R. 152</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20210104">January 4, 2021</action-date><action-desc><sponsor name-id="R000515">Mr. Rush</sponsor> (for himself, <cosponsor name-id="C000754">Mr. Cooper</cosponsor>, <cosponsor name-id="D000627">Mrs. Demings</cosponsor>, <cosponsor name-id="G000551">Mr. Grijalva</cosponsor>, <cosponsor name-id="K000380">Mr. Kildee</cosponsor>, <cosponsor name-id="M000687">Mr. Mfume</cosponsor>, <cosponsor name-id="N000147">Ms. Norton</cosponsor>, <cosponsor name-id="P000607">Mr. Pocan</cosponsor>, <cosponsor name-id="R000606">Mr. Raskin</cosponsor>, <cosponsor name-id="S001145">Ms. Schakowsky</cosponsor>, and <cosponsor name-id="S001165">Mr. Sires</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HBA00">Committee on Financial Services</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To require any payments of principal or interest on a residential mortgage loan that are deferred during a COVID–19 emergency period to be due no earlier than the last day of the loan term, and for other purposes.</official-title></form><legis-body id="HCD0962C4F553430792AF9CDC687328BD" style="OLC"><section id="HBC428B53D2D54EB4849A2445A1853474" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Ensuring Homeowner and Occupant Monetary Encouragement and Stability Act </short-title></quote> or the <quote><short-title>Ensuring HOMES Act</short-title></quote>. </text></section><section id="H1758D89E5BB7474489A63FC948DEF8B8"><enum>2.</enum><header>Treatment of deferred residential mortgage payments</header><subsection id="H41823C4E06D74283991690C0A62F8B2D"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">With respect to any payments of principal or interest on a residential mortgage loan that are deferred during a COVID–19 emergency period (whether pursuant to Federal law or otherwise), the applicable holder or servicer of such loan may not require such payments to be due until the later of—</text><paragraph id="HFFF2855FAED54D608A4CC66FB1B8780D"><enum>(1)</enum><text>the last day of the loan term; or</text></paragraph><paragraph id="HA10CF200AAFD4A359C2C3F4C514CE50A"><enum>(2)</enum><text>the end of the deferral period.</text></paragraph></subsection><subsection id="HB706F6414CB04FA8BB19F48E9FFFDE8A"><enum>(b)</enum><header>Rule of construction</header><text>Nothing in this section may be construed as prohibiting a borrower from making payments on a loan before the date specified under subsection (a).</text></subsection><subsection id="H1A6FF4E1B710466AB47960C3BFE3A971"><enum>(c)</enum><header>Definitions</header><text>In this section:</text><paragraph id="H3BFFBE5506D74E2DB11C476A227C16E8"><enum>(1)</enum><header>Residential mortgage loan</header><text display-inline="yes-display-inline">The term <term>residential mortgage loan</term> means any loan which is secured by residential real property designed principally for the occupancy of families, regardless of the number of families by which the real property is designed to be occupied.</text></paragraph><paragraph id="H82F15E894C8F4F8892DC8C6E0323EF37"><enum>(2)</enum><header>COVID–19 emergency period</header><text>The term <term>COVID–19 emergency period</term> means the period that—</text><subparagraph id="H40F9128CD84742DE89E49AF07ECFBBBD"><enum>(A)</enum><text>begins upon a date that the President declares an emergency under the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/4121">42 U.S.C. 4121</external-xref> et seq.) relating to a Coronavirus Disease 2019 (COVID–19) pandemic; and</text></subparagraph><subparagraph id="HE7F464D2D0C84D1285345D2010B2ECB4"><enum>(B)</enum><text display-inline="yes-display-inline">ends upon the date of the termination by the Federal Emergency Management Administration of such emergency declaration.</text></subparagraph></paragraph></subsection></section><section id="H9A15AC259B3845B097F7961DD1B5C32D"><enum>3.</enum><header>Tenant Protection Program</header><subsection id="HF64A4F36EC934D4BA7FA361027CCD17C"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary of Housing and Urban Development (in this section referred to as the <quote>Secretary</quote>) shall carry out a program to be known as the Tenant Protection Program, under which the Secretary shall make quarterly loans to landlords who waive rent owned by tenants during the COVID–19 emergency period, in accordance with this section.</text></subsection><subsection id="H987F7353E2B348448A715DEAD242FE2F"><enum>(b)</enum><header>Loan details</header><paragraph id="H6D53F04E630A44DDBC5CB8C04894204D"><enum>(1)</enum><header>Loan amount</header><text>A loan provided under this section shall be in an amount equal to no more than half of the amount of rent that a landlord anticipates waiving during the applicable quarter.</text></paragraph><paragraph id="HC40C707133B14242982D22714277C986"><enum>(2)</enum><header>Fees; interest</header><text display-inline="yes-display-inline">The Secretary may not charge any fee in connection with a loan made under this section and may not charge interest on any such loan in an amount greater than 4 percent.</text></paragraph></subsection><subsection id="H92B0A2ADB4DB497FA8EAE5F77F9378B7"><enum>(c)</enum><header>Loan forgiveness</header><text>The Secretary shall forgive any loan made under this section to a landlord if—</text><paragraph id="H61BE9711444C4956AC0B20ACFD1C70C6"><enum>(1)</enum><text display-inline="yes-display-inline">the landlord permits each tenant of the landlord to extend any lease until the date that is 60 days after the end of the COVID–19 emergency period, if such lease would have terminated before such date; and</text></paragraph><paragraph id="H1CBE3B3013EF448CB5C964A8FAE6EEBD"><enum>(2)</enum><text display-inline="yes-display-inline">the landlord enters into an agreement with the Secretary under which the landlord will not evict any tenant until the date that is 60 days after the end of the COVID–19 emergency period.</text></paragraph></subsection><subsection id="H8108E788DA434729A8C9C6B5992FA8E8"><enum>(d)</enum><header>COVID–19 emergency period defined</header><text>In this section, the term <term>COVID–19 emergency period</term> has the meaning given that term under section 2.</text></subsection><subsection id="H2CC4E56A4CD245C3A7DFEE681B87EFAC"><enum>(e)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated to the Secretary such sums as may be necessary to carry out this section.</text></subsection></section><section id="H428C13F8FA1D49319126F8B646EFD822"><enum>4.</enum><header>Rules of application</header><subsection id="HE01EFEBB5C68460DAFFEEB056C870C1D"><enum>(a)</enum><header>Application to existing and new emergencies</header><text display-inline="yes-display-inline">This Act shall apply to a COVID–19 emergency period (as defined under section 2) in existence on the date of enactment of this Act or beginning after the date of enactment of this Act.</text></subsection><subsection id="HC8E356DF0F4B49599ABC7F2406AD9B09"><enum>(b)</enum><header>Retroactive effect</header><text>With respect to the COVID–19 emergency period in existence on the date of enactment of this Act, the provisions of this Act shall apply retroactively to actions taken beginning on the first day of such emergency period.</text></subsection></section></legis-body></bill>
