which was referred to the <committee-name committee-id="HJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Immigration and Nationality Act to provide Temporary Resident Status for certain parents and spouses of citizens or lawful residents of the United States, and for other purposes.</official-title></form><legis-body id="H88A4A696EF5742BCBBE7A9262DD63D11" style="OLC"><section id="HD602CAA5C2794F9A92D546FA5510789B" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>American Right to Family Act</short-title></quote>.</text></section><section id="H734DBB0BA2D8423E915C46145E9E3447"><enum>2.</enum><header>Temporary resident status for certain long-term resident parents</header><text display-inline="no-display-inline">Section 101(a)(15) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(a)(15)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" id="H71A61D3106A44E80B58AEE315A7D2CF9" display-inline="no-display-inline"><subparagraph id="H5C9FC20B199A4CE880D7375CE807712D"><enum>(W)</enum><header>Temporary resident status for certain long-term resident parents</header><clause id="H8C31A6C37CAF41ADADA320F0B9817B6C"><enum>(i)</enum><header>In general</header><text>Subject to section 214(s), an alien who files a petition for status under this subparagraph, if the Secretary of Homeland Security determines that—</text><subclause id="H09129E20FB5E48A5B2229F9003494BDB"><enum>(I)</enum><text>the alien—</text><item id="HD5D7DBB8C5A14604B9E959D02042C201"><enum>(aa)</enum><text>has been physically present in the United States for a continuous period of not less than 10 years immediately preceding the date of the alien’s application; </text></item><item id="HEEC61319F4ED42E89EE661E23416EF96"><enum>(bb)</enum><text>has been granted deferred action pursuant to the Deferred Action for Childhood Arrivals Memorandum announced by the Secretary of Homeland Security on June 15, 2012, or would have otherwise qualified for the Deferred Action for Childhood Arrivals announced by the Secretary of Homeland Security pursuant to the November 14, 2014, Memorandum; and</text></item><item id="HE9119085258B4551A5993F4C03E332F8"><enum>(cc)</enum><text>is a covered person;</text></item></subclause><subclause id="H4892D295BFA043B2A75B6D0397E2DE5E"><enum>(II)</enum><text display-inline="yes-display-inline">the alien—</text><item id="HFC133D65D71744AEB38BD45FECEDE13A"><enum>(aa)</enum><text>was issued an order of removal from the United States under sections 235 or 240 of the Immigration and Nationality Act, and—</text><subitem id="HF2D3D9B85C5E4F4A9A943677E13E8088"><enum>(AA)</enum><text>remained in the United States;</text></subitem><subitem id="HA5971262B78440BFA93FD5A2884B21A6" commented="no"><enum>(BB)</enum><text>was removed, deported, or permitted to depart voluntarily from the United States;</text></subitem><subitem id="H15DE8A84BCD2448F80210B17572B6BF7" commented="no"><enum>(CC)</enum><text>resides outside of the United States; or</text></subitem><subitem id="H2566A2A14FF8499581FCC654D2112F94" commented="no"><enum>(DD)</enum><text>unlawfully reentered the United States after being issued an order of removal under section 235 or 240 of the Immigration and Nationality Act;</text></subitem></item><item id="H0F33966AB2B743478C986CD83057D99D"><enum>(bb)</enum><text>was physically present in the United States for a continuous presence of not less than 10 years immediately preceding the date of the alien’s order of removal; and</text></item><item id="H2F7FD550286044F68C2A60A808EF48F1"><enum>(cc)</enum><text>is a covered person.</text></item></subclause></clause><clause id="HB2F828F664F644BC8799AA5B6BCE8504"><enum>(ii)</enum><header>Definition</header><text>For purposes of this subparagraph, a covered person is an alien who is—</text><subclause id="HF02BC49C611F4515B657702CEF364FFF"><enum>(I)</enum><text>the parent of a child who—</text><item id="H079EB33BCF204C2D80D195881965328A"><enum>(aa)</enum><text display-inline="yes-display-inline">is a citizen or national of the United States; or</text></item><item id="H012D3498223F4D88B27B3126FA8F1976"><enum>(bb)</enum><text display-inline="yes-display-inline">initially entered the United States before the age of 16 and has been continuously and physically present in the United States since their last entry; or</text></item></subclause><subclause id="HBE9E853F17FB4F69ADF8077DA22481AF"><enum>(II)</enum><text>the spouse of a person who—</text><item id="H88F40B2AC29B4B76AC628D273CA4584B"><enum>(aa)</enum><text display-inline="yes-display-inline">is a citizen or lawful permanent resident of the United States; or</text></item><item id="H682348D03FD34A8F8FFDDF66E9302081"><enum>(bb)</enum><text display-inline="yes-display-inline">initially entered the United States before the age of 16 and has been continuously and physically present in the United States since their last entry.</text></item></subclause></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="H0C8BE4B9FA134A6D8C44360A4C0DA3B9"><enum>3.</enum><header>Requirements for temporary resident status for certain long-term resident parents</header><text display-inline="no-display-inline">Section 214 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1184">8 U.S.C. 1184</external-xref>) is amended by adding the following subsection:</text><quoted-block style="OLC" id="H89094B12F3CC4B2B97D04FA915D46721" display-inline="no-display-inline"><subsection id="H58096CA9858C42EAA2F5B9DAB83CC86F"><enum>(s)</enum><header>Requirements applicable to section 101(<enum-in-header>a</enum-in-header>)(15)(<enum-in-header>W</enum-in-header>) visas or nonimmigrant status</header><paragraph id="H11724712A16945CFAA92513CC63566F9"><enum>(1)</enum><header>In general</header><text>In the case of a nonimmigrant described in section 101(a)(15)(W), the alien—</text><subparagraph id="H30E1282202474739BAC632A13F6F3B03"><enum>(A)</enum><text>is not inadmissible under section 212(a)(1), (a)(6)(E), (a)(8), or (a)(10) of the Immigration and Nationality Act;</text></subparagraph><subparagraph id="HE6467FC3DCFF4293A869792393FEC69F"><enum>(B)</enum><text>is not inadmissible under section 212(a)(2), unless eligible for a waiver pursuant to subsection (6) of this section; and</text></subparagraph><subparagraph id="H1DFF938CF5BC4D21A00C0DF91FDF2C0F"><enum>(C)</enum><text>has not ordered, incited assisted or otherwise participated in the persecution of any person on account of race, religion, nationality, membership in a particular social group, or political opinion.</text></subparagraph></paragraph><paragraph id="H340CDB81367D4E6DBE37F9412A91A7CF"><enum>(2)</enum><header>Credible evidence considered</header><text>In acting on any petition filed under this subsection, the consular officer, Secretary of Homeland Security, or the Attorney General, as appropriate, shall consider any credible evidence relevant to the petition.</text></paragraph><paragraph id="HDC0897896F7844DE89FDF0353A57F060"><enum>(3)</enum><header>Work authorization</header><text>In the case of a nonimmigrant described in section 101(a)(15)(W), the Secretary of Homeland Security shall authorize the alien to engage in employment in the United States during the period of authorized admission and shall provide the alien with an <quote>employment authorized</quote> endorsement or other appropriate document signifying authorization of employment. Work authorization provided under this paragraph shall be effective throughout the period the alien is in temporary resident status.</text></paragraph><paragraph id="H4E4677CF3A024CDCA4BAAF591A3CB3C3"><enum>(4)</enum><header>No numerical limitations</header><text>The number of aliens who may be issued visas or otherwise provided status as nonimmigrants under section 101(a)(15)(W) shall have no numerical limitations.</text></paragraph><paragraph id="HE49C021383AF4E3280EBFE680B0C38B5"><enum>(5)</enum><header>Duration of Status</header><text>The authorized period of status of an alien as a nonimmigrant under section 101(a)(15)(W) shall be valid for a period of 3 years, but the Secretary of Homeland Security shall extend or renew such period, with no limit on the number of such renewals, if—</text><subparagraph id="H8BE366E75E6B47A7B687552033FD5698"><enum>(A)</enum><text>the alien files a nonfrivolous application for renewal before the date of expiration of authorized stay determined by the Secretary; and</text></subparagraph><subparagraph id="H10DCE6897760406FBA7B6E4827E56192"><enum>(B)</enum><text>the Secretary determines that the alien continues to meet the conditions as defined by section 101(a)(15)(W) and subject to the requirements provided under this subsection.</text></subparagraph><continuation-text continuation-text-level="paragraph">Further, in the case of an alien who files a nonfrivolous application for renewal before the date of expiration of the period of authorized stay by the Secretary, the alien’s period of temporary resident status and work authorization shall be deemed automatically extended during the pendency of the application. </continuation-text></paragraph><paragraph id="H041E090FB0404B96A5A6DDEA9B78CEFE"><enum>(6)</enum><header>Waivers for Certain Misdemeanors</header><text>Include the same or similar language in section 240A(f)(3)(C), and explain that certain crimes related to section 212(a)(2) are also to be expressly excluded (and the applicant remains eligible for relief under this section) if described in section 240A(f)(D)(i)(ii)(I) (i.e. except simple possession of cannabis/paraphernalia, etc.) and include the language in treatment of certain crimes.</text></paragraph><paragraph id="HF9E9549A08704CE3A99AC0F8713F2323"><enum>(7)</enum><header>Nonexclusive relief</header><text>Nothing in this subsection limits the ability of aliens who qualify for status under section 101(a)(15)(W) to seek any other immigration benefit or status for which the alien may be eligible.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="H05BC6F3C93924D8A9C309064840459F3"><enum>4.</enum><header>Cancellation of removal and temporary resident status for certain long-term resident parents</header><text display-inline="no-display-inline">Section 240A of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1229b">8 U.S.C. 1229b</external-xref>) is amended by adding at the end the following:</text><quoted-block id="HDE0B1849A02F41F59973A929169BB900" style="OLC"><subsection id="H533757EC393142B69EADFF758697E599"><enum>(f)</enum><header>Cancellation of removal and temporary resident status for certain long-Term resident parents</header><paragraph id="H50D9BC5502CE4663BF1D1D82A6A7497A"><enum>(1)</enum><header>In general</header><text>Notwithstanding any other provision of law, the Secretary of Homeland Security or the Attorney General shall cancel the removal of, and adjust to the status of an alien having lawful temporary residence, an alien who is inadmissible or deportable from the United States if—</text><subparagraph id="HE2ECC07BE9914BEE96F5E231197EFB30"><enum>(A)</enum><text>the alien—</text><clause id="H8CB1F802F69C4BFE8BD92171F7D83D77"><enum>(i)</enum><text>has been physically present in the United States for a continuous period of not less than 10 years immediately preceding the date of the alien’s application;</text></clause><clause id="HC59C3D9B52EE4738A9EDA411C69BD3E5"><enum>(ii)</enum><text>subject to paragraph (7), was removed, deported, or permitted to depart voluntarily from the United States after having been physically present in the United States for a continuous period of not less than 10 years;</text></clause><clause id="H5B0105D1A4AD47E48F7BD8BC3DD07D77"><enum>(iii)</enum><text>has been granted deferred action pursuant to the Deferred Action for Childhood Arrivals Memorandum announced by the Secretary of Homeland Security on June 15, 2012, or would have otherwise qualified for the Deferred Action for Childhood Arrivals announced by the Secretary of Homeland Security pursuant to the November 14, 2014, Memorandum; or</text></clause><clause id="H0E420E9FBF3046E29DE55BB8B1933EA1"><enum>(iv)</enum><text>would have been eligible for a grant of deferred action pursuant to such policy, if the memorandum announcing the policy were fully in effect since the date issued;</text></clause></subparagraph><subparagraph id="H1A3DF908C48C4655814266669D2E7471"><enum>(B)</enum><text>the alien is the parent of a son or daughter who—</text><clause id="HA80B8950BDFE40BFB0491D97DBFBFB97"><enum>(i)</enum><text>is a citizen or national of the United States; or</text></clause><clause id="HA38B5B2F0C904F21B3358707B6C72283"><enum>(ii)</enum><text>initially entered the United States while under 16 years of age and has been continuously physically present in the United States since such entry; and</text></clause></subparagraph><subparagraph id="H541CE280C3554D75BD2C7AF929B19A24"><enum>(C)</enum><text>the alien—</text><clause id="HA781F457F2684F23AEB3932C0AE08BA6"><enum>(i)</enum><text>is not inadmissible under paragraph (1), (6)(E), (6)(G), (8), or (10) of section 212(a);</text></clause><clause id="H119798CF39E9418FA1F05EFFEAFF9707"><enum>(ii)</enum><text>has not ordered, incited, assisted, or otherwise participated in the persecution of any person on account of race, religion, nationality, membership in a particular social group, or political opinion; and</text></clause><clause id="H7A27C7E7EEB7458FAD3F8B05608F68EF"><enum>(iii)</enum><text>is not barred from adjustment of status under this subsection based on the criminal and national security grounds described under paragraph (3), subject to the provisions of such paragraph.</text></clause></subparagraph></paragraph><paragraph id="H677D053DE6254CDA8A08F4CA9D3507D2"><enum>(2)</enum><header>Determination of continuous presence</header><subparagraph id="HA59068D4A4C840EB85EFD6FACD275EA1"><enum>(A)</enum><header>Effect of notice to appear</header><text>Any period of continuous physical presence in the United States of an alien who applies for temporary resident status under this subsection shall not terminate when the alien is served a notice to appear under section 239(a).</text></subparagraph><subparagraph id="HBB62805C39034D73A90FA0B0B423E1AC"><enum>(B)</enum><header>Treatment of certain breaks in presence or residence</header><clause id="HD6CC84E5A1F04B4794DC1F5E3B18B590"><enum>(i)</enum><header>In general</header><text>Except as provided in clauses (ii) and (iii), an alien shall be considered to have failed to maintain continuous physical presence in the United States under this subsection if the alien has departed from the United States for any period exceeding 90 days or for any periods, in the aggregate, exceeding 180 days.</text></clause><clause id="HA9F9315805744B89A0679ED3348BC03A"><enum>(ii)</enum><header>Extensions for extenuating circumstances</header><text>The Secretary may extend the time period described in clause (i) for an alien who demonstrates that the failure to timely return to the United States was due to extenuating circumstances beyond the alien’s control, including the serious illness of the alien, or death or serious illness of a parent, grandparent, sibling, or child of the alien.</text></clause><clause id="H2EFB5EDD9A29480791090A123EC59B37"><enum>(iii)</enum><header>Travel authorized by the secretary</header><text>Any period of travel outside of the United States by an alien that was authorized by the Secretary of Homeland Secretary may not be counted toward any period of departure from the United States under clause (i).</text></clause></subparagraph></paragraph><paragraph id="H749143528BFA4AB89B8A9D0D9F932056"><enum>(3)</enum><header>Criminal and national security bars</header><subparagraph id="H69F7471CC50F4A99AB0ADA06E86E0D03"><enum>(A)</enum><header>Grounds of ineligibility</header><text>Except as provided in subparagraphs (B) and (C), an alien is ineligible for cancellation of removal and adjustment of status under this subsection if any of the following apply:</text><clause id="HC32A16366A5444A78D6A8E54AA7A381B"><enum>(i)</enum><text>The alien is inadmissible under paragraph (2) or (3) of section 212(a) of the Immigration and Nationality Act.</text></clause><clause id="H3DD810F07AA74C45BA1E6B4147F0EC55"><enum>(ii)</enum><text>Excluding any offense under State law for which an essential element is the alien’s immigration status, and any minor traffic offense, the alien has been convicted of—</text><subclause id="HD56D89A5C2D04314828E14B1E049080F"><enum>(I)</enum><text>any felony offense;</text></subclause><subclause id="H9E31EF83767B442D982F571105FA4D44"><enum>(II)</enum><text>three or more misdemeanor offenses (excluding simple possession of cannabis or cannabis-related paraphernalia, any offense involving cannabis or cannabis-related paraphernalia which is no longer prosecutable in the State in which the conviction was entered, and any offense involving civil disobedience without violence) not occurring on the same date, and not arising out of the same act, omission, or scheme of misconduct; or</text></subclause><subclause id="H26CD628AC6F945C0914400337029811D"><enum>(III)</enum><text>a misdemeanor offense of domestic violence, unless the alien demonstrates that such crime is related to the alien having been—</text><item id="HF6A8A02F5AA94628AB98774FC479C04A"><enum>(aa)</enum><text>a victim of domestic violence, sexual assault, stalking, child abuse or neglect, abuse or neglect in later life, or human trafficking;</text></item><item id="H969EAA26ABEA49CDA07E69476B7A8FEB"><enum>(bb)</enum><text>battered or subjected to extreme cruelty; or</text></item><item id="H3022D2A3FE3C44579CBB01A424B0250A"><enum>(cc)</enum><text>a victim of criminal activity described in section 101(a)(15)(U)(iii).</text></item></subclause></clause></subparagraph><subparagraph id="H7618D5EFBB1D4D5CAB76A39B9E4F0353"><enum>(B)</enum><header>Treatment of certain offenses</header><clause id="H11546F8584054BA0B08F89232FCD8943"><enum>(i)</enum><header>In general</header><text>Notwithstanding section 101(h), a crime described in clause (ii) shall only be considered for purposes of this subsection if—</text><subclause id="H655CC7FFA352428FA423C829F2B640F2"><enum>(I)</enum><text display-inline="yes-display-inline">such crime involves personal injury or death to another; or</text></subclause><subclause id="HEBA84354049947A09532B7865099E043"><enum>(II)</enum><text display-inline="yes-display-inline">the alien has been convicted of such a crime more than once during the 10 years immediately preceding the date of the alien’s application.</text></subclause></clause><clause id="HAE021769A0C24A01B698BD8953B5EEAC"><enum>(ii)</enum><header>Crime described</header><text>A crime described in this clause is—</text><subclause id="H1FD447DC6E0744329BB16DF8973FAB9D"><enum>(I)</enum><text display-inline="yes-display-inline">a crime of reckless driving or of driving while intoxicated or under the influence of alcohol or of controlled substances; or</text></subclause><subclause id="H07058BEE3F1E419BBF915B10B1ABFF86" commented="no"><enum>(II)</enum><text>a crime involving controlled substances.</text></subclause></clause></subparagraph><subparagraph id="H2EE86CB0B4864395BABA9C3B877DFC0C"><enum>(C)</enum><header>Waivers for certain misdemeanors</header><text>For humanitarian purposes, family unity, or if otherwise in the public interest, the Secretary may—</text><clause id="H05C3644546244737AF3BEB02C9C72982"><enum>(i)</enum><text>waive the grounds of inadmissibility under subparagraphs (A), (C), and (D) of section 212(a)(2), unless the conviction forming the basis for inadmissibility would otherwise render the alien ineligible under subparagraph (A)(ii) (subject to clause (ii)); and</text></clause><clause id="H5E40361393B648D79F9544D26B872454"><enum>(ii)</enum><text>for purposes of subclauses (II) and (III) of subparagraph (A)(ii), waive consideration of—</text><subclause id="H1D3F633C99D64C49B5F4696E0AA0ABE7"><enum>(I)</enum><text>one misdemeanor offense if the alien has not been convicted of any offense in the 5-year period preceding the date on which the alien applies for adjustment of status under this subsection; or</text></subclause><subclause id="HB566693D7C884AB4B9331E5B205E313F"><enum>(II)</enum><text>up to two misdemeanor offenses if the alien has not been convicted of any offense in the 10-year period preceding the date on which the alien applies for adjustment of status under this subsection.</text></subclause></clause></subparagraph><subparagraph id="H6828FF310D9448F09AC4527EBAF15CF6"><enum>(D)</enum><header>Authority to conduct secondary review</header><clause id="H36940409B96848EBBFAF7488E633A8C0"><enum>(i)</enum><header>In general</header><text>Notwithstanding an alien’s eligibility for adjustment of status under this subsection, and subject to the procedures described in this subparagraph, the Secretary of Homeland Security or the Attorney General may, as a matter of non-delegable discretion, provisionally deny an application for adjustment of status if the Secretary or the Attorney General, based on clear and convincing evidence, which shall include credible law enforcement information, determines that the alien is described in clause (ii) or (iv).</text></clause><clause id="HCD1A9C7DDAD843AB81FC26BAE5368431"><enum>(ii)</enum><header>Public safety</header><text>An alien is described in this clause if—</text><subclause id="HF8CE0DA3377541D2A26CCFA106DBCCB2"><enum>(I)</enum><text>excluding simple possession of cannabis or cannabis-related paraphernalia, any offense involving cannabis or cannabis-related paraphernalia which is no longer prosecutable in the State in which the conviction was entered, any offense under State law for which an essential element is the alien’s immigration status, any offense involving civil disobedience without violence, and any minor traffic offense, the alien—</text><item id="HA2D3881CDCCC41949AFA9003A2041C1A"><enum>(aa)</enum><text>has been convicted of a misdemeanor offense punishable by a term of imprisonment of more than 30 days; or</text></item><item id="H9FF8E40114B74BB9A73C883E4A0D2E59"><enum>(bb)</enum><text>has been adjudicated delinquent in a State or local juvenile court proceeding that resulted in a disposition ordering placement in a secure facility; and</text></item></subclause><subclause id="HDB367BB268644FC99A9F3FB7A9D4ED0F"><enum>(II)</enum><text>the alien poses a significant and continuing threat to public safety related to such conviction or adjudication.</text></subclause></clause><clause id="H03897930FD7B4FD09DEB00F7E5E7D562"><enum>(iii)</enum><header>Public safety determination</header><text>For purposes of clause (ii)(II), the Secretary shall consider the recency of the conviction or adjudication; the length of any imposed sentence or placement; the nature and seriousness of the conviction or adjudication, including whether the elements of the offense include the unlawful possession or use of a deadly weapon to commit an offense or other conduct intended to cause serious bodily injury; and any mitigating factors pertaining to the alien’s role in the commission of the offense.</text></clause><clause id="HBCAC2B6434DF49BFA53477E97D8D9AA0"><enum>(iv)</enum><header>Gang participation</header><text>An alien is described in this clause if the alien has, within the 5 years immediately preceding the date of the application, knowingly, willfully, and voluntarily participated in offenses committed by a criminal street gang (as described in subsections (a) and (c) of section 521 of title 18, United States Code) with the intent to promote or further the commission of such offenses.</text></clause><clause id="HD51BB4E0B7694C099E019FDC2588FC42"><enum>(v)</enum><header>Evidentiary limitation</header><text>For purposes of clause (iv), allegations of gang membership obtained from a State or Federal in-house or local database, or a network of databases used for the purpose of recording and sharing activities of alleged gang members across law enforcement agencies, shall not establish the participation described in such clause.</text></clause><clause id="H9BC493892F934A7F80BA86DA3DB3FCB0"><enum>(vi)</enum><header>Notice</header><subclause id="H7E491012F0C54F47B0870EEA1C22310A"><enum>(I)</enum><header>In general</header><text>Prior to rendering a discretionary decision under this subparagraph, the Secretary of Homeland Security or the Attorney General shall provide written notice of the intent to provisionally deny the application to the alien (or the alien’s counsel of record, if any) by certified mail and, if an electronic mail address is provided, by electronic mail (or other form of electronic communication). Such notice shall—</text><item id="H20F6568D5D4E495B83AEA221319089AA"><enum>(aa)</enum><text>articulate with specificity all grounds for the preliminary determination, including the evidence relied upon to support the determination; and</text></item><item id="H4E17966F6FAD4353896D142C71A3CBEB"><enum>(bb)</enum><text>provide the alien with not less than 90 days to respond.</text></item></subclause><subclause id="HE3AB5D6A7CED41DE99C0DB80518B0C72"><enum>(II)</enum><header>Second notice</header><text>Not more than 30 days after the issuance of the notice under subclause (I), the Secretary of Homeland Security or the Attorney General shall provide a second written notice that meets the requirements of such clause.</text></subclause><subclause id="H43F37E59861C4F5E804657A79724E38D"><enum>(III)</enum><header>Notice not received</header><text>Notwithstanding any other provision of law, if an applicant provides good cause for not contesting a provisional denial under this paragraph, including a failure to receive notice as required under this subparagraph, the Secretary of Homeland Security or the Attorney General shall, upon a motion filed by the alien, reopen an application for adjustment of status under this subsection and allow the applicant an opportunity to respond, consistent with subclause (I)(bb).</text></subclause></clause></subparagraph><subparagraph id="H3D8937439D184DCBB870A8324105F34E"><enum>(E)</enum><header>Definitions</header><text>For purposes of this paragraph—</text><clause id="H3CB9A0425A2B450E8ED0A74BC8F4726A"><enum>(i)</enum><text>the term <term>felony offense</term> means an offense under Federal or State law that is punishable by a maximum term of imprisonment of more than 1 year;</text></clause><clause id="HB17F7BE58BD84271B517CBC856D75CB0"><enum>(ii)</enum><text>the term <term>misdemeanor offense</term> means an offense under Federal or State law that is punishable by a term of imprisonment of more than 5 days but not more than 1 year;</text></clause><clause id="HA33EADE26FE44402A9436766556A2E4E"><enum>(iii)</enum><text>the term <term>crime of domestic violence</term> means any offense that has as an element the use, attempted use, or threatened use of physical force against a person committed by a current or former spouse of the person, by an individual with whom the person shares a child in common, by an individual who is cohabiting with or has cohabited with the person as a spouse, by an individual similarly situated to a spouse of the person under the domestic or family violence laws of the jurisdiction where the offense occurs, or by any other individual against a person who is protected from that individual’s acts under the domestic or family violence laws of the United States or any State, Indian tribal government, or unit of local government; and</text></clause><clause id="H05AC94FE961D48B29D2A8FF8D56E26F0"><enum>(iv)</enum><text>the terms <term>convicted</term>, <term>conviction</term>, <term>adjudicated</term>, and <term>adjudication</term> do not include a judgment that has been expunged or set aside, that resulted in a rehabilitative disposition, or the equivalent.</text></clause></subparagraph></paragraph><paragraph id="HE4D6C2A153D945D981C99959E59F615B"><enum>(4)</enum><header>Work authorization</header><text>In the case of an alien who has temporary resident status under this subsection, the Secretary of Homeland Security shall authorize the alien to engage in employment in the United States and provide the alien with an <quote>employment authorized</quote> endorsement or other appropriate work permit. Work authorization provided under this paragraph shall be effective throughout the period the alien is in temporary resident status under this subsection.</text></paragraph><paragraph id="H107B04AFCCFA459C8884FC332B8A19E3"><enum>(5)</enum><header>Terms of status</header><subparagraph id="HD9B973BB475B4991B6F50D55CF08E4F8"><enum>(A)</enum><header>In general</header><text>Temporary resident status under this subsection shall be valid for a period of 3 years, unless such period is extended or renewed.</text></subparagraph><subparagraph id="H2E993A4FE4DB41EFA310EEF85B47C61B"><enum>(B)</enum><header>Renewal</header><text>In the case of an alien who has temporary resident status under this subsection, the Secretary of Homeland Security shall renew the status in 3-year increments, with no limit on the number of such renewals, if—</text><clause id="HFDA4CEA3A8354FDE8CC92B494CF93FE6"><enum>(i)</enum><text>the alien files a nonfrivolous application for renewal before the date of expiration of the period of stay authorized by the Secretary; and</text></clause><clause id="H9CFF876F91DB4593A4CDE6729E8346C8"><enum>(ii)</enum><text>the Secretary determines that the alien continues to meet the conditions for adjustment of status under this subsection.</text></clause></subparagraph><subparagraph id="HED929E4CA1E84EE187A7BDBBB25F1817"><enum>(C)</enum><header>Automatic extension during pendency of application</header><text>In the case of an alien who files a nonfrivolous application for renewal before the date of expiration of the period of stay authorized by the Secretary, the alien’s period of temporary resident status and work authorization shall be deemed extended during the pendency of the application.</text></subparagraph></paragraph><paragraph id="H4AAE0316802F4813BF017B71A18C12E8"><enum>(6)</enum><header>Documents establishing continuous physical presence</header><text>To establish that an alien has been continuously physically present in the United States, as required under paragraph (1), the alien may submit the following forms of evidence:</text><subparagraph id="HD0091C0C0F744001B94E97F464131532"><enum>(A)</enum><text>Passport entries, including admission stamps on the alien’s passport.</text></subparagraph><subparagraph id="HFA41C24C90394A2186B72512CC10451A"><enum>(B)</enum><text>Any document from the Department of Justice or the Department of Homeland Security noting the alien’s date of entry into the United States.</text></subparagraph><subparagraph id="H6FEB225EB1EA48B0B6E9D51EE445F6E4"><enum>(C)</enum><text>Records from any educational institution the alien has attended in the United States.</text></subparagraph><subparagraph id="H61DE2A6000B34281B5945824A755EECB"><enum>(D)</enum><text>Employment records of the alien that include the employer’s name and contact information, or other records demonstrating earned income.</text></subparagraph><subparagraph id="H58D0F1F589024FCD8B5606E80FCC2EED"><enum>(E)</enum><text>Records of service from the Uniformed Services.</text></subparagraph><subparagraph id="H81F4C084B493479DA9AA6CE142F52461"><enum>(F)</enum><text>Official records from a religious entity confirming the alien’s participation in a religious ceremony.</text></subparagraph><subparagraph id="H4D9727E0434E462AA001B6BE866F63F0"><enum>(G)</enum><text>A birth certificate for a child who was born in the United States.</text></subparagraph><subparagraph id="HAD5B362A1EB34F1882AB15607564509D"><enum>(H)</enum><text>Hospital or medical records showing medical treatment or hospitalization, the name of the medical facility or physician, and the date of the treatment or hospitalization.</text></subparagraph><subparagraph id="H5BA4B64F768C4468A680E4B57930EFCF"><enum>(I)</enum><text>Automobile license receipts or registration.</text></subparagraph><subparagraph id="H97D5026D538948F69F80965092B37B1E"><enum>(J)</enum><text>Deeds, mortgages, or rental agreement contracts.</text></subparagraph><subparagraph id="HCE08FBAF1DD1435188C82490CCF10880"><enum>(K)</enum><text>Rent receipts or utility bills bearing the alien’s name or the name of an immediate family member of the alien, and the alien’s address.</text></subparagraph><subparagraph id="H1FFC5873C63C41BABD7382DB527A83EB"><enum>(L)</enum><text>Tax receipts.</text></subparagraph><subparagraph id="HA196FA1DDAFE4A33B434076BE7488E15"><enum>(M)</enum><text>Insurance policies.</text></subparagraph><subparagraph id="HE8EA090D9B3D40338F36C79E918E4A54"><enum>(N)</enum><text>Remittance records, including copies of money order receipts sent in or out of the country.</text></subparagraph><subparagraph id="HE6E94787684B41FC89F78BFF76D5E67C"><enum>(O)</enum><text>Travel records.</text></subparagraph><subparagraph id="H8BDC620D042A4497A77A49BA5BADFDFB"><enum>(P)</enum><text>Dated bank transactions.</text></subparagraph><subparagraph id="HB916EEFE24264860AF4C06065ED5D98C"><enum>(Q)</enum><text>Two or more sworn affidavits from individuals who are not related to the alien who have direct knowledge of the alien’s continuous physical presence in the United States, that contain—</text><clause id="HAA60DC374CDE4185BA6D75EB84C38751"><enum>(i)</enum><text>the name, address, and telephone number of the affiant; and</text></clause><clause id="H817E5D210BEA4D2CA118611F30761EDF"><enum>(ii)</enum><text>the nature and duration of the relationship between the affiant and the alien.</text></clause></subparagraph><subparagraph id="HC59365F49C1E45B59A91FDDB66967A87"><enum>(R)</enum><text>Any other evidence determined to be credible by the Secretary of Homeland Security or the Attorney General.</text></subparagraph></paragraph><paragraph id="H4DFE5A62AAD54299B01D4D81FC0EE08F"><enum>(7)</enum><header>Eligibility of removed, deported, or voluntarily departed aliens</header><text>An alien who was removed, deported, or permitted to depart voluntarily from the United States may apply for relief under this subsection from abroad if the reason for their removal, deportation, or voluntary departure was that the alien—</text><subparagraph id="H6CC6D80EF9244B778B6B220215FB35CC"><enum>(A)</enum><text>was present in the United States after the expiration of the period of stay authorized by the Secretary of Homeland Security or was present in the United States without being admitted or paroled; or</text></subparagraph><subparagraph id="HC4BC720DF88A46268CF41CC122E221AB"><enum>(B)</enum><text>committed an offense, if that offense does not render the alien ineligible for relief under this subsection pursuant to the provisions of paragraph (3).</text></subparagraph></paragraph><paragraph id="H5BD5B69093C44E1CAE9AD3E683540261"><enum>(8)</enum><header>Construction</header><subparagraph id="HD419B3EF629D499496D8E4853E32321D"><enum>(A)</enum><header>In general</header><text>A denial of cancellation of removal under any other provision of this section shall not prejudice a decision under this subsection. An alien’s eligibility for temporary resident status under this subsection shall not preclude the alien from seeking any status under any other provision of law for which the alien may otherwise be eligible.</text></subparagraph><subparagraph id="HF4B5B9790E6A489E86B81FB169462910"><enum>(B)</enum><header>Determination of continuous presence and residence</header><text>Subsection (d) shall not apply to cancellation of removal or adjustment of status under this subsection.</text></subparagraph><subparagraph id="H2862A262EDF245BD8301060A84BA50E7"><enum>(C)</enum><header>Annual limitation</header><text>Subsection (e) shall not apply to cancellation of removal or adjustment of status under this subsection.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
