which was referred to the <committee-name committee-id="HBA00">Committee on Financial Services</committee-name>, and in addition to the Committee on <committee-name committee-id="HBU00">the Budget</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Fair Debt Collection Practices Act to provide enhanced protection against debt collector harassment of members of the Armed Forces, and for other purposes.</official-title></form><legis-body id="HA63145E82C07406AB03E359D72A5BDE1" style="OLC"><section id="H3F466A9D260941119506321A78054CD8" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Fair Debt Collection Practices for Servicemembers Act</short-title></quote>.</text></section><section id="HE67CB357DC644FA486556BF6EFFCB6F8"><enum>2.</enum><header>Enhanced protection against debt collector harassment of ser­vice­mem­bers</header><subsection id="H5053D5AD2190467DBEDA8A01EB62CED1"><enum>(a)</enum><header>Communication in connection with debt collection</header><text display-inline="yes-display-inline">Section 805 of the Fair Debt Collection Practices Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1692c">15 U.S.C. 1692c</external-xref>) is amended by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="HA3D85BB0449C44408BC4AD8B4FFAE8E6" style="OLC"><subsection id="H12841988EF1944A3A6ECFB16E3077461"><enum>(e)</enum><header>Communications concerning servicemember debts</header><paragraph id="H96D6DEB855114266B585D36AF3BCA0EF"><enum>(1)</enum><header>Definition</header><text display-inline="yes-display-inline">In this subsection, the term <term>covered member</term> means—</text><subparagraph id="H3BE06CE8808F4E8ABA8C5748D312D98E"><enum>(A)</enum><text>a covered member or a dependent as defined in section 987(i) of title 10, United States Code; and</text></subparagraph><subparagraph id="H093949C540674D859135C1619674D6A9"><enum>(B)</enum><clause commented="no" display-inline="yes-display-inline" id="H7B8AE2C097144E6AAAE54BF609218371"><enum>(i)</enum><text>an individual who was separated, discharged, or released from duty described in such section 987(i)(1), but only during the 365-day period beginning on the date of separation, discharge, or release; or</text></clause><clause id="H1D98C27FDD084742B529D4B317FBB3ED" indent="up1"><enum>(ii)</enum><text display-inline="yes-display-inline">a person, with respect to an individual described in clause (i), described in subparagraph (A), (D), (E), or (I) of section 1072(2) of title 10, United States Code.</text></clause></subparagraph></paragraph><paragraph id="HDC16D02211FB4B129490E936127DC362"><enum>(2)</enum><header>Prohibitions</header><text>A debt collector may not, in connection with the collection of any debt of a covered member—</text><subparagraph id="HCA550EE31B32414F85809C6183FB0ECB"><enum>(A)</enum><text display-inline="yes-display-inline">threaten to have the covered member reduced in rank;</text></subparagraph><subparagraph id="HBC998227F219406194A14E091E1626F7"><enum>(B)</enum><text>threaten to have the covered member’s security clearance revoked; or</text></subparagraph><subparagraph id="H0539F1157B4A4A24BA1543FF659EC85F"><enum>(C)</enum><text display-inline="yes-display-inline">threaten to have the covered member prosecuted under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/10/47">chapter 47</external-xref> of title 10, United States Code (the Uniform Code of Military Justice).</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H9ED72C4A2F91456988EC17B8A6216E79"><enum>(b)</enum><header>Unfair practices</header><text>Section 808 of the Fair Debt Collection Practices Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1692f">15 U.S.C. 1692f</external-xref>) is amended by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="H1D4C4599D0C74D7B82FAD4770575DA6B" style="OLC"><paragraph id="H0CB1E56ECD86459CBE1DF00DBC29039C"><enum>(9)</enum><text>The representation to any covered member (as defined under section 805(e)(1)) that failure to cooperate with a debt collector will result in—</text><subparagraph id="H5F3EB5F8AA454833817C55DC4E91AFD8"><enum>(A)</enum><text>a reduction in rank of the covered member;</text></subparagraph><subparagraph id="HF2A6770D0D0C4C32B7A75E9A78854E88"><enum>(B)</enum><text display-inline="yes-display-inline">a revocation of the covered member’s security clearance; or</text></subparagraph><subparagraph id="HDE1E551D9A484C57AA097276C67DC78B"><enum>(C)</enum><text>prosecution under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/10/47">chapter 47</external-xref> of title 10, United States Code (the Uniform Code of Military Justice).</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="H7B8D454DEDD84924938FDA64173D24CC"><enum>3.</enum><header>GAO study</header><text display-inline="no-display-inline">The Comptroller General of the United States shall conduct a study and submit a report to Congress on the impact of this Act on—</text><paragraph id="HD9CB361E2E61414C97469972C38F6BF0"><enum>(1)</enum><text>the timely delivery of information to a covered member (as defined in section 805(e) of the Fair Debt Collection Practices Act, as added by this Act);</text></paragraph><paragraph id="HFC07630BBAB1440D951470FF775D4016"><enum>(2)</enum><text>military readiness; and</text></paragraph><paragraph id="H6F374786FDE04EBDAB02165C0C632FCF"><enum>(3)</enum><text>national security, including the extent to which covered members with security clearances would be impacted by uncollected debt.</text></paragraph></section><section id="HC493710F9F9E44CCA1DA49036E30B11C"><enum>4.</enum><header>Determination of budgetary effects</header><text display-inline="no-display-inline">The budgetary effects of this Act, for the purpose of complying with the Statutory Pay-As-You-Go Act of 2010, shall be determined by reference to the latest statement titled <quote>Budgetary Effects of PAYGO Legislation</quote> for this Act, submitted for printing in the Congressional Record by the Chairman of the House Budget Committee, provided that such statement has been submitted prior to the vote on passage.</text></section></legis-body></bill>
