R. 1385</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20210225">February 25, 2021</action-date><action-desc><sponsor name-id="T000483">Mr. Trone</sponsor> (for himself, <cosponsor name-id="E000294">Mr. Emmer</cosponsor>, <cosponsor name-id="M001163">Ms. Matsui</cosponsor>, <cosponsor name-id="T000469">Mr. Tonko</cosponsor>, and <cosponsor name-id="C001097">Mr. Cárdenas</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To establish the position of Interagency Coordinator for Behavioral Health to coordinate the programs and activities of the Federal Government relating to mental health, and for other purposes.</official-title></form><legis-body id="HEC2D738E5570429B86D4B1380A7AF85B" style="OLC"><section id="HF59A38D2A71342DE81014332720F2130" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Behavioral Health Coordination and Communication Act of 2021</short-title></quote>.</text></section><section id="HE3D1D14541E449CA9FABB3EE4653263D"><enum>2.</enum><header>Interagency Coordinator for Behavioral Health</header><subsection id="H91706DD671574A4089643D258F16BD5D"><enum>(a)</enum><header>Position</header><paragraph id="HBD1AA651B7EC475495356423A2B75B27"><enum>(1)</enum><header>Appointment</header><text display-inline="yes-display-inline">There is within the Executive Office of the President an Interagency Coordinator for Behavioral Health (in this Act referred to as the <quote>Interagency Coordinator</quote>) who shall—</text><subparagraph id="HA54FEB35DC3B41BA95A818541CB3997F"><enum>(A)</enum><text>be appointed by the President, by and with the advice and consent of the Senate; and</text></subparagraph><subparagraph id="H000A12D8A24B4D85BCDCA04DE011B981"><enum>(B)</enum><text>report directly to the President.</text></subparagraph></paragraph><paragraph id="H7693BA7247B9421CBC3EF0C3CDC8BF57"><enum>(2)</enum><header>Qualifications</header><text>The Interagency Coordinator shall—</text><subparagraph id="HB7B97542DC3D422EB3C8C8A96F2A3DD1"><enum>(A)</enum><text display-inline="yes-display-inline">have expertise in mental health and substance use disorders; and</text></subparagraph><subparagraph id="H3BDD5D9E527F4AA5BF5F8EED610E48D2"><enum>(B)</enum><text>have administrative experience.</text></subparagraph></paragraph><paragraph id="HAE577AF8427F4ED8BBA96FDD24DBC490"><enum>(3)</enum><header>Term</header><text>The Interagency Coordinator shall be appointed for a term of 5 years. The same individual may be reappointed to serve as the Interagency Coordinator for subsequent 5-years terms.</text></paragraph><paragraph id="HFAC05F34EDC847A7A219E5663B228A15"><enum>(4)</enum><header>Rate of pay</header><text>To the extent or in the amounts provided in advance in appropriation Acts, the Interagency Coordinator shall be paid at a rate equal to the rate of basic pay for level 1 of the Executive Schedule.</text></paragraph></subsection><subsection id="HE9C93394FCDB4641A2C5E2BEC4384927"><enum>(b)</enum><header>Principal responsibility</header><paragraph id="HF4C9DD1F55C94DC0AAD35308805FF0F5"><enum>(1)</enum><header>In general</header><text>The Interagency Coordinator shall coordinate the programs and activities of the Federal Government relating to mental health and substance use disorders.</text></paragraph><paragraph id="HFE70E1D51AA142AE9C8438D8D63E9CEC"><enum>(2)</enum><header>Consultation</header><subparagraph id="HAC077C95362745CC95E4692B0C9DE42E"><enum>(A)</enum><header>Required consultation</header><text>In carrying out paragraph (1) with respect to any program or activity, the Interagency Coordinator shall consult with—</text><clause id="H0A8536FD73384AF68DEC3FB05B9E9D02"><enum>(i)</enum><text display-inline="yes-display-inline">the Assistant Secretary of Defense for Health Affairs;</text></clause><clause id="HBACDB6D6DD064D4BAC9F1E13B81566E4"><enum>(ii)</enum><text>the Attorney General of the United States, the Administrator of the Office of Juvenile Justice and Delinquency Prevention, and the Director of the Bureau of Prisons;</text></clause><clause id="H27230B2758F940DFB948913AF3C3FD17"><enum>(iii)</enum><text>the Director of National Drug Control Policy;</text></clause><clause id="H59D7CA6882AA4F14854E23C5F2D2C335"><enum>(iv)</enum><text display-inline="yes-display-inline">the Secretary of Education, including the Assistant Secretary for Special Education and Rehabilitative Services;</text></clause><clause id="HF1E248857C9240EE8D6FA53AE0758E6C"><enum>(v)</enum><text display-inline="yes-display-inline">the Secretary of Health and Human Services, the Assistant Secretary for Health, the Assistant Secretary for the Administration for Children and Families, the Assistant Secretary for Mental Health and Substance Use, and the Director of the Indian Health Service;</text></clause><clause id="H36035939982942B1B9D10BA841DD7B82"><enum>(vi)</enum><text>the Secretary of Homeland Security;</text></clause><clause id="H57913089AD504C058402D5DD93E42FE1"><enum>(vii)</enum><text>the Secretary of Housing and Urban Development;</text></clause><clause id="H5FA64333756147A78608A739E9253B6A"><enum>(viii)</enum><text>the Secretary of Labor;</text></clause><clause id="HA5CD291732C64F72A0BEE24DD00514C9"><enum>(ix)</enum><text>the Secretary of Veterans Affairs; and</text></clause><clause id="H98ABA3BBB1CD4D908F7A8F3BB7D0B3F9"><enum>(x)</enum><text>the Deputy Assistant Secretary for Minority Health.</text></clause></subparagraph><subparagraph id="H98E3A89B4D44483FB0E6E9557395C9F5"><enum>(B)</enum><header>Additional consultation</header><text display-inline="yes-display-inline">In carrying out paragraph (1) with respect to any program or activity, the Interagency Coordinator may consult with the Director of the Centers for Disease Control and Prevention, the Commissioner of Food and Drugs, the Director of the National Institutes of Health, the Administrator of the Centers for Medicare &amp; Medicaid Services, and such additional Federal officials as the Interagency Coordinator determines appropriate.</text></subparagraph></paragraph></subsection><subsection id="H90B43C083E5643DAA960FF252F2F4563"><enum>(c)</enum><header>Other responsibilities</header><paragraph id="H35C32A700A224D8481AB27520DFCA8F6"><enum>(1)</enum><header>Framework for mental health and substance use disorders</header><text>The Interagency Coordinator shall work with Federal departments and agencies to create a framework within and across such departments and agencies for mental health and substance use disorders. Such framework shall include the following:</text><subparagraph id="H295386B9957548D6B3011ACFF16CF08C"><enum>(A)</enum><text>Care coordination to better integrate mental health and substance use disorder care into health care settings and ensure seamless transitions for patients, including by—</text><clause id="H381BA3A080E344D3BBF120C31397D575"><enum>(i)</enum><text>promoting mental health and substance use disorder care earlier in the health care continuum;</text></clause><clause id="H73E6CDFE36024BA88D8AC77313326917"><enum>(ii)</enum><text>focusing on providing mental health and substance use disorder care in more appropriate settings and locations;</text></clause><clause id="HD641D69DFEE047CD9F08F38431FD89A5"><enum>(iii)</enum><text display-inline="yes-display-inline">promoting diversion to mental health and substance use disorder treatment programs instead of incarceration for mental health conditions and substance use disorders;</text></clause><clause id="H65ACB2A0040E40A9803C2AE3D9D34691"><enum>(iv)</enum><text display-inline="yes-display-inline">improving access to primary care and other medical services in community mental health and substance use disorder settings; </text></clause><clause id="HEA9B9E095AFB431CB9635A50B1C68274"><enum>(v)</enum><text>promoting better treatment and services for mental health conditions and substance use disorders while incarcerated; and</text></clause><clause id="H3D32A5A3B7804BA4873FCA0C5B2845CE"><enum>(vi)</enum><text display-inline="yes-display-inline">providing better coordination for wraparound services at every point in health care and the justice system for individuals with mental health conditions and substance use disorders, including social supports, housing, education, and employment.</text></clause></subparagraph><subparagraph id="H97DDEB63A1A44423A71CAAD501DCD434"><enum>(B)</enum><text>A focus on adults, children, youth, and adolescents.</text></subparagraph><subparagraph id="H470216611D46429EB18F8C19394B4DD0"><enum>(C)</enum><text>Creating and implementing a transition plan for patients with mental health conditions or substance use disorders who change systems, departments, agencies, or services.</text></subparagraph></paragraph><paragraph id="HA086C3F6BE7E46FAA8B42C1193D84C31"><enum>(2)</enum><header>Inventory</header><text>The Interagency Coordinator shall—</text><subparagraph id="HDFF6D427766C4F2CAA26F519C2AED7C1"><enum>(A)</enum><text>take an inventory of all positions, committees, task forces, grants, and funding streams in the Federal Government that are related to mental health and substance use disorders; and</text></subparagraph><subparagraph id="H1CF88E521184442D87DF07868DD56E24"><enum>(B)</enum><text>provide suggestions to the President, the Congress, and relevant Federal departments and agencies on removing, restructuring, and reorganizing such positions, committees, task forces, grants, and funding streams.</text></subparagraph></paragraph><paragraph id="H9E8237F501C049F09A438153494C5D2A"><enum>(3)</enum><header>Knowledge center</header><text>The Interagency Coordinator shall establish and maintain a knowledge center to provide to the public, including by means of a website, reliable information on mental health and substance use disorders, including insurance information and navigation tools for the appeals process for insurance denials.</text></paragraph><paragraph id="H1614E9637EF348A4AED5EA3314A025C3"><enum>(4)</enum><header>Best practices</header><text>The Interagency Coordinator shall identify best practices for—</text><subparagraph id="HD025787E74ED4BB1817C1C65172526A4"><enum>(A)</enum><text>culturally congruent and linguistically appropriate mental health and substance use disorder care;</text></subparagraph><subparagraph id="H6ECB6A1080D74E27AFA3A21A67617CEB"><enum>(B)</enum><text>comprehensive mental health and substance use disorder care;</text></subparagraph><subparagraph id="HE45FBACEE410490EAA8BC1700FCF88C3"><enum>(C)</enum><text>continuity of mental health and substance use disorder care;</text></subparagraph><subparagraph id="HD7B6C643E16C41359CC0E6A434F1CB1A"><enum>(D)</enum><text>destigmatization of mental health conditions and substance use disorders; and</text></subparagraph><subparagraph id="H9B5DF79D97144740AB45A84E14EFB841"><enum>(E)</enum><text>education campaigns on mental health and substance use disorders in a variety of settings that include—</text><clause id="H0FF3C8D57FA340859777E587C9DB743A"><enum>(i)</enum><text>the full spectrum of education levels, ranging from prekindergarten through higher education;</text></clause><clause id="H5D7ABA07C7EF4902AF8613FD401B9FCF"><enum>(ii)</enum><text>a range of patient populations, including pediatric, adult, geriatric, veteran, racial and ethnic minority populations, as well as patient populations in the justice system;</text></clause><clause id="H95A3B6A927D5412EA6733E020729285E"><enum>(iii)</enum><text>a range of health care provider populations; and</text></clause><clause id="HD098C17F8C38410F91353E76D3155811"><enum>(iv)</enum><text>a range of providers in the justice system.</text></clause></subparagraph></paragraph><paragraph id="H31DDDE9B37974D6BA49A3F93990AB990"><enum>(5)</enum><header>Guidance on mental health and substance use disorder telehealth treatment across State lines</header><text display-inline="yes-display-inline">Not later than 180 days after the date of enactment of this Act, the Interagency Coordinator shall issue guidance on collaboration among States to enable mental health and substance use disorder care professionals to treat patients across State lines through telehealth technologies.</text></paragraph><paragraph id="HFCF5E42EC67A4B17A6EC5B26F57A3E52"><enum>(6)</enum><header>Annual report</header><text>Not later than one year after the date of enactment of this Act, and annually thereafter, the Interagency Coordinator shall submit a public report to the Congress and the President that includes—</text><subparagraph id="H9251D8F826454FA1BD2D671B05189DE5"><enum>(A)</enum><text>a description of the activities of the Interagency Coordinator over the reporting period;</text></subparagraph><subparagraph id="HAB526C32E57749C1BC60CD4BC91ADBCE"><enum>(B)</enum><text>the strategic goals of the Interagency Coordinator over the next 5- and 10-year periods; and</text></subparagraph><subparagraph id="H7FB28E1C494441E1A12B96E73A0A010C"><enum>(C)</enum><text>an inventory of all Federal programs pertaining to mental health and substance use disorders.</text></subparagraph></paragraph><paragraph id="HD7A3A37B1B474E6081819F91AC2B63B7"><enum>(7)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than one year after the date of enactment of this Act, the Interagency Coordinator shall submit a public report to the Congress and the President—</text><subparagraph id="HE6FB8FEFEC3D48CAA43DED4756FF40D3"><enum>(A)</enum><text display-inline="yes-display-inline">describing the racial, ethnic, disability, sex, and gender disparities within the mental health and substance use disorder workforce, describing how such disparities impact access to care, particularly for minority populations, and recommending how to address such disparities;</text></subparagraph><subparagraph id="HCC4898EF47014913B739188EC35183F8"><enum>(B)</enum><text>projecting the diversity of mental health and substance use disorder care professional in terms of race, ethnicity, sex, and gender in 5 and 10 years;</text></subparagraph><subparagraph id="H0D8D8C481F4B45649C1BEA999353CFA5"><enum>(C)</enum><text display-inline="yes-display-inline">describing the racial, ethnic, disability, sex, and gender disparities in education and training for the mental health and substance use disorder care professionals, and recommending how to address such disparities;</text></subparagraph><subparagraph id="HA2D1432F721D470E826DA33178133AC1"><enum>(D)</enum><text display-inline="yes-display-inline">describing geographic racial, ethnic, disability, sex, and gender disparities of the mental health and substance use disorder workforce, and recommending how to address such disparities;</text></subparagraph><subparagraph id="HBC3BC855FBA14D799A34691B0FB8466E"><enum>(E)</enum><text>recommending ways to include nonsubjective mental health and substance use disorder screenings as a vital sign;</text></subparagraph><subparagraph id="H44AACBF54EB24704B0F084A20C007DDC"><enum>(F)</enum><text display-inline="yes-display-inline">recommending ways to create a complexity index for mental health and substance use disorders; and</text></subparagraph><subparagraph id="H94324F4BC103495F865F584692693910"><enum>(G)</enum><text display-inline="yes-display-inline">assessing access to community-based mental health and substance use disorder services in underserved geographic areas and communities of color.</text></subparagraph></paragraph></subsection><subsection id="H778BA0F4E65A4A38AA9A95CB7BCFA9D7"><enum>(d)</enum><header>Team</header><paragraph id="H72CCDC25F5C2448586A13188B605C2B4"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Interagency Coordinator may appoint such personnel (in this Act referred to as the <quote>team</quote>) as the Interagency Coordinator considers appropriate.</text></paragraph><paragraph id="HEC5A0E4E7E5647D98A10864B12CEFB24"><enum>(2)</enum><header>Composition</header><text display-inline="yes-display-inline">The Interagency Coordinator shall ensure that the team, collectively, has the following experience:</text><subparagraph id="HB0C78E40DB7B4071BA29FEB531924BF8"><enum>(A)</enum><text>Working in an adult mental health setting.</text></subparagraph><subparagraph id="H135D046887FB4993809F7EC2D7CE4B24"><enum>(B)</enum><text>Working in a geriatric mental health setting.</text></subparagraph><subparagraph id="HD67426BA93B74DE28A99574DADBCA84D"><enum>(C)</enum><text>Working in a child mental health setting.</text></subparagraph><subparagraph id="H9E9AE438C5D04BFDAFFF6728F91C6C59"><enum>(D)</enum><text>Working in an adult substance use disorder setting.</text></subparagraph><subparagraph id="H5C41D68F4F1349FC959F3E49DC4EC50C"><enum>(E)</enum><text>Working in a child substance use disorder setting.</text></subparagraph><subparagraph id="H9327AD2549D443038D586D85BB7EF68B"><enum>(F)</enum><text>Working in the adult justice system with a focus on mental health and substance use disorders.</text></subparagraph><subparagraph id="H8B25E7F2F28F435B9C2B46F463566CD7"><enum>(G)</enum><text>Working in the juvenile justice system with a focus on mental health and substance use disorders.</text></subparagraph><subparagraph id="H59ED942F270B4A9EBAFDBC69ECD75DF1"><enum>(H)</enum><text display-inline="yes-display-inline">Working in a school or college campus-based setting with a focus on mental health and substance use disorders.</text></subparagraph><subparagraph id="H41E92E215F864E3CAA681A544393AE3D"><enum>(I)</enum><text>Working in a health care facility of the Department of Veterans Affairs with a focus on mental health and substance use disorders.</text></subparagraph><subparagraph id="H5936FC3299AF416EA25CFF0564E57569"><enum>(J)</enum><text>Working in a foster care setting.</text></subparagraph><subparagraph id="H84A45AE87B81471F943E6F5FD12A1A77"><enum>(K)</enum><text display-inline="yes-display-inline">Working in an integrated care setting.</text></subparagraph><subparagraph id="H91543A1829854433A7A032B5C8901D40"><enum>(L)</enum><text>Receiving mental health and substance use disorder care as an adult.</text></subparagraph><subparagraph id="H0134F14613934998874DDA4AFB0CAD98"><enum>(M)</enum><text>Receiving mental health and substance use disorder care as a child.</text></subparagraph><subparagraph id="HC31CEAC424A94089A8D7D330EE106552"><enum>(N)</enum><text>Having been incarcerated in the adult justice system while suffering from a mental illness or substance use disorder.</text></subparagraph><subparagraph id="HD0CF14989401445DB04F5D70A253D4C1"><enum>(O)</enum><text>Having been detained in the juvenile justice system while suffering from a mental illness or substance use disorder.</text></subparagraph><subparagraph id="HDC7BAA739D7D4F7E98BA34BF6A152DFC"><enum>(P)</enum><text>Having been placed in a foster care setting.</text></subparagraph><subparagraph id="H65541F4303E545F6B6ECC5288D03B73D"><enum>(Q)</enum><text display-inline="yes-display-inline">Experience providing mental health or substance use disorder care in minority and underserved communities.</text></subparagraph></paragraph><paragraph id="H81A6FBADBF6F43AEB0CBAC3A120D0B96"><enum>(3)</enum><header>Delegation of responsibilities</header><text display-inline="yes-display-inline">The Interagency Coordinator shall delegate to the team responsibilities including—</text><subparagraph id="HC098C8951B1D49DAA7DC306C46F968DA"><enum>(A)</enum><text>using the framework created under subsection (c)(1);</text></subparagraph><subparagraph id="HF4863EFA1F4D47DDB91D50B79A07158B"><enum>(B)</enum><text>helping to identify Federal, State, Tribal, and local partnerships between the public and private sectors for improving mental health and substance use disorders; and</text></subparagraph><subparagraph id="HC3A8CBA2589D475F9689BC9B4E752169"><enum>(C)</enum><text>help with implementation of this Act.</text></subparagraph></paragraph><paragraph id="H18C5C13B9A6C463F80A801EE23597CC5"><enum>(4)</enum><header>Applicability of certain civil service laws</header><text display-inline="yes-display-inline">The team may be appointed without regard to the provisions of title 5, United States Code, governing appointments in the competitive service, and may be paid without regard to the provisions of chapter 51 and subchapter III of chapter 53 of that title relating to classification and General Schedule pay rates, except that an individual so appointed may not receive pay in excess of the annual rate of basic pay for GS–15 of the General Schedule.</text></paragraph><paragraph id="H61487275DF3C4DA3972E83639A97F55E"><enum>(5)</enum><header>Experts and consultants</header><text display-inline="yes-display-inline">The Interagency Coordinator may procure temporary and intermittent services under section 3109(b) of title 5, United States Code, but at rates for individuals not to exceed the daily equivalent of the annual rate of basic pay for GS–15 of the General Schedule.</text></paragraph><paragraph id="H54F48B65F81440D39412ECC1DFC50937"><enum>(6)</enum><header>Staff of Federal agencies</header><text display-inline="yes-display-inline">Upon request of the Interagency Coordinator, the head of any Federal department or agency may detail, on a reimbursable basis, any of the personnel of that department or agency to the Interagency Coordinator to assist it in carrying out the responsibilities under this Act.</text></paragraph></subsection><subsection id="H0C5C1D5C314A4853B59D1B2BA95512F2"><enum>(e)</enum><header>Powers</header><paragraph id="H9F7C9BDE5C214891A907F50FEDFE701E"><enum>(1)</enum><header>Hearings and sessions</header><text>The Interagency Coordinator may, for the purpose of carrying out this Act, hold hearings, sit and act at times and places, take testimony, and receive evidence as the Interagency Coordinator considers appropriate.</text></paragraph><paragraph id="H6AA3BD5CB250438A9FF99273DC1309FD"><enum>(2)</enum><header>Powers of team and agents</header><text>Any member of the team or agent of the Interagency Coordinator may, if authorized by the Interagency Coordinator, take any action which the Commission is authorized to take by this section.</text></paragraph><paragraph id="HE8A83A09ABDB4BF48C0735C539C9B545"><enum>(3)</enum><header>Obtaining official data</header><text display-inline="yes-display-inline">The Interagency Coordinator may secure directly from any department or agency of the United States information necessary to enable the Interagency Coordinator to carry out this Act. Upon request of the Interagency Coordinator, the head of that department or agency shall, within 30 days of receiving the request, furnish that information to the Interagency Coordinator.</text></paragraph><paragraph id="H7502A19E3454418B9362263BC607FA54"><enum>(4)</enum><header>Mails</header><text display-inline="yes-display-inline">The Interagency Coordinator may use the United States mails in the same manner and under the same conditions as other departments and agencies of the United States.</text></paragraph><paragraph id="H925F56E07ED942B8948D59B8CAE5AE24"><enum>(5)</enum><header>Administrative support services</header><text display-inline="yes-display-inline">Upon the request of the Interagency Coordinator, the Administrator of General Services shall provide to the Interagency Coordinator, on a reimbursable basis, the administrative support services necessary for the Interagency Coordinator to carry out the responsibilities under this Act.</text></paragraph><paragraph id="HE8DA2C8B8A094B1DA97C4224A904192C"><enum>(6)</enum><header>Contract authority</header><text display-inline="yes-display-inline">To the extent or in the amounts provided in advance in appropriation Acts, the Interagency Coordinator may contract with and compensate government and private agencies or persons for supplies and services.</text></paragraph></subsection><subsection id="HA83B064EC07A47D0B40DB6CE2AC8E26D"><enum>(f)</enum><header>Definition</header><text display-inline="yes-display-inline">In this section, the term <term>culturally congruent</term> means consistent with preferred cultural values, beliefs, worldview, language, and practices.</text></subsection></section><section id="HBADE2E0D1CF4403C8F178525BF82E01D"><enum>3.</enum><header>Cooperation by other Federal agencies</header><text display-inline="no-display-inline">The head of each Federal department or agency seeking to commence development or implementation of a policy, including through rulemaking or guidance, that is directly related to mental health or substance use disorder care shall—</text><paragraph id="HD6AA26953CC046C48463C16DFC2529A6"><enum>(1)</enum><text>give notice of the policy to the Interagency Coordinator;</text></paragraph><paragraph id="HDE9A6A9C3B644F3EBE0E23B831B381F6"><enum>(2)</enum><text>in accordance with section 2(e)(3), share such information relating to the policy as the Interagency Coordinator may request; and</text></paragraph><paragraph id="HDAC1FFAC12394BF3BC99C683F34211A3"><enum>(3)</enum><text display-inline="yes-display-inline">participate in such discussions and meetings regarding the policy as the Interagency Coordinator may request for purposes of coordination pursuant to section 2(b).</text></paragraph></section><section id="H31AE72B07358497890AF41F0393EA1D7"><enum>4.</enum><header>Study on reimbursement of mental health and substance use disorder services for juveniles</header><subsection id="H75D61D38014E4F66AEBBC81F4D296411"><enum>(a)</enum><header>Reimbursement of mental health and substance use disorder services provided in preschool, elementary school, and secondary school settings</header><text display-inline="yes-display-inline">Not later than 2 years after the date of enactment of this Act, the Comptroller General of the United States shall—</text><paragraph id="HFE6C962BC93841EE93A0E7945A8176E8"><enum>(1)</enum><text>complete a study on the reimbursement of mental health and substance use disorder care professionals for services provided in preschool, elementary school, and secondary school settings; and</text></paragraph><paragraph id="HF6C261EE7CF54B5CBBB314D375F1C652"><enum>(2)</enum><text>submit a public report to the Congress and the President on the findings, conclusions, and recommendations resulting from such study.</text></paragraph></subsection><subsection id="HA92248F6D0FF4E96B6634BD5D8131D2F"><enum>(b)</enum><header>Services available to justice involved juveniles</header><text display-inline="yes-display-inline">Not later than 2 years after the date of enactment of this Act, the Comptroller General of the United States shall—</text><paragraph id="H5D316EDC823440BBACAA4770DFC19C73"><enum>(1)</enum><text display-inline="yes-display-inline">complete a study to determine the percentage of the budget of the Federal Government and each State government, disaggregated by agency, used to support mental health and substance use disorder services for juveniles who are arrested or become part of the juvenile or criminal justice systems; and</text></paragraph><paragraph id="H332360869B8C41E39CFA43A959D621B7"><enum>(2)</enum><text>submit a public report to the Congress and the President on the findings, conclusions, and recommendations resulting from such study, including recommendations on—</text><subparagraph id="HC66BFDB7985F42B697A580C72138A55C"><enum>(A)</enum><text display-inline="yes-display-inline">whether the amount expended by each Federal and State agency on mental health and substance use disorder services for such juveniles needs to be adjusted; and</text></subparagraph><subparagraph id="H037160C49D024C8A98D79FFC71B3808C"><enum>(B)</enum><text>any gaps in community-based services for juveniles with mental health conditions or substance use disorders that should be available to prevent such juveniles from becoming part of the juvenile or criminal justice systems.</text></subparagraph></paragraph></subsection></section><section id="H320F6925E952408F9DD3415FBE4A14E3"><enum>5.</enum><header>Report on Interagency Coordinator’s involvement at the Federal and State levels in programs, decisions, and changes relating to mental health and substance use disorders</header><text display-inline="no-display-inline">Not later than 5 years after the date of enactment of this Act, the Comptroller General shall—</text><paragraph id="H478444623F1E4C8B9E2CF4A7A97924F6"><enum>(1)</enum><text>submit a report to the Congress and the President on the involvement of the Interagency Coordinator and the Interagency Coordinator’s team at the Federal and State levels in programs, decisions, and changes relating to mental and behavioral health;</text></paragraph><paragraph id="HE890578D807C44578CA91359778A31A1"><enum>(2)</enum><text>disaggregate the information in such report by year; and</text></paragraph><paragraph id="HA24AB8D2E5BF475EBB06AB0B0C145DEB"><enum>(3)</enum><text display-inline="yes-display-inline"> include in such report recommendations on—</text><subparagraph id="H495C164D727247BF9883AED858FA26B0"><enum>(A)</enum><text>ways to improve such involvement of the Interagency Coordinator and the Interagency Coordinator’s team; and</text></subparagraph><subparagraph id="H09C6B1B4DDB74492A601F0143EB25FFD"><enum>(B)</enum><text>addressing any identified gaps in such involvement.</text></subparagraph></paragraph></section></legis-body></bill>
