R. 1408</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20210226">February 26, 2021</action-date><action-desc><sponsor name-id="D000610">Mr. Deutch</sponsor> (for himself, <cosponsor name-id="D000627">Mrs. Demings</cosponsor>, <cosponsor name-id="D000631">Ms. Dean</cosponsor>, <cosponsor name-id="J000032">Ms. Jackson Lee</cosponsor>, <cosponsor name-id="M001188">Ms. Meng</cosponsor>, and <cosponsor name-id="S000185">Mr. Scott of Virginia</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To incentivize States and localities to improve access to justice, and for other purposes.</official-title></form><legis-body id="H18928C99DD204DA8B47E321DF9A81466" style="OLC"><section id="H395E0F50F1FD43F8B7C802EE482231EB" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Ensuring Quality Access to Legal Defense Act of 2021</short-title></quote> or the <quote><short-title>EQUAL Defense Act of 2021</short-title></quote>.</text></section><section id="H0A8E62E158574B9E9AAE4F977AF642EE"><enum>2.</enum><header>Purpose</header><text display-inline="no-display-inline">The purpose of this Act is—</text><paragraph id="HCB649137F05F4F449528E486CA420952"><enum>(1)</enum><text display-inline="yes-display-inline">to protect the rights of defendants in criminal cases to due process and a fair trial under the Fifth, Sixth, and Fourteenth Amendments to the Constitution of the United States, including the right to counsel in State criminal trials, as articulated by the United States Supreme Court in Gideon v. Wainwright, 372 U.S. 335 (1963);</text></paragraph><paragraph id="HBE78EA971BC04C67ADBBD69F2A2F6BA2"><enum>(2)</enum><text display-inline="yes-display-inline">to collect data related to public defense in order to facilitate the development of evidence-based workload limits, and for other purposes; and</text></paragraph><paragraph id="HB85C4AC63BD540FFB4EF61D016C19332"><enum>(3)</enum><text display-inline="yes-display-inline">to ensure that public defender compensation reflects the constitutional imperative of the work and adequately incentivizes attorneys at all levels to pursue a career in public defense.</text></paragraph></section><section id="HF505E0B3F6834335B6D3FA7B1668AE78"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act, except as otherwise provided in section 6:</text><paragraph id="H48112B33767B4A9EAF7FB6A79A502461"><enum>(1)</enum><header>Applicable court</header><text>The term <term>applicable court</term>, with respect to an eligible entity that is—</text><subparagraph id="H16CF985C4D6542E08031A76E234D098E"><enum>(A)</enum><text>a State or unit of local government, means—</text><clause id="HB32197C93D0A4A459E3344BF62E7BB6D"><enum>(i)</enum><text>a court of the eligible entity; and</text></clause><clause id="H177F5799957F4C50A6292CAFD46234D9"><enum>(ii)</enum><text>a court of a unit of local government within the eligible entity; and</text></clause></subparagraph><subparagraph id="H0AB002C8207846168CDE3B382DCF8BDE"><enum>(B)</enum><text>a Tribal organization, means a court of the Indian Tribe.</text></subparagraph></paragraph><paragraph id="H977CAD91AF1041CC9F3FFA02DFE8188A"><enum>(2)</enum><header>Applicable public defender's office</header><text>The term <term>applicable public defender's office</term>, with respect to an eligible entity that is—</text><subparagraph id="HC4FD426CAE924972A2BE7EECCAE1E2FA"><enum>(A)</enum><text>a public defender's office, means the eligible entity;</text></subparagraph><subparagraph id="H3113787BEBC14405BE3F8A418A27F6C2"><enum>(B)</enum><text>a State or unit of local government, means—</text><clause id="H7977084D2719429ABC53B0FAD177694C"><enum>(i)</enum><text>the public defender's office of the eligible entity; and</text></clause><clause id="HC0955535603B405BA7E1915270C3809E"><enum>(ii)</enum><text>a public defender's office of a unit of local government within the eligible entity; and</text></clause></subparagraph><subparagraph id="H888D94670460463FBC4E7C306AB6FD63"><enum>(C)</enum><text>a Tribal organization, means the public defender's office of the Tribal organization.</text></subparagraph></paragraph><paragraph id="H2950063CE318483DBF62E3876E48A60E"><enum>(3)</enum><header>Basis of compensation</header><text>The term <term>basis of compensation</term> means the classification of the compensation of an employee into one of the following categories:</text><subparagraph id="H0F4C1B84DAB94D7FAFFDDB2BD9C7910D"><enum>(A)</enum><text>Hourly.</text></subparagraph><subparagraph id="H2BFFA68643CE45019DF79C28394752D8"><enum>(B)</enum><text>Flat rate.</text></subparagraph><subparagraph id="H6ECEB91BFF4F48F190D7C83F5EC6D46C"><enum>(C)</enum><text>Per case.</text></subparagraph><subparagraph id="HE8C38FEE536141898B7F00F6132C0A54"><enum>(D)</enum><text>Salary.</text></subparagraph></paragraph><paragraph id="HB7C8F00B1D584C87AC37334A61E4A083"><enum>(4)</enum><header>Case</header><subparagraph id="H073C567D68D8459C8676B09D36ED00D1"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The term <term>case</term> includes all charges involved in a single incident of alleged criminal or delinquent conduct.</text></subparagraph><subparagraph id="H78CFB201B9C2496EB36E6F7266B19F15"><enum>(B)</enum><header>Multiple defendants</header><text display-inline="yes-display-inline">If a charging document states that multiple defendants were involved in a single incident of alleged criminal or delinquent conduct, each defendant shall be counted as a separate case.</text></subparagraph></paragraph><paragraph id="H57CB979E85364C8BBE74AE6CABE97EE3"><enum>(5)</enum><header>Case type</header><subparagraph id="HDE784DF92C7F4CCAAF56A5DE1D32F56A"><enum>(A)</enum><header>In general</header><text>The term <term>case type</term> means the classification of a client’s case into one of the following categories, as defined under State law:</text><clause id="H1A79F358B64D428896CA2E2FD60C769D"><enum>(i)</enum><text>Juvenile.</text></clause><clause id="H468D619A7240423EA188C4AE83855D5D"><enum>(ii)</enum><text>Misdemeanor.</text></clause><clause id="HC2A3C65EB0854CCAA3D12A78F12F47E2"><enum>(iii)</enum><text>Felony.</text></clause><clause id="H98518EAC0C03477DAA6C6639C541C350"><enum>(iv)</enum><text>Life without parole.</text></clause><clause id="H2220AE4FC7DC46F493808C9A26A32AEE"><enum>(v)</enum><text>Capital or death penalty.</text></clause></subparagraph><subparagraph id="H812B543CB61A4857A142B242F8670FB5"><enum>(B)</enum><header>Multiple charges</header><text>If a case involves multiple charges, the case type shall be determined according to the dominant charge.</text></subparagraph></paragraph><paragraph id="HEA346268F07E43DABBE247A4E28ED427"><enum>(6)</enum><header>Chief prosecutor</header><text display-inline="yes-display-inline">The term <term>chief prosecutor</term>, with respect to—</text><subparagraph id="H7B766694AEF04D258A1FECD5EE786926"><enum>(A)</enum><text display-inline="yes-display-inline">a State, means the attorney general of the State;</text></subparagraph><subparagraph id="H7675FEF5ADE04B1293E28B5728B89785"><enum>(B)</enum><text display-inline="yes-display-inline">a unit of local government, means the district attorney of the unit of local government; and</text></subparagraph><subparagraph id="H34995672EAE3404B8BA086E90D64DBCB"><enum>(C)</enum><text>a Tribal organization, means the lead prosecutor of the Tribal organization.</text></subparagraph></paragraph><paragraph id="H568133302CB54F3881EBA53C0CD7BE9A"><enum>(7)</enum><header>Chief public defender</header><text>The term <term>chief public defender</term>, with respect to a State, unit of local government, or Tribal organization, means the head of the public defender's office of the State, unit of local government, or Tribal organization, respectively.</text></paragraph><paragraph id="H903953CCE9B74C4EBD2D034B12429908"><enum>(8)</enum><header>Corresponding prosecutor's office</header><text>The term <term>corresponding prosecutor's office</term>, with respect to a public defender's office, means the prosecutorial unit that appears adverse to the public defender's office in criminal proceedings.</text></paragraph><paragraph id="H68744771F0BC4E38BD0E49B601252DC0"><enum>(9)</enum><header>Covered grant</header><text>The term <term>covered grant</term> means a grant awarded under section 4.</text></paragraph><paragraph id="HB18D96E6F5244E7A834BD95846AA4B34"><enum>(10)</enum><header>Dominant charge</header><text>The term <term>dominant charge</term>, with respect to a case that involves multiple charges, means the charge that carries the most severe or lengthy maximum penalty.</text></paragraph><paragraph id="HAF991B17EB394ED6A5F4C2495FAEBD0A"><enum>(11)</enum><header>Eligible entity</header><text display-inline="yes-display-inline">The term <term>eligible entity</term> means a State, unit of local government, Tribal organization, or public defender's office that, as of the date of enactment of this Act and without regard to the deadlines under section 4(b)—</text><subparagraph id="HC7A0DD4895B14DA6A0E011E92602F7CC"><enum>(A)</enum><text display-inline="yes-display-inline">has not developed and implemented a data collection process that meets the requirements under paragraph (1) of that section;</text></subparagraph><subparagraph id="H935626C63E2B4E5D84CE1A02F463B7E7"><enum>(B)</enum><text display-inline="yes-display-inline">has not developed workload limits that meet the requirements under paragraph (2) of that section, or has developed such limits but is not in compliance with the limits; or</text></subparagraph><subparagraph id="HAFE9725228034A5487433CB119F7110E"><enum>(C)</enum><text>does not meet the compensation requirements under paragraph (3) of that section.</text></subparagraph></paragraph><paragraph id="H392A029BD2024366BBCC275EFDA17ABD"><enum>(12)</enum><header>Full-time</header><text>The term <term>full-time</term>, with respect to an employee of a prosecutor's office or public defender's office, means an employee who works not less than 40 hours per week for that office.</text></paragraph><paragraph id="H7110F5259ACD408EAE710D95447CAA38"><enum>(13)</enum><header>Peripheral charge</header><text>The term <term>peripheral charge</term>, with respect to a case that involves multiple charges, means any charge that is not the dominant charge.</text></paragraph><paragraph id="H1630D31477ED46BE9A7396D88C03459D"><enum>(14)</enum><header>Prosecutor</header><text display-inline="yes-display-inline">The term <term>prosecutor</term>—</text><subparagraph id="HDE3A0AE5031140B7924E8C6E673BD51A"><enum>(A)</enum><text display-inline="yes-display-inline">has the meaning given the term in section 3001(b) of title I of the Omnibus Crime Control and Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/34/10671">34 U.S.C. 10671(b)</external-xref>); and</text></subparagraph><subparagraph id="H8402D2547DDF47CE8DB43A5E018737B0"><enum>(B)</enum><text>includes a full-time employee of a Tribal organization who—</text><clause id="H79246BA6E2C7455D941A90796D3718AF"><enum>(i)</enum><text>is continually licensed to practice law; and</text></clause><clause id="H32E867EAE53C42ADB4B6D5B8B409FF84"><enum>(ii)</enum><text>carries out activities equivalent to those of a prosecutor referred to in subparagraph (A).</text></clause></subparagraph></paragraph><paragraph id="HBD727CC77B934EAEB7194BD16A6B34D6"><enum>(15)</enum><header>Prosecutor's office; public defender's office</header><text>The terms <term>prosecutor's office</term> and <term>public defender's office</term> mean an agency or office of a State, unit of local government, or Tribal organization that employs prosecutors or public defenders, respectively.</text></paragraph><paragraph id="HF26C3E36D06E4B7398BF13F350E65732"><enum>(16)</enum><header>Public defender</header><text>The term <term>public defender</term>—</text><subparagraph id="HC01143F00C0D4098988425EB96EA8F3B"><enum>(A)</enum><text display-inline="yes-display-inline">has the meaning given the term in section 3001(b) of title I of the Omnibus Crime Control and Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/34/10671">34 U.S.C. 10671(b)</external-xref>); and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HE0335A230AF7427F87C9A3F4F9D3DE36"><enum>(B)</enum><text>includes an attorney employed by a Tribal organization who—</text><clause commented="no" display-inline="no-display-inline" id="H91F8FADD81FE49ECBFE06562151ABA7E"><enum>(i)</enum><text>is continually licensed to practice law; and</text></clause><clause commented="no" display-inline="no-display-inline" id="H8D7FE0351961420FAD2F02C6891FCB03"><enum>(ii)</enum><text>carries out activities equivalent to those of a public defender referred to in subparagraph (A).</text></clause></subparagraph></paragraph><paragraph id="H389774289FA04950A9ED9D4C7B71ED99"><enum>(17)</enum><header>Staff attorney</header><text>The term <term>staff attorney</term>, with respect to a prosecutor's office or public defender's office, means a prosecutor or public defender who is not the chief prosecutor or chief public defender, respectively.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H689B025C2BB542FABB6195F806CF2F5C"><enum>(18)</enum><header>State</header><text>The term <term>State</term> has the meaning given the term in section 901 of title I of the Omnibus Crime Control and Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/34/10251">34 U.S.C. 10251</external-xref>).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H8A01EA3DCD0E47DB9566623E92240E84"><enum>(19)</enum><header>Tribal organization</header><text>The term <term>Tribal organization</term> has the meaning given the term <term>tribal organization</term> in section 4(l) of the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/5304">25 U.S.C. 5304(l)</external-xref>).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H2E1CA7D7D77C4BDC92131406BE1D8E44"><enum>(20)</enum><header>Unit of local government</header><text>The term <term>unit of local government</term> has the meaning given the term in section 901 of title I of the Omnibus Crime Control and Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/34/10251">34 U.S.C. 10251</external-xref>).</text></paragraph></section><section id="H9F722C712F5545FCBA21F1C52B8E34FE"><enum>4.</enum><header>Public defense grant program</header><subsection id="H8B76E0D0881E40A1B1C09506F6BB6891"><enum>(a)</enum><header>Grant authority</header><paragraph id="H3D1F686FB1A642A79F58E66F84E903E9"><enum>(1)</enum><header>In general</header><subparagraph id="HC5043397C1274F26A270C1A6C4CABD6B"><enum>(A)</enum><header>Initial grants</header><text>During the first 5 fiscal years beginning after the date of enactment of this Act, the Attorney General shall award a grant, to be used for public defense, to any eligible entity that commits to satisfying the requirements under subsection (b) and section 5.</text></subparagraph><subparagraph id="H0CF3370F1E4F4F188BA85A47FB8FB931"><enum>(B)</enum><header>Continuing grants</header><text>During the sixth fiscal year beginning after the date of enactment of this Act, and each fiscal year thereafter, the Attorney General shall award a grant to any eligible entity that—</text><clause id="H20D160CD94EC43E08CFF95CBDB1DA263"><enum>(i)</enum><text>commits to satisfying the requirements under section 5;</text></clause><clause id="H2F20CE82E90F41CE8CF706F9BB9B3838"><enum>(ii)</enum><text>certifies that the eligible entity is in compliance with—</text><subclause id="H8C2A002A8A644513A68A6F8DECCC4A17"><enum>(I)</enum><text>the workload limits developed by the eligible entity under subsection (b)(2) of this section; and</text></subclause><subclause id="H9EA6DF38943D4C9FA20E3FF646FF63B0"><enum>(II)</enum><text>the requirements under subsection (b)(3) of this section; and</text></subclause></clause><clause id="H6190BE3AA0394E299BF2ED02E8ED226D"><enum>(iii)</enum><text>commits to using the grant funds for public defense.</text></clause></subparagraph></paragraph><paragraph id="HDAEDF1C4CAF34465A5188B27B2171F0A"><enum>(2)</enum><header>Amount</header><text>In applying for a grant under paragraph (1), an eligible entity shall request a grant amount that takes into account—</text><subparagraph id="H83CD9E1F621B4820A918B7BAD4B800F4"><enum>(A)</enum><text>any technology and training required to meet the requirements under subsection (b)(1); and</text></subparagraph><subparagraph id="H04F71E16F12B4A10AC084CC00A0CD767"><enum>(B)</enum><text>the size of the justice system—</text><clause id="HBE984A96A1F84BCABC3EEDB39AB3BF67"><enum>(i)</enum><text>that the entity administers or in which the entity participates, as applicable, relative to the size of other justice systems in—</text><subclause id="HBC0F3659A2224FE89BC0D32D0A9C5925"><enum>(I)</enum><text>the United States, if the entity is a State or a public defender's office of a State; or</text></subclause><subclause id="HE408FEB80838478D93839DA033D5FCEA"><enum>(II)</enum><text>the State in which the entity is located, if the entity is a unit of local government or a public defender's office of a unit of local government; or</text></subclause></clause><clause id="H07BBC0F2AC634D60866777648C9B50FB"><enum>(ii)</enum><text>of the Indian Tribe, if the entity is a Tribal organization or a public defender's office of a Tribal organization.</text></clause></subparagraph></paragraph></subsection><subsection id="H17449AFBC6AB48169CE5B8751D9C5095"><enum>(b)</enum><header>Requirements</header><text>The requirements for an eligible entity under this subsection are as follows:</text><paragraph id="HBB203D507B554B978BE09AE8513AADDF"><enum>(1)</enum><header>Data collection</header><subparagraph id="H3EFC334A6ADD4BB09625B5F2C2FFA0DD"><enum>(A)</enum><header>Process</header><text>During the first fiscal year for which the eligible entity receives a covered grant, the eligible entity shall develop and implement a process for collecting the following data for full-time attorneys employed by each applicable public defender's office during the fiscal year:</text><clause id="H042E41B5BE1F4F078FD9A1CAD7D742A3"><enum>(i)</enum><text>The mean and median number of hours per month worked per attorney.</text></clause><clause id="H7794E67955D246CA89E1B7A92AF2245C"><enum>(ii)</enum><text>The mean and median percentage of hours per month spent with clients per attorney, excluding court appearances.</text></clause><clause id="H00F925C061024AA2A6689D12F06D60FC"><enum>(iii)</enum><text>The mean and median percentage of hours per month spent in court proceedings per attorney.</text></clause><clause id="H3A8A1A24A22C4C5CB2750B16C6FA7F65"><enum>(iv)</enum><text>The mean and median percentage of hours spent per month by an attorney on—</text><subclause id="HD07A0501A00B4CDCAFF75D401860F287"><enum>(I)</enum><text>investigation;</text></subclause><subclause id="H18D5164FB884416981E723797F4207BD"><enum>(II)</enum><text>research;</text></subclause><subclause id="H9953B0CA8C724065A07013D908042C72"><enum>(III)</enum><text>writing; and</text></subclause><subclause id="H340391E394E64F7680218129188F5032"><enum>(IV)</enum><text>preparation.</text></subclause></clause><clause id="H82519C953EB24209A4F4053426DDAAEA"><enum>(v)</enum><text>The amount of attorney turnover, broken down by the level of experience and length of employment of the attorney.</text></clause><clause id="HC801B4917ECC41218EC00373DB807BD2"><enum>(vi)</enum><text>The number of open cases as of the last day of the fiscal year, broken down by—</text><subclause id="H60144804E2A644699C37A7A658DE2626"><enum>(I)</enum><text>case type, including by—</text><item id="HFA9EAE7294DE43ADAD49966FF455F748"><enum>(aa)</enum><text>the dominant charge; and</text></item><item id="HDD54E7F031D044B28F092BCA19D0046D"><enum>(bb)</enum><text>each peripheral charge;</text></item></subclause><subclause id="H4C9A2724E66F4672A615DFF02E22BA66"><enum>(II)</enum><text>the attorney, who shall be identified using an anonymized unique identifier;</text></subclause><subclause id="H8D1F747BE6E74DE09B8D53247997DE4E"><enum>(III)</enum><text>the date on which the attorney was appointed to the case; and</text></subclause><subclause id="HDDB46C0E04C44C33B4F3197415497219"><enum>(IV)</enum><text>the date on which the attorney first met with the client.</text></subclause></clause><clause id="H998AF6E85AD74F4E8DBB034C20848D4B"><enum>(vii)</enum><text>The number of cases closed during the fiscal year, broken down by—</text><subclause id="H8B6FEFC8D58648A4AF39A4C6FF9D3AFB"><enum>(I)</enum><text>case type, including by—</text><item id="HD8F2721D844A447F85A395E84204813D"><enum>(aa)</enum><text>the dominant charge; and</text></item><item commented="no" display-inline="no-display-inline" id="H90A908D2A04346088856241908C6D9E2"><enum>(bb)</enum><text>each peripheral charge;</text></item></subclause><subclause id="H201F82170C5D43F086E60A0944369DFC"><enum>(II)</enum><text>the attorney, who shall be identified using an anonymized unique identifier;</text></subclause><subclause id="H69D1E59100C843B2A3D241793412CDE6"><enum>(III)</enum><text>the date on which the case was referred to the public defender's office;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="H26DCEE054A5441BF9F4F89053EBE70B5"><enum>(IV)</enum><text>the date on which the attorney was appointed to the case; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="H2C5FD1662E114A8C90FE1D428ADC15E9"><enum>(V)</enum><text>the date on which the case was closed.</text></subclause></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H6C0315750A9B43209C574426B4896B9E"><enum>(B)</enum><header>Collection and submission requirement</header><text>For the second fiscal year, and each subsequent fiscal year, for which an eligible entity receives a covered grant, the eligible entity shall—</text><clause commented="no" display-inline="no-display-inline" id="HBB605DFD81624A6CA27A1588454A9370"><enum>(i)</enum><text>collect the data described in subparagraph (A) with respect to that fiscal year; and</text></clause><clause commented="no" display-inline="no-display-inline" id="HE299BA48EADD4EDDA117491810AA1D9A"><enum>(ii)</enum><text>submit the data to the Attorney General.</text></clause></subparagraph></paragraph><paragraph id="H52153FAFC05849DE9AD2B8D774AA124E"><enum>(2)</enum><header>Workload limits</header><subparagraph id="HC613A5BEC7A149F2A130BB8738D1CB42"><enum>(A)</enum><header>Development of workload limits</header><text>During the second fiscal year for which the eligible entity receives a covered grant, the eligible entity shall develop workload limits, based on the data collected under paragraph (1), that provide each full-time public defender employed by an applicable public defender's office with sufficient time to provide—</text><clause id="H8B1E3DF7844E4E25B251338567C2781F"><enum>(i)</enum><text>reasonably effective assistance of counsel pursuant to prevailing professional norms; and</text></clause><clause id="HECBE98945A924535A18114ABBEDDDDEF"><enum>(ii)</enum><text>competent representation pursuant to applicable rules of professional responsibility.</text></clause></subparagraph><subparagraph id="HE74DF6131C2E40B8BBBAAF03AC1957D5"><enum>(B)</enum><header>Periodic updates</header><text>If the eligible entity receives covered grants under subsection (a)(1)(B), the eligible entity shall review and, as necessary, update the limits developed under subparagraph (A) of this paragraph not less frequently than once every 10 fiscal years.</text></subparagraph></paragraph><paragraph id="H3A3CBA969C85401787900DE2491BEC86"><enum>(3)</enum><header>Public defender compensation</header><text>During the sixth fiscal year, and each subsequent fiscal year, for which the eligible entity receives a covered grant, the eligible entity shall satisfy the following requirements with respect to employees of each applicable public defender's office (or, in the case of subparagraph (D), with respect to each private attorney appointed by an applicable court):</text><subparagraph id="H0DA1F94C157E479CAA4BC603EEF34B09"><enum>(A)</enum><text>The rate and basis of compensation of the chief public defender shall be equivalent to the rate and basis of compensation of the corresponding chief prosecutor.</text></subparagraph><subparagraph id="H1725B7D8E270409FBA511CAB96447D77"><enum>(B)</enum><text>The rate and basis of compensation of an entry-level full-time staff attorney shall be equivalent to the rate and basis of compensation of an entry-level full-time staff attorney employed by the corresponding prosecutor's office.</text></subparagraph><subparagraph id="HC345BE28260049D8A87BC6B1B17066C7"><enum>(C)</enum><text>The rate and basis of compensation of a non-entry-level full-time staff attorney shall be equivalent to the greater of—</text><clause id="H089CE4BA81B940F8A5706658CD2C3A36"><enum>(i)</enum><text>the rate and basis of compensation of a full-time staff attorney employed by the corresponding prosecutor's office who has the same number of years of experience working as a criminal attorney; or</text></clause><clause id="H5B982576DE3A4ADC807543AD524897F6"><enum>(ii)</enum><text>the rate and basis of compensation of a full-time staff attorney employed by the corresponding prosecutor's office who has an equivalent supervisory or managerial role.</text></clause></subparagraph><subparagraph id="HB3197BEC8C6845249A1256610E5D337F"><enum>(D)</enum><text>In the case of an eligible entity that is not a public defender's office, the rate of compensation of a private attorney appointed by an applicable court to represent a defendant shall be equivalent to the rate of compensation of an attorney appointed under section 3006A of title 18, United States Code, by the United States district court for the Federal judicial district in which the applicable court is located, for the same or a similar type of case.</text></subparagraph><subparagraph id="H29670696C7704052BE030E165AA7964F"><enum>(E)</enum><text>The rate and basis of compensation of a full-time investigator shall be equivalent to the rate and basis of compensation of a full-time investigator employed by the corresponding prosecutor's office who has the same number of years of experience working as an investigator.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H80DEB99A806640308473A81E35A20842"><enum>(F)</enum><text>The rate and basis of compensation of a full-time paralegal shall be equivalent to the rate and basis of compensation of a full-time paralegal employed by the corresponding prosecutor's office who has the same number of years of experience working as a paralegal.</text></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HA8944D41B6B94940BBC0DD6317317439"><enum>(c)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated to the Attorney General to carry out this section—</text><paragraph commented="no" display-inline="no-display-inline" id="H0A3B371D02D8411790A13906B4F5D48C"><enum>(1)</enum><text>$250,000,000 for each of the first 5 fiscal years beginning after the date of enactment of this Act; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HFDCC286D47A14517BD25EC9CC1ECBACB"><enum>(2)</enum><text>such sums as may be necessary for each fiscal year thereafter.</text></paragraph></subsection></section><section id="H2893E5DE2BF74EE188881D0DDE83DDDC"><enum>5.</enum><header>Progress reports; certifications</header><subsection id="H96554C7038A84125BB5D1D5AD446B76A"><enum>(a)</enum><header>Progress reports</header><text>For each of the first 5 fiscal years for which a State or Tribal organization receives a covered grant, the State or Tribal organization shall submit a report to the Attorney General that—</text><paragraph id="HFDE52130B73948AF809F21BED88A2CA2"><enum>(1)</enum><text>documents the progress of the State or Tribal organization in meeting the requirements under section 4(b)(3);</text></paragraph><paragraph id="H5F6FFBC4D174439B90ED3299E69EC46B"><enum>(2)</enum><text>provides a formal accounting of total amounts expended on public defense during the fiscal year by the—</text><subparagraph id="H48D50CF059F347F4B8B1F0C3E8CFAB4C"><enum>(A)</enum><text>State, including each unit of local government in the State; or</text></subparagraph><subparagraph id="HB79C528C28404B9D90A3CE0206A6E399"><enum>(B)</enum><text>Tribal organization;</text></subparagraph></paragraph><paragraph id="H9240BEB73DFB41DE90889BD064DDA720"><enum>(3)</enum><text>provides a formal accounting of total amounts expended on prosecution during the fiscal year by the—</text><subparagraph id="H3939211DA03F4915A62FC0B73CF6024C"><enum>(A)</enum><text>State, including each unit of local government in the State; or</text></subparagraph><subparagraph id="HA673FEB1E2B44F2AB10C5A4CA0AD47B4"><enum>(B)</enum><text>Tribal organization; and</text></subparagraph></paragraph><paragraph id="HC4A5D6966641444583C6CC00E0BBE402"><enum>(4)</enum><text>documents the progress of the State, including each unit of local government in the State, or Tribal organization in achieving overall resource parity between prosecution and public defense.</text></paragraph></subsection><subsection id="H8292E4F4D0B744DAAE8F8A15D4CC2D0F"><enum>(b)</enum><header>Certifications</header><paragraph id="H04379BED2F8C463994F6768FA483C755"><enum>(1)</enum><header>Data collection process</header><text>For the first fiscal year for which an eligible entity receives a covered grant, the eligible entity shall submit to the Attorney General a certification that the eligible entity has developed and implemented a data collection process in accordance with section 4(b)(1)(A).</text></paragraph><paragraph id="H441931C123E748D5B8C5E1DF1FB7168E"><enum>(2)</enum><header>Workload limits</header><subparagraph id="HEAFC848E093D41329EE2643D05D57ABE"><enum>(A)</enum><header>Compliance</header><text>Subject to subparagraph (B), for the third fiscal year for which an eligible entity receives a covered grant, and each fiscal year thereafter, the eligible entity shall submit to the Attorney General a certification that the eligible entity has complied with the workload limits developed under section 4(b)(2).</text></subparagraph><subparagraph id="H0510C1AD2CF243A9B05D00A98AC8BF0A"><enum>(B)</enum><header>Requirement</header><text>If an eligible entity is unable to certify under subparagraph (A) that the eligible entity has complied with the workload limits developed under section 4(b)(2)—</text><clause id="H8CDDBC6FEF3F405C9473FD1D3AA5B9F2"><enum>(i)</enum><text>the eligible entity shall report to the Attorney General the number of additional public defenders and the amount of additional funding needed to ensure compliance with the limits developed under that section; and</text></clause><clause commented="no" display-inline="no-display-inline" id="H49D26057A25A408981E5BDCFB2ADED83"><enum>(ii)</enum><text>the Attorney General shall factor the information provided under clause (i) into the amount of the covered grant awarded to the eligible entity for the following fiscal year.</text></clause></subparagraph></paragraph><paragraph id="H79296DE91127406680FEDC373794A531"><enum>(3)</enum><header>Compensation parity</header><text>For the sixth fiscal year, and each subsequent fiscal year, for which an eligible entity receives a covered grant, the eligible entity shall submit to the Attorney General a certification that the eligible entity is in compliance with section 4(b)(3).</text></paragraph></subsection></section><section id="H7C2160C5ED6E4EE69CFDA69EC5C44FA6"><enum>6.</enum><header>Requirements for States receiving Byrne JAG funds</header><subsection id="H694F7CE136A346D38EC02E1C885BACA2"><enum>(a)</enum><header>Data collection</header><paragraph id="H2233BC57B2DB4EF096D4A03ECD5D21FA"><enum>(1)</enum><header>In general</header><text>For any fiscal year beginning after the date of enactment of this Act, a State that receives funds under subpart 1 of part E of title I of the Omnibus Crime Control and Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/34/10501">34 U.S.C. 10501</external-xref> et seq.) shall submit to the Attorney General data on the following with respect to criminal cases heard by a court of the State or of a unit of local government in the State during that fiscal year:</text><subparagraph id="H72C623F094EF4136977B1FB769BFCDB5"><enum>(A)</enum><text>The number of cases for which a defendant waived his or her right to counsel, and the number of charges in each case, broken down by race, ethnicity, and gender of the defendant.</text></subparagraph><subparagraph id="H30D480647C7248FF883885C18CE211C6"><enum>(B)</enum><text>The number of cases for which a defendant was represented in court by counsel who was publicly appointed, broken down by—</text><clause id="H73F9367C30644D22824A624B232DD6D3"><enum>(i)</enum><text>public defender, court-appointed private attorney, or contract attorney, and the number of charges in each case; and</text></clause><clause id="H17B436CB2A73495DAFB1FF0EF4F0C9EE"><enum>(ii)</enum><text>race, ethnicity, and gender of the defendant.</text></clause></subparagraph><subparagraph id="H56F62B68973F43FB8C2103594EE03A8A"><enum>(C)</enum><text>The number of cases for which a defendant was represented in court by counsel who was not publicly appointed, and the number of charges in each case, broken down by race, ethnicity, and gender of the defendant.</text></subparagraph></paragraph><paragraph id="H9A51CBBF586C4CAB91AD02667F97871B"><enum>(2)</enum><header>Applicable criminal offenses</header><text>A State shall submit data under paragraph (1) with respect to—</text><subparagraph id="H653CB84FC7F6445C85017466348715F0"><enum>(A)</enum><text>criminal offenses for which a term of imprisonment of more than 1 year may be imposed;</text></subparagraph><subparagraph id="H96A81FED0A054124815F7859FFAA9958"><enum>(B)</enum><text>criminal offenses for which a term of imprisonment of 1 year or less may be imposed, including misdemeanors, traffic violations, and violations of municipal ordinances; and</text></subparagraph><subparagraph id="H404136E7032A422BA7C2FFE09C70B221"><enum>(C)</enum><text>acts of juvenile delinquency or juvenile status offenses for which any term of detention may be imposed.</text></subparagraph></paragraph><paragraph id="H9879B5449A9147C8A212EA2DAFE639C2"><enum>(3)</enum><header>Withholding of funds</header><text>If a State does not comply with paragraph (1) or (2) for a fiscal year, the Attorney General shall withhold from the State 20 percent of the funds that would otherwise be allocated to the State for the following fiscal year under subpart 1 of part E of title I of the Omnibus Crime Control and Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/34/10501">34 U.S.C. 10501</external-xref> et seq.).</text></paragraph></subsection></section><section id="H009B8D786A4E43E497100F2A8D6A00F8"><enum>7.</enum><header>Funding to train public defenders</header><subsection id="HC7CC9168ED3F4F75A9581ABB204470B4"><enum>(a)</enum><header>Definition</header><text>In this section, the term <term>eligible entity</term> means an entity that—</text><paragraph id="HE68BED9D6B6748648ADAE69A8477B34B"><enum>(1)</enum><text>is—</text><subparagraph id="HF9F1DB289CA64518B51152CED5BCE4C3"><enum>(A)</enum><text>an organization—</text><clause id="H7A47945850DE41888016367A96DA1A2D"><enum>(i)</enum><text>described in paragraph (3) or (6) of <external-xref legal-doc="usc" parsable-cite="usc/26/501">section 501(c)</external-xref> of the Internal Revenue Code of 1986 and exempt from taxation under section 501(a) of such Code; or</text></clause><clause id="HA8130CB14BF84132AF9333F91639549E"><enum>(ii)</enum><text>funded by a State or unit of local government; or</text></clause></subparagraph><subparagraph id="H3CBBE879E163471C9618006154390778"><enum>(B)</enum><text>a State, unit of local government, Indian Tribal government, or political subdivision of an Indian Tribe; and</text></subparagraph></paragraph><paragraph id="HAADECF568B8F44FE8189772CFEEDEA8F"><enum>(2)</enum><text>has a comprehensive educational program specific to public defenders that offers—</text><subparagraph id="H7751F8F074B04C5BAA01975D6E3A8E14"><enum>(A)</enum><text>ongoing training and support; and</text></subparagraph><subparagraph id="HCBC0B7AB001E41899BD3A38B203F66CE"><enum>(B)</enum><text>programming that includes—</text><clause id="HDF28D6EB45EC47D98A775CD3D4347CA5"><enum>(i)</enum><text>skills training, including pretrial practice, negotiation skills, and trial skills;</text></clause><clause id="H8E0B688A231B4B4B80E70BB2C50D03E5"><enum>(ii)</enum><text>client-centered values;</text></clause><clause id="H2F4DAA77F356490892919123A55FBEAF"><enum>(iii)</enum><text>implicit bias training;</text></clause><clause id="HAFFB928D106442D1B9033BC0941649E3"><enum>(iv)</enum><text>leadership development; and</text></clause><clause id="HFF8E18F4E7E8429193A70EAAE729C169"><enum>(v)</enum><text>ongoing support to reinforce the training curriculum.</text></clause></subparagraph></paragraph></subsection><subsection id="HFE7216CC6FD9430081D81637354CC92B"><enum>(b)</enum><header>Grants</header><text>The Attorney General shall award grants to eligible organizations to be used to train public defenders, court-appointed private attorneys, and contract attorneys.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="H060F3542B72B459E8A817D55DD375B61"><enum>(c)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated to the Attorney General to carry out this section $5,000,000 for each of the first 5 fiscal years beginning after the date of enactment of this Act.</text></subsection></section><section id="H1E2CB0AD8A0F4FF9BE93F5355B3D9F4F"><enum>8.</enum><header>Enhancement of student loan repayment program</header><subsection id="H1C47A653039942D8932654CB5A16ABD8"><enum>(a)</enum><header>Reauthorization</header><text display-inline="yes-display-inline">Section 3001(j) of title I of the Omnibus Crime Control and Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/34/10671">34 U.S.C. 10671(j)</external-xref>) is amended—</text><paragraph id="H5D0DDA1CF52744118D423DE01AF07724"><enum>(1)</enum><text>by striking <quote>this section $25,000,000</quote> and inserting the following:</text><quoted-block display-inline="yes-display-inline" id="HB5FEFDBBC3B54EF794EDBAC75274FDCC" style="OLC"><text>this section—</text><paragraph id="H0978FB72CADF4A729F0D58206817E2E6"><enum>(1)</enum><text>$25,000,000</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="H3947EB6E201B45FDA955829EE86A4FF2"><enum>(2)</enum><text>by striking the period at the end and inserting the following:</text><quoted-block display-inline="yes-display-inline" id="H58DE0A001FC34DB392018A0DAE804CE6" style="OLC"><text>; and</text><paragraph id="H000E400705EA4AC48049D12E7D31BD79"><enum>(2)</enum><text>$75,000,000 for each of fiscal years 2022 through 2025.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HC73ABE2CEF354A18BE8C8A3D55ED558C"><enum>(b)</enum><header>Increasing limits on repayment amount</header><text display-inline="yes-display-inline">Section 3001(d)(3)(A) of title I of the Omnibus Crime Control and Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/34/10671">34 U.S.C. 10671(d)(3)(A)</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="H361A249AB7494B0ABFAD544488A4063C"><enum>(1)</enum><text>in clause (i), by striking <quote>$10,000</quote> and inserting <quote>$35,000</quote>; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H799F926551664E9E9D99DA177EB8FD54"><enum>(2)</enum><text>in clause (ii), by striking <quote>$60,000</quote> and inserting <quote>$200,000</quote>.</text></paragraph></subsection></section></legis-body></bill>
