R. 1508</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date>October 21, 2021</action-date><action-desc>Received</action-desc></action><action><action-date>April 27, 2022</action-date><action-desc>Read twice and placed on the calendar</action-desc></action><legis-type>AN ACT</legis-type><official-title display="yes">To require a guidance clarity statement on certain agency guidance, and for other purposes.</official-title></form><legis-body id="H77C7E6C5B5B7423F946CF9C284F81423" style="OLC"><section id="H3C62DDD38C4B47319F0829BF05E29AD6" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Guidance Clarity Act of 2021</short-title></quote>.</text></section><section id="H705208333597487099F2E5A3B71A1984"><enum>2.</enum><header>Guidance clarity statement required</header><subsection id="HCCD7A20D5D674B98AA9B494B4F9AC397"><enum>(a)</enum><header>Requirement</header><text>Each agency, as defined in section 551 of title 5, United States Code, shall include a guidance clarity statement as described in subsection (b) on any guidance issued by that agency under section 553(b)(3)(A) of title 5, United States Code, on and after the date that is 30 days after the date on which the Director of the Office of Management and Budget issues the guidance required under subsection (c).</text></subsection><subsection id="H7C27D60256174380B2F68762A88B0109"><enum>(b)</enum><header>Guidance clarity statement</header><text>A guidance clarity statement required under subsection (b) shall—</text><paragraph id="HA5D8717B636941E6838BC16ACFC36D83"><enum>(1)</enum><text>be displayed prominently on the first page of the document; and</text></paragraph><paragraph id="H0328E28ECFB444FFBD545F1757020F78"><enum>(2)</enum><text>include the following: <quote>The contents of this document do not have the force and effect of law and do not, of themselves, bind the public or the agency. This document is intended only to provide clarity to the public regarding existing requirements under the law or agency policies.</quote>.</text></paragraph></subsection><subsection id="H30E84A52050847248A628E69DF2A2FE4"><enum>(c)</enum><header>OMB guidance</header><text>Not later than 90 days after the date of enactment of this Act, the Director of the Office of Management and Budget shall issue guidance to implement this Act.</text></subsection></section><section id="H64940670E2F24628B316233C3ED86FB4"><enum>3.</enum><header>Determination of budgetary effects</header><text display-inline="no-display-inline">The budgetary effects of this Act, for the purpose of complying with the Statutory Pay-As-You-Go Act of 2010, shall be determined by reference to the latest statement titled <quote>Budgetary Effects of PAYGO Legislation</quote> for this Act, submitted for printing in the Congressional Record by the Chairman of the House Budget Committee, provided that such statement has been submitted prior to the vote on passage.</text></section></legis-body><attestation><attestation-group><attestation-date date="20211020" chamber="House">Passed the House of Representatives October 20, 2021.</attestation-date><attestor display="yes">Cheryl L.
