Gutierrez Purple Heart Survivor Naturalization Fee Relief Act of 2021</short-title></quote>.</text></section><section id="H4076467858654F54AE6BDC6C3755E4C8"><enum>2.</enum><header>Exemption of fees for certain immediate relatives of an individual who received the Purple Heart</header><subsection id="H91519A10AEED431B82FDEF8D4EA5416C"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 90 days after the date of the enactment of this Act, the Secretary of Homeland Security shall include on a certain application or petition an opportunity for certain immediate relatives of an individual who was awarded the Purple Heart to identify themselves as such an immediate relative. </text></subsection><subsection id="H30EF4CA7F1594F7F8CD975B85EDF661A"><enum>(b)</enum><header>Fee exemption</header><text display-inline="yes-display-inline">The Secretary shall exempt certain immediate relatives of an individual who was awarded the Purple Heart, who identifies as such an immediate relative on a certain application or petition, from a fee with respect to a certain application or petition and any associated fee for biometrics. </text></subsection><subsection id="HC6C0EF47CAF345DC9DB8C7D71127E7FB"><enum>(c)</enum><header>Pending applications and petitions</header><text display-inline="yes-display-inline">The Secretary of Homeland Security may waive fees for a certain application or petition and any associated fee for biometrics for certain immediate relatives of an individual who was awarded the Purple Heart, if such application or petition is submitted not more than 90 days after the date of the enactment of this Act. </text></subsection><subsection id="H6B36870808B04F0E98888555F2DFE6C1"><enum>(d)</enum><header>Definition</header><text>In this section:</text><paragraph id="HF06D39F43531491C83ACA1CC42C29668"><enum>(1)</enum><header>Active service</header><text>The term <quote>active service</quote> has the meaning given such term in section 101(d) of title 10, United States Code. </text></paragraph><paragraph id="HBCFF850F11D4424CB810D690A8BB2CDA"><enum>(2)</enum><header>Certain immediate relatives of an individual who was awarded the Purple Heart</header><text display-inline="yes-display-inline">The term <quote>certain immediate relatives of an individual who was awarded the Purple Heart</quote> means an immediate relative of a living or deceased member of the Armed Forces who was awarded the Purple Heart and who is not a person ineligible for military honors pursuant to section 985(a) of title 10, United States Code. </text></paragraph><paragraph id="HC08F4A8E861F4EE68F0F655D69ED2B87"><enum>(3)</enum><header>Certain application or petition</header><text>The term <quote>certain application or petition</quote> means—</text><subparagraph id="H295D4B68F572485A8B6C54F7FCA0DC5E" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">an application using Form–400, Application for Naturalization (or any successor form); or</text></subparagraph><subparagraph id="HB79E984F3B0446A89039895B0FBDAE4D"><enum>(B)</enum><text display-inline="yes-display-inline">a petition using Form I–360, Petition for Amerasian, Widow(er), or Special Immigrant (or any successor form). </text></subparagraph></paragraph><paragraph id="H49F24A0E78994FD0982A883ABE0FB61D"><enum>(4)</enum><header>Immediate relative</header><text>The term <quote>immediate relative</quote> has the meaning given such term in section 201(b) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1151">8 U.S.C. 1151(b)</external-xref>). </text></paragraph></subsection></section></legis-body></bill>
