which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To increase support for State Children’s Health Insurance programs during the COVID–19 emergency, and for other purposes.</official-title></form><legis-body id="H2FCD23A18D224448A9D61089443B08FB" style="OLC"><section section-type="section-one" id="H07F3A42E8E7049F1B2D7BB2519FF2E65"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Children’s Health Insurance Program Pandemic Enhancement and Relief Act</short-title></quote> or the <quote><short-title>CHIPPER Act</short-title></quote>.</text></section><section id="HA835801DB9404C4A8D2245DEEE3388A6"><enum>2.</enum><header>Increasing the CHIP enhanced FMAP to help States respond to the COVID–19 pandemic</header><text display-inline="no-display-inline">Section 2105(b) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1397ee">42 U.S.C. 1397ee(b)</external-xref>) is amended—</text><paragraph id="HEE8D8829005B49E482A9F485A63CD0DB"><enum>(1)</enum><text>by striking <quote>For purposes of subsection (a),</quote> and inserting the following:</text><quoted-block style="OLC" id="H9ED56606B6CE4280B50DF426F465C04A" act-name=""><paragraph id="H20BE2920B09E4DABAA43589DF5528A9E"><enum>(1)</enum><header>In general</header><text>For purposes of subsection (a),</text></paragraph><after-quoted-block>; </after-quoted-block></quoted-block></paragraph><paragraph id="HE8EDE027B6584659B8FB80729D9AF8BC"><enum>(2)</enum><text>in the second sentence— </text><subparagraph id="H28B75EEFA074436B8D0CD9905F120E66"><enum>(A)</enum><text>by inserting <quote>, subject to paragraph (2),</quote> after <quote>23 percentage points, and</quote>; and</text></subparagraph><subparagraph id="HE6C92019B17E44A396961F391913B305"><enum>(B)</enum><text>by striking <quote>September 30, 2020</quote> and inserting <quote>September 30, 2022</quote>; and</text></subparagraph></paragraph><paragraph id="HB3387206A5434F349C28F28C861B64D2"><enum>(3)</enum><text>by adding at the end the following new paragraph: </text><quoted-block style="OLC" id="HDC8BD7CAAC7547F1BEC0CC66BF717FCF" act-name=""><paragraph id="H3AF2753DA7474BBB8DAB6FA6F88C0803"><enum>(2)</enum><header>Requirements</header><text>During the period that begins on October 1, 2020, and ends on September 30, 2022, a State shall not receive the increase described in the second sentence of paragraph (1) to the enhanced FMAP for such State, with respect to a quarter that occurs during such period, if—</text><subparagraph id="H28712619BB7045C4B6108DE8E9F84C45"><enum>(A)</enum><text display-inline="yes-display-inline">the amount of any premium imposed by the State under the State child health plan (or a waiver of such plan) during such quarter, with respect to an individual enrolled under such plan (or waiver), exceeds the amount of such premium as of January 1, 2020;</text></subparagraph><subparagraph id="H6222F3BC4F7A44D7BC9BD6E76EC68AC5"><enum>(B)</enum><text display-inline="yes-display-inline">the State fails to provide that an individual who is enrolled for benefits under such plan (or waiver) as of the date of enactment of this paragraph or enrolls for benefits under such plan (or waiver) during the period beginning on such date of enactment and ending on the last day of the month in which the emergency period defined in paragraph (1)(B) of section 1135(g) ends shall be treated as eligible for such benefits through the end of the month in which such emergency period ends unless the individual requests a voluntary termination of eligibility or the individual ceases to be a resident of the State; </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H7E8E10D0CA704BBF8F52C0DB38F7864E"><enum>(C)</enum><text>the State does not provide coverage under such plan (or waiver), without the imposition of cost sharing, during such quarter for any testing services and treatments for COVID–19, including vaccines, specialized equipment, and therapies;</text></subparagraph><subparagraph commented="no" id="HEC042765A49A4C92B382FCE95CDF7ED3"><enum>(D)</enum><text>the State imposes a waiting period under the State child health plan prior to the provision of child health assistance to a targeted low-income child; or</text></subparagraph><subparagraph commented="no" id="H4090477A706849DCB2C05A345653CB69"><enum>(E)</enum><text>the State fails to take active measures (as determined by the Secretary) to identify and re-enroll children who are eligible for child health assistance under the State plan and who were previously enrolled in such plan.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></legis-body></bill>
