<official-title display="yes">To amend title 18, United States Code, to provide for prohibitions on eviction, and for other purposes.</official-title>

<section id="HCBF258ED318942919187B68CE6908133" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Emergency Eviction Enforcement Act of 2021</short-title></quote>.</text></section> <section id="H5DFDF308D0614916BC74724D51879CFF"><enum>2.</enum><header>Prohibition on eviction during national emergency</header> <subsection id="H3C809160C058402DB7E3B14DC94B9438"><enum>(a)</enum><header>Civil action</header><text display-inline="yes-display-inline">Any person injured by a violation of this section, or the Attorney General, on behalf of such person, unless such person at any time may bring a cause of action for injunctive relief, repossession of the property under the terms prior to the violation of this section, and damages equal to the greater of three times the amount of the injury or three times the amount of any rent charged for the covered dwelling following a violation of this section, and may be awarded attorneys’ fees. If the prevailing party is the Attorney General, any damages recovered shall be disbursed equally between—</text>
<paragraph id="H365B2BC755FB4FE5AA3157044AC2C0C2"><enum>(1)</enum><text>the victim of the offense;</text></paragraph> <paragraph id="HE99F6CF100DC433A8EB95F4560FBC3F1"><enum>(2)</enum><text>a fund that shall be available to the Attorney General without further appropriation or limitation as to fiscal year, exclusively for purposes of engaging in other civil actions under this section; and</text></paragraph>
<paragraph id="HBDC68F6E18C04CE5A815321C4121C98C"><enum>(3)</enum><text>the Legal Services Corporation for purposes of any activities to support the provision of fair housing.</text></paragraph></subsection> <subsection id="H39023B4D04794B87B391DCC5904D4C70"><enum>(b)</enum><header>In general</header><text display-inline="yes-display-inline">Whoever, being a lessor of a covered dwelling, knowingly—</text>
<paragraph id="H17FC5336EB684EFEA331E8A8E99251DC"><enum>(1)</enum><text display-inline="yes-display-inline">repossesses or physically attempts to repossess a covered dwelling from a tenant of the covered dwelling without a duly issued order from a court of jurisdiction; </text></paragraph> <paragraph id="H62810639C0F64330A2BA1DB1B4848EDC"><enum>(2)</enum><text display-inline="yes-display-inline">threatens, harasses, intimidates, or creates a hostile environment for a tenant of a covered dwelling for the purpose of causing the tenant to vacate the covered dwelling; or</text></paragraph>
<paragraph id="H390CFE156CE9470EADA0BDAADA705697"><enum>(3)</enum><text display-inline="yes-display-inline">impairs the habitability of a covered dwelling (including suspending utility service, changing locks, refusing to repair structure, plumbing, electrical, ventilation systems, maintain appliances in state of good repair) for the purpose of causing the tenant to vacate the covered dwelling,</text></paragraph><continuation-text continuation-text-level="subsection">shall have violated this section. </continuation-text></subsection> <subsection id="H3CFA099C5CA7491DAC70CFC608F7E68B"><enum>(c)</enum><header>Definition</header><text display-inline="yes-display-inline">In this section:</text>
<paragraph id="H1D0D9D7740B246CA8D25B454A46A6204"><enum>(1)</enum><text>The term <quote>dwelling</quote>—</text> <subparagraph id="H197B9F1F1A93444288DF871F4B481FD8"><enum>(A)</enum><text>has the meaning given the term in section 802 of the Fair Housing Act (<external-xref legal-doc="usc" parsable-cite="usc/42/3602">42 U.S.C. 3602</external-xref>); and</text></subparagraph>
<subparagraph id="H378F445026AB4F24949FBA67C148566F"><enum>(B)</enum><text>includes houses and dwellings described in section 803(b) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/3603">42 U.S.C. 3603(b)</external-xref>). </text></subparagraph></paragraph> <paragraph id="H14FFC5F9BC564AC89F411BED4252EDC1"><enum>(2)</enum><text display-inline="yes-display-inline">The term <quote>covered dwelling</quote> means a dwelling located in an area designated by the President as a national emergency, for the duration of the designation, under the National Emergencies Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1601">50 U.S.C. 1601</external-xref> et seq.), Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/247d">42 U.S.C. 247d</external-xref>), or Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5121">42 U.S.C. 5121</external-xref> et seq.). </text></paragraph></subsection></section>
