which was referred to the <committee-name committee-id="HII00">Committee on Natural Resources</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To assist in the conservation of critically endangered species in foreign countries, and for other purposes.</official-title></form><legis-body id="H16FEB540C00C46A1AAA2D14A91BF9A27" style="OLC"><section id="H1F18679435C340D6A8EAE299AEF81B42" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline"> This Act may be cited as the <quote><short-title>Critically Endangered Animals Conservation Act of 2021</short-title></quote>.</text></section><section id="HD35C2FA9EAD249248E623A25AAFC984E"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act—</text><paragraph id="HFF42E8342C8540258F46D8102FEB87B9"><enum>(1)</enum><text>the term <term>Convention</term> means the Convention on International Trade in Endangered Species of Wild Fauna and Flora (27 UST 1087; TIAS 8249);</text></paragraph><paragraph id="H700F8762E5174F27A7B4A8258EE6117B" commented="no"><enum>(2)</enum><text>the term <term>conservation</term> means the protection and restoration of species and the habitat of such species;</text></paragraph><paragraph id="H21BE090DC91A48A4A4CDA871DEB9E061"><enum>(3)</enum><text>the term <term>Fund</term> means the Critically Endangered Animals Conservation Fund established by section 5;</text></paragraph><paragraph id="H15F13E64A4D445F68E7C3910C3BE827E"><enum>(4)</enum><text display-inline="yes-display-inline">the term <term>critically endangered species</term>—</text><subparagraph id="H956C9308C9D140DF9AD9B901479CCE2D"><enum>(A)</enum><text>means—</text><clause id="HD7E1CEB0A6144757AD381A654D721CCD"><enum>(i)</enum><text>any animal species categorized on the International Union Conservation of Nature Red List of Threatened Species as either Endangered or Critically Endangered; and</text></clause><clause id="HDE25BA21CFAB45009183AF8C6CF57F28"><enum>(ii)</enum><text display-inline="yes-display-inline">any other animals species categorized on the International Union Conservation of Nature Red List of Threatened Species as Data Deficient or under a threat category lower than Endangered if the Secretary determines that—</text><subclause id="HAFB7CFB133E5463BA431C4CC44EBDD21"><enum>(I)</enum><text>the most recent International Union Conservation of Nature Red List assessment indicates that the population is decreasing; or</text></subclause><subclause id="HCF116A9A8EB74369A8EE3F098284BECF"><enum>(II)</enum><text>such species is facing new or emerging threats; and </text></subclause></clause></subparagraph><subparagraph id="HA29DBB621E154133B2C7762FD3FC8AE0"><enum>(B)</enum><text>includes—</text><clause id="HE825C1C3717A4957903DD8B1C09851D4"><enum>(i)</enum><text>any part, product, egg, offspring or live specimen of a species described in subparagraph (A); and</text></clause><clause id="HE8D139EC35A44D9F972D0674CCDDB00A"><enum>(ii)</enum><text>a carcass of such a species; </text></clause></subparagraph></paragraph><paragraph id="HFD6FD3D640DF4D5DA2CAB2C6634C72D6"><enum>(5)</enum><text>the term <term>Multinational Species Conservation Fund</term> means the fund established under the heading <quote>multinational species conservation fund</quote> in title I of the Department of the Interior and Related Agencies Appropriations Act, 1999 (<external-xref legal-doc="usc" parsable-cite="usc/16/4246">16 U.S.C. 4246</external-xref>); and</text></paragraph><paragraph id="H0B2A9FF14B6245758D6D7B33EEBE9F77"><enum>(6)</enum><text>the term <term>Secretary</term> means the Secretary of the Interior.</text></paragraph></section><section id="H9F890F457AEE475F9051C38179D25AFB"><enum>3.</enum><header>Critically endangered animals conservation assistance</header><subsection id="HD0E66F13C5F84AB5931344FF824E6950"><enum>(a)</enum><header>In general</header><text>In consultation with other Federal officials, the Secretary shall use amounts in the Fund to carry out a competitive grant program to provide financial assistance for the conservation of critically endangered species.</text></subsection><subsection id="H826B132C2B2C4E9F9EA9908689E0C086"><enum>(b)</enum><header>Project proposals</header><paragraph id="H0DE270BB994942779AD782D8C6497B31"><enum>(1)</enum><header>Eligible applicants</header><subparagraph id="HB13FEE04975F4BB5AECF6177676193CB"><enum>(A)</enum><header>In general</header><text>A proposal for a grant under subsection (a) may be submitted to the Secretary by—</text><clause id="H0D3F2CBC7435426898C3AC1CB2DA1BE7"><enum>(i)</enum><text>any wildlife management authority of a foreign country that has within its boundaries natural habitat of the critically endangered species if the activities of the authority directly or indirectly benefit that species’ conservation; or</text></clause><clause id="H276EF938D05D43A180618A1B981E4460"><enum>(ii)</enum><text>any other person or group with the demonstrated expertise and capacity required for the conservation of a critically endangered species.</text></clause></subparagraph><subparagraph id="H6E77DB673E7F48648BE49EC39F3086F2"><enum>(B)</enum><header>Ineligible applicants</header><text display-inline="yes-display-inline">Any such wildlife management authority or other person or group that receives funding for a particular critically endangered species from any multinational species conservation fund to which the United States Fish and Wildlife Service is a party is not eligible for a grant under this Act with respect to a such species.</text></subparagraph></paragraph><paragraph id="HA423912205B245E7BA1B5EED1C15E427"><enum>(2)</enum><header>Required elements</header><text>A project proposal shall include— </text><subparagraph id="H8A0DA626053E415E835827F348B6D4CF"><enum>(A)</enum><text>evidence of support for the project by appropriate governmental entities of the country in which the project will be conducted, if the Secretary determines that such support is required for the success of the project; </text></subparagraph><subparagraph id="HFE0FF70AD5374493B8152D400C42BD4A"><enum>(B)</enum><text>evidence of sensitivity to local historic and cultural resources and compliance with applicable laws;</text></subparagraph><subparagraph id="HE523A018C26642969AEA04426B4F368A"><enum>(C)</enum><text display-inline="yes-display-inline">evidence of free, prior, and informed consent by indigenous peoples and local communities in the areas the project will be conducted, if the Secretary, based on the nature of the project, determines that such consent is required for the success of the project; </text></subparagraph><subparagraph id="HE0FBEC42D0744802816D8C0A9B24F8EF"><enum>(D)</enum><text>information regarding the source and amount of matching funding available for the project; and</text></subparagraph><subparagraph id="H7E7247FCD54340A996F3C1461475F652"><enum>(E)</enum><text>any other information that the Secretary determines to be appropriate.</text></subparagraph></paragraph></subsection><subsection id="H936B24E0DAC9429F9F6627275B3EFC06" commented="no"><enum>(c)</enum><header>Evaluation and Approval</header><paragraph id="HD8BDF2AC3486403FBD00229F6C5938B0" commented="no"><enum>(1)</enum><header>Goals</header><text>The Secretary may approve a proposal under this section if the project will—</text><subparagraph id="HC7DFAA6C70F642FCB410A54C3682F816" commented="no"><enum>(A)</enum><text display-inline="yes-display-inline">help recover and sustain viable populations in the wild of a critically endangered species with a range that is, in whole or in part, outside of the United States;</text></subparagraph><subparagraph id="H3CF0A6D4CD54416A8B5E3FF4636E3656" commented="no"><enum>(B)</enum><text>enhance compliance with provisions of the Convention and laws of the United States or a foreign country related to the conservation of a critically endangered species; or</text></subparagraph><subparagraph id="H064CEEB2B46544C08ACF031B50B802BF" commented="no"><enum>(C)</enum><text>develop sound scientific information on that species’ habitat, population numbers and trends, reproduction, mortality, and other threats to survival.</text></subparagraph></paragraph><paragraph id="H728BFD00BBF54B27AEA54B8DEC70EF19" commented="no"><enum>(2)</enum><header>Methods</header><text display-inline="yes-display-inline">The Secretary may approve a proposal under this section if the proposal would achieve one of the goals set forth in paragraph (1) through—</text><subparagraph id="HA58637A7C0D2462D8B09C30BE4D1F61D" commented="no"><enum>(A)</enum><text>protection, restoration, and management of habitat;</text></subparagraph><subparagraph id="H9D4C9C8355C74FA9ABB817526654EFA2" commented="no"><enum>(B)</enum><text>in situ research and monitoring of populations, habitats, annual reproduction, and species population trends;</text></subparagraph><subparagraph id="H23ECBB7C12E940C09B5A1F35E03BE2E3" commented="no"><enum>(C)</enum><text>development, implementation, and improvement of national and regional management plans for a critically endangered species and the habitat of such species;</text></subparagraph><subparagraph id="H2C786BFBC19B4984994A2B39E30B0DDB" commented="no"><enum>(D)</enum><text>enforcement and implementation of the Convention or the law of a foreign country to—</text><clause id="HA6E2F9FEF7A144B594501AD1880819BC" commented="no"><enum>(i)</enum><text>protect and manage a critically endangered species or the habitat of such species;</text></clause><clause id="HD9491E1EB3AA4397AF767256DD8B16F5" commented="no"><enum>(ii)</enum><text>prevent illegal or unsustainable removal of a critically endangered species from the wild, including as marine bycatch; or</text></clause><clause id="HBB2386DFE4ED400E8087FD3F88EADCCA" commented="no"><enum>(iii)</enum><text>prevent illegal trade of a critically endangered species;</text></clause></subparagraph><subparagraph id="H5261ACADC5304E54B1C362FFFA914720" commented="no"><enum>(E)</enum><text>training and capacity building for local law enforcement officials in the interdiction and prevention of the illegal killing, removal from the wild, or trade of a critically endangered species;</text></subparagraph><subparagraph id="HA81D2C1C9B334ED292E365183A6FBC2C" commented="no"><enum>(F)</enum><text>an initiative to resolve a conflict between humans and a critically endangered species;</text></subparagraph><subparagraph id="HD88A7A31093F4F47AE4EB93648439AD4" commented="no"><enum>(G)</enum><text>research and implementation of projects to address disease and threats to the health of a critically endangered species;</text></subparagraph><subparagraph id="H602DC576DC8448289467CBD7DD4C7267" commented="no"><enum>(H)</enum><text>community outreach and education on conservation of a critically endangered species and the habitat of such species; or</text></subparagraph><subparagraph id="HE3644E33321C4A1688E844C3F03EF449" commented="no"><enum>(I)</enum><text>strengthening the ability of local communities to implement a conservation program.</text></subparagraph></paragraph><paragraph id="HB27701994AE446689226C898F483F3E3"><enum>(3)</enum><header>Consultation</header><text display-inline="yes-display-inline">The Secretary shall, prior to approving any proposal under this section, consult with each of the following with respect to such proposal:</text><subparagraph id="H9B69543794B8406C9D1AF0361554D812"><enum>(A)</enum><text>The Government of each country in which such proposal will be carried out.</text></subparagraph><subparagraph id="H54455F4E5CF046E9BA97B4E90F58B61C"><enum>(B)</enum><text>Any other Federal agency the Secretary determines is appropriate.</text></subparagraph></paragraph><paragraph id="H13E542D5569F4BBFB9F15620F474EE11" commented="no"><enum>(4)</enum><header>Preferential consideration</header><text display-inline="yes-display-inline">In determining whether to approve a proposal, the Secretary shall give preference to a proposal that—</text><subparagraph id="H61ED15FA272D4A5F867FEA8FCEAA70F1" commented="no"><enum>(A)</enum><text>is designed to ensure effective, long-term conservation of critically endangered species and their habitats; and</text></subparagraph><subparagraph id="H96BB072856424D3F91573644C92965F4" commented="no"><enum>(B)</enum><text display-inline="yes-display-inline">has matching funds available. </text></subparagraph></paragraph><paragraph id="H8BF5104D190948F191BB9593756E8402" commented="no"><enum>(5)</enum><header>Approval</header><text>The Secretary shall, within 180 days of receiving a proposal under this section, approve or disapprove of the proposal and provide written notification of such approval or disapproval to—</text><subparagraph id="HEA067A7375D04487AD8A096DC56FA51B"><enum>(A)</enum><text>the person who submitted such proposal;</text></subparagraph><subparagraph id="H697E2CE892DC4CB89E85869ACA389C1B"><enum>(B)</enum><text>any Federal agency the Secretary determines appropriate; and</text></subparagraph><subparagraph id="HEBD06BC2398243E69027AA4AA84A49DB"><enum>(C)</enum><text>the foreign country in which such proposal would be carried out.</text></subparagraph></paragraph></subsection><subsection id="H02DF8CAF9C634748A3D7769236BE0A1D"><enum>(d)</enum><header>Project reporting</header><paragraph id="H32B24F992424494BACD4573AF65D9B79"><enum>(1)</enum><header>In general</header><text> The Secretary shall require each person that receives assistance under this section to submit periodic reports including such information as the Secretary may require in order to evaluate the progress and success of each grant issued under this section.</text></paragraph><paragraph id="H4031705CD82943DEA082241450878F39"><enum>(2)</enum><header>Availability to the public</header><text>Reports under paragraph (1), and any other documents relating to projects for which financial assistance is provided under this Act except for documents that the Secretary determines to be confidential in nature, shall be made available to the public. </text></paragraph></subsection><subsection id="H98A76E27AB3F4B20943B45E9775A4432"><enum>(e)</enum><header>Limitations on use for captive breeding</header><text>Amounts provided as a grant under this Act—</text><paragraph id="H91A8CF9EDF5F413182802144AD709561"><enum>(1)</enum><text>may not be used for captive breeding of critically endangered species other than for captive breeding designed for release into the wild; and</text></paragraph><paragraph id="HB52F4D2222AE4FF69B8679E0DF16FB37"><enum>(2)</enum><text>may be used for captive breeding of a species for release into the wild only if no other conservation method for the species is biologically or technically feasible.</text></paragraph></subsection></section><section id="HD4409D4ABC0F4C35838365B5262B013D"><enum>4.</enum><header>Critically Endangered Animals Conservation fund</header><subsection id="HF5A9922C6BB64C3FB2D7B1BDD417D8A9"><enum>(a)</enum><header>Establishment</header><text>There is established in the Multinational Species Conservation Fund a separate account to be known as the <quote>Critically Endangered Animals Conservation Fund</quote>, consisting of—</text><paragraph id="H624C98AB20CB49C7BAF9C9EC0623DC19"><enum>(1)</enum><text>amounts transferred to the Secretary of the Treasury for deposit into the Fund under subsection (e);</text></paragraph><paragraph id="H66E9ED50E4524FC6B60B59F78425C5CC"><enum>(2)</enum><text>amounts appropriated to the Fund under section 6; and</text></paragraph><paragraph id="H286E6339B0C94CAAA7D9FD4441F8BC9C"><enum>(3)</enum><text>any interest earned on investment of amounts in the Fund under subsection (c).</text></paragraph></subsection><subsection id="H4A6AB6D6116C42968C78FCC12741D717"><enum>(b)</enum><header>Expenditures from fund</header><paragraph id="H3A2689D370D34E8A95B7473AD88043BB"><enum>(1)</enum><header>In general</header><text>Subject to paragraph (2), at the request of the Secretary, the Secretary of the Treasury shall transfer from the Fund to the Secretary, without further appropriation, such amounts as the Secretary determines are necessary to carry out section 3.</text></paragraph><paragraph id="H8EF3C6036F8E40CF90453A1B975DD615"><enum>(2)</enum><header>Administrative expenses</header><text>Of the amounts in the account available for each fiscal year, the Secretary may expend not more than 3 percent, or up to $150,000, whichever is greater, to pay the administrative expenses necessary to carry out this Act.</text></paragraph></subsection><subsection id="HF079AE2150054BAB91E239C3D5ED7E93"><enum>(c)</enum><header>Investment of amounts</header><paragraph id="HF60EE5BA6FF1487C960FF0B9B9F4449F"><enum>(1)</enum><header>In general</header><text>The Secretary of the Treasury shall invest such portion of the Fund as is not, in the judgment of the Secretary of the Treasury, required to meet current withdrawals. Investments may be made only in interest-bearing obligations of the United States.</text></paragraph><paragraph id="H2605EFC6E88746FBB8F349CEEC5AF046"><enum>(2)</enum><header>Acquisition of obligations</header><text>For the purpose of investments under paragraph (1), obligations may be acquired—</text><subparagraph id="H7484C249976B4D98950F41ACA7C51116"><enum>(A)</enum><text>on original issue at the issue price; or</text></subparagraph><subparagraph id="H0B6B90105986460DB9643E511EE875C5"><enum>(B)</enum><text>by purchase of outstanding obligations at market price.</text></subparagraph></paragraph><paragraph id="H17815DD96FCC479D8102E227D1FA52E0"><enum>(3)</enum><header>Sale of obligations</header><text>Any obligation acquired by the Fund may be sold by the Secretary of the Treasury at market price.</text></paragraph><paragraph id="HC8952891B7FD4CE7B257EC04E59E29DD"><enum>(4)</enum><header>Credits to fund</header><text>The interest on, and the proceeds from the sale or redemption of, any obligations held in the Fund shall be credited to and form a part of the Fund.</text></paragraph></subsection><subsection id="HB8BE5DA4141444CA8A89B22DF5539258"><enum>(d)</enum><header>Transfers of amounts</header><paragraph id="HDB565994C7514DC4A2219987E9215585"><enum>(1)</enum><header>In general</header><text>The amounts required to be transferred to the Fund under this section shall be transferred at least monthly from the general fund of the Treasury to the Fund on the basis of estimates made by the Secretary of the Treasury.</text></paragraph><paragraph id="H5EA518BD566F4F1BB7C338E714797DD8"><enum>(2)</enum><header>Adjustments</header><text>Proper adjustment shall be made in amounts subsequently transferred to the extent prior estimates were in excess of or less than the amounts required to be transferred.</text></paragraph></subsection><subsection id="HB103B6C6405E4E39BE7078BD35301C52"><enum>(e)</enum><header>Acceptance and use of donations</header><text display-inline="yes-display-inline">The Secretary may accept and use donations to provide assistance under section 4. Amounts received by the Secretary in the form of donations shall be transferred to the Secretary of the Treasury for deposit in the Fund. The Secretary may reject a gift under this section when the rejection is in the interest of the Government.</text></subsection></section><section id="H7864CA7DE3FF4B2087395D159C2ABDB1"><enum>5.</enum><header>Authorization of appropriations</header><text display-inline="no-display-inline">There is authorized to be appropriated to the Fund $5,000,000 for each of fiscal years 2022 through 2027.</text></section><section id="H112189FFFC884023B4BD1D3C1C89A85E"><enum>6.</enum><header>Report to Congress</header><text display-inline="no-display-inline">Not later than 1 year after the date of enactment of this Act, and every 2 years thereafter, the Secretary shall submit to Congress a report on the results and effectiveness of the program carried out under this Act.</text></section></legis-body></bill>
