<section id="HF9351C6F72A44C918D64462B8D65A249" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Prevent Outages With Energy Resilient Options Nationwide Act</short-title></quote> or the <quote><short-title>POWER ON Act</short-title></quote>.</text></section> <section id="H4934F33ABDE7497D95C986DEA5AF14E9"><enum>2.</enum><header>Amendments to Federal Power Act<editorial></editorial></header> <subsection id="H7262D6076A064CD392B95FF1CAE0ADFE"><enum>(a)</enum><header>Designation of National Interest Electric Transmission Corridors</header><text display-inline="yes-display-inline">Section 216(a) of the Federal Power Act (<external-xref legal-doc="usc" parsable-cite="usc/16/824p">16 U.S.C. 824p(a)</external-xref>) is amended—</text> 
<paragraph id="HE5C29B0B412A47E6833E2FB460045CF2"><enum>(1)</enum><text>in paragraph (1), by inserting <quote>capacity constraints and</quote> before <quote>congestion</quote>;</text></paragraph> <paragraph id="HCDA7DF6B3F80489394E2953CF9A44553"><enum>(2)</enum><text>in paragraph (2)—</text> 
<subparagraph id="H9C79676EF4B84A3393E35FAD4EFBCC4A"><enum>(A)</enum><text>by inserting <quote>, not less often than once every 3 years,</quote> after <quote>Secretary shall</quote>;</text></subparagraph> <subparagraph id="H62BD9F32D7FE49FB8D9BC8BB81B96BE2"><enum>(B)</enum><text>by inserting <quote>and Indian tribes</quote> after <quote>affected States</quote>; </text></subparagraph> 
<subparagraph id="HB148D25E511F492A8271D6869447DA22"><enum>(C)</enum><text>by inserting <quote>or other information about electric transmission capacity constraints or congestion</quote> after <quote>the study</quote>; and</text></subparagraph> <subparagraph id="H08797C12E895447DAA012998C43A83EE"><enum>(D)</enum><text display-inline="yes-display-inline">by inserting <quote>, or that is expected to experience such constraints or congestion,</quote> after <quote>consumers</quote>;</text></subparagraph></paragraph> 
<paragraph id="H385AE0BA5F764C898CE2B2704EDC2DC9" commented="no"><enum>(3)</enum><text>in paragraph (3), by inserting <quote>, not less often than once every 3 years,</quote> after <quote>Secretary shall</quote>; and</text></paragraph> <paragraph id="H7CD6C9DB249C4DDFB26C5AE8D5D2427B"><enum>(4)</enum><text>in paragraph (4)—</text> 
<subparagraph id="HB4AFE332495F421D9D70B5845DD8812A"><enum>(A)</enum><text>in subparagraph (C), by inserting <quote>or energy security</quote> after <quote>independence</quote>;</text></subparagraph> <subparagraph id="H8989A83F3ECD48659E25063D4BC74C34"><enum>(B)</enum><text display-inline="yes-display-inline">in subparagraph (D), by striking the <quote>and</quote> at the end;</text></subparagraph> 
<subparagraph id="H9839E2582F92414791206502875C7DCE"><enum>(C)</enum><text>in subparagraph (E), by striking <quote>security.</quote> and inserting <quote>security;</quote>; and</text></subparagraph> <subparagraph id="H484EAE5A48954CA5A02AD7BC51C243C4"><enum>(D)</enum><text>by adding at the end the following:</text> 
<quoted-block style="OLC" id="H242504230871439D81B323B1DD38845C" display-inline="no-display-inline"> 
<subparagraph id="HCD0A7280613C4212B6A148516289E87B" commented="no" indent="up1"><enum>(F)</enum><text display-inline="yes-display-inline">the designation would—</text> <clause id="HF2D4F6D26F6F475AB1FF9D95AEF15F0B"><enum>(i)</enum><text display-inline="yes-display-inline">enhance the ability of facilities that generate or transmit renewable energy, low-emission energy, or emission-free energy to connect to the electric grid;</text></clause> 
<clause id="H9650E9825CDA40CC915DF08D9F582CA6"><enum>(ii)</enum><text>promote electrification of other sectors, including the transportation sector; or</text></clause> <clause id="H7990BBCE01384B9E9F556BAC665CDC9D"><enum>(iii)</enum><text>facilitate other public policies to decarbonize the grid;</text></clause></subparagraph> 
<subparagraph id="H40BE7A693A37465887EB6EE22D6175AB" indent="up1"><enum>(G)</enum><text display-inline="yes-display-inline">the designation—</text> <clause id="H479D36A7FB7F416F8B1C28556BA399F8"><enum>(i)</enum><text>maximizes existing rights-of-way, including along highways, brownfields, and railways; and</text></clause> 
<clause id="H539F1EF9795C4E41B34BC8711C31A1B8"><enum>(ii)</enum><text display-inline="yes-display-inline">avoids, to the maximum extent practicable, sensitive environmental areas and cultural heritage sites; and</text></clause></subparagraph> <subparagraph id="H7A3F958751494CA6AA0F3F9251117849" indent="up1"><enum>(H)</enum><text display-inline="yes-display-inline">the designation would result in a reduction in the cost to purchase electric energy for consumers.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection> 
<subsection id="H999B8EC42CFF4DD787332A704E1B08E9"><enum>(b)</enum><header>Construction Permit</header><text display-inline="yes-display-inline">Section 216(b) of the Federal Power Act (<external-xref legal-doc="usc" parsable-cite="usc/16/824p">16 U.S.C. 824p(b)</external-xref>) is amended—</text> <paragraph id="H56D605F100184002811B17091209EA00"><enum>(1)</enum><text>in paragraph (1)—</text> 
<subparagraph id="HD81690E2B501475A80D7F56FAF8BAE3B"><enum>(A)</enum><text>in subparagraph (A)(ii), by inserting <quote>or interregional benefits</quote> after <quote>interstate benefits</quote>; and</text></subparagraph> <subparagraph id="H22A17E7DBF134012A2FF14FED6CE37FE"><enum>(B)</enum><text>by amending subparagraph (C) to read as follows:</text>

<subparagraph id="H0474D54FDB534E1F9231DFA340B2307B" indent="up1"><enum>(C)</enum><text>a State commission or other entity that has authority to approve the siting of the facilities has—</text> <clause id="HE126EC4A7C944B3F962B7406CEECA83D"><enum>(i)</enum><text display-inline="yes-display-inline">not approved or denied an application seeking approval pursuant to applicable law by the date that is 1 year after the filing of the application or 1 year after the designation of the relevant national interest electric transmission corridor, whichever is later;</text></clause> 
<clause id="HA1E88B6987F443AAA94903B1523A0A86"><enum>(ii)</enum><text>conditioned its approval in such a manner that the proposed construction or modification will not significantly reduce transmission congestion in interstate commerce or is not economically feasible; or</text></clause> <clause id="HE4B07B2096414A3EB0F575C7CD36BF93"><enum>(iii)</enum><text>denied an application seeking approval pursuant to applicable law;</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection> 
<subsection id="H36E0EDF7F5B04424B4245D3C2D7108FE"><enum>(c)</enum><header>Rights-of-Way</header><text display-inline="yes-display-inline">Section 216(e)(1) of the Federal Power Act (<external-xref legal-doc="usc" parsable-cite="usc/16/824p">16 U.S.C. 824p(e)(1)</external-xref>) is amended by inserting <quote>and the permit holder has made good faith efforts to engage landowners and other stakeholders early,</quote> after <quote>facilities,</quote>.</text></subsection> <subsection id="H7D558C59657B4B36BC7CE885E1782EE9"><enum>(d)</enum><header>Interstate Compacts</header><text display-inline="yes-display-inline">Section 216(i) of the Federal Power Act (<external-xref legal-doc="usc" parsable-cite="usc/16/824p">16 U.S.C. 824p</external-xref>) is amended—</text> 
<paragraph id="HDB8F521FDC3D48519245D7B4080E2AA4"><enum>(1)</enum><text>in paragraph (2), by striking <quote>may</quote> and inserting <quote>shall</quote>; and</text></paragraph> <paragraph id="HACCC25E6B8A7403E8607C5DBCB0C3A04"><enum>(2)</enum><text display-inline="yes-display-inline">in paragraph (4), by striking <quote>the members of the compact are in disagreement and the Secretary makes, after notice and an opportunity for a hearing, the finding described in subsection (b)(1)(C)</quote> and inserting <quote>the Secretary finds that the members of the compact are in disagreement after the date that is 1 year after the filing of an application for the facility or 1 year after the designation of the relevant national interest electric transmission corridor, whichever is later</quote>.</text></paragraph></subsection></section>
