<official-title display="yes">To clarify and increase the restrictions on political activities that are applicable to the members of the Postal Service Board of Governors, including the Postmaster General and the Deputy Postmaster General, and for other purposes.</official-title>

<section id="H08E8D34150C7451E8D91221754F778A4" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Nonpartisan Postmaster General Act of 2021</short-title></quote>.</text></section> <section id="HC823F6188C6548E38B29DF067F91F206" section-type="subsequent-section"><enum>2.</enum><header>Postal Service officers’ political activities limited</header> <subsection id="HE8EFF8844CAB40C2964EE9E21019E03D"><enum>(a)</enum><header>Hatch act officer applicability</header> <paragraph id="HE80D7F48A8D74FED8DBC1552C4810CA1"><enum>(1)</enum><header>In general</header><text>Section 410 of title 39, United States Code, is amended by adding at the end the following new subsection:</text>
<quoted-block style="USC" display-inline="no-display-inline" id="H997D6918C25042429785A27E9F73334B">
<subsection id="H86A55E6D3D994203B75F88F6FB22FD30"><enum>(e)</enum><text display-inline="yes-display-inline">For the purposes of applying subchapter III of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/73">chapter 73</external-xref> of title 5, and any regulations thereunder, to the Postal Service pursuant to subsection (b)(1), the following are deemed to be employees of the Postal Service:</text> <paragraph id="HC22779EC1E8345789644038DE9810A8D"><enum>(1)</enum><text>The Postmaster General.</text></paragraph>
<paragraph id="HDC261EBB6D1D44C0912941838AF8C35A"><enum>(2)</enum><text>The Deputy Postmaster General.</text></paragraph> <paragraph id="H9B2F06A881D7493CB52064336A249A03"><enum>(3)</enum><text>Any individual holding a position in the Postal Service to which such individual was appointed by the President, by and with the advice and consent of the Senate, including a Governor appointed under section 202.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph>
<paragraph id="H4B4DCE1907714EDBBB00667E20BA634E"><enum>(2)</enum><header>Further restricted employees</header><text>Section 7323(b)(2)(B) of title 5, United States Code, is amended—</text> <subparagraph id="HAC54F7519F6A4E81808B211A573E405C"><enum>(A)</enum><text>in clause (i)(XIV), by striking <quote>or</quote> at the end;</text></subparagraph>
<subparagraph id="HDAC1F6CD84FA4B40BB498C326B2EEA66"><enum>(B)</enum><text>in clause (ii), by striking the period at the end and inserting <quote>; and</quote>; and</text></subparagraph> <subparagraph id="H2DC94F2EFDB348DE814014E54193667B"><enum>(C)</enum><text>by adding at the end the following new clause:</text>

<clause id="H18A502E79F2D486C871CA4140BD2A29C" indent="up2"><enum>(iii)</enum><text display-inline="yes-display-inline">a person holding a position described in section 410(e) of title 39.</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection> <subsection id="H203E91637F59437998DCC142C00079CC"><enum>(b)</enum><header>Political activities of board members</header><text display-inline="yes-display-inline">Section 202 of title 39, United States Code, is amended by adding at the end the following new subsections:</text>
<quoted-block style="USC" display-inline="no-display-inline" id="H0ADF733463C84657A3917E89D4CF5865">
<subsection id="H2BB7F8DB233544C08546CADBBCDF0754"><enum>(f)</enum><text>While serving as a member of the Board, an individual may not—</text> <paragraph id="H7A1CE5936E1D4C85A091339EE57C0BB9"><enum>(1)</enum><text>hold a political position; or</text></paragraph>
<paragraph id="H17AD18CC559B492683BDEFDB8583F0D4"><enum>(2)</enum><text>solicit funds for—</text> <subparagraph id="H0971566DAA534A64B5EFAA1A49082048"><enum>(A)</enum><text>the campaign of a candidate for election for a Federal, State, or local elected office; or</text></subparagraph>
<subparagraph id="H9D5212EEAA8F42E7AF151C570CB40E54"><enum>(B)</enum><text display-inline="yes-display-inline">a Federal, State, or local political party (as defined in the Federal Election Campaign Act of 1971 (<external-xref legal-doc="usc" parsable-cite="usc/52/30101">52 U.S.C. 30101</external-xref> et seq.)).</text></subparagraph></paragraph></subsection> <subsection id="HEE16A443D85A4CC99B51EE4BA1FFF5D8"><enum>(g)</enum><text>For purposes of this section, an individual holds a political position if such individual—</text>
<paragraph id="H03B09D54C6414C4DA1316A39D5F40A2C"><enum>(1)</enum><text>holds Federal, State, or local elected office;</text></paragraph> <paragraph id="HC005BE642279439A9C2724C3AC266BF6"><enum>(2)</enum><text>files paperwork to be a candidate for election for a Federal, State, or local elected office; or</text></paragraph>
<paragraph id="H57B4DE00BB614E5EAFAB9EA8BCFCA9E1"><enum>(3)</enum><text>is an officer, director, or employee of a Federal, State, or local political party (as defined in subsection (f)(2)(B)).</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> <subsection id="HC6398087B2F44B73BBDEBE466CFC300F"><enum>(c)</enum><header>Severability</header><text display-inline="yes-display-inline">If any provision of this Act, an amendment made by this Act, or the application of such provision or amendment to any person or circumstance is held to be unconstitutional, the remainder of this Act, the amendments made by this Act, and the application of the provisions of such to any person or circumstance shall not be affected thereby.</text></subsection></section>
<section id="HEF67D7D0A06D44B6A854B1922C09038D"><enum>3.</enum><header>Financial disclosures required prior to assuming duties of Postmaster General or Deputy Postmaster General</header><text display-inline="no-display-inline">The Ethics in Government Act of 1978 (5 U.S.C. App) is amended—</text> <paragraph id="HD523B28E1AD546B28116AED2FEACE8B7"><enum>(1)</enum><text>in section 101(a)—</text>
<subparagraph id="H17318DF431794C06AE680A4102BDA814"><enum>(A)</enum><text>by striking <quote>(a) Within</quote> and inserting <quote>(a)(1) Within</quote>; and</text></subparagraph> <subparagraph id="HE709597C49E248A39E00DE5FDE0F450E"><enum>(B)</enum><text>by adding at the end the following:</text>

<paragraph id="H0EF0E33870874E8C93874035AE02E6B3" indent="up1"><enum>(2)</enum>
<subparagraph commented="no" display-inline="yes-display-inline" id="HE52D79D589D442B0B05AEDA6BE123FBB"><enum>(A)</enum><text display-inline="yes-display-inline">An individual proposed pursuant to section 202 of title 39, United States Code, to assume the position of Postmaster General or Deputy Postmaster General shall file the report required by paragraph (1) before assuming such position.</text></subparagraph> <subparagraph id="H2B8E75A129AC4938A1656B304E487187" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">An individual proposed for such a position may not carry out any duty of the position until the report submitted by the individual pursuant to subparagraph (A) is reviewed and signed by the Director of the Office of Government Ethics under section 106(b)(1), and any action taken by that individual in the performance of any function or duty of the applicable position before the date on which such signature occurs shall have no force or effect.</text></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph>
<paragraph id="HCCB332691D934000B04590BE07DDBCD8"><enum>(2)</enum><text>in section 103(b)—</text> <subparagraph id="HE37E9610C86942B197C314C29171FD1E"><enum>(A)</enum><text>by striking <quote>(b) The President</quote> and inserting <quote>(b)(1) The President</quote>; and</text></subparagraph>
<subparagraph id="HAB2568A30F644C2EBB69BCC17CA2479C"><enum>(B)</enum><text>by adding at the end the following:</text> <quoted-block style="OLC" id="HB063BBFA8EC64807A3EA9466413771C9" display-inline="no-display-inline"> <paragraph id="H746BF26383A44CBCAC21B47932E6CCDF" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">Notwithstanding subsection (a), an individual proposed pursuant to section 202 of title 39, United States Code, to assume the position of Postmaster General or Deputy Postmaster General shall file the report required under section 101(a) with the Director of the Office of Government Ethics.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></section>
