R. 1495</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20210302">March 2, 2021</action-date><action-desc><sponsor name-id="E000294">Mr. Emmer</sponsor> introduced the following bill; which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title XIX of the Social Security Act to provide coverage under the Medicaid program for services for the treatment of psychiatric or substance use disorders furnished to certain individuals in an institution for mental diseases, and for other purposes.</official-title></form><legis-body id="H67CDA17695C44794838017E1E6522510" style="OLC"><section id="HA456407A087F42E692FA195A97739E9D" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Jim Ramstad Legacy of Recovery Act</short-title></quote>.</text></section><section id="H71B831EF3ADD4F1A93BE81EBFDB1FF6B"><enum>2.</enum><header>Medicaid coverage for services for the treatment of psychiatric or substance use disorders furnished to certain individuals in an institution for mental diseases</header><subsection id="H9FB58BC369BC465899F50B42AFDDC05C"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 1905(a) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396d">42 U.S.C. 1396d(a)</external-xref>) is amended—</text><paragraph id="H080C3583A6E047ADA8DEE0419C3D125C"><enum>(1)</enum><text>in paragraph (29), by striking <quote>; and</quote> at the end;</text></paragraph><paragraph id="H5FC3603017474AF295F11DE30E1C18C1"><enum>(2)</enum><text>by redesignating paragraph (30) as paragraph (31);</text></paragraph><paragraph id="HA58A4F2DD7F54426A15D4E549B45064B"><enum>(3)</enum><text>by inserting after paragraph (29) the following new paragraph:</text><quoted-block display-inline="no-display-inline" id="H6DCDB5FE3A244760A3C876981BE9ECED" style="OLC"><paragraph id="H4A4B0A1BF48A408FBE90B5C94FECA5FD"><enum>(30)</enum><text display-inline="yes-display-inline">services for the treatment of psychiatric or substance use disorders furnished to any individual who is eligible for medical assistance under the State plan (or a waiver of such plan), enrolled with a medicaid managed care organization (as defined in section 1903(m)(1)(A)) or a prepaid inpatient health plan described in section 1903(m)(9)(D)(iii)(I), and is a patient in an institution for mental diseases; and</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="HDC738843F77B4196B1DC158BE16CB2E6"><enum>(4)</enum><text>in the matter preceding the subdivision (A) following paragraph (31), as redesignated by paragraph (2), by striking <quote>as otherwise provided in paragraph (16)</quote> and inserting <quote>as otherwise provided in paragraphs (16) and (30)</quote>.</text></paragraph></subsection><subsection id="H70E2760CE76848139C29CF7ACFFDACDC"><enum>(b)</enum><header>Conforming amendment</header><text>Section 1903(m)(7) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396b">42 U.S.C. 1396b(m)(7)</external-xref>) is amended by inserting before the period at the end the following: <quote>, and made with respect to services described in such section provided before the date of enactment of the Jim Ramstad Legacy of Recovery Act</quote>.</text></subsection><subsection id="H7942A28E43D943EDAC790E1B0D325EEE"><enum>(c)</enum><header>Effective date</header><text display-inline="yes-display-inline">The amendments made by subsection (a) shall apply with respect to medical assistance provided on or after the date of the enactment of this Act.</text></subsection></section></legis-body></bill>
