacturing sector;</text></subparagraph><subparagraph id="H469D5BBC9D9B4ED9B868883E5B11EFD8"><enum>(H)</enum><text>recommend appropriate tax incentives and financial tools to assist manufacturing enterprises to improve their competitiveness;</text></subparagraph><subparagraph id="H9951737AA6CB407DA499ADEBB79F0F12"><enum>(I)</enum><text>review Federal and State regulations to focus on reducing the cost of manufacturing, while improving innovation, productivity, and environmental sustainability;</text></subparagraph><subparagraph id="HCFFE6F909F594315890FA0EAD2149E7D"><enum>(J)</enum><text>promote the export of United States manufactured goods and the enforcement of fair trade rules embedded in bilateral and international agreements, including rules related to intellectual property rights and labor protection;</text></subparagraph><subparagraph id="H79F16D111E684C1DACFF957FD9CFB07A"><enum>(K)</enum><text>identify other forms of assistance for companies that manufacture in the United States, enabling them to compete successfully in the international marketplace; and</text></subparagraph><subparagraph id="H987A1053983E40FA81EB9D230564645D"><enum>(L)</enum><text>address such other issues as the President determines necessary.</text></subparagraph></paragraph><paragraph id="H0FB9329769794C87B80BABDCBF619DF1"><enum>(2)</enum><header>Incorporation of other strategic plans</header><text>The Chief Manufacturing Officer shall integrate into the National Manufacturing Strategy described in paragraph (1) the following:</text><subparagraph id="H58C3AB3B6CDC458E8049F23E0CF31F0A"><enum>(A)</enum><text>The national strategic plan for advanced manufacturing developed under section 102(c) of the America COMPETES Reauthorization Act of 2010 (<external-xref legal-doc="usc" parsable-cite="usc/42/6622">42 U.S.C. 6622(c)</external-xref>).</text></subparagraph><subparagraph id="H20A343ED826E405A8600B6E6FCFD89FE"><enum>(B)</enum><text>The strategic plan developed for the Network for Manufacturing Innovation Program under section 34(f)(2)(C) of the National Institute of Standards and Technology Act (<external-xref legal-doc="usc" parsable-cite="usc/15/278s">15 U.S.C. 278s(f)(2)(C)</external-xref>).</text></subparagraph><subparagraph id="H70AA9462F2E34673A6FF8733AB58B897"><enum>(C)</enum><text display-inline="yes-display-inline">The manufacturing elements of the National Nanotechnology Initiative Strategic Plan under section 2(c)(4) of the 21st Century Nanotechnology Research and Development Act (<external-xref legal-doc="usc" parsable-cite="usc/15/7501">15 U.S.C. 7501(c)(4)</external-xref>).</text></subparagraph></paragraph></subsection><subsection id="H34D2E9D9D3894EE380F31E4D3DE9C92A"><enum>(e)</enum><header>Bi-Annual Report</header><text display-inline="yes-display-inline">Not later than 2 years after the date of the enactment of this Act, and every 2 years thereafter, the Chief Manufacturing Officer, in consultation with the Director of the Office of Management and Budget, shall submit to the President and Congress a report that describes progress made in the implementation of the National Manufacturing Strategy and in fulfilment of its objectives.</text></subsection></section></legis-body></bill>
