Security</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Homeland Security Act of 2002 to develop and make available guidance relating to domestic preparedness for and collective response to terrorism regarding active shooter and mass casualty incident response assistance, and for other purposes.</official-title></form><legis-body id="HA0D2CD5FAD9F4BE1979B039D82320CEA" style="OLC"><section id="HC91F4B8292104C349E180C9540ED9BFA" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Providing Rational Options Toward the Elimination of Catastrophic Terrorism Act of 2021</short-title></quote> or the <quote><short-title>PROTECT Act</short-title></quote>.</text></section><section id="H7AC22B406A4B4E0EA557BD60D840B0C7"><enum>2.</enum><header>Active shooter and mass casualty incident response assistance</header><subsection id="H1018952F104246178709F75D7703B641"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Subtitle H of title VIII of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/451">6 U.S.C. 451</external-xref> et seq.) is amended by adding at the end the following new section:</text><quoted-block id="HD22187219E42438498358633A6A89CF6"><section id="HC898730275DD4A4E933AD40271E2D111"><enum>890B.</enum><header>Active shooter and mass casualty incident response assistance</header><subsection id="H4CD0F0CA21E44981B7AECFD1B7C4ADF1"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary, in consultation with the Attorney General and the heads of other Federal agencies as appropriate, shall develop and make available to State, local, tribal, territorial, private sector, and nongovernmental partners guidance relating to domestic preparedness for and collective response to terrorism in order to assist in the development of emergency action and response plans for active shooter and mass casualty incidents in public and private locations, including facilities that have been identified by the Department as potentially vulnerable targets.</text></subsection><subsection id="H03A5560031F3422086A6EED02DC699C6"><enum>(b)</enum><header>Guidance described</header><text>Guidance developed and provided pursuant to subsection (a) may relate to the development of the following:</text><paragraph id="H87AA9A3958F040AC8E355168E8F33A1D"><enum>(1)</enum><text>A strategy for properly responding to an active shooter or mass casualty incident in a public or private location, including training, evacuating, and providing care to persons in such location, with consideration given to the needs of persons with disabilities.</text></paragraph><paragraph id="H34654AFE0A704FACAA36B2E8A9D195A3"><enum>(2)</enum><text display-inline="yes-display-inline">A plan for establishing a unified command, including identification of casualty collection points and staging areas for law enforcement, fire response, and medical personnel.</text></paragraph><paragraph id="H0F7C9E1972834EA68C26BF3D27A463D5"><enum>(3)</enum><text>A schedule for regular testing of equipment used to receive communications during such an incident.</text></paragraph><paragraph id="HF21980CBDEA44786A43A7EFF940071D1"><enum>(4)</enum><text>A practiced method and plan to communicate with occupants of such location during such an incident.</text></paragraph><paragraph id="H2D33CB67736A42BEBE9F5CD011E9F1E6"><enum>(5)</enum><text>A practiced method and plan to communicate with the surrounding community regarding such an incident and the needs of Federal, State, and local officials.</text></paragraph><paragraph id="H87FA1EDD0BD847E5AA8A76281C49F708"><enum>(6)</enum><text>A plan for coordinating with volunteer organizations to expedite assistance for victims.</text></paragraph><paragraph id="H4D1E3A3C6E45431CA6A12C520434F49A"><enum>(7)</enum><text>A schedule for joint exercises and training.</text></paragraph><paragraph id="H6153BF2DC22F41CE9C3DECDF623696B0"><enum>(8)</enum><text>A plan for outreach to facilities that have been identified by the Department as potentially vulnerable targets.</text></paragraph><paragraph id="HA383CC8C290A49AAAD3B64C8C6949C31"><enum>(9)</enum><text>Other planning documents, as determined by the Secretary, including appropriate regionally focused products, plans, training, and outreach.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H8CEA3AEF6324456793DCC1FFD8017281"><enum>(b)</enum><header>Clerical amendment</header><text>The table of contents of the Homeland Security Act of 2002 is amended by inserting after the item relating to section 890A the following new item:</text><quoted-block display-inline="no-display-inline" id="HDEBED6710FB54C598CE0DD85CB5D2A60" style="OLC"><toc regeneration="no-regeneration"><toc-entry level="section">Sec. 890B. Active shooter and mass casualty incident response assistance.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="H37340CB3F3A6454595F2D1E752F3411A"><enum>3.</enum><header>Consideration of active shooter threats</header><text display-inline="no-display-inline">Subsection (b) of section 2007 of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/608">6 U.S.C. 608</external-xref>) is amended—</text><paragraph id="H4BB91D310064483499C8C8D3BE3717DB"><enum>(1)</enum><text>by redesignating paragraph (9) as paragraph (10); and</text></paragraph><paragraph id="H0C8653B661A04BF39ABF75335551A0DB"><enum>(2)</enum><text>by inserting after paragraph (8) the following new paragraph:</text><quoted-block display-inline="no-display-inline" id="HA57310B5F0864FACBC991B415CA389F5" style="OLC"><paragraph id="HC58984271EBC4C00982193CFEB39799F"><enum>(9)</enum><text display-inline="yes-display-inline">Active shooters.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></legis-body></bill>
