<official-title display="yes">To authorize the Secretary of Health and Human Services, acting through the Director of the Center for Mental Health Services of the Substance Abuse and Mental Health Services Administration, to award grants to facilitate the funding of community-based mental health and substance use disorder services and peer support programs, and for other purposes.</official-title>

<section id="HC6E6831033E64FB7AF52993D3D6919EF" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Virtual Community Support Act of 2021</short-title></quote>. </text></section> <section id="H93978BA6E59842C89503AA709F9AD981"><enum>2.</enum><header>Grant for community-based mental health and substance use disorder services and peer support programs</header> <subsection id="H0A7D68DCF8974E17897E32B0D237F714"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 15 days after the date of the enactment of this Act, the Secretary of Health and Human Services, acting through the Director of the Center for Mental Health Services of the Substance Abuse and Mental Health Services Administration, shall establish a program (in this Act referred to as the <quote>Program</quote>) to facilitate the funding of community-based mental health and substance use disorder services and peer support programs.</text></subsection> 
<subsection id="H28C2EE6E0E1F466A84AF0FCE4D4C4D5B"><enum>(b)</enum><header>Grant authority</header><text>In carrying out the Program, the Secretary shall award a grant in accordance with this section.</text></subsection> <subsection id="H07AEF84AEECE470EA67ABFBAC10CB2E3"><enum>(c)</enum><header>Eligible recipients</header><text>The Secretary may award a grant under the Program to an eligible recipient determined by the Secretary to be authorized and capable of carrying out a project described in subsection (d).</text></subsection> 
<subsection id="H4547F1EC6DE041908E5000B97B34BC7F"><enum>(d)</enum><header>Eligible projects</header><text>Grant funds awarded under the Program may be used to—</text> <paragraph id="HE721A64E9D964FA4BF427538719ABB8F"><enum>(1)</enum><text display-inline="yes-display-inline">identify and coordinate care between programs that provide access to community-based mental health and substance use disorder services for juveniles and assist in the coordination of such services; </text></paragraph> 
<paragraph id="H4B1D0FD13B4342B7A0563AE5F46CF3B5"><enum>(2)</enum><text display-inline="yes-display-inline">identify and coordinate care between programs that provide access to community-based mental health and substance use disorder services for adults and assist in the coordination of such services; </text></paragraph> <paragraph id="HBB66D00DD91B495F912EE146E2E8C2E8"><enum>(3)</enum><text>obtain technology required to provide a community-based mental health and substance use disorder services virtually; </text></paragraph> 
<paragraph id="H9A73406C183943B2AF6C67D84B42399C"><enum>(4)</enum><text display-inline="yes-display-inline">compensate a healthcare provider or a peer specialist for the provision of community-based mental health and substance use disorder services; </text></paragraph> <paragraph id="HE208A17117F54512954FD80CE2CF7D5E"><enum>(5)</enum><text display-inline="yes-display-inline">provide education assistance to an individual seeking certification as a peer specialist; </text></paragraph> 
<paragraph id="H0EAC066F9BC64C77895D24D3DF5C9956"><enum>(6)</enum><text display-inline="yes-display-inline">provide for workforce development, recruitment, and retention activities, to train, recruit, and retain peer specialists; </text></paragraph> <paragraph id="HC959C51FB4B44706AF5B0AE86F320ADC"><enum>(7)</enum><text display-inline="yes-display-inline">transition a network of in-person, peer specialist facilitated behavioral health support services to a virtual platform for such behavioral health support services; or</text></paragraph> 
<paragraph id="H7B658530BF8141EAA6F01CD383F7DF4E"><enum>(8)</enum><text>expand or improve virtual, peer specialist facilitated behavioral health support services carried out by the entity prior to the date of enactment of this section. </text></paragraph></subsection> <subsection id="HF892221EAFF34E488620BAF7C85AD62E"><enum>(e)</enum><header>Applications</header><text display-inline="yes-display-inline">To be eligible for a grant under the Program, an eligible recipient shall submit to the Secretary an application in such form, at such time, and containing such information as the Secretary determines to be appropriate.</text></subsection> 
<subsection id="H145059A21770439EBBD7048A1D2A730D"><enum>(f)</enum><header>Guidance</header><text>Not later than 15 days after the date of the enactment of this Act, the Secretary shall issue guidance on the requirements an eligible recipient shall take to provide community-based mental health and substance use disorder services.</text></subsection> <subsection id="H1C2F374F5AF34F8AA489F31840523619"><enum>(g)</enum><header>Supplement not supplant</header><text display-inline="yes-display-inline">Federal funds paid to an eligible recipient pursuant to the Program must be used to supplement, but not supplant, any other Federal, State, or local funds available to such eligible recipient. </text></subsection> 
<subsection id="H3B17C6F79EEB419E9E33B20D7BC9F292"><enum>(h)</enum><header>Report</header> 
<paragraph id="HE916D908F42944C08ECC0A24BE6A3FBA"><enum>(1)</enum><header>Interim report</header><text display-inline="yes-display-inline">Not later than 90 days after the date on which funds are distributed under the Program, the Secretary shall submit to Congress a report on the Program that includes—</text> <subparagraph id="H2C51B60BA76A4705B18C2149CA621174"><enum>(A)</enum><text>the number of grants awarded under the Program;</text></subparagraph> 
<subparagraph id="HAF4D2C73672B47EFAA9037C1EFFECE15"><enum>(B)</enum><text>the location of each grant awarded under the Program; and </text></subparagraph> <subparagraph id="H421E0744F859450DB418A1545D07C2F1"><enum>(C)</enum><text>the amount requested and amount awarded for each grant under the Program. </text></subparagraph></paragraph> 
<paragraph id="H7DC337D0AFC849F585293D14616CA8A1"><enum>(2)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than 30 days after the end of the COVID-19 emergency period, the Secretary shall submit to Congress a report on the Program that includes—</text> <subparagraph id="HFAD15663DE664722B23B19C141F8FD91"><enum>(A)</enum><text>the number of grants awarded under the Program;</text></subparagraph> 
<subparagraph id="H933A610B4BE14F7FADE0E3833BA9DDC1"><enum>(B)</enum><text>the location of each grant awarded under the Program; and </text></subparagraph> <subparagraph id="H3BE7332589B243E1B5CC427CBFE42B0E"><enum>(C)</enum><text>the amount requested and amount awarded for each grant under the Program. </text></subparagraph></paragraph> 
<paragraph id="H1AD1F4EC140B42E6BC74CB3769BFD036"><enum>(3)</enum><header>Publication requirement</header><text>On the date on which a report is submitted under paragraphs (1) or (2), the Secretary shall publish such report submitted on the website of the Department of Health and Human Services. </text></paragraph></subsection> <subsection id="H5B8B588A9DB74D9E83DFE8B9D87FBCE4"><enum>(i)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to carry out the Program—</text> 
<paragraph id="HE7E09CDC706949DABA7077F7B609EA30"><enum>(1)</enum><text>during the COVID-19 emergency period, such sums as may be necessary for each of the fiscal years such emergency period is ongoing; and</text></paragraph> <paragraph id="H6B0BF76B3E8B4AB3AFAB17D39C264E55"><enum>(2)</enum><text>after the COVID-19 emergency period, $5,000,000 for each of the five fiscal years beginning after the termination of the COVID-19 emergency period.</text></paragraph></subsection> 
<subsection id="H93809F5A300D4B4D82DC39A159B19225"><enum>(j)</enum><header>Definitions</header><text>In this section:</text> <paragraph id="H25D46E54713E4C6992757F0163C01B38"><enum>(1)</enum><header><enum-in-header>COVID-19</enum-in-header> emergency period</header><text display-inline="yes-display-inline">The term <quote>COVID-19 emergency period</quote> means the public health emergency declared by the Secretary of Health and Human Services on January 27, 2020, with respect to the 2019 novel coronavirus. </text></paragraph> 
<paragraph id="H3B50942A6D734243B695A96A76D63CA3"><enum>(2)</enum><header>Eligible Recipient</header><text display-inline="yes-display-inline">The term <quote>eligible recipient</quote> means—</text> <subparagraph id="HF691FA57E3264A96B9043FA3FEA44EC3"><enum>(A)</enum><text>a department of health or a department of public health, in coordination with a State; </text></subparagraph> 
<subparagraph id="H0D398F0696A64278833C6E984E739316"><enum>(B)</enum><text>a behavioral health program that primarily serves individuals with mental health or substance abuse disorders; </text></subparagraph> <subparagraph id="H06B05E9691664F62A0D3A1036DE441BE"><enum>(C)</enum><text display-inline="yes-display-inline">community-based nonprofit, that is a consumer-controlled and is certified in accordance with applicable State law to deliver peer specialist support services at a State or local level; or</text></subparagraph> 
<subparagraph id="H941C4B9C80FA4C8898258BD9ECD2BD68"><enum>(D)</enum><text>an institution of higher education providing service learning and civic-engagement courses for peer specialist training. </text></subparagraph></paragraph> <paragraph id="HC5AB7324F1BB470DB0A8CCD99E5480A5"><enum>(3)</enum><header>Healthcare provider</header><text display-inline="yes-display-inline">The term <quote>healthcare provider</quote> mean a certified provider who provides behavioral health services.</text></paragraph> 
<paragraph id="HA6FAA479F9764E99A9AFE5D626778DB3"><enum>(4)</enum><header>Peer specialist</header><text>The term <quote>peer specialist</quote> includes—</text> <subparagraph id="H02DEF5C62C8942618DB895AE29DEE654"><enum>(A)</enum><text>a certified peer specialist;</text></subparagraph> 
<subparagraph id="HAB99F09D578645E19F5AD86F7EE7C407"><enum>(B)</enum><text>a peer recovery support specialist; and</text></subparagraph> <subparagraph id="H27120E86879D406792CBBD9785F7BC43"><enum>(C)</enum><text>a recovery coach for behavioral health.</text></subparagraph></paragraph> 
<paragraph id="HDE12EDF15173430BBFEDF2B9A33BB911"><enum>(5)</enum><header>State</header><text>The term <quote>State</quote> means a State of the United States, the District of Columbia, or any commonwealth, territory, or possession of the United States, or an Indian tribe. </text></paragraph></subsection></section> </legis-body> </bill>
