which was referred to the <committee-name committee-id="HSM00">Committee on Small Business</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Small Business Act to optimize the operations of the microloan program, lower costs for small business concerns and intermediary participants in the program, and for other purposes.</official-title></form><legis-body id="HBCCFBDD21AC34CC18349F345E38355FB" style="OLC"><section id="HA5337BD2B66A4824A2BCF4D8E77503AA" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Microloan Improvement Act of 2021</short-title></quote>.</text></section><section id="H30B5B0133789481691176AD2A8F8A3A2" section-type="subsequent-section"><enum>2.</enum><header>Interest rate for certain intermediaries</header><text display-inline="no-display-inline">Section 7(m)(3)(F)(iii) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/636">15 U.S.C. 636(m)(3)(F)(iii)</external-xref>) is amended by striking <quote>$7,500</quote> and inserting <quote>$10,000</quote>.</text></section><section id="H6B25240810E34AD1AB97553F83CCF6C4"><enum>3.</enum><header>Lines of credit authorized</header><text display-inline="no-display-inline"> Section 7(m)(6)(A) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/636">15 U.S.C. 636(m)(6)(A)</external-xref>) is amended by inserting <quote>(including lines of credit)</quote> after <quote>fixed rate loans</quote>.</text></section><section id="HEF034AD1A8F141048E61AE16A5EDD592"><enum>4.</enum><header>Extended repayment terms</header><subsection id="H3536908096B54EC78FE06D2E15451249"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 7(m)(6) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/636">15 U.S.C. 636(m)(6)</external-xref>) is amended by adding at the end the following:</text><quoted-block id="H60C40D4C061643A082984991EC172C30" style="OLC"><subparagraph id="H054B56CC33A04E5994CBAF3E1BA958CB"><enum>(F)</enum><header>Repayment terms</header><clause id="H7A5F8397F97141778E3FF6A4787178E8"><enum>(i)</enum><header>Limitation on repayments term</header><text>The repayment term for a loan made under this paragraph shall not be more than—</text><subclause id="H84518B2BDD18492CB0926DEEAD79C2C7"><enum>(I)</enum><text>in the case of a loan made by an intermediary of $10,000 or less, 7 years; and</text></subclause><subclause id="H3E35B8BB58AB4C7B8E6976215BE4B678"><enum>(II)</enum><text>in the case of a loan made by an intermediary of greater than $10,000, 10 years.</text></subclause></clause><clause id="H70581DA097C4448BBFAEFCB15CAA9095"><enum>(ii)</enum><header>No additional limitations</header><text>The Administrator may not impose any additional limitation on the term for repayment of a loan made by an intermediary under this paragraph.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H22536275D09D48AF915F96C3423E91B4"><enum>(b)</enum><header>Technical amendment</header><text display-inline="yes-display-inline">Section 329(c) of the Economic Aid to Hard-Hit Small Businesses, Nonprofits, and Venues Act (<external-xref legal-doc="public-law" parsable-cite="pl/116/260">Public Law 116–260</external-xref>; 134 Stat. 2042 <external-xref legal-doc="usc" parsable-cite="usc/15/636">15 U.S.C. 636</external-xref> note) is repealed.</text></subsection></section><section id="H124412217EEB4C58A551B17FDDF6C7FD"><enum>5.</enum><header>Program funding for microloans</header><subsection id="HC6EE1F783A7240A9836EE504EE47B43F"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 7(m) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/636">15 U.S.C. 636(m)</external-xref>) is amended—</text><paragraph id="H3B1312BA7D334963A6F8A8F15C6BA78E"><enum>(1)</enum><text>in paragraph (7)(B)—</text><subparagraph id="HA90327AE4C8D433AA03E702861559F29"><enum>(A)</enum><text>by amending clause (i) to read as follows:</text><quoted-block style="OLC" id="HC92DCB3A14C34558BD051B14ED14F50A" display-inline="no-display-inline"><clause id="HF64B485649934E23944C77DC4ABB23DA"><enum>(i)</enum><header>Allocation</header><text display-inline="yes-display-inline">Subject to the availability of appropriations and for the first 2 quarters of a fiscal year, of the total amount of new loan funds made available for award under this subsection in such fiscal year, the Administrator shall—</text><subclause id="HA6B20B7642E94D7F87A3EA3FC200D332" commented="no"><enum>(I)</enum><text>reserve 15 percent of such funds for award to designated underutilized States; and</text></subclause><subclause id="H6AB546239CEE4D2FBAC2F1F7C558EF5A"><enum>(II)</enum><text>make the remaining 85 percent of such funds available for award in any State.</text></subclause></clause><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph id="H4C54328A07A04147A7921233C0EB22D7"><enum>(B)</enum><text>in clause (ii), by striking <quote>to carry out</quote> and all that follows through the period at the end and inserting the following: <quote>under clause (i)(I) remains unexpended, the Administrator may make that portion available for award in any State or designated underutilized State.</quote>; and</text></subparagraph></paragraph><paragraph id="H6E449DA13C384EF795767A3B95CCF258"><enum>(2)</enum><text>in paragraph (11)—</text><subparagraph id="HE8190BE9D635446D856F1A59A9C7424D"><enum>(A)</enum><text>in subparagraph (C)(ii), by striking <quote>and</quote> at the end;</text></subparagraph><subparagraph id="H2C1F4184AE014F14818899D2A8AB4A82"><enum>(B)</enum><text>in subparagraph (D), by striking the period at the end and inserting <quote>; and</quote>; and</text></subparagraph><subparagraph id="HA817467F05804CE1BC91272709040A9F"><enum>(C)</enum><text>by adding at the end the following new subparagraph:</text><quoted-block style="OLC" id="HB56025EB47CF4031B27EEB4A2370B4F0" display-inline="no-display-inline"><subparagraph id="H2084FF8AABF74DFC9C11493A644EDC9F"><enum>(E)</enum><text display-inline="yes-display-inline">the term <term>State</term> means each of the several States, the District of Columbia, the Commonwealth of Puerto Rico, the United States Virgin Islands, Guam, the Northern Mariana Islands, and American Samoa.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection><subsection id="H13583DA8D695496EB832F9F7F46860AB" commented="no"><enum>(b)</enum><header>Rulemaking</header><text display-inline="yes-display-inline">Not later than 180 days after the date of the enactment of this Act, the Administrator of the Small Business Administration shall issue regulations to define the term <term>designated underutilized State</term>, as used in section 7(m)(7)(B) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/636">15 U.S.C. 636(m)(7)(B)</external-xref>), as added by this section.</text></subsection></section><section id="H07361106C9F047E189638B58C6A41709"><enum>6.</enum><header>Credit reporting information</header><text display-inline="no-display-inline">The Administrator of the Small Business Administration shall issue rules establishing a process under which an intermediary that makes a loan to a borrower under section 7(m) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/636">15 U.S.C. 636(m)</external-xref>) shall be required to provide the major credit reporting agencies with information about the borrower relevant to credit reporting, such as the borrower’s payment activity on the loan.</text></section><section id="HCB17715C593E4A4DB56C5E0085E7AEF5"><enum>7.</enum><header>Report regarding equitable distribution</header><text display-inline="no-display-inline">Section 7(m)(8) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/636">15 U.S.C. 636(m)(8)</external-xref>) is amended—</text><paragraph id="H9748BB319936477EADF1297E8FA9F3D6"><enum>(1)</enum><text>by striking <quote>In approving</quote> and inserting the following:</text><quoted-block display-inline="no-display-inline" id="H557B140D16C74D53BA174D45A59D51A9" style="OLC"><subparagraph id="H8B746F2F07FD41F6820FA300577CB400"><enum>(A)</enum><header>In general</header><text>In approving</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="HDEDF1EA479DC404FA9C1AA4D024005E3"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="H871F489FA8E146C7848D4B43E980A3E7" style="OLC"><subparagraph id="HA38F337BBDAC4D20AB055EBA940FE135"><enum>(B)</enum><header>Annual report</header><text display-inline="yes-display-inline">The Administrator shall include in the report submitted under paragraph (10), and make publicly available on the website of the Administration, information on how the Administration has met the requirements of subparagraph (A).</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></legis-body></bill>
