which was referred to the <committee-name committee-id="HJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To modernize the Undetectable Firearms Act of 1988.</official-title></form><legis-body id="HB2CB548577EA4195973978ECF653A9F7" style="OLC"><section id="H568A66BF1FE74A6494D6F8D092274A8F" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Undetectable Firearms Modernization Act</short-title></quote>.</text></section><section id="H33A3355C2EDB4FDEA814FBD01B860D83" section-type="subsequent-section"><enum>2.</enum><header>Modernization of the prohibition on undetectable firearms</header><text display-inline="no-display-inline">Section 922(p) of title 18, United States Code, is amended—</text><paragraph id="H09BEACD2DA04475992CE5BA45300EB81"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (1)—</text><subparagraph id="H73C0D9D1750041F0B7FEBEA4193424D1"><enum>(A)</enum><text display-inline="yes-display-inline">in subparagraph (A), by striking <quote>grips, stocks, and magazines, is not as detectable as the Security Exemplar, by walk-through metal detectors calibrated and operated to detect the Security Exemplar</quote> and inserting <quote>all parts other than major components, does not contain detectable material</quote>; and</text></subparagraph><subparagraph id="HB140C8E60B234FEF9C233B7A70F4CBD3"><enum>(B)</enum><text>in subparagraph (B), by striking <quote>when subjected to inspection by the types of x-ray machines commonly used at airports, does not generate</quote> and inserting the following: <quote>if subjected to inspection by the types of detection devices commonly used at airports for security screening, would not generate</quote>;</text></subparagraph></paragraph><paragraph id="H785E258807E5462FA001DECE19FBC015"><enum>(2)</enum><text>in paragraph (2)—</text><subparagraph id="H6F7607EDCA114031B4CBB672A84BCAB9"><enum>(A)</enum><text>by striking subparagraph (B) and inserting the following:</text><quoted-block display-inline="no-display-inline" id="HB5387816CD8F442EA00C8EBC97542AEC" style="OLC"><subparagraph id="HFB2B47144D6B4CBC9F47497DE13C3BED" indent="up1"><enum>(B)</enum><text>the term <term>major component</term>, with respect to a firearm—</text><clause id="H00F8D93EF6964B6E88F77672D64126F7"><enum>(i)</enum><text>means the slide or cylinder, or the frame or receiver of the firearm; and</text></clause><clause id="H2E168BB0A6DA461BB3E7F69DE3B9FB34"><enum>(ii)</enum><text>in the case of a rifle or shotgun, includes the barrel of the firearm; and</text></clause></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph id="HBE0C55B8173D4E9BA387D75E4537F37D"><enum>(B)</enum><text>by striking subparagraph (C) and the proviso that follows and inserting the following:</text><quoted-block display-inline="no-display-inline" id="H0429C2C903E240FD930EA610B87AD932" style="OLC"><subparagraph id="HEED7E9AE31494493B6B6A0D290CBDD0C" indent="up1"><enum>(C)</enum><text>the term <term>detectable material</term> means material that produces a magnetic field that is equivalent in strength to the magnetic field produced by 3.7 ounces of 17–4 PH stainless steel.</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H239D09FBAE7F4745A9B667D1483836B6"><enum>(3)</enum><text>in paragraph (3)—</text><subparagraph id="H7A6202EDDEED4BF6B3AC41ECF16012B8" indent="down1"><enum>(A)</enum><text>in the first sentence, by inserting after <quote>of a firearm</quote> the following: <quote>, including a prototype,</quote>; and</text></subparagraph><subparagraph id="HB3942154D71D483D9B9A154CED947FB9" indent="down1"><enum>(B)</enum><text>by striking the second sentence; and</text></subparagraph></paragraph><paragraph id="H7DD39CF149F74B3F9C57FEB478B0EEEB"><enum>(4)</enum><text>in paragraph (5), by striking <quote>shall not apply to any firearm which</quote> and all that follows and inserting the following: “shall not apply to—</text><quoted-block display-inline="no-display-inline" id="HDFA4114AA129470BA2557A0A2042B012" style="OLC"><subparagraph id="HDC15E5666DD340D5AF8748B53F46B73A" indent="up1"><enum>(A)</enum><text>any firearm received by, in the possession of, or under the control of the United States; or</text></subparagraph><subparagraph id="H16AA8B9C88B84CE9929EE6F076B33CBA" indent="up1"><enum>(B)</enum><text>the manufacture, importation, possession, transfer, receipt, shipment, or delivery of a firearm by a licensed manufacturer or licensed importer pursuant to an existing contract with the United States.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></legis-body></bill>
