<official-title display="yes">To amend the Public Health Service Act to provide for a public awareness campaign with respect to human papillomavirus, and for other purposes.</official-title>

<section id="H7E376778EA3B49B59C74FA1351102E25" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Promoting Resources to Expand Vaccination, Education, and New Treatments for HPV Cancers Act of 2021</short-title></quote> or the <quote><short-title>PREVENT HPV Cancers Act of 2021</short-title></quote>.</text></section> <section id="H172B125E2101442AA3600D14B27D1816"><enum>2.</enum><header>Preventing HPV and HPV-associated cancers; reauthorizing Johanna’s law</header><text display-inline="no-display-inline">Section 317P of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/247b-17">42 U.S.C. 247b–17</external-xref>) is amended—</text> 
<paragraph id="HD32053C7F45B428984599A8DC9B3B5D7"><enum>(1)</enum><text>in subsection (c)(1)—</text> <subparagraph id="H469A2E648927411C80DCE4C54FEEAE9D"><enum>(A)</enum><text>in subparagraph (B), by striking <quote>cervical</quote>;</text></subparagraph> 
<subparagraph id="H1BE6884D37704C7F973056914DA0A869"><enum>(B)</enum><text>in subparagraph (C), by striking <quote>and</quote> at the end; </text></subparagraph> <subparagraph id="HF18DA8CF7D1F41DEABDE0499A9AEB571"><enum>(C)</enum><text>in subparagraph (D) by striking <quote>other</quote> and all that follows through <quote>cancer.</quote> and inserting <quote>recommended diagnostics for early intervention for, and prevention of, HPV-associated cancers; and</quote>; and</text></subparagraph> 
<subparagraph id="H3E31DB19185D4E5A9A2EFA46EDB0C30C"><enum>(D)</enum><text>by adding at the end the following:</text> <quoted-block id="H2F2B9675F18946E490F333EFE6ECA4FD" style="OLC"> <subparagraph id="H8AB695AFD3494D7798C0B7482F7455C5"><enum>(E)</enum><text>the importance of recommended vaccines for prevention of HPV and HPV-associated cancers, including for males;</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph> 
<paragraph id="H88D347E3CC544B9EBAD297B5ABB915A8"><enum>(2)</enum><text display-inline="yes-display-inline">by amending subsection (d) to read as follows:</text> <quoted-block style="OLC" id="H6256BE2AE84041339F00B341BEA54110" display-inline="no-display-inline"> <subsection id="H2A71CF9363F64DB7B80464F9BEF2CB2C"><enum>(d)</enum><header>Johanna's Law</header> <paragraph id="HDB1AF8650CD64AB282FB7F59658F257B"><enum>(1)</enum><header>National public awareness campaign</header> <subparagraph id="H28D9868E81C141C28ADF8BEC01B37BD7"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall carry out a national campaign to increase the awareness and knowledge of health care providers and individuals with respect to gynecologic cancers, HPV, and HPV-associated cancers, and the importance of HPV vaccines in preventing HPV and HPV-associated cancers.</text></subparagraph> 
<subparagraph id="HEDD02AB6A8E945EE800DF645EA74553F"><enum>(B)</enum><header>Written materials</header><text>Activities under the national campaign under subparagraph (A) shall include—</text> <clause id="H572142C0C8694C0DA2688CE8D08BA79B"><enum>(i)</enum><text display-inline="yes-display-inline">maintaining a supply of written materials that provide information to the public on gynecologic cancers, HPV, and HPV-associated cancers; and</text></clause> 
<clause id="H620194436897494594D86C43AA7B7E81"><enum>(ii)</enum><text>distributing the materials to members of the public upon request.</text></clause></subparagraph> <subparagraph id="H5BC7B4EEA73747AAB9BF424582530278"><enum>(C)</enum><header>Public service announcements</header><text display-inline="yes-display-inline">Activities under the national campaign under subparagraph (A) shall, in accordance with applicable law and regulations, include publishing materials in digital or print form, public engagement, and developing and placing public service announcements intended to encourage individuals to discuss with their physicians—</text> 
<clause id="H23A65AF66C4F400DB4330ABD76FC79EC"><enum>(i)</enum><text>their risk of gynecologic cancers and HPV-associated cancers; and</text></clause> <clause id="HA0E988810D7F402DA73B175BCD626EFA"><enum>(ii)</enum><text>the importance of HPV vaccines in preventing HPV and HPV-associated cancers.</text></clause></subparagraph> 
<subparagraph id="HB1F2D796DF2A4306AD0ED0E5BDC3CDD3"><enum>(D)</enum><header>Targeted populations</header><text>Activities under the national campaign under subparagraph (A) shall include culturally and linguistically competent public service announcements and other forms of communication and public engagement under subparagraph (C) targeted to—</text> <clause id="H3CB289C1FE54438A8AC899DC9CAF0E50"><enum>(i)</enum><text>specific higher-risk populations of individuals based on race, ethnicity, level of acculturation, and family history, including African-American and Ashkenazi Jewish individuals;</text></clause> 
<clause id="H50FAB1C011244ACEB6C2B36C837C550F"><enum>(ii)</enum><text>communities with high rates of unvaccinated individuals, including males;</text></clause> <clause id="HA21FCF386BC64D4F8498DA76453E8B01"><enum>(iii)</enum><text>rural communities;</text></clause> 
<clause id="H4FF4E91D18C6479E892CBBBD2D792618"><enum>(iv)</enum><text>populations affected by increasing rates of oropharynx cancers;</text></clause> <clause id="H4AC1372E45A34CEA87E8FB9CB9D8748C"><enum>(v)</enum><text display-inline="yes-display-inline">health care providers specializing in assisting survivors of sexual assault; and</text></clause> 
<clause id="H942B6948043642BB8E1727FDAA918B0B"><enum>(vi)</enum><text>such other communities as the Secretary determines appropriate.</text></clause></subparagraph></paragraph> <paragraph id="H8A7F422141574DB1BC799D4D32C16061"><enum>(2)</enum><header>Consultation</header><text>In carrying out the national campaign under this section, the Secretary shall consult with—</text> 
<subparagraph id="HA75F27396A304CA48D77237C31F21715"><enum>(A)</enum><text>health care providers;</text></subparagraph> <subparagraph id="H1F665CF673B94AC5890022AF4550E0A6"><enum>(B)</enum><text>nonprofit organizations (including gynecologic cancer organizations and organizations that represent communities and individuals most affected by HPV-associated cancers and low vaccination rates);</text></subparagraph> 
<subparagraph id="H2071222CF3C24C3B82FAA1E0587A2B3D"><enum>(C)</enum><text>State and local public health departments; and</text></subparagraph> <subparagraph id="H4763F09BB9684E5CB5CDECB63B1244BF"><enum>(D)</enum><text>elementary and secondary education organizations and institutions of higher education.</text></subparagraph></paragraph> 
<paragraph id="HFE603607A4164ED1B9A44B50382E6C6C"><enum>(3)</enum><header>Demonstration projects regarding outreach and education strategies</header> 
<subparagraph id="H64947EFF5320483CB125B322FAC8FB1A"><enum>(A)</enum><header>In general</header> 
<clause id="H97E46648608143C0ADF1F4D7F2896CB9"><enum>(i)</enum><header>Program</header><text>The Secretary may carry out a program to award grants or contracts to public or nonprofit private entities for the purpose of carrying out demonstration projects to test, compare, and evaluate different evidence-based outreach and education strategies to increase the awareness and knowledge of women, their families, physicians, nurses, and other key health professionals with respect to gynecologic cancers, including with respect to early warning signs, risk factors, prevention, screening, and treatment options.</text></clause> <clause id="HA100096D303A46ABB0D286E9B927497D"><enum>(ii)</enum><header>Science-based resources</header><text>In making awards under clause (i), the Secretary shall encourage awardees to use science-based resources such as the Inside Knowledge About Gynecologic Cancer education campaign of the Centers for Disease Control and Prevention.</text></clause></subparagraph> 
<subparagraph id="HD7C672E3FCFD4B2EBD30F50E91BF452C"><enum>(B)</enum><header>Preferences in awarding grants or contracts</header><text>In making awards under subparagraph (A), the Secretary shall give preference to—</text> <clause id="H6DB2540A766648A3B76B78D42492332D"><enum>(i)</enum><text>applicants with demonstrated expertise in gynecologic cancer education or treatment or in working with groups of women who are at increased risk of gynecologic cancers; and</text></clause> 
<clause id="H57C1A68BD237432C820416F3D9107A61"><enum>(ii)</enum><text>applicants that, in the demonstration project funded by the grant or contract, will establish linkages between physicians, nurses, other key health professionals, health profession students, hospitals, payers, and State health departments.</text></clause></subparagraph> <subparagraph id="HA058F3B364A545EB9CD7BA72B9A77455"><enum>(C)</enum><header>Application</header><text>To seek a grant or contract under subparagraph (A), an entity shall submit an application to the Secretary in such form, in such manner, and containing such agreements, assurances, and information as the Secretary determines to be necessary to carry out this paragraph.</text></subparagraph> 
<subparagraph id="HEF5346F320B24FE687E7AA72697A645E"><enum>(D)</enum><header>Certain requirements</header><text>In making awards under subparagraph (A), the Secretary shall—</text> <clause id="HB6EFF9E84DA04A55936AB7B6B536ED16"><enum>(i)</enum><text>make awards, as practicable, to not fewer than five applicants; and</text></clause> 
<clause id="HD2921DBFBA2A400B9D32980B9281367A"><enum>(ii)</enum><text>ensure that information provided through demonstration projects under this paragraph is consistent with the best available medical information.</text></clause></subparagraph> <subparagraph id="H1F3A9988E62242698E73FBE9D9824574"><enum>(E)</enum><header>Report to congress</header><text>Not later than 24 months after the date of the enactment of the <short-title>PREVENT HPV Cancers Act of 2021</short-title>, and annually thereafter, the Secretary shall submit to the Committee on Energy and Commerce of the House of Representatives and the Committee on Health, Education, Labor, and Pensions of the Senate a report that—</text> 
<clause id="H1D59423B7A6D4124A2D10F258114A5DE"><enum>(i)</enum><text>summarizes the activities of demonstration projects under subparagraph (A);</text></clause> <clause id="HD3CBA78291D447A095A3C1385EB25C81"><enum>(ii)</enum><text>evaluates the extent to which the projects were effective in increasing awareness and knowledge of risk factors and early warning signs in the populations to which the projects were directed; and</text></clause> 
<clause id="H711A1CC570AF406284BE8D1F16B762DC"><enum>(iii)</enum><text>identifies barriers to early detection and appropriate treatment of such cancers.</text></clause></subparagraph></paragraph> <paragraph id="H34C64B39505F4D5BA28410E6756954DF"><enum>(4)</enum><header>Authorization of appropriations</header><text>For the purpose of carrying out this subsection, there is authorized to be appropriated $25,000,000 for the period of fiscal years 2022 through 2026.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section>
