Return to pre-2018 estate and gift tax basic exclusion amount.</toc-entry></toc></subsection></section><section id="H82EC4B50703A420380DA3F7C739721A6"><enum>2.</enum><header>Purposes</header><text display-inline="no-display-inline">The purposes of this Act are as follows:</text><paragraph id="H17B1A89EE9354A6B8CFEACB1D451E01F"><enum>(1)</enum><text display-inline="yes-display-inline">to develop a national strategy to build the infrastructure necessary to eliminate lead-based pipe and tap hazards in housing;</text></paragraph><paragraph id="H18FCFC1A76274CCCAD6E870AAD6D1939"><enum>(2)</enum><text>to reorient the national approach to the presence of lead-based pipe and taps in public and private homes to implement, on a priority basis, a program to evaluate and reduce lead-based pipe hazards in the Nation’s building stock;</text></paragraph><paragraph id="H58E18CF25F5F43818FDAE055BBFFBABF"><enum>(3)</enum><text>to encourage effective action to prevent childhood lead poisoning by establishing a workable framework for lead-based pipe and tap hazard evaluation and reduction and by ending the current confusion over reasonable standards of care;</text></paragraph><paragraph id="H0CE74BC8DE1046D5BC48D21F92E8E7CE"><enum>(4)</enum><text>to ensure and implement the definitions of lead hazards in section 1417 of the Safe Drinking Water Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300g-6">42 U.S.C. 300g–6</external-xref>) and ensure that the existence of lead-based pipe and taps hazards is taken into account in the development of Federal Government housing policies and in the sale, rental and renovation of homes, and apartments;</text></paragraph><paragraph id="H709BACEAFCBD4078BF5DF156459AF5D6"><enum>(5)</enum><text>to mobilize national resources expeditiously, through a partnership among all levels of government and the private sector, to develop the most promising, cost-effective methods for evaluating and reducing lead-based pipe and tap hazards;</text></paragraph><paragraph id="H42F80E4119F54128878AB55E7D8CA5A1"><enum>(6)</enum><text>to reduce the threat of childhood lead poisoning in housing owned, assisted, or transferred by the Federal Government; and</text></paragraph><paragraph id="HF7B26C0DDFE34EE0A38AAB263CFEEE01"><enum>(7)</enum><text>to educate the public concerning the hazards and sources of lead-based pipes and taps poisoning and steps to reduce and eliminate such hazards.</text></paragraph></section><section id="HBA9C4DABA25741D89B91279FE8F03358"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">For purposes of this Act, the following definitions shall apply:</text><paragraph id="H974E00A9745F40E58330AB3F2243C493"><enum>(1)</enum><header>Abatement</header><text display-inline="yes-display-inline">The term <term>abatement</term> means any set of measures designed to permanently eliminate lead-based pipe hazards in accordance with standards established by appropriate Federal agencies. Such term includes—</text><subparagraph id="H78DD6F855A63485B9E78AA91440C4EF7"><enum>(A)</enum><text>the removal of lead-based pipes and taps;</text></subparagraph><subparagraph id="H9E4F4870C9C64AE1AC41D9B36B17C050"><enum>(B)</enum><text>all preparation, cleanup, disposal, and post-abatement clearance testing activities associated with such measures; and</text></subparagraph><subparagraph commented="no" id="H21601BDA249E487A989BE26B64D89851"><enum>(C)</enum><text>all repair to damages post-abatement.</text></subparagraph></paragraph><paragraph id="H95FACCEC05FE411F9CA8F24A5A55DB05"><enum>(2)</enum><header>Certified contractor</header><text>The term <term>certified contractor</term> means—</text><subparagraph id="H88AC1ECCBE6B4440936C710A8FD0BF57"><enum>(A)</enum><text>a contractor, inspector, or supervisor who has completed a training program certified by the appropriate Federal agency and has met any other requirements for certification or licensure established by such agency or who has been certified by any State through a program which has been found by such Federal agency to be at least as rigorous as the Federal certification program; and</text></subparagraph><subparagraph id="H195CAE1180C64A2594771CC0533A63AE"><enum>(B)</enum><text>workers or designers who have fully met training requirements established by the appropriate Federal agency.</text></subparagraph></paragraph><paragraph id="H613F35B731BC4A43A6C2FDA1BB2818A2"><enum>(3)</enum><header>Contract for the purchase and sale of residential real property</header><text>The term <term>contract for the purchase and sale of residential real property</term> means any contract or agreement in which one party agrees to purchase an interest in real property on which there is situated or more residential dwellings used or occupied, or intended to be used or occupied, in whole or in part, as the home or residence of one or more persons.</text></paragraph><paragraph id="HFE3AE85644DF476ABD22DE7794C6A7D6"><enum>(4)</enum><header>Evaluation</header><text>The term <term>evaluation</term> means risk assessment, inspection, or risk assessment and inspection.</text></paragraph><paragraph id="HC70296F59ED84708BD1B75C2F93B9DD2"><enum>(5)</enum><header>Federally assisted housing</header><text>The term <term>federally assisted housing</term> means residential dwellings receiving project-based assistance under programs including—</text><subparagraph id="H3845F09681F84BB9A71F75A595CC3BF3"><enum>(A)</enum><text>section 221(d)(3) or 236 of the National Housing Act (<external-xref legal-doc="usc" parsable-cite="usc/12/1715l">12 U.S.C. 1715l(d)(3)</external-xref>; 1715z–1);</text></subparagraph><subparagraph id="HE6780CA28D18412B9C9E2DBE840A186C"><enum>(B)</enum><text>section 101 of the Housing and Urban Development Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/12/1701s">12 U.S.C. 1701s</external-xref>);</text></subparagraph><subparagraph id="H167EDB5D7E2A454BAA4995A94D8A2CB6"><enum>(C)</enum><text>section 8 of the United States Housing Act of 1937 (<external-xref legal-doc="usc" parsable-cite="usc/42/1437f">42 U.S.C. 1437f</external-xref>); and</text></subparagraph><subparagraph id="H784708DD0CF540CFBE6DBED29A5B4C05"><enum>(D)</enum><text>sections 502(a), 504, 514, 515, 516, and 533 of the Housing Act of 1949 (<external-xref legal-doc="usc" parsable-cite="usc/42/1472">42 U.S.C. 1472(a)</external-xref>; 1474; 1484; 1485; 1486; 1490m).</text></subparagraph></paragraph><paragraph id="H0AC35AEED5F548E998EE5522B85A0ED1"><enum>(6)</enum><header>Federally owned housing</header><text>The term <term>federally owned housing</term> means residential dwellings owned or managed by a Federal agency, or for which a Federal agency is a trustee or conservator. For the purpose of this paragraph, the term <term>Federal agency</term> includes the Department of Housing and Urban Development, the Rural Housing Service of the Department of Agriculture, the Federal Deposit Insurance Corporation, the General Services Administration, the Department of Defense, the Department of Veterans Affairs, the Department of the Interior, the Department of Transportation, and any other Federal agency.</text></paragraph><paragraph id="HABCD96CE16AA4F769FC5563420195CD2"><enum>(7)</enum><header>Federally supported work</header><text display-inline="yes-display-inline">The term <term>federally supported work</term> means any lead hazard evaluation or reduction activities conducted in federally owned or assisted housing or funded in whole or in part through any financial assistance program of the Department of Housing and Urban Development, the Rural Housing Service of the Department of Agriculture, or the Department of Veterans Affairs.</text></paragraph><paragraph id="H9242D5B0C539433EB0E76506B099E4D3"><enum>(8)</enum><header>Inspection</header><text display-inline="yes-display-inline">The term <term>inspection</term> means an investigation to determine the presence of lead-based pipe or taps as provided in section 141.86 of the regulations of the Environmental Protection Agency (40 C.F.R. 181.46; relating to monitoring requirements for lead and copper in tap water) and the provision of a report explaining the results of the investigation.</text></paragraph><paragraph id="HEC506740D92E46F5873C3C4F0A33C050"><enum>(9)</enum><header>Interim controls</header><text>The term <term>interim controls</term> means a set of measures designed to reduce temporarily human exposure or likely exposure to lead-based pipe hazards, including specialized cleaning, repairs, maintenance, ongoing monitoring of lead-based pipe or potential hazards, and the establishment and operation of management and resident education programs.</text></paragraph><paragraph id="H9790002DCBCF44B4892A2FC109144FD6"><enum>(10)</enum><header>Lead-based pipe</header><text display-inline="yes-display-inline">The term <term>lead-based pipe</term> means any pipe, including fittings, taps, fixtures, solder, and flux that does not satisfy the definition of <term>lead-free</term> established under section 1417 of the Safe Drinking Water Act.</text></paragraph><paragraph id="HCE31DD29B6894F409A1EF90232470B9F"><enum>(11)</enum><header>Lead-based pipe hazards</header><text>The term <term>lead-based pipe hazards</term> means any condition that causes exposure to lead from lead-based pipe that would result in adverse human health effects, as established by the Environmental Protection Agency.</text></paragraph><paragraph id="H2AB743838B81488EBC63B5A7E881BBDA"><enum>(12)</enum><header>Mortgage loan</header><text>The term <term>mortgage loan</term> includes any loan (other than temporary financing such as a construction loan) that—</text><subparagraph id="HFDB8B0B8EB8744C3AE40DE06F7D3C5D6"><enum>(A)</enum><text>is secured by a first lien on any interest in residential real property; and</text></subparagraph><subparagraph id="HC874D5195C2242A3A0C2935321A3032C"><enum>(B)</enum><text>either—</text><clause id="H3B0C3D73483A4C66AFEB1471483DB9B6"><enum>(i)</enum><text display-inline="yes-display-inline">is insured, guaranteed, made, or assisted by the Department of Housing and Urban Development, the Department of Veterans Affairs, or the Rural Housing Service of the Department of Agriculture, or by any other agency of the Federal Government; or</text></clause><clause id="H0DD65FD18A19444FB51195D5A6AB9C27"><enum>(ii)</enum><text>is intended to be sold by each originating mortgage institution to any federally chartered secondary mortgage market institution.</text></clause></subparagraph></paragraph><paragraph id="H0F59B30D52A249F7983961E769A1FD7B"><enum>(13)</enum><header>Originating mortgage institution</header><text>The term <term>originating mortgage institution</term> means a lender that provides mortgage loans.</text></paragraph><paragraph id="H85277E246C7E4403BD8502927B697ED8"><enum>(14)</enum><header>Priority housing</header><text>The term <term>priority housing</term> means housing that qualifies as affordable housing under section 215 of the Cranston-Gonzalez National Affordable Housing Act (<external-xref legal-doc="usc" parsable-cite="usc/42/12745">42 U.S.C. 12745</external-xref>), including housing that receives assistance under subsection (b) or (o) of section 8 of the United States Housing Act of 1937 (<external-xref legal-doc="usc" parsable-cite="usc/42/1437f">42 U.S.C. 1437f</external-xref>).</text></paragraph><paragraph id="H798ED13E80D44CFE8A870CB2984EC765"><enum>(15)</enum><header>Public housing</header><text>The term <term>public housing</term> has the meaning given such term in section 3(b) of the United States Housing Act of 1937 (<external-xref legal-doc="usc" parsable-cite="usc/42/1437a">42 U.S.C. 1437a(b)</external-xref>).</text></paragraph><paragraph id="H21020369D5844FD18522A5B1CBD2EC0E"><enum>(16)</enum><header>Reduction</header><text>The term <term>reduction</term> means measures designed to reduce or eliminate human exposure to lead-based pipe hazards through methods including interim controls and abatement.</text></paragraph><paragraph id="HE0CFFEE089FA4BADBEC866B4498FD80C"><enum>(17)</enum><header>Residential dwelling</header><text>The term <term>residential dwelling</term> means—</text><subparagraph id="HE5C6A2E4D1C5451694DCF3DC8084B4A8"><enum>(A)</enum><text>a single-family dwelling, including attached structures such as porches and stoops; or</text></subparagraph><subparagraph id="HD6320FF5DD694D21968DDA948F03100F"><enum>(B)</enum><text>a single-family dwelling unit in a structure that contains more than 1 separate residential dwelling unit, in which each such unit is used or occupied, or intended to be used or occupied, in whole or in part, as the home or residence of one or more persons.</text></subparagraph></paragraph><paragraph id="H0A7989D3C42843CA8CD100E26608E72D"><enum>(18)</enum><header>Residential real property</header><text>The term <term>residential real property</term> means real property on which there is situated one or more residential dwellings used or occupied, or intended to be used or occupied, in whole or in part, as the home or residence of one or more persons.</text></paragraph><paragraph id="HBB30586DF15E46AD9D2108EBA7A5F344"><enum>(19)</enum><header>Risk assessment</header><text>The term <term>risk assessment</term> means an on-site investigation to determine and report the existence, nature, severity, and location of lead-based pipe hazards in residential dwellings, including—</text><subparagraph id="H820FFB99D21944949105EB82572261AD"><enum>(A)</enum><text>information gathering regarding the age and history of the housing and occupancy by children under age 6;</text></subparagraph><subparagraph id="H19B6C252FF9049ED990716CBC4175D00"><enum>(B)</enum><text>visual inspection;</text></subparagraph><subparagraph id="HC7056218D30D47CD8DF9179207A64483"><enum>(C)</enum><text>other activities as may be appropriate; and</text></subparagraph><subparagraph id="H8DDA5E5C39454A888CADD970401F90CB"><enum>(D)</enum><text>provision of a report explaining the results of the investigation.</text></subparagraph></paragraph><paragraph id="HDA4C891479B64799ACBA0212FEA42D3B"><enum>(20)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Housing and Urban Development.</text></paragraph></section><title id="HAFF6228A59BD470EA8EEDE37FF3ED66D"><enum>I</enum><header>Lead-Based Pipe Hazard Reduction</header><section id="HAE7CB6FC43D246BEA9E389E5F0128C3B"><enum>101.</enum><header>Grants for lead-based pipe hazard reduction in housing</header><subsection id="HF852A1116A3A45F7A135D9BBACBA11DE"><enum>(a)</enum><header>General authority</header><text display-inline="yes-display-inline">The Secretary of Housing and Urban Development is authorized to provide grants to eligible applicants to evaluate and reduce lead-based pipes hazards in priority housing that is not federally assisted housing, federally owned housing, or public housing, in accordance with the provisions of this section.</text></subsection><subsection id="H6FDB26A1D64C40648C4B8D880B018D6B"><enum>(b)</enum><header>Eligible applicants</header><text>A State or unit of local government that has an approved comprehensive housing affordability strategy under section 105 of the Cranston-Gonzalez National Affordable Housing Act (<external-xref legal-doc="usc" parsable-cite="usc/42/12705">42 U.S.C. 12705</external-xref>) is eligible to apply for a grant under this section.</text></subsection><subsection id="H37F7AF74B289429796871BE667B5D369"><enum>(c)</enum><header>Form of application</header><text>To receive a grant under this section, a State or unit of local government shall submit an application in such form and in such manner as the Secretary shall prescribe. An application shall contain—</text><paragraph id="H54863AC2A2B1434AA15E01066D913AF2"><enum>(1)</enum><text>a copy of that portion of an applicant's comprehensive housing affordability strategy required by section 105(b)(16) of the Cranston-Gonzalez National Affordable Housing Act;</text></paragraph><paragraph id="HAE3E704E1A9B46C693B125EC1B9CB64B"><enum>(2)</enum><text>a statement of the amount of assistance the applicant seeks under this section;</text></paragraph><paragraph id="H4D559742A7E2402DBDF87B6D42E5798C"><enum>(3)</enum><text>a description of the planned activities to be undertaken with grants under this section, including an estimate of the amount to be allocated for each activity;</text></paragraph><paragraph id="HC7B0262FD0074165912C574A819A8DEE"><enum>(4)</enum><text>a description of the forms of financial assistance to owners and occupants of priority housing that will be provided through grants under this section; and</text></paragraph><paragraph id="H6267180E16434AE3BB30C474395BB29A"><enum>(5)</enum><text>such assurances as the Secretary may require regarding the applicant's capacity to carry out the activities.</text></paragraph></subsection><subsection id="H9A9CFC4AE0634ACE8323C4379A9FB5F9"><enum>(d)</enum><header>Selection criteria</header><text>The Secretary shall award grants under this section on the basis of the merit of the activities proposed to be carried out and on the basis of selection criteria, which shall include—</text><paragraph id="HE9D458FEDD0347B7A6C3A8890B65D2BF"><enum>(1)</enum><text>the extent to which the proposed activities will reduce the risk of lead-based water poisoning to children under the age of 6 who reside in priority housing;</text></paragraph><paragraph id="HE56DFCC003164790B54ABDBF0DF86BE1"><enum>(2)</enum><text>the degree of severity and extent of lead-based pipe hazards in the jurisdiction to be served;</text></paragraph><paragraph id="H9228BE54544C4D5FB2A4FC7F5DCE462A"><enum>(3)</enum><text>the ability of the applicant to leverage State, local, and private funds to supplement the grant under this section;</text></paragraph><paragraph id="H6444AA9B2CC2456396B08C4B3A3BDC70"><enum>(4)</enum><text>the ability of the applicant to carry out the proposed activities; and</text></paragraph><paragraph id="HB43745C3F8E3414AABA08E21FEBD658F"><enum>(5)</enum><text>such other factors as the Secretary determines appropriate to ensure that grants made available under this section are used effectively and to promote the purposes of this Act.</text></paragraph></subsection><subsection id="H4BF40DB1259F4F27B842B7B76CA45210"><enum>(e)</enum><header>Eligible activities</header><text>A grant under this section may be used to—</text><paragraph id="H32F8F63661D7405C9BE68A04FEABBF37"><enum>(1)</enum><text>perform risk assessments and inspections in priority housing;</text></paragraph><paragraph id="H159A65A1CB2A4204B3548520B5CDCBCF"><enum>(2)</enum><text>provide for the interim control of lead-based pipe hazards in priority housing;</text></paragraph><paragraph id="HA8D7B51AB9644059BA52760D93791E91"><enum>(3)</enum><text>provide for the abatement of lead-based pipe hazards in priority housing;</text></paragraph><paragraph id="H8E3D0034C14C4FDEA5E05DA0B04D37A1"><enum>(4)</enum><text>provide for the additional cost of reducing lead-based pipe hazards in units undergoing renovation funded by other sources;</text></paragraph><paragraph id="H2A934FFD91504A5DAE3DECC7018C81F4"><enum>(5)</enum><text>ensure that risk assessments, inspections, and abatements are carried out by certified contractors monitor the blood-lead levels of workers involved in lead hazard reduction activities funded under this section;</text></paragraph><paragraph id="H82E887EA19924704A5F8694725C309C9"><enum>(6)</enum><text>assist in the temporary relocation of families forced to vacate priority housing while lead-based pipe hazard reduction measures are being conducted;</text></paragraph><paragraph id="H8B530A7FBE1F4F71973A11698483D41F"><enum>(7)</enum><text>educate the public on the nature and causes of lead poisoning and measures to reduce exposure to lead, including exposure due to residential lead-based pipe hazards;</text></paragraph><paragraph id="H90EE915DC38C4373908C77A120EC67B9"><enum>(8)</enum><text>test the blood-lead levels of children under the age of 6 residing in priority housing after lead-based pipe hazard reduction activity has been conducted, to assure that such activity does not cause excessive exposures to lead; and</text></paragraph><paragraph id="HCF587A7D1B6D4DE791931D56092A99C3"><enum>(9)</enum><text>carry out such other activities that the Secretary determines appropriate to promote the purposes of this Act.</text></paragraph></subsection><subsection id="HE9B91B165FF74B40A09AB9E53C494AED"><enum>(f)</enum><header>Forms of assistance</header><text>A recipient of a grant under this section may provide the services described in this section through a variety of programs, including grants, loans, equity investments, revolving loan funds, loan funds, loan guarantees, interest write-downs, and other forms of assistance approved by the Secretary.</text></subsection><subsection id="H517000F338E04729816F8CAA002CF766"><enum>(g)</enum><header>Technical assistance and capacity buildings</header><paragraph id="H02F3A3B265FD469DB01DCCE14FEC6F29"><enum>(1)</enum><header>In general</header><text>The Secretary shall develop the capacity of eligible applicants to carry out the requirements of section 105(b)(18) of the Cranston-Gonzalez National Affordable Housing Act and to carry out activities under this section. In fiscal years 2022 and 2023, the Secretary may make grants of up to $200,000 for the purpose of establishing State training, certification, or accreditation programs that meet the requirements of section 201 of this Act (relating to lead-based pipe activities training and certification).</text></paragraph><paragraph id="HA27D7543D58D438699A5AB6381865943"><enum>(2)</enum><header>Set-aside</header><text>Of the total amount approved in appropriation Acts under section 301, there shall be set aside to carry out this subsection $3,000,000 for each of fiscal years 2022 through 2031.</text></paragraph></subsection><subsection id="H69E206DA7258449E84B734E9544952B4"><enum>(h)</enum><header>Matching requirement</header><text>The recipient of a grant under this section shall make contributions toward the cost of activities that receive assistance under this section in an amount not less than 10 percent of the total grant amount under this section.</text></subsection><subsection id="HC9129FCE64DB44A08E33FCB62893D4CC"><enum>(i)</enum><header>Prohibition of substitution of funds</header><text>Grants under this section may not be used to replace other amounts made available or designated by State or local governments for use for the purposes under this title.</text></subsection><subsection id="H3C2EA967808042E3921D721269D072F5"><enum>(j)</enum><header>Limitation on use</header><text>A recipient of a grant under this section shall ensure that not more than 10 percent of the grant will be used for administrative expenses associated with the activities funded by the grant.</text></subsection><subsection id="H79F0646139E1453090E5EAA5E03F748F"><enum>(k)</enum><header>Financial records</header><text>A recipient of a grant under this section shall maintain and provide the Secretary with financial records sufficient, in the determination of the Secretary, to ensure proper accounting and disbursing of amounts received from a grant under this section.</text></subsection><subsection id="HADE349A4C5BD4398BD70A5EBE035AAFE"><enum>(l)</enum><header>Report</header><text>A recipient of a grant under this section shall submit to the Secretary, for any fiscal year in which the recipient expends grant funds under this section, a report that—</text><paragraph id="H3229796C4BA647E59121BEBA979FC718"><enum>(1)</enum><text>describes the use of the amounts received;</text></paragraph><paragraph id="H0F3CF7B71E0A43579AFB9E0930370B77"><enum>(2)</enum><text>states the number of risk assessments and the number of inspections conducted in residential dwellings;</text></paragraph><paragraph id="H644D64C4DD04455D85F3F5692ABEFA2B"><enum>(3)</enum><text>states the number of residential dwellings in which lead-based pipe hazards have been reduced through interim controls;</text></paragraph><paragraph id="HF1F1A39396444B1D9D85BDE91A89FCD1"><enum>(4)</enum><text>states the number of residential dwellings in which lead-based pipe hazards have been abated; and</text></paragraph><paragraph id="HD3D85D32E7B8470B96BB4BB170547E3A"><enum>(5)</enum><text>provides any other information that the Secretary determines to be appropriate.</text></paragraph></subsection><subsection display-inline="no-display-inline" id="HA777FB0CEF76467A83C664117C66842A"><enum>(m)</enum><header>Notice of funding availability</header><text>The Secretary shall publish a Notice of Funding Availability not later than 120 days after funds are appropriated to carry out this section.</text></subsection></section><section id="HB53D5FF925594B8DB747F8A0849CCC3F"><enum>102.</enum><header>Evaluation and reduction of lead-based pipe hazards in federally assisted housing</header><subsection id="H264666A31A394C30B840CDF8C3ED1BF4"><enum>(a)</enum><header>Requirements for federally assisted housing</header><text display-inline="yes-display-inline">The Secretary shall provide for appropriate measures and procedures to conduct risk assessments, inspections, interim controls, and abatement of lead-based pipe hazards in federally assisted housing. At a minimum, such procedures shall require—</text><paragraph id="H6270CD1CBCA44203B72879FB4108DD2E"><enum>(1)</enum><text>the provision of lead hazard information pamphlets, developed pursuant to section 205 of this Act for purchasers and tenants of such housing;</text></paragraph><paragraph id="H255A29BBB2574824B9390DD789BE3232"><enum>(2)</enum><text>periodic risk assessments and interim controls for such housing in accordance with a schedule determined by the Secretary, which shall provide for the initial risk assessment to be performed—</text><subparagraph id="H49DB5FC7CB2C4C0C919BA3E3F479AFF3"><enum>(A)</enum><text>in not less than 50 percent of the dwelling units of such housing within 5 years after the date of the enactment of this Act; and</text></subparagraph><subparagraph id="H56D77984412B4EF683FE5CA2417B1C2F"><enum>(B)</enum><text>in the remainder of the dwelling units of such housing within 10 years after such date of enactment;</text></subparagraph></paragraph><paragraph id="HD03655D7A71B49B294E0EB4C3A4A0D6F"><enum>(3)</enum><text>inspection for the presence of lead-based pipe in such housing prior to federally funded renovation or rehabilitation;</text></paragraph><paragraph id="HC591D68BD6424D6E85D1AACE8D280C1B"><enum>(4)</enum><text>reduction of lead-based pipe hazards in such housing in the course of rehabilitation projects receiving less than $25,000 per unit in Federal funds;</text></paragraph><paragraph id="H40958DF70FC64D0992D75CD590B67C2B"><enum>(5)</enum><text>abatement of lead-based pipe hazards in such housing in the course of substantial rehabilitation projects receiving more than $25,000 per unit in Federal funds;</text></paragraph><paragraph id="H5C21355CBEAF4477810BE56171A87FE7"><enum>(6)</enum><text>where risk assessment, inspection, or reduction activities have been undertaken in such housing, the provision of notice to occupants describing the nature and scope of such activities and the actual risk assessment or inspection reports (including available information on the location of any remaining lead-based pipe and lead-based pipe hazards); and</text></paragraph><paragraph id="H53F6F67496934DBCBAE7E3CE7B5177F5"><enum>(7)</enum><text>such other measures for such housing as the Secretary deems appropriate.</text></paragraph></subsection><subsection commented="no" id="H80A1E16533A54900955A30EDDC514C48"><enum>(b)</enum><header>Public housing</header><text>Section 9(d)(1) of the United States Housing Act of 1937 (<external-xref legal-doc="usc" parsable-cite="usc/42/1437g">42 U.S.C. 1437g(d)(1)</external-xref>) is amended—</text><paragraph id="H38FD129633434358AB8FB250C7D41359"><enum>(1)</enum><text>in subparagraph (K), by striking <quote>and</quote> at the end;</text></paragraph><paragraph id="H87276683E162486BA4AE89D48B2A7945"><enum>(2)</enum><text>in subparagraph (L), by striking the period at the end and inserting <quote>; and</quote>; and</text></paragraph><paragraph id="HD998A5CF2DEB48F48884AAC19EC11BF5"><enum>(3)</enum><text>by adding at the end the following new subparagraph:</text><quoted-block display-inline="no-display-inline" id="H255EC97C0B974DB891A316270E5536D8" style="OLC"><subparagraph id="H448D4AC4FEB24B93B31A8EC93E8B96B9"><enum>(M)</enum><text display-inline="yes-display-inline">lead-based pipe hazard evaluation and reduction, as defined in section 3 of the <short-title>Grants for Eliminating the Toxic Hazard of Environmental Lead in Our Towns Act of 2021</short-title>.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="HEC991182F7E041D5AC14A05392EB7613"><enum>(c)</enum><header> HOME Investment Partnerships</header><text display-inline="yes-display-inline">Section 212(a) of the Cranston-Gonzalez National Affordable Housing Act (<external-xref legal-doc="usc" parsable-cite="usc/42/12742">42 U.S.C. 12742(a)</external-xref>) is amended—</text><paragraph id="H49F8A5AD2A424C0EB362199BBBC86866"><enum>(1)</enum><text>by redesignating paragraph (5) (relating to lead-based paint hazards) as paragraph (4); and</text></paragraph><paragraph id="HE1E5AD2A0F56478689E53CC29AB16859"><enum>(2)</enum><text>by adding at the end the following new paragraph:</text><quoted-block display-inline="no-display-inline" id="HBDC6E965E947404498F1129A8D3629ED" style="OLC"><paragraph id="H4CB4803B7CEA4DD79A81A2936651B7A7"><enum>(5)</enum><header>Lead-based pipe hazards</header><text display-inline="yes-display-inline">A participating jurisdiction may use funds provided under this subtitle for the evaluation and reduction of lead-based pipe hazards.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H7E3BAF8451194C02B4F98797EE2D9148"><enum>(d)</enum><header>Community development block grants</header><text>Section 105(a) of the Housing and Community Development Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/42/5305">42 U.S.C. 5305(a)</external-xref>) is amended—</text><paragraph id="HA04A222550174FF286CE6E7E0F5ADB16"><enum>(1)</enum><text>in paragraph (24)(D), by striking <quote>and</quote> at the end;</text></paragraph><paragraph id="H94A16969ACB8408A8BA1F397B36C32BD"><enum>(2)</enum><text>in paragraph (25), by striking the period at the end and inserting <quote>; and</text></subclause><subclause id="H918CE677C8724EE3B4A4A0B187C19CF7"><enum>(II)</enum><text>by striking the period at the end and inserting <quote>and</quote>; and</text></subclause></clause><clause id="HF9A31C8E31AF428EA6659F895A08A993"><enum>(iv)</enum><text>by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="HCBE714A7760A4074956D53CDB78D2B7D" style="OLC"><paragraph id="HD3D482D9DEA546B08DED3EF9866566E1"><enum>(5)</enum><text display-inline="yes-display-inline">the terms <term>evaluation</term>, <term>reduction</term>, and <term>lead-based pipe hazard</term>, when used with respect to lead-based pipe hazards, have the meaning given such term in section 3 of the <short-title>Grants for Eliminating the Toxic Hazard of Environmental Lead in Our Towns Act of 2021</short-title>.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></clause></subparagraph></paragraph><paragraph id="H589B8EA915BA48BDBED9E05CAD7F471E"><enum>(2)</enum><header>Rehabilitation loans</header><text>The last sentence of section 203(k)(2)(B) of the National Housing Act (<external-xref legal-doc="usc" parsable-cite="usc/12/1709">12 U.S.C. 1709(k)(2)(B)</external-xref>) is amended by inserting before the period at the end the following: <quote>, and measures to evaluate and reduce lead-based pipe hazards, as such terms are defined in section 3 of the <short-title>Grants for Eliminating the Toxic Hazard of Environmental Lead in Our Towns Act of 2021</short-title></quote>.</text></paragraph></subsection><subsection id="H944074F1A1CB4EBC99EDA0EAF38E095E"><enum>(j)</enum><header>FHA insurance for mortgages for multifamily housing</header><text>Section 221(d)(4)(iv) of the National Housing Act (<external-xref legal-doc="usc" parsable-cite="usc/12/17151">12 U.S.C. 17151(d)(4)(iv)</external-xref>) is amended by inserting before the closing parentheses the following: <quote>, and the cost of evaluating and reducing lead-based pipe hazards, as such terms are defined in section 3 of the <short-title>Grants for Eliminating the Toxic Hazard of Environmental Lead in Our Towns Act of 2021</short-title></quote>.</text></subsection><subsection id="H75C21D993EB34FFAA12A22E62F5EC3B7"><enum>(k)</enum><header>Rural housing</header><text display-inline="yes-display-inline">Section 501(a)(5) of the Housing Act of 1949 (<external-xref legal-doc="usc" parsable-cite="usc/42/1471">42 U.S.C. 1471</external-xref>) is amended by inserting before the period at the end the following: <quote>, and measures to evaluate and reduce lead-based pipe hazards, as such terms are defined in section 3 of the <short-title>Grants for Eliminating the Toxic Hazard of Environmental Lead in Our Towns Act of 2021</short-title></quote>.</text></subsection></section><section id="HAD3B1ED395C94B1D9E61D6F1E9B69569"><enum>103.</enum><header>Comprehensive housing affordability strategies</header><text display-inline="no-display-inline">Section 105 of the Cranston-Gonzalez National Affordable Housing Act (<external-xref legal-doc="usc" parsable-cite="usc/42/12705">42 U.S.C. 12705</external-xref>) is amended—</text><paragraph id="HC9D7E36887694A9A8927486FD0C3D1D5"><enum>(1)</enum><text>in subsection (b)—</text><subparagraph id="H6A396C4CDD7B4684928CEA0B1CFB8577"><enum>(A)</enum><text>by redesignating paragraphs (18), (19), and (20) as paragraphs (19), (20), and (21), respectively; and</text></subparagraph><subparagraph id="HAE1CF0ADB05D4240A95002639A42A75F"><enum>(B)</enum><text>by inserting after paragraph (17) the following new paragraph:</text><quoted-block display-inline="no-display-inline" id="H6A7F9BE160244E648D1622C3D528D4BD" style="OLC"><paragraph id="HD484F8E90D304A32BA93CAC1F38F5EFE"><enum>(18)</enum><text display-inline="yes-display-inline">estimate the number of housing units within the jurisdiction that are occupied by low-income families or very low-income families and that contain lead-based pipe hazards, as defined in section 3 of the <short-title>Grants for Eliminating the Toxic Hazard of Environmental Lead in Our Towns Act of 2021</short-title>, outline the actions proposed or being taken to evaluate and reduce lead-based pipe hazards, and describe how lead-based pipe hazard reduction will be integrated into housing policies and programs;</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H6B6DDB1C27504429AEC23EFDE8862C4E"><enum>(2)</enum><text>in subsection (e)—</text><subparagraph id="H286B035E1F1C4AF1B89FC773946E4DCC"><enum>(A)</enum><text display-inline="yes-display-inline">in paragraph (2), by striking <quote>paragraph (16)</quote> and inserting <quote>paragraph (17)</quote>; and</text></subparagraph><subparagraph id="H16082A9F4D754BD5BD1D093D4DF1E83D"><enum>(B)</enum><text>by adding at the end the following new paragraph:</text><quoted-block display-inline="no-display-inline" id="H2E89684550C54D86BB973B39AB39E0F3" style="OLC"><paragraph id="H546FEDFA2E764BE7A119F45CCBA2F093"><enum>(3)</enum><header>Lead-based pipe hazards</header><text display-inline="yes-display-inline">When preparing the portion of a housing strategy required by subsection (b)(18), a jurisdiction shall consult with State or local health and child welfare agencies and examine existing data related to lead-based pipe hazards and poisonings, including health department data on the addresses of housing units in which children have been identified as lead poisoned.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></section><section id="H424383219A4842ACAD2F26A2410A4689"><enum>104.</enum><header>Task force on lead-based pipe hazard reduction and financing</header><subsection id="HCE6C2E446CBB4701AF15F557D638CA75"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary, in consultation with the Administrator of the Environmental Protection Agency shall establish a task force to make recommendations on expanding resources and efforts to evaluate and reduce lead-based pipe hazards in private housing.</text></subsection><subsection id="H8F74F8502E1E4B1BB5FAA7C2F3E81366"><enum>(b)</enum><header>Membership</header><text>The task force shall include individuals representing the Department of Housing and Urban Development, the Rural Housing Service of the Department of Agriculture, the Department of Veterans Affairs, the Federal Home Loan Mortgage Corporation, the Federal National Mortgage Association, the Environmental Protection Agency, employee or organizations in the building and construction trades industry, landlords, tenants, primary lending institutions, private mortgage insurers, single family and multifamily real estate interests, nonprofit housing developers, property liability insurers, public housing agencies, low-income housing advocacy organizations, national, State and local lead-poisoning prevention advocates and experts, and community-based organizations located in areas with substantial rental housing.</text></subsection><subsection id="H18311803353040B09CD948834AF5E83F"><enum>(c)</enum><header>Responsibilities</header><text>The task force shall make recommendations to the Secretary and the Administrator of the Environmental Protection Agency concerning—</text><paragraph id="H445D832160D7481EBF128B39C15B7EFA"><enum>(1)</enum><text>incorporating the need to finance lead-based pipe hazard reduction into underwriting standards;</text></paragraph><paragraph id="H8B1F1A20FA654803A26B34D610C75258"><enum>(2)</enum><text>developing new loan products and procedures for financing lead-based pipe hazard evaluation and reduction activities;</text></paragraph><paragraph id="HE3F73C704FAF43D087C2A213788FF5F3"><enum>(3)</enum><text>adjusting appraisal guidelines to address lead safety;</text></paragraph><paragraph id="HC62F53DFCAEB4435970E4719259D42C7"><enum>(4)</enum><text>incorporating risk assessments or inspections for lead-based pipe as a routine procedure in the origination of new residential mortgages;</text></paragraph><paragraph id="HB456A95B2FCD4BCF867DBFC366A56CC6"><enum>(5)</enum><text>revising guidelines, regulations, and educational pamphlets issued by the Department of Housing and Urban Development and other Federal agencies relating to lead-based pipe poisoning prevention;</text></paragraph><paragraph id="HAC295DFE195541AEA359C032BB9360F1"><enum>(6)</enum><text>reducing the current uncertainties of liability related to lead-based pipe in rental housing; clarifying standards of care for landlords and lenders, and exploring the <quote>safe harbor</quote> concept;</text></paragraph><paragraph id="H94ADD84B49F24F7FA94E66DB684F58E8"><enum>(7)</enum><text>increasing the availability of liability insurance for owners of rental housing and certified contractors and establishing alternative systems to compensate victims of lead-based pipe poisoning; and</text></paragraph><paragraph id="H40D2E90CAA014B40A283DF9722C6AFE4"><enum>(8)</enum><text>evaluating the utility and appropriateness of requiring risk assessments or inspections and notification to prospective leases of rental housing.</text></paragraph></subsection><subsection id="H9451681FCEB841419E45EE0690499D26"><enum>(d)</enum><header>Compensation</header><text>The members of the task force shall not receive Federal compensation for their participation.</text></subsection></section><section id="HC48293A2B45D4B918B26F7158865B198"><enum>105.</enum><header>National consultation on lead-based pipe hazard reduction</header><text display-inline="no-display-inline">In carrying out this Act, the Secretary shall consult on an ongoing basis with the Administrator of the Environmental Protection Agency, the Director of the Centers for Disease Control, other Federal agencies concerned with lead poisoning prevention, and the task force established pursuant to section 104.</text></section><section id="HAFDD2405B08B4AF593912B6919FC4629"><enum>106.</enum><header>Guidelines for lead-based pipe hazard evaluation and reduction activities</header><text display-inline="no-display-inline">Not later than 12 months after the date of the enactment of this Act, the Secretary, in consultation with the Administrator of the Environmental Protection Agency, the Secretary of Labor, and the Secretary of Health and Human Services (acting through the Director of the Centers for Disease Control), shall issue guidelines for the conduct of federally supported work involving risk assessments, regulations, inspections, interim controls, and abatement of lead-based pipe hazards. Such guidelines shall be based upon criteria that measure the condition of the housing (and the presence of children under age 6 for the purposes of risk assessments) and shall not be based upon criteria that measure the health of the residents of the housing.</text></section><section id="H4B8D1402E2AB49D6AD088C21EE7F40A4"><enum>107.</enum><header>Disclosure of information concerning lead upon transfer of residential property</header><subsection id="H899E218C878B4CCD810EAAE56BD2DB04"><enum>(a)</enum><header>Disclosure in purchase and sale or lease of housing</header><paragraph id="H9308A71004DE4DEDB617DD75C935A35A"><enum>(1)</enum><header>Lead-based pipe hazards</header><text display-inline="yes-display-inline">Not later than 2 years after the date of the enactment of this Act, the Secretary and the Administrator of the Environmental Protection Agency shall promulgate regulations under this section for the disclosure of lead-based pipe hazards in housing that is offered for sale or lease. The regulations shall require that, before the purchaser or lessee is obligated under any contract to purchase or lease the housing, the seller or lessor shall—</text><subparagraph id="H182339BAD61744EBBB0909B514859B43"><enum>(A)</enum><text>provide the purchaser or lessee with a lead hazard information pamphlet, as prescribed by the Administrator of the Environmental Protection Agency under section 406 of the Toxic Substances Control Act;</text></subparagraph><subparagraph id="H3E45DA917BBE40A2B1FC8049D51D206C"><enum>(B)</enum><text>disclose to the purchaser or lessee the presence of any known lead-based pipe, or any known lead-based pipe hazards, in such housing and provide to the purchaser or lessee a lead hazard evaluation report available to the seller or lessor; and</text></subparagraph><subparagraph id="H182694447BF74FC69BE613E02F9D0B63"><enum>(C)</enum><text>permit the purchaser a 10-day period (unless the parties mutually agree upon a different rid of time) to conduct a risk assessment or inspection or the presence of lead-based pipe hazards.</text></subparagraph></paragraph><paragraph id="H67C902FA5E8F48BDACEA3F708C65DE64"><enum>(2)</enum><header>Contract for purchase and sale</header><text>The regulations promulgated under this section shall provide that every contract for the purchase and sale of any interest in housing shall contain a Lead Warning Statement and a statement signed by the purchaser that the purchaser has—</text><subparagraph id="HA20ECDBA3A4C42FB996970B33D338C06"><enum>(A)</enum><text>read the Lead Warning Statement and understands its contents;</text></subparagraph><subparagraph id="H259B9AE9DE024536BB7B7291D5E5B5F2"><enum>(B)</enum><text>received a lead hazard information pamphlet; and</text></subparagraph><subparagraph id="HB7F0320937194B688FB35408E1CFE334"><enum>(C)</enum><text>had a 10-day opportunity (unless the parties mutually agreed upon a different period of time) before becoming obligated under the contract to purchase the housing to conduct a risk assessment or inspection for the presence of lead-based pipe hazards.</text></subparagraph></paragraph><paragraph id="H8ACA65D2B1C14F6AAE9853314FFFEC9E"><enum>(3)</enum><header>Contents of lead warning statement</header><text>The Lead Warning Statement referred to in paragraph (2) shall contain the following text printed in large type on a separate sheet of paper attached to the contract: <quote>Every purchaser of any interest in residential real property on which a residential dwelling was built prior to 1986 is notified that such property may present exposure to lead from lead-based pipes that may place young children at risk of developing lead poisoning. Lead poisoning in young children may produce permanent neurological damage, including learning disabilities, reduced intelligence quotient, behavioral problems, and impaired memory. Lead poisoning also poses a particular risk to pregnant women. The seller interest in residential real property is required to provide the buyer with any information on lead-based pipe hazards from risk assessment or inspections in the seller's possession and notify the buyer of any known lead-based pipe hazards. A risk assessment or inspection for possible lead-based pipe hazards is recommended prior to purchase.</quote>.</text></paragraph><paragraph id="HD80D5A592FAB4955932A6D9ADA99C263"><enum>(4)</enum><header>Compliance assurance</header><text>Whenever a seller or lessor has entered into a contract with an agent for the purpose of selling or leasing a unit of housing, the regulations promulgated under this section shall require the agent, on behalf of the seller or lessor, to ensure compliance with the requirements of this section.</text></paragraph></subsection><subsection id="HA39144F6543447589B916687EC9C1ED7"><enum>(b)</enum><header>Promulgation</header><text>A suit may be brought against the Secretary of Housing and Urban Development and the Administrator of the Environmental Protection Agency under section 20 of the Toxic Substances Control Act to compel promulgation of the regulations required under this section and the Federal district court shall have jurisdiction to order such promulgation.</text></subsection><subsection id="HCC01B1C7921A4DC7892C137FC260DBD0"><enum>(c)</enum><header>Penalties for violations</header><paragraph id="H600277764A22419C96AC9D87B9FA07FA"><enum>(1)</enum><header>Monetary penalty</header><text display-inline="yes-display-inline">Any person who knowingly violates any provision of this section shall be subject to civil money penalties in accordance with the provisions of section 102 of the Department of Housing and Urban Development Reform Act of 1989 (<external-xref legal-doc="usc" parsable-cite="usc/42/3545">42 U.S.C. 3545</external-xref>).</text></paragraph><paragraph id="HD1FAFE07D30345CB872B711AAC49DB96"><enum>(2)</enum><header>Action by Secretary</header><text>The Secretary is authorized to take such lawful action as may be necessary to enjoin any violation of this section.</text></paragraph><paragraph id="H4140AD7174354565ACC673C65E45C5FC"><enum>(3)</enum><header>Civil liability</header><text>Any person who knowingly violates the provisions of this section shall be jointly and severally liable to the purchaser or lessee in an amount equal to 3 times the amount of damages incurred by such individual.</text></paragraph><paragraph id="HC9019414AF4547298C19C59F5A2D3893"><enum>(4)</enum><header>Costs</header><text>In any civil action brought for damages, the appropriate court may award court costs to the party commencing such action, together with reasonable attorney fees and any expert witness fees, if that party prevails.</text></paragraph><paragraph id="H201243B4D21542E68C4DE5AF0A94E4C1"><enum>(5)</enum><header>Prohibited act</header><text>It shall be a prohibited act under section 409 of the Toxic Substances Control Act for any person to fail or refuse to comply with a provision of this section or with any rule or order issued under this section. For purposes of enforcing this section under the Toxic Substances Control Act, the penalty for each violation applicable under section 16 of that Act shall not be more than $10,000.</text></paragraph></subsection><subsection id="H3B376739A72743D79771056385088A2D"><enum>(d)</enum><header>Validity of contracts and liens</header><text>Nothing in this section shall affect the validity or enforceability of any sale or contract for the purchase and sale or lease of any interest in residential real property or any loan, loan agreement, mortgage, or lien made or arising in connection with a mortgage loan, nor shall anything in this section create a defect in title.</text></subsection><subsection id="H727986CC4DB24C0C8BBAE20C32AD7853"><enum>(e)</enum><header>Effective date</header><text>The regulations under this section shall take effect 3 years after the date of the enactment of this Act.</text></subsection></section></title><title id="H83CC1F05C30D46E5814A31C8C290778E"><enum>II</enum><header>Lead Exposure Reduction</header><section id="HAD75A12F705C48C9A684E40147441DD5"><enum>201.</enum><header>Lead-based pipe activities training and certification</header><subsection id="H06E612C4FE45436C807CAF236284D3A7"><enum>(a)</enum><header>Regulations</header><paragraph id="H1E47186EBEB5483C925367D625B4FDB5"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 18 months after the date of the enactment of this Act, the Administrator of the Environmental Protection Agency (in this title referred to as the <quote>Administrator</quote>) shall, in consultation with the Secretary of Labor, the Secretary of Housing and Urban Development, and the Secretary of Health and Human Services (acting through the Director of the National Institute for Occupational Safety and Health), promulgate final regulations governing lead-based pipe activities to ensure that individuals engaged in such activities are properly trained; that training programs are accredited; and that contractors are engaged in such activities are certified. Such regulations shall contain standards for performing lead-based pipe activities, taking into account reliability, effectiveness, and safety. Such regulations shall require that all risk assessment, inspection, and abatement activities performed in housing shall be performed by certified contractors.</text></paragraph><paragraph id="HD5EC11376128425F80DE6CA45A770FE1"><enum>(2)</enum><header>Accreditation of training programs</header><text>Final regulations shall contain specific requirements for the accreditation of lead-based pipe activities training programs for workers, supervisors, inspectors and planners, and other individuals involved in lead-based pipe activities, including, but not limited to, each of the following:</text><subparagraph id="H2A59440BEDCC4A06A5C58B9F9026F5AD"><enum>(A)</enum><text>Minimum requirements for the accreditation of training providers.</text></subparagraph><subparagraph id="H484D6EEB119D41A8B7607ED56B72F311"><enum>(B)</enum><text>Minimum training curriculum requirements.</text></subparagraph><subparagraph id="H341BF864A0F74085902006EB400AE540"><enum>(C)</enum><text>Minimum training hour requirements.</text></subparagraph><subparagraph id="H28734BCB07DD41858C7A96F600BD2566"><enum>(D)</enum><text>Minimum hands-on training requirements.</text></subparagraph><subparagraph id="H0359B55B5C784040BB989E82F52F406C"><enum>(E)</enum><text>Minimum trainee competency and proficiency requirements.</text></subparagraph><subparagraph id="HA9DB360692F844F0B3008BAE9DB59388"><enum>(F)</enum><text>Minimum requirements for training program quality control.</text></subparagraph></paragraph><paragraph id="H4BBAFA29F208488B847DF8E4178105AC"><enum>(3)</enum><header>Accreditation and certification fees</header><text>The Administrator (or the State in the case of an authorized State program) shall impose a fee on—</text><subparagraph id="HF40DEF2EA46D4E918D34B0712EC64EC6"><enum>(A)</enum><text>persons operating training programs accredited under this title; and</text></subparagraph><subparagraph id="H7BBB349E9D5D44EE984F121D0E2594E1"><enum>(B)</enum><text>lead-based pipe activities contractors certified in accordance accreditation with paragraph (1).</text></subparagraph><continuation-text continuation-text-level="paragraph">The fees shall be established at such level as is necessary to cover the costs of administering and enforcing the standards and regulations under this section which are applicable to such programs and contractors. The fee shall not be imposed on any State, local government, or nonprofit training program. The Administrator (or the State in the case of an authorized State program) may waive the fee for lead-based pipe activities contractors for the purpose of training their own employees. </continuation-text></paragraph></subsection><subsection id="HC52E012FD3AB4C0BA1BB225981149DF9"><enum>(b)</enum><header> Lead-Based pipe activities</header><text display-inline="yes-display-inline">For purposes of this title, the term <term>lead-based pipe activities</term> means—</text><paragraph id="HA650E41CA7014DB0AE307E1EF8E13374"><enum>(1)</enum><text>in the case of housing, risk assessment, inspection, and abatement; and</text></paragraph><paragraph id="HE0C4EFCAFEEA4CF1835829967D14D0E2"><enum>(2)</enum><text>in the case of any public building constructed before 1986, commercial building, or any other structure, evaluation and abatement of lead-based pipes and lead-based pipe hazards.</text></paragraph></subsection><subsection id="H036BB3DD33FD41F9A41EB710A930F0E5"><enum>(c)</enum><header>Renovation and remodeling</header><paragraph id="HBF26BF1D980446ED88ED1B1B3D12D7E6"><enum>(1)</enum><header>Guidelines</header><text display-inline="yes-display-inline">In order to reduce the risk of exposure to lead in connection with renovation and remodeling of housing, public buildings, and commercial buildings, the Administrator shall, within 18 months after the enactment of this section, promulgate guidelines for the conduct of such renovation and remodeling activities which may create a risk of exposure to dangerous levels of lead. The Administrator shall disseminate such guidelines to persons engaged in such renovation and remodeling through hardware stores, employee organizations, trade groups, State and local agencies, and through other appropriate means.</text></paragraph><paragraph id="H173EB7146B6C4778AC4C5342481D1D6C"><enum>(2)</enum><header>Study of certification</header><text>The Administrator shall conduct a study of the extent to which persons engaged in various types of renovation and remodeling activities in housing, public buildings, and commercial buildings are exposed to lead in the conduct of such activities or disturb lead and create a lead-based pipe hazard on a regular or occasional basis. The Administrator shall complete such study and publish the results thereof within 30 months after the enactment of this section.</text></paragraph><paragraph id="HD6AA6EE1A2784250B2BF283ABEA8A7D9"><enum>(3)</enum><header>Certification determination</header><text>Within 4 years after the enactment of this section, the Administrator shall revise the regulations to apply the regulations to renovation or remodeling activities in housing and commercial buildings that create lead-based pipe hazards. In determining which contractors are engaged in such activities, the Administrator shall utilize the results of the study and consult with the representatives of labor organizations, lead-based pipe activities contractors, persons engaged in remodeling and renovation, experts in lead health effects, and others. If the Administrator determines that a category of contractors engaged in renovation or remodeling does not require certification, the Administrator shall publish an explanation of the basis for that determination.</text></paragraph></subsection></section><section id="H7A9608D7EDAF4E16A61EC07BBD7E276B"><enum>202.</enum><header>Identification of dangerous levels of lead</header><text display-inline="no-display-inline">Within 18 months after the enactment of this Act, the Administrator shall promulgate regulations which shall identify for purposes of this title lead-based pipe hazards.</text></section><section id="H8C2BB1B850FC42D782A5FC8389391DA8"><enum>203.</enum><header>Authorized State programs</header><subsection id="HF46D474E0D034261A160D3CD19EC079C"><enum>(a)</enum><header>Approval</header><text display-inline="yes-display-inline">Any State which seeks to administer and enforce the standards, regulations, or other requirements established may, after notice and opportunity for public hearing, develop and submit to the Administrator an application, in such form as the Administrator shall require, for authorization of such a State program. Any such State may also certify to the Administrator at the time of submitting such program that the State program meets the requirements of paragraphs (1) and (2) of subsection (b). Upon submission of such certification, the State program shall be deemed to be authorized under this section, and shall apply in such State in lieu of the corresponding Federal program as the case may be, until such time as the Administrator disapproves the program or withdraws the authorization.</text></subsection><subsection id="H2ACCF19E4CCE42819BB90E1EFCACB96D"><enum>(b)</enum><header>Approval or disapproval</header><text>Within 180 days following submission of an application, the Administrator shall approve or disapprove the application. The Administrator may approve the application only if after notice and after opportunity for public hearing, the Administrator finds that—</text><paragraph id="HAD0A360DDF714ACB8EF6A865920478A1"><enum>(1)</enum><text>the State program is at least as protective of human health and the environment as the Federal program as the case may be; and</text></paragraph><paragraph id="H79AEBB24FD4447898984567BA37FAEA4"><enum>(2)</enum><text>such State program provides adequate enforcement.</text></paragraph><continuation-text continuation-text-level="subsection">Upon authorization of a date program under this section, it shall be unlawful for any person to violate or fail or refuse to comply with any requirement of such program. </continuation-text></subsection><subsection id="H124DAFB112FB4636B86C18750F6B0D7D"><enum>(c)</enum><header>Withdrawal of authorization</header><text>If a State is not administering and enforcing a program authorized under this section in compliance with standards, regulations, and other requirements of this title, the Administrator shall so notify the State and, if corrective action is not completed within a reasonable time, not to exceed 180 days, the Administrator shall withdraw authorization of such program and establish a Federal program pursuant to this title.</text></subsection><subsection id="HC282E2F041AE476A8320457D6F4AD9D3"><enum>(d)</enum><header>Model State program</header><text>Within 18 months after the enactment of this title, the Administrator shall promulgate a model State program which may be adopted by any State which seeks to administer and enforce a State program under this title. Such model program shall, to the extent practicable, encourage States to utilize existing State and local certification and accreditation programs and procedures. Such program shall encourage reciprocity among the States with respect to the certification.</text></subsection><subsection id="HFF500A8D73E941DD8D22BD7685A4F013"><enum>(e)</enum><header>Other State requirements</header><text>Nothing in this title shall be construed to prohibit any State or political subdivision thereof from imposing any requirements which are more stringent than those imposed by this title.</text></subsection><subsection id="HDDDC9AAE7299462CB82D685DF19B6824"><enum>(f)</enum><header>State and local certification</header><text>The regulations under this title shall, to the extent appropriate, encourage States to seek program authorization and to use existing State and local certification and accreditation procedures, except that a State or local government shall not require more than 1 certification under this section for any lead-based pipe activities contractor to carry out lead-based pipe activities in the State or political subdivision thereof.</text></subsection><subsection id="HC4CB1257F5C945DDA933798FF92C7DF2"><enum>(g)</enum><header>Grants to States</header><text>The Administrator is authorized to make grants to States to develop and carry out authorized State programs under this section. The grants shall be subject to such terms and conditions as the Administrator may establish to further the purposes of this title.</text></subsection><subsection id="H651CBDA35DF64BCE9726B3A3424A80CD"><enum>(h)</enum><header>Enforcement by Administrator</header><text>If a State does not have a State program authorized under this section and in effect by the date which is 2 years after promulgation of the regulations the Administrator shall, by such date, establish a Federal program for such State.</text></subsection></section><section id="H3F6ADABFE093446A85499206948F1015"><enum>204.</enum><header>Lead abatement and measurement</header><subsection id="H2747C770AA1A488486E9A2007FAD9F6C"><enum>(a)</enum><header>Program To promote lead exposure abatement</header><text display-inline="yes-display-inline">The Administrator, in cooperation with other appropriate Federal departments and agencies, shall conduct a comprehensive program to promote safe, effective, and affordable monitoring, detection, and abatement of lead-based pipe and other lead exposure hazards.</text></subsection><subsection id="HD580EE14872F453DADF278D1524C2D5E"><enum>(b)</enum><header>Standards for environmental sampling laboratories</header><paragraph id="H18B8DD1BEB554D1A97F3351FD1CCD5C2"><enum>(1)</enum><header>Minimum performance standards</header><text display-inline="yes-display-inline">The Administrator shall establish protocols, criteria, and minimum performance standards for laboratory analysis of lead in paint pipes, taps, and water. Within 2 years after the enactment of this Act, the Administrator, in consultation with the Secretary of Health and Human Services, shall establish a program to certify laboratories as qualified to test substances for lead content unless the Administrator determines, by the date specified in this paragraph, that effective voluntary accreditation programs are in place and operating on a nationwide basis at the time of such determination. To be certified under such program, a laboratory shall, at a minimum, demonstrate an ability to test substances accurately for lead content.</text></paragraph><paragraph id="H87C81FFDFCF643E9AA1C2E1DB46EDF32"><enum>(2)</enum><header>Public information</header><text>Not later than 24 months after the date of the enactment of this section, and annually thereafter, the Administrator shall publish and make available to the public a list of certified or accredited environmental sampling laboratories.</text></paragraph><paragraph id="H026860D4A28C43C8AA7998C9C697475D"><enum>(3)</enum><header>Certification program</header><text>If the Administrator determines that effective voluntary accreditation programs are in place for environmental sampling laboratories, the Administrator shall review the performance and effectiveness of such programs within 3 years after such determination. If, upon such review, the Administrator determines that the voluntary accreditation programs are not effective in assuring the quality and consistency of laboratory analyses, the Administrator shall, not more than 12 months thereafter, establish a certification program that meets the requirements of paragraph (1).</text></paragraph></subsection><subsection id="H188600C514864258BD88226588994826"><enum>(c)</enum><header>Exposure studies</header><paragraph id="HCC4FA5C202BB4C8EBF068E6E71968774"><enum>(1)</enum><header>Children</header><text display-inline="yes-display-inline">The Secretary of Health and Human Services (in this subsection referred to as the <quote>Secretary</quote>), acting through the Director of the Centers for Disease Control (CDC), and the Director of the National Institute of Environmental Health Sciences, shall jointly conduct a study of the sources of lead exposure in children who have elevated blood lead levels (or other indicators of elevated lead body burden), as defined by the Director of the Centers for Disease Control.</text></paragraph><paragraph id="H770329F24C894165B8C5E662689EF97E"><enum>(2)</enum><header>Water</header><text>The Secretary, in consultation with the Director of the National Institute for Occupational Safety and Health, shall conduct a comprehensive study of means to reduce hazardous occupational lead abatement exposures in water. This study shall include, at a minimum, each of the following:</text><subparagraph id="H4A832021DBA643E09C0F8EFF1E684E23"><enum>(A)</enum><text>Surveillance and intention capability in the States to identify and prevent hazardous exposures to lead abatement workers.</text></subparagraph><subparagraph id="HFDFE0BF3CD7D4F08B92286B78A409837"><enum>(B)</enum><text>Demonstration of lead abatement control methods and devices and work practices to identify and prevent hazardous lead exposures in the workplace.</text></subparagraph><subparagraph id="HAB47003882C0426BBB17FB02E0A668FB"><enum>(C)</enum><text>Evaluation, in consultation with the National Institute of Environmental Health Sciences, of health effects of low and high levels of occupational lead exposures through fluids on reproductive, neurological, renal, and cardiovascular health.</text></subparagraph><subparagraph id="HB6E1B39794A947DCB9001ABA747CB101"><enum>(D)</enum><text>Identification of high-risk occupational settings to which prevention activities and resources should be targeted.</text></subparagraph><subparagraph id="H7EA61C8BB9A546ED94F7F2CD0542E03C"><enum>(E)</enum><text>A study assessing the potential exposures and risks from lead to janitorial and custodial workers.</text></subparagraph></paragraph><paragraph id="HED7B8E6CC72248CB955A4C9469315A36"><enum>(3)</enum><header>Contribution to elevated lead body burden</header><text>The studies described in paragraphs (1) and (2) shall as appropriate, examine the relative contributions to elevated lead body burden from each of the following:</text><subparagraph id="H50E2B7415ADB4B968762EF38522D5F30"><enum>(A)</enum><text>Drinking water.</text></subparagraph><subparagraph id="H381B50C6FB09402F96C9B32E48426F7B"><enum>(B)</enum><text>Food.</text></subparagraph><subparagraph id="HAEB4312924FE4C6593AC0A737ADD4BF1"><enum>(C)</enum><text>Occupational exposures, and other exposures that the Secretary determines to be appropriate.</text></subparagraph></paragraph><paragraph id="H5E39A2C6EFB04BC6B000A891C94BB542"><enum>(4)</enum><header>Report</header><text>Not later than 30 months after the date of the enactment of this section, the Secretary shall submit a report to the Congress concerning the studies described in paragraphs (1) and (2).</text></paragraph></subsection><subsection id="HDD533354812A46A5931D34AF856C5ABF"><enum>(d)</enum><header>Public education</header><paragraph id="HB93ABC545CA14AE18A1652845F25D7A3"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Administrator, in conjunction with the Secretary of Health and Human Services, acting through the Director of the Agency for Toxic Substances and Disease Registry, and in conjunction with the Secretary of Housing and Urban Development, shall sponsor public education and outreach activities to increase public awareness of—</text><subparagraph id="H8D2A822737B34349B7D4AAD10521FE27"><enum>(A)</enum><text>the scope and severity of lead poisoning from household sources, particularly lead-based pipes;</text></subparagraph><subparagraph id="HACFBDBC038704DA197981E2976D47511"><enum>(B)</enum><text display-inline="yes-display-inline">potential exposure to sources of lead in schools and childhood day care centers, particularly lead-based pipes;</text></subparagraph><subparagraph id="H755C80C5F2FE4A0D83D44E9DF8427A04"><enum>(C)</enum><text>the implications of exposures for men and women, particularly those of childbearing age;</text></subparagraph><subparagraph id="H02C8E6E1B4EF4842B7001E64B49F3334"><enum>(D)</enum><text>the need for careful, quality, abatement and management actions;</text></subparagraph><subparagraph id="HF74BC22A7E2A416499CFC33E2768789D"><enum>(E)</enum><text>the need for universal screening of children;</text></subparagraph><subparagraph id="HC90C93C22949428CAC4A8B5F76D77177"><enum>(F)</enum><text>other components of a lead poisoning prevention program;</text></subparagraph><subparagraph id="H81DEF36B8D624723A57DB26225827DEC"><enum>(G)</enum><text>the health consequences of lead exposure resulting from lead-based pipe hazards;</text></subparagraph><subparagraph id="HDD7535DFA8974E5BAA5E3D7F06712FA1"><enum>(H)</enum><text>risk assessment and inspection methods for lead-based pipe hazards; and</text></subparagraph><subparagraph id="H2E693D1114334999AC3D9B0FE219FF63"><enum>(I)</enum><text>measures to reduce the risk of lead exposure from lead-based pipes.</text></subparagraph></paragraph><paragraph id="H64E14A54E9FB43DF93B2F8CE28A6BBCE"><enum>(2)</enum><header>Targeted audiences</header><text>The activities described in paragraph (1) shall be designed to provide educational services and information to—</text><subparagraph id="H966B4F1A03AF48A9B4A7012F35DE3C51"><enum>(A)</enum><text>health professionals;</text></subparagraph><subparagraph id="H037CE4C3AB4F49B484B47D343F95BB3C"><enum>(B)</enum><text>the general public, with emphasis on parents of young children;</text></subparagraph><subparagraph id="HF2941AF5DD3C42B5BE3EA334427E8546"><enum>(C)</enum><text>homeowners, landlords, and tenants;</text></subparagraph><subparagraph id="H9F379171D2AD464E992377AB61468843"><enum>(D)</enum><text>consumers of home improvement products;</text></subparagraph><subparagraph id="HFF5CEA9D48764F6A80BFEF1C82C70E30"><enum>(E)</enum><text>the residential real estate industry; and</text></subparagraph><subparagraph id="H66627596661D4B8197A393C7E1928865"><enum>(F)</enum><text>the home renovation industry.</text></subparagraph></paragraph></subsection><subsection id="HBE634D25C0A948FD8848305492C9C259"><enum>(e)</enum><header>Technical assistance</header><paragraph id="HFC6A291C324B47A9877FF9F0AEBF44D9"><enum>(1)</enum><header>Clearinghouse</header><text display-inline="yes-display-inline">Not later than 6 months after the enactment of this Act, the Administrator shall establish, in consultation with the Secretary of Housing and Urban Development and the Director of the Centers for Disease Control, a National Clearinghouse on Childhood Lead Poisoning (in this section referred to as the <quote>Clearinghouse</quote>). The Clearinghouse shall—</text><subparagraph id="H530FE4847939406E8001C6AB2E3CE52E"><enum>(A)</enum><text>collect, evaluate, and disseminate current information on the assessment and reduction of lead-based pipe hazards, adverse health effects, sources of exposure, detection and risk assessment methods, environmental hazards abatement, and clean-up standards;</text></subparagraph><subparagraph id="H7CA4D2ED16C647A5B5FEF47A09EA468B"><enum>(B)</enum><text>maintain a rapid-alert system to inform certified lead-based pipe activities contractors of significant developments in research related to lead-based paint hazards; and</text></subparagraph><subparagraph id="HFFD5994CED384306958BCF9D3B6CF1A1"><enum>(C)</enum><text>perform any other duty that the Administration determines necessary to achieve the purposes of this Act.</text></subparagraph></paragraph><paragraph id="HAD3857EE63454E10A0DD2AC4F6B6A5DB"><enum>(2)</enum><header>Hotline</header><text>Not later than 6 months after the enactment of this subsection, the Administrator, in cooperation with other Federal agencies and with State and local governments, shall establish a single lead-based pipe hazard hotline to provide the public with answers to questions about lead poison in prevention and referrals to the Clearinghouse for technical information.</text></paragraph></subsection></section><section id="H082349008E524924B7B4528F533D9A58"><enum>205.</enum><header>Lead hazard information pamphlet</header><subsection id="HDE82E4EF08F142068AB73DF381515EE6"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 2 years after the enactment of this Act, after notice and opportunity for comment, the Administrator of the Environmental Protection Agency, in consultation with the Secretary of Housing and Urban Development and with the Secretary of Health and Human Services, shall publish, and from time to time revise, a lead hazard information pamphlet. The pamphlet shall—</text><paragraph id="H4A7E63D1295A4EAAA1D852FB93539637"><enum>(1)</enum><text>contain information regarding the health risks associated with exposure to lead;</text></paragraph><paragraph id="H380269CD398F444E9C6089BCA0185129"><enum>(2)</enum><text>provide information on the presence of lead-based pipe hazards in federally assisted, federally owned, and other housing;</text></paragraph><paragraph id="H926763610CDC40A99D452CEE17BC852B"><enum>(3)</enum><text>describe the risks of lead exposure for children under 6 years of age, pregnant women, women of childbearing age, persons involved in home renovation, and others residing in a dwelling with lead-based pipe hazards;</text></paragraph><paragraph id="H860F28D7D99A41C3829AB9FA8D8C879B"><enum>(4)</enum><text>describe the risks of renovation in a dwelling with lead-based pipe hazards;</text></paragraph><paragraph id="HCE1A4D4C544B433292CFF0343F9F3F00"><enum>(5)</enum><text>provide information on approved methods for evaluating and reducing lead-based pipe hazards and their effectiveness in identifying, reducing, eliminating, or preventing exposure to lead-based pipe hazards;</text></paragraph><paragraph id="H1E78590C11AC4EB99DF9F8DD71072A8E"><enum>(6)</enum><text>advise persons how to obtain a list of contractors certified pursuant to this title in lead-based pipe hazard evaluation and reduction in the area in which the pamphlet is to be used;</text></paragraph><paragraph id="H9F2262461492476FB11D16A97AC3A92E"><enum>(7)</enum><text>state that a risk assessment or inspection for lead-based pipe is recommended prior to the purchase, lease, or renovation of housing;</text></paragraph><paragraph id="H6A91DCB5452444FFA30A32C42BF5DBB4"><enum>(8)</enum><text>state that certain State and local laws impose additional requirements related to lead-based pipe in housing and provide a listing of Federal, State, and local agencies in each State, including address and telephone number, that can provide information about applicable laws and available govern-mental and private assistance and financing; and</text></paragraph><paragraph id="HB4C769410CD242EBBE0579A9F6EFA9C2"><enum>(9)</enum><text>provide such other information about environmental hazards associated with residential real property as the Administrator deems appropriate.</text></paragraph></subsection><subsection id="HFDFA89005EE84A3CA0681188152E00A5"><enum>(b)</enum><header>Renovation of housing</header><text display-inline="yes-display-inline">Within 2 years after the enactment of this section, the Administrator shall promulgate regulations under this subsection to require each person who performs for compensation a renovation of housing to provide a lead hazard information pamphlet to the owner and occupant of such housing prior to commencing the renovation.</text></subsection></section><section id="H0F8305DD901247DDA15FAEFA380C076D"><enum>206.</enum><header>Regulations</header><text display-inline="no-display-inline">The regulations of the Administrator under this title shall include such recordkeeping and reporting requirements as may be necessary to insure the effective implementation of this title. The regulations may be amended from time to time as necessary.</text></section><section id="H594074E325FF41ADA900B0CBEF9B82D3"><enum>207.</enum><header>Control of lead-based pipe hazards at Federal facilities</header><text display-inline="no-display-inline">Each department, agency, and instrumentality of executive, legislative, and judicial branches of the Federal Government (1) having jurisdiction over any property or facility, or (2) engaged in any activity resulting, or which may result, in a lead-based pipe hazard, and each officer, agent, or employee thereof, shall be subject to, and comply with, all Federal, State, interstate, and local requirements, both substantive and procedural (including any requirement for certification, licensing, recordkeeping, or reporting or any provisions for injunctive relief and such sanctions as may be imposed by a court to enforce such relief respecting lead-based pipe, lead-based pipe activities, and lead-based pipe hazards in the same manner, and to the same extent as any nongovernmental entity is subject to such requirements, including the payment of reasonable service charges). The Federal, State, interstate, and local substantive and procedural requirements referred to in this subsection include, but are not limited to, all administrative orders and all civil and administrative penalties and fines regardless of whether such penalties or fines are punitive or coercive in nature, or whether imposed for isolated, intermittent or continuing violations. The United States hereby expressly waives any immunity otherwise applicable to the United States with respect to any such substantive or procedural requirement (including, but not limited to, any injunctive relief, administrative order, or civil or administrative penalty referred to in the preceding sentence, or reasonable service charge). The reasonable service charges referred to in this section include, but are not limited to, fees or charges assessed for certification and licensing, as well as any other nondiscriminatory charges that are assessed in connection with a Federal, State, interstate, or local lead-based pipe, lead-based pipe activities, or lead-based pipe hazard activities program. No agent, employee, or officer of the United States shall be personally liable for any civil penalty under any Federal, State, interstate, or local law relating to lead-based pipe, lead-based pipe activities, or lead-based pipe hazards with respect to any act or omission within the scope of his official duties.</text></section><section id="H0E3845251B4D43678E0006E11A8081CC"><enum>208.</enum><header>Prohibited Acts</header><text display-inline="no-display-inline">It shall be unlawful for any person to fail or refuse to comply with a provision of this title or with any rule or order issued under this title.</text></section><section id="HDEF53BB50D4E48D0A99EE56146D82A48"><enum>209.</enum><header>Relationship to other Federal law</header><text display-inline="no-display-inline">Nothing in this title shall affect the authority of other appropriate Federal agencies to establish or enforce any requirements which are at least as stringent as those established pursuant to this title.</text></section><section id="H79C28340D9F842E88074ADCD6D38CFE8"><enum>210.</enum><header>General provisions relating to administrative proceedings</header><subsection id="H121E2AE5690340B185D6F14C2633D2D2"><enum>(a)</enum><header>Applicability</header><text display-inline="yes-display-inline">This section applies to the promulgation or revision of any regulation issued under this title.</text></subsection><subsection id="H5833E319C0F84EAC84E86591C30B007E"><enum>(b)</enum><header>Rulemaking docket</header><text>Not later than the date of proposal of an action to which this section applies, the Administrator shall establish a rulemaking docket for such action (in this subsection referred to as a <term>rule</term>). Whenever a rule applies only within a particular State, a second (identical) docket shall be established in the appropriate regional office of the Environmental Protection Agency.</text></subsection><subsection id="H599436F561F747D2A5CF2B07263897F9"><enum>(c)</enum><header>Inspection and copying</header><paragraph id="H20762EFCBD294D2CA1576DDF64451D31"><enum>(1)</enum><header>Public availability</header><text display-inline="yes-display-inline">The rulemaking docket required under subsection (b) shall be open for inspection by the public at reasonable times specified in the notice of proposed rulemaking. Any person may copy documents contained in the docket. The Administrator shall provide copying facilities which may be used at the expense of the person seeking copies, but the Administrator may waive or reduce such expenses in such instances as the public interest requires. Any person may request copies by mail if the person pays the expenses, including personnel costs to do the copying.</text></paragraph><paragraph id="HFA2692D1EC69472F953F88C803307A3A"><enum>(2)</enum><header>Docket</header><subparagraph id="HCAF63B497F4E48A6895971C956A479EA"><enum>(A)</enum><header>Comments and information</header><text display-inline="yes-display-inline">Promptly upon receipt by the agency, all written comments and documentary information on the proposed rule received from any person for inclusion in the docket during the comment period shall be placed in the docket. The transcript of public hearing if any, on the proposed rule shall also be included in the docket promptly upon receipt from the person who transcribed such hearings. All documents which become available after the proposed rule has been published and which the Administrator determines are of central relevance to the rulemaking shall be placed in the docket as soon as possible after their availability.</text></subparagraph><subparagraph id="H20FEDCB330E840A4A64DEC2AD26E64E9"><enum>(B)</enum><header>Drafts of rules</header><text>The drafts of proposed rules submitted by the Administrator to the Office of Management and Budget for any interagency review process prior to proposal of any such rule, all documents accompanying such drafts, and all written comments thereon by other agencies and all written responses to such written comments by the Administrator shall be placed in the docket no later than the date of proposal of the rule. The drafts of the final rule submitted for such review process prior to promulgation and all such written comments thereto all documents accompanying such drafts, and written responses thereto shall be placed in the docket no later than the date of promulgation.</text></subparagraph></paragraph></subsection><subsection id="HE5D6540A98D3480B93503E78FCC8CA75"><enum>(d)</enum><header>Explanation</header><paragraph id="H84D31BA4E25747BA95491545EA562617"><enum>(1)</enum><header>Major changes</header><text display-inline="yes-display-inline">The promulgated rule shall be accompanied by an explanation of the reasons for any major changes in the promulgated rule from the proposed rule.</text></paragraph><paragraph id="H914DC1BD92334E85AF253DAF92A50433"><enum>(2)</enum><header>Responses</header><text>The promulgated rule shall also be accompanied by a response to each of the significant comments, criticisms, and new data submitted in written or oral presentations during the comment period.</text></paragraph><paragraph id="HCD319A788346477CBBD5E5B5C031F2D9"><enum>(3)</enum><header>Limitation</header><text>The promulgated rule may not be based (in part or whole) on any information or data which has not been placed in the docket as of the date of such promulgation.</text></paragraph></subsection><subsection id="H1EB2AC68C5E040B491ECE2BDB75413A2"><enum>(e)</enum><header>Effective date</header><text>The requirements of this section shall take effect with respect to any rule the proposal of which occurs after 90 days after the date of the enactment of this Act.</text></subsection></section></title><title id="H564F017B718C474599852B87B42D13DF"><enum>III</enum><header>Authorization of Appropriations for Lead Hazard Reduction</header><section id="HD71E9DFB03B84612967CCD7B7E3C0182"><enum>301.</enum><header>HUD grants for lead hazards reduction in housing</header><text display-inline="no-display-inline">There is authorized to be appropriated for grants under section 101 of this Act and section 1011 of the Residential Lead-Based Paint Hazard Reduction Act of 1992 (<external-xref legal-doc="usc" parsable-cite="usc/42/4852">42 U.S.C. 4852</external-xref>) $9,500,000,000 for each of fiscal years 2022 through 2031.</text></section><section id="H8BB5B2AEF4CD4B0BACDF447EDD083C37"><enum>302.</enum><header>EPA funding for lead exposure reduction</header><text display-inline="no-display-inline">There is authorized to be appropriated such sums as may be necessary for each of fiscal years 2022 through 2031 to carry out—</text><paragraph commented="no" id="H0260644B66C141AFB5A6B0C8C7B7F0BB"><enum>(1)</enum><text display-inline="yes-display-inline">title II of this Act;</text></paragraph><paragraph id="H22CA205F49D2451CB0EA25B408E3A654"><enum>(2)</enum><text display-inline="yes-display-inline">title IV of the Toxic Substances Control Act (<external-xref legal-doc="usc" parsable-cite="usc/15/2681">15 U.S.C. 2681</external-xref> et seq.); and</text></paragraph><paragraph commented="no" id="HF65A9FF6D004440D851F52F32E36C663"><enum>(3)</enum><text>such other lead hazard reduction activities as the Administrator of the Environmental Protection Agency is authorized under law to undertake, including activities under the Safe Drinking Water Act (<external-xref Provisions</header><section commented="no" display-inline="no-display-inline" id="HEA387A28B1F94232B8C5CA1FA8AA2EC0" section-type="subsequent-section"><enum>401.</enum><header>Partnership interests transferred in connection with performance of services</header><subsection commented="no" id="H1EED0BD634BC4272AD70C58DF58326F0"><enum>(a)</enum><header>Modification to election To include partnership interest in gross income in year of transfer</header><text display-inline="yes-display-inline">Subsection (c) of <external-xref legal-doc="usc" parsable-cite="usc/26/83">section 83</external-xref> of the Internal Revenue Code of 1986 is amended by redesignating paragraph (4) as paragraph (5) and by inserting after paragraph (3) the following new paragraph:</text><quoted-block display-inline="no-display-inline" id="H004E188489B94889AEB7EA063B8877CB" style="OLC"><paragraph id="H01E3DC81F9F74F74A0A63B784E116356"><enum>(4)</enum><header>Partnership interests</header><text display-inline="yes-display-inline">Except as provided by the Secretary—</text><subparagraph id="H03E39383EA80491588CB404EF0FF9AA3"><enum>(A)</enum><header>In general</header><text>In the case of any transfer of an interest in a partnership in connection with the provision of services to (or for the benefit of) such partnership—</text><clause id="H7470E6A085CB4EA2BFCD470DF7A920D7"><enum>(i)</enum><text display-inline="yes-display-inline">the fair market value of such interest shall be treated for purposes of this section as being equal to the amount of the distribution which the partner would receive if the partnership sold (at the time of the transfer) all of its assets at fair market value and distributed the proceeds of such sale (reduced by the liabilities of the partnership) to its partners in liquidation of the partnership, and</text></clause><clause id="HE74A9E7673BB453EB532CEDBE1463E19"><enum>(ii)</enum><text>the person receiving such interest shall be treated as having made the election under subsection (b)(1) unless such person makes an election under this paragraph to have such subsection not apply.</text></clause></subparagraph><subparagraph id="H6463BBA7602C463ABF14351E3EBB685B"><enum>(B)</enum><header>Election</header><text>The election under subparagraph (A)(ii) shall be made under rules similar to the rules of subsection (b)(2).</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H49DC0B143D9A421C90004C11187DF82F"><enum>(b)</enum><header>Effective date</header><text>The amendments made by this section shall apply to interests in partnerships transferred after the date of the enactment of this Act.</text></subsection></section><section display-inline="no-display-inline" id="HFA704658424A45E9B4F163A3F7343C64" section-type="subsequent-section"><enum>402.</enum><header>Special rules for partners providing investment management services to partnerships</header><subsection id="HACFD73AE4F594C11AC037B57EB1951D2"><enum>(a)</enum><header>In general</header><text>Part I of subchapter K of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/26/1">chapter 1</external-xref> of the Internal Revenue Code of 1986 is amended by adding at the end the following new section:</text><quoted-block display-inline="no-display-inline" id="HA1F4D05C66694F689CF6583DB396AC1E" style="OLC"><section id="H881A9384E61F4D34B4D5D55B8FD4AF14"><enum>710.</enum><header>Special rules for partners providing investment management services to partnerships</header><subsection id="H164418B9F87E4C678A13BDD56FEF3EB6"><enum>(a)</enum><header>Treatment of distributive share of partnership items</header><text display-inline="yes-display-inline">For purposes of this title, in the case of an investment services partnership interest—</text><paragraph id="H188920F4C6904090A1DB2E0AB8E6E890"><enum>(1)</enum><header>In general</header><text>Notwithstanding section 702(b)—</text><subparagraph id="HBDD6CAB855F04E0CB419ECB24FAD4C17"><enum>(A)</enum><text>an amount equal to the net capital gain with respect to such interest for any partnership taxable year shall be treated as ordinary income, and</text></subparagraph><subparagraph id="HCF56014521D14333B84D9FEDA606AAC4"><enum>(B)</enum><text>subject to the limitation of paragraph (2), an amount equal to the net capital loss with respect to such interest for any partnership taxable year shall be treated as an ordinary loss.</text></subparagraph></paragraph><paragraph id="H4A94069686FE42B6890264FC33E7F423"><enum>(2)</enum><header>Recharacterization of losses limited to recharacterized gains</header><text>The amount treated as ordinary loss under paragraph (1)(B) for any taxable year shall not exceed the excess (if any) of—</text><subparagraph id="H4D206294084B45EA9B94980CD1A3E65D"><enum>(A)</enum><text>the aggregate amount treated as ordinary income under paragraph (1)(A) with respect to the investment services partnership interest for all preceding partnership taxable years to which this section applies, over</text></subparagraph><subparagraph id="H606FB19B2789473DA8451635F55913DF"><enum>(B)</enum><text>the aggregate amount treated as ordinary loss under paragraph (1)(B) with respect to such interest for all preceding partnership taxable years to which this section applies.</text></subparagraph></paragraph><paragraph id="H9F152347600745A1AEF4D53EBBFBFC46"><enum>(3)</enum><header>Allocation to items of gain and loss</header><subparagraph id="HEC4577AFA6EF43B7AEF478F52900A332"><enum>(A)</enum><header>Net capital gain</header><text>The amount treated as ordinary income under paragraph (1)(A) shall be allocated ratably among the items of long-term capital gain taken into account in determining such net capital gain.</text></subparagraph><subparagraph id="H7C9FDB6BDBA44D09BC6F8D27A6432307"><enum>(B)</enum><header>Net capital loss</header><text>The amount treated as ordinary loss under paragraph (1)(B) shall be allocated ratably among the items of long-term capital loss and short-term capital loss taken into account in determining such net capital loss.</text></subparagraph></paragraph><paragraph id="H87482F145A374B2597D3662CD781F3CC"><enum>(4)</enum><header>Terms relating to capital gains and losses</header><text>For purposes of this section—</text><subparagraph id="HAC30458CE9A148968AB9119E393F4925"><enum>(A)</enum><header>In general</header><text>Net capital gain, long-term capital gain, and long-term capital loss, with respect to any investment services partnership interest for any taxable year, shall be determined under section 1222, except that such section shall be applied—</text><clause id="HC68EDC205803474686D6C565CDF47C63"><enum>(i)</enum><text>without regard to the recharacterization of any item as ordinary income or ordinary loss under this section,</text></clause><clause id="HA4BE06C9687D426C98611F8A5587ECB7"><enum>(ii)</enum><text>by only taking into account items of gain and loss taken into account by the holder of such interest under section 702 (other than subsection (a)(9) thereof) with respect to such interest for such taxable year, and</text></clause><clause id="H5036274AE43C48FF8BE40D8640AE0052"><enum>(iii)</enum><text>by treating property which is taken into account in determining gains and losses to which section 1231 applies as capital assets held for more than 1 year.</text></clause></subparagraph><subparagraph id="H9170E8AD71FC43E6A04493EA68EFDE38"><enum>(B)</enum><header>Net capital loss</header><text>The term <term>net capital loss</term> means the excess of the losses from sales or exchanges of capital assets over the gains from such sales or exchanges. Rules similar to the rules of clauses (i) through (iii) of subparagraph (A) shall apply for purposes of the preceding sentence.</text></subparagraph></paragraph><paragraph id="HF6F38B6E8D7F46DB9E0B7BBFE04A404F"><enum>(5)</enum><header>Special rule for dividends</header><text display-inline="yes-display-inline">Any dividend allocated with respect to any investment services partnership interest shall not be treated as qualified dividend income for purposes of section 1(h).</text></paragraph><paragraph id="H49AEB76E3A8E438AA667A08FD5AE1B58"><enum>(6)</enum><header>Special rule for qualified small business stock</header><text display-inline="yes-display-inline">Section 1202 shall not apply to any gain from the sale or exchange of qualified small business stock (as defined in section 1202(c)) allocated with respect to any investment services partnership interest.</text></paragraph></subsection><subsection id="HF0FC9AEA555B468993C4E0A333667455"><enum>(b)</enum><header>Dispositions of partnership interests</header><paragraph id="H93E2BEE192114D9AB7BBD5C412508889"><enum>(1)</enum><header>Gain</header><subparagraph id="H94585C4FCBE94F138FB0EF77BDF13720"><enum>(A)</enum><header>In general</header><text>Any gain on the disposition of an investment services partnership interest shall be—</text><clause id="H338E177FA9ED44ACB519AF3408F51154"><enum>(i)</enum><text>treated as ordinary income, and</text></clause><clause id="H34E3666801A646F5AF02966E976BF299"><enum>(ii)</enum><text>recognized notwithstanding any other provision of this subtitle.</text></clause></subparagraph><subparagraph id="H9C46FE4ED0C146C1BF8B860C7DC1176B"><enum>(B)</enum><header>Gift and transfers at death</header><text>In the case of a disposition of an investment services partnership interest by gift or by reason of death of the taxpayer—</text><clause id="H29A977DA7C594AEDBA6DB8A68404E9E7"><enum>(i)</enum><text>subparagraph (A) shall not apply,</text></clause><clause id="HC5AD0E708909401DBBB7C4F87CC070CC"><enum>(ii)</enum><text>such interest shall be treated as an investment services partnership interest in the hands of the person acquiring such interest, and</text></clause><clause id="H29C8523B781F43649DBAEF601B0503C5"><enum>(iii)</enum><text>any amount that would have been treated as ordinary income under this subsection had the decedent sold such interest immediately before death shall be treated as an item of income in respect of a decedent under section 691.</text></clause></subparagraph></paragraph><paragraph id="HE23593EE7CD14233BBCE75AED6017E35"><enum>(2)</enum><header>Loss</header><text>Any loss on the disposition of an investment services partnership interest shall be treated as an ordinary loss to the extent of the excess (if any) of—</text><subparagraph id="HFA6E0CE041D14015B23DC4224C02FEC0"><enum>(A)</enum><text>the aggregate amount treated as ordinary income under subsection (a) with respect to such interest for all partnership taxable years to which this section applies, over</text></subparagraph><subparagraph id="H11E47FA361A24DFF9CEC592CFEB286D8"><enum>(B)</enum><text>the aggregate amount treated as ordinary loss under subsection (a) with respect to such interest for all partnership taxable years to which this section applies.</text></subparagraph></paragraph><paragraph id="H77C00B2CB4A24EB28500084873E1F01F"><enum>(3)</enum><header>Election with respect to certain exchanges</header><text>Paragraph (1)(A)(ii) shall not apply to the contribution of an investment services partnership interest to a partnership in exchange for an interest in such partnership if—</text><subparagraph id="HDD0D89D78C8040E3B4713EE169B4EA2F"><enum>(A)</enum><text>the taxpayer makes an irrevocable election to treat the partnership interest received in the exchange as an investment services partnership interest, and</text></subparagraph><subparagraph id="HEA31840CD41143D99A15EB48F99CD068"><enum>(B)</enum><text>the taxpayer agrees to comply with such reporting and recordkeeping requirements as the Secretary may prescribe.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HB494B8D1C95E4ECA8472F141B59B698C"><enum>(4)</enum><header>Distributions of partnership property</header><subparagraph id="H2A4FC977B387473ABAD148A3215170C5"><enum>(A)</enum><header>In general</header><text>In the case of any distribution of property by a partnership with respect to any investment services partnership interest held by a partner, the partner receiving such property shall recognize gain equal to the excess (if any) of—</text><clause commented="no" id="H34F2E87E2A4B48158E96E51EF8400002"><enum>(i)</enum><text>the fair market value of such property at the time of such distribution, over</text></clause><clause commented="no" id="HA9D0A2CD4BB3461EB91DF58BC7D63E38"><enum>(ii)</enum><text>the adjusted basis of such property in the hands of such partner (determined without regard to subparagraph (C)).</text></clause></subparagraph><subparagraph id="H17B7FBBC067D456A921A4208DCB39934"><enum>(B)</enum><header>Treatment of gain as ordinary income</header><text>Any gain recognized by such partner under subparagraph (A) shall be treated as ordinary income to the same extent and in the same manner as the increase in such partner’s distributive share of the taxable income of the partnership would be treated under subsection (a) if, immediately prior to the distribution, the partnership had sold the distributed property at fair market value and all of the gain from such disposition were allocated to such partner. For purposes of applying subsection (a)(2), any gain treated as ordinary income under this subparagraph shall be treated as an amount treated as ordinary income under subsection (a)(1)(A).</text></subparagraph><subparagraph id="HA256A1B217144B4B9FFF87E3F91569CF"><enum>(C)</enum><header>Adjustment of basis</header><text>In the case a distribution to which subparagraph (A) applies, the basis of the distributed property in the hands of the distributee partner shall be the fair market value of such property.</text></subparagraph><subparagraph id="H4DEE2DA17A27415E97A8E30B7EE6AA08"><enum>(D)</enum><header>Special rules with respect to mergers, divisions, and technical terminations</header><text>In the case of a taxpayer which satisfies requirements similar to the requirements of subparagraphs (A) and (B) of paragraph (3), this paragraph and paragraph (1)(A)(ii) shall not apply to the distribution of a partnership interest if such distribution is in connection with a contribution (or deemed contribution) of any property of the partnership to which section 721 applies pursuant to a transaction described in paragraph (1)(B) or (2) of section 708(b).</text></subparagraph></paragraph></subsection><subsection id="HE1383892E2C048E8979DCF239E2260FA"><enum>(c)</enum><header>Investment services partnership interest</header><text display-inline="yes-display-inline">For purposes of this section—</text><paragraph commented="no" id="H07563B8827134A1F82CC782DB8A381BB"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The term <term>investment services partnership interest</term> means any interest in an investment partnership acquired or held by any person in connection with the conduct of a trade or business described in paragraph (2) by such person (or any person related to such person). An interest in an investment partnership held by any person—</text><subparagraph id="H0A2FC22B5B04492ABF2C24BBB91F3AAD"><enum>(A)</enum><text>shall not be treated as an investment services partnership interest for any period before the first date on which it is so held in connection with such a trade or business,</text></subparagraph><subparagraph id="HBB1F60D92CD04E1BBFD432997C65DC6D"><enum>(B)</enum><text>shall not cease to be an investment services partnership interest merely because such person holds such interest other than in connection with such a trade or business, and</text></subparagraph><subparagraph id="H2D03B1F563504CD0AA17BDAAC6ACC032"><enum>(C)</enum><text>shall be treated as an investment services partnership interest if acquired from a related person in whose hands such interest was an investment services partnership interest.</text></subparagraph></paragraph><paragraph id="H64C66107211349E4979C2CE74AF93574"><enum>(2)</enum><header>Businesses to which this section applies</header><text display-inline="yes-display-inline">A trade or business is described in this paragraph if such trade or business primarily involves the performance of any of the following services with respect to assets held (directly or indirectly) by one or more investment partnerships referred to in paragraph (1):</text><subparagraph id="HDD08AD32DAFB4132B899C06B65A4DA3D"><enum>(A)</enum><text>Advising as to the advisability of investing in, purchasing, or selling any specified asset.</text></subparagraph><subparagraph id="H51E36DD23EF24AE48B57884955253FDA"><enum>(B)</enum><text>Managing, acquiring, or disposing of any specified asset.</text></subparagraph><subparagraph id="H47A89D090240419B8E50BF45D5225C49"><enum>(C)</enum><text>Arranging financing with respect to acquiring specified assets.</text></subparagraph><subparagraph id="HA7B29F6C8B214DDB9D58593C4D01EAB7"><enum>(D)</enum><text>Any activity in support of any service described in subparagraphs (A) through (C).</text></subparagraph></paragraph><paragraph id="H8EB39C25FBBC4ED2AD43ABD6A511DC35"><enum>(3)</enum><header>Investment partnership</header><subparagraph id="H400620B241304E3B9356BEAABCCC8460"><enum>(A)</enum><header>In general</header><text>The term <term>investment partnership</term> means any partnership if, at the end of any two consecutive calendar quarters ending after the date of enactment of this section—</text><clause id="H5029FBDE9AED4E8A9E98A3DC6BB6F421"><enum>(i)</enum><text>substantially all of the assets of the partnership are specified assets (determined without regard to any section 197 intangible within the meaning of section 197(d)), and</text></clause><clause id="H4D2D4500C5734BC89EF2F2B1FF7C2D6E"><enum>(ii)</enum><text>less than 75 percent of the capital of the partnership is attributable to qualified capital interests which constitute property held in connection with a trade or business of the owner of such interest.</text></clause></subparagraph><subparagraph id="H269D31126E414E308804C54AD574FCED"><enum>(B)</enum><header>Look-through of certain wholly owned entities for purposes of determining assets of the partnership</header><clause id="HDB03055DA9624C3B9D77DBE0D382FE86"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">For purposes of determining the assets of a partnership under subparagraph (A)(i)—</text><subclause id="H5FFDF01A422F416CB3D666FAA6745073"><enum>(I)</enum><text>any interest in a specified entity shall not be treated as an asset of such partnership, and</text></subclause><subclause id="H7C1B6F8839A0457E9B6F051BC55027CC"><enum>(II)</enum><text>such partnership shall be treated as holding its proportionate share of each of the assets of such specified entity.</text></subclause></clause><clause id="HDBCF6B073C18411CB4E3E0C236473EBA"><enum>(ii)</enum><header>Specified entity</header><text>For purposes of clause (i), the term <term>specified entity</term> means, with respect to any partnership (hereafter referred to as the upper-tier partnership), any person which engages in the same trade or business as the upper-tier partnership and is—</text><subclause id="HACC3CAC76DEA4101B4438F38B3409850"><enum>(I)</enum><text>a partnership all of the capital and profits interests of which are held directly or indirectly by the upper-tier partnership, or</text></subclause><subclause id="HD04D30B9A34C4A02AFB45A8B0AEF09E1"><enum>(II)</enum><text>a foreign corporation which does not engage in a trade or business in the United States and all of the stock of which is held directly or indirectly by the upper-tier partnership.</text></subclause></clause></subparagraph><subparagraph id="HBE7CA403DE4146DCA68DA9278C785C71"><enum>(C)</enum><header>Special rules for determining if property held in connection with trade or business</header><clause id="H6DEEA13B98BD45EB9EF7EF5DBF336FB8"><enum>(i)</enum><header>In general</header><text>Except as otherwise provided by the Secretary, solely for purposes of determining whether any interest in a partnership constitutes property held in connection with a trade or business under subparagraph (A)(ii)—</text><subclause id="HACD613A148594419B3D068FFFB4CBA98"><enum>(I)</enum><text>a trade or business of any person closely related to the owner of such interest shall be treated as a trade or business of such owner,</text></subclause><subclause id="H97C3B6C788C64D25A12D8B7C2822E1AA"><enum>(II)</enum><text>such interest shall be treated as held by a person in connection with a trade or business during any taxable year if such interest was so held by such person during any 3 taxable years preceding such taxable year, and</text></subclause><subclause id="HD8D338782251424CBB8A77AA655B77AD"><enum>(III)</enum><text>paragraph (5)(B) shall not apply.</text></subclause></clause><clause id="H7270F6A59CF445F3864387D3EA4AB23C"><enum>(ii)</enum><header>Closely related persons</header><text>For purposes of clause (i)(I), a person shall be treated as closely related to another person if, taking into account the rules of section 267(c), the relationship between such persons is described in—</text><subclause id="H9145FBC8D8374BC19C69D1286A738069"><enum>(I)</enum><text>paragraph (1) or (9) of section 267(b), or</text></subclause><subclause id="HBFAE546191234EF0A9FAE6EA08BC6C99"><enum>(II)</enum><text>section 267(b)(4), but solely in the case of a trust with respect to which each current beneficiary is the grantor or a person whose relationship to the grantor is described in paragraph (1) or (9) of section 267(b).</text></subclause></clause></subparagraph><subparagraph id="H4DD31DFCA9D848F4810E08DC7D570F0A"><enum>(D)</enum><header>Antiabuse rules</header><text>The Secretary may issue regulations or other guidance which prevent the avoidance of the purposes of subparagraph (A), including regulations or other guidance which treat convertible and contingent debt (and other debt having the attributes of equity) as a capital interest in the partnership.</text></subparagraph><subparagraph id="HE0354160046F4809BD101DB7F688402B"><enum>(E)</enum><header>Controlled groups of entities</header><clause id="H451F487C09EF427F8E16474B96EA2C44"><enum>(i)</enum><header>In general</header><text>In the case of a controlled group of entities, if an interest in the partnership received in exchange for a contribution to the capital of the partnership by any member of such controlled group would (in the hands of such member) constitute property held in connection with a trade or business, then any interest in such partnership held by any member of such group shall be treated for purposes of subparagraph (A) as constituting (in the hands of such member) property held in connection with a trade or business.</text></clause><clause display-inline="no-display-inline" id="HA58958887C4F431892D075FB4FC16062"><enum>(ii)</enum><header>Controlled group of entities</header><text display-inline="yes-display-inline">For purposes of clause (i), the term <term>controlled group of entities</term> means a controlled group of corporations as defined in section 1563(a)(1), applied without regard to subsections (a)(4) and (b)(2) of section 1563. A partnership or any other entity (other than a corporation) shall be treated as a member of a controlled group of entities if such entity is controlled (within the meaning of section 954(d)(3)) by members of such group (including any entity treated as a member of such group by reason of this sentence).</text></clause></subparagraph><subparagraph id="H8BEAFE2DFD964B9EAA3FDF7F4788DD93"><enum>(F)</enum><header>Special rule for corporations</header><text>For purposes of this paragraph, in the case of a corporation, the determination of whether property is held in connection with a trade or business shall be determined as if the taxpayer were an individual.</text></subparagraph></paragraph><paragraph id="H82D7B315521545AABA083643551DCB5F"><enum>(4)</enum><header>Specified asset</header><text>The term <term>specified asset</term> means securities (as defined in section 475(c)(2) without regard to the last sentence thereof), real estate held for rental or investment, interests in partnerships, commodities (as defined in section 475(e)(2)), cash or cash equivalents, or options or derivative contracts with respect to any of the foregoing.</text></paragraph><paragraph display-inline="no-display-inline" id="H0F61C29AD9D7415BAAEE634A14740BD4"><enum>(5)</enum><header>Related persons</header><subparagraph id="HE5520C69102B4001B74F4E0E4FEC7C4D"><enum>(A)</enum><header>In general</header><text>A person shall be treated as related to another person if the relationship between such persons is described in section 267(b) or 707(b).</text></subparagraph><subparagraph id="HA5875D6E4ACD436D9AE9E1592278BAEF"><enum>(B)</enum><header>Attribution of partner services</header><text>Any service described in paragraph (2) which is provided by a partner of a partnership shall be treated as also provided by such partnership.</text></subparagraph></paragraph></subsection><subsection id="H907E7CD00B944635A3FDBC6CFAF1FD2D"><enum>(d)</enum><header>Exception for certain capital interests</header><paragraph id="HCDD0639F973F42BC9A2BA9DCF70DDBC1"><enum>(1)</enum><header>In general</header><text>In the case of any portion of an investment services partnership interest which is a qualified capital interest, all items of gain and loss (and any dividends) which are allocated to such qualified capital interest shall not be taken into account under subsection (a) if—</text><subparagraph id="H1FD8AB650A8F4081BB674E6EF8492DE1"><enum>(A)</enum><text>allocations of items are made by the partnership to such qualified capital interest in the same manner as such allocations are made to other qualified capital interests held by partners who do not provide any services described in subsection (c)(2) and who are not related to the partner holding the qualified capital interest, and</text></subparagraph><subparagraph id="H9BD74C1E207744A78063E97B9FA5421A"><enum>(B)</enum><text>the allocations made to such other interests are significant compared to the allocations made to such qualified capital interest.</text></subparagraph></paragraph><paragraph id="H6B7915AC5DB94BCAB1474772A12715A4"><enum>(2)</enum><header>Authority to provide exceptions to allocation requirements</header><text display-inline="yes-display-inline">To the extent provided by the Secretary in regulations or other guidance—</text><subparagraph id="H0AAAE4909BCF4672A7C850490DEE7AD9"><enum>(A)</enum><header>Allocations to portion of qualified capital interest</header><text>Paragraph (1) may be applied separately with respect to a portion of a qualified capital interest.</text></subparagraph><subparagraph id="HBBAA29F78AFF41E9AE9903C0D387E4E6"><enum>(B)</enum><header>No or insignificant allocations to nonservice providers</header><text display-inline="yes-display-inline">In any case in which the requirements of paragraph (1)(B) are not satisfied, items of gain and loss (and any dividends) shall not be taken into account under subsection (a) to the extent that such items are properly allocable under such regulations or other guidance to qualified capital interests.</text></subparagraph><subparagraph id="H62ED42FE4F5E4FC2B1605F87CF90993B"><enum>(C)</enum><header>Allocations to service providers’ qualified capital interests which are less than other allocations</header><text>Allocations shall not be treated as failing to meet the requirement of paragraph (1)(A) merely because the allocations to the qualified capital interest represent a lower return than the allocations made to the other qualified capital interests referred to in such paragraph.</text></subparagraph></paragraph><paragraph commented="no" id="HECE38748A10B4C81B4DC68E099A7AA92"><enum>(3)</enum><header>Special rule for changes in services and capital contributions</header><text display-inline="yes-display-inline">In the case of an interest in a partnership which was not an investment services partnership interest and which, by reason of a change in the services with respect to assets held (directly or indirectly) by the partnership or by reason of a change in the capital contributions to such partnership, becomes an investment services partnership interest, the qualified capital interest of the holder of such partnership interest immediately after such change shall not, for purposes of this subsection, be less than the fair market value of such interest (determined immediately before such change).</text></paragraph><paragraph id="H679A7C22D6ED435DB867629802B6EC46"><enum>(4)</enum><header>Special rule for tiered partnerships</header><text>Except as otherwise provided by the Secretary, in the case of tiered partnerships, all items which are allocated in a manner which meets the requirements of paragraph (1) to qualified capital interests in a lower-tier partnership shall retain such character to the extent allocated on the basis of qualified capital interests in any upper-tier partnership.</text></paragraph><paragraph id="HA80BE7F02F584624AF7D2FDA14950FFB"><enum>(5)</enum><header>Exception for no-self-charged carry and management fee provisions</header><text>Except as otherwise provided by the Secretary, an interest shall not fail to be treated as satisfying the requirement of paragraph (1)(A) merely because the allocations made by the partnership to such interest do not reflect the cost of services described in subsection (c)(2) which are provided (directly or indirectly) to the partnership by the holder of such interest (or a related person).</text></paragraph><paragraph display-inline="no-display-inline" id="HAD199896AE174A039A7A351088C9FB3D"><enum>(6)</enum><header>Special rule for dispositions</header><text display-inline="yes-display-inline">In the case of any investment services partnership interest any portion of which is a qualified capital interest, subsection (b) shall not apply to so much of any gain or loss as bears the same proportion to the entire amount of such gain or loss as—</text><subparagraph id="HD29067ECEE554E39AE15AF40A943CED0"><enum>(A)</enum><text display-inline="yes-display-inline">the distributive share of gain or loss that would have been allocated to the qualified capital interest (consistent with the requirements of paragraph (1)) if the partnership had sold all of its assets at fair market value immediately before the disposition, bears to</text></subparagraph><subparagraph id="H6AD2B11F1B684E56ABA998E2C79DE8F3"><enum>(B)</enum><text>the distributive share of gain or loss that would have been so allocated to the investment services partnership interest of which such qualified capital interest is a part.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H13B2037AA94B431B88D31210E68C0C76"><enum>(7)</enum><header>Qualified capital interest</header><text>For purposes of this section—</text><subparagraph id="H0EB902BF20A545D7A9C359D627351222"><enum>(A)</enum><header>In general</header><text>The term <term>qualified capital interest</term> means so much of a partner’s interest in the capital of the partnership as is attributable to—</text><clause commented="no" id="H68444CC97A584D6AA22E7126A8AB48F5"><enum>(i)</enum><text>the fair market value of any money or other property contributed to the partnership in exchange for such interest (determined without regard to section 752(a)),</text></clause><clause commented="no" id="HBB854F1D74E34D568BF73D8A7AFFF422"><enum>(ii)</enum><text>any amounts which have been included in gross income under section 83 with respect to the transfer of such interest, and</text></clause><clause commented="no" id="HA70E7D0DFB2B421682749B9FCC0F74E1"><enum>(iii)</enum><text>the excess (if any) of—</text><subclause id="HD425DB7BA7DD43CC83384D178F725709"><enum>(I)</enum><text>any items of income and gain taken into account under section 702 with respect to such interest, over</text></subclause><subclause id="H3C928082305748EFAEBD6E3EF3AEC5FC"><enum>(II)</enum><text>any items of deduction and loss so taken into account.</text></subclause></clause></subparagraph><subparagraph id="H4390126ADCF8485A93929AD89EEC7EDB"><enum>(B)</enum><header>Adjustment to qualified capital interest</header><clause id="H645BE8184AD14FCF92071CC2EB3CCD59"><enum>(i)</enum><header>Distributions and losses</header><text>The qualified capital interest shall be reduced by distributions from the partnership with respect to such interest and by the excess (if any) of the amount described in subparagraph (A)(iii)(II) over the amount described in subparagraph (A)(iii)(I).</text></clause><clause id="HC857E08E29374A31BA2455567E93EC0A"><enum>(ii)</enum><header>Special rule for contributions of property</header><text>In the case of any contribution of property described in subparagraph (A)(i) with respect to which the fair market value of such property is not equal to the adjusted basis of such property immediately before such contribution, proper adjustments shall be made to the qualified capital interest to take into account such difference consistent with such regulations or other guidance as the Secretary may provide.</text></clause></subparagraph><subparagraph id="H3D1730DD8FD347E18A5E7200EC28E5F3"><enum>(C)</enum><header>Technical terminations, etc., disregarded</header><text>No increase or decrease in the qualified capital interest of any partner shall result from a termination, merger, consolidation, or division described in section 708, or any similar transaction.</text></subparagraph></paragraph><paragraph id="H5C6CDBD057654CE88144F4D327A57F74"><enum>(8)</enum><header>Treatment of certain loans</header><subparagraph id="HBE78A3E899CF4741A12C49956158E1E6"><enum>(A)</enum><header>Proceeds of partnership loans not treated as qualified capital interest of service providing partners</header><text display-inline="yes-display-inline">For purposes of this subsection, an investment services partnership interest shall not be treated as a qualified capital interest to the extent that such interest is acquired in connection with the proceeds of any loan or other advance made or guaranteed, directly or indirectly, by any other partner or the partnership (or any person related to any such other partner or the partnership). The preceding sentence shall not apply to the extent the loan or other advance is repaid before the date of the enactment of this section unless such repayment is made with the proceeds of a loan or other advance described in the preceding sentence.</text></subparagraph><subparagraph id="HC25AC383E1A54003A8B6A418C1BB3EF6"><enum>(B)</enum><header>Reduction in allocations to qualified capital interests for loans from nonservice-providing partners to the partnership</header><text>For purposes of this subsection, any loan or other advance to the partnership made or guaranteed, directly or indirectly, by a partner not providing services described in subsection (c)(2) to the partnership (or any person related to such partner) shall be taken into account in determining the qualified capital interests of the partners in the partnership.</text></subparagraph></paragraph><paragraph id="HF946CF48E105498AA84E307E026C32F2"><enum>(9)</enum><header>Special rule for qualified family partnerships</header><subparagraph id="HFB66BA3215FC4D4F90D034EDD112A616"><enum>(A)</enum><header>In general</header><text>In the case of any specified family partnership interest, paragraph (1)(A) shall be applied without regard to the phrase <quote>and who are not related to the partner holding the qualified capital interest</quote>.</text></subparagraph><subparagraph id="H619175DF94104912BF507A8EE2F6B78D"><enum>(B)</enum><header>Specified family partnership interest</header><text>For purposes of this paragraph, the term <term>specified family partnership interest</term> means any investment services partnership interest if—</text><clause id="H4A756AE04FFC413BBEEA5EF93E2F25DB"><enum>(i)</enum><text>such interest is an interest in a qualified family partnership,</text></clause><clause id="H4DAD1EA5FD314D1FA8698CB2B7EACC41"><enum>(ii)</enum><text>such interest is held by a natural person or by a trust with respect to which each beneficiary is a grantor or a person whose relationship to the grantor is described in section 267(b)(1), and</text></clause><clause id="H54FA146E30F04A2E82182787A13BF149"><enum>(iii)</enum><text>all other interests in such qualified family partnership with respect to which significant allocations are made (within the meaning of paragraph (1)(B) and in comparison to the allocations made to the interest described in clause (ii)) are held by persons who—</text><subclause id="H69F2A31801B1402184C7D806A4303B1C"><enum>(I)</enum><text>are related to the natural person or trust referred to in clause (ii), or</text></subclause><subclause id="HBDAB3927C70A48519147F5854EFE0574"><enum>(II)</enum><text display-inline="yes-display-inline">provide services described in subsection (c)(2).</text></subclause></clause></subparagraph><subparagraph id="H0479EB75160C48CDB7BB8A76851692E8"><enum>(C)</enum><header>Qualified family partnership</header><text>For purposes of this paragraph, the term <term>qualified family partnership</term> means any partnership if—</text><clause id="HD4C304F4DB9249E58E67EA44BD863F15"><enum>(i)</enum><text>all of the capital and profits interests of such partnership are held by—</text><subclause id="H64FA336CCC104C5A978A5F4D502FCA16"><enum>(I)</enum><text>specified family members,</text></subclause><subclause id="H85B9899C18B14C90958D22FB51EDD2BC"><enum>(II)</enum><text>any person closely related (within the meaning of subsection (c)(3)(C)(ii)) to a specified family member, or</text></subclause><subclause id="HAB45EDD7A9F7418FAFAA7DD2E547A1AA"><enum>(III)</enum><text display-inline="yes-display-inline">any other person (not described in subclause (I) or (II)) if such interest is an investment services partnership interest with respect to such person, and</text></subclause></clause><clause id="H475B406E469545D983302DD7955DDC6F"><enum>(ii)</enum><text>such partnership does not hold itself out to the public as an investment advisor.</text></clause></subparagraph><subparagraph id="H260D13A8B8F64511873088841D98B44F"><enum>(D)</enum><header>Specified family members</header><text>For purposes of subparagraph (C), individuals shall be treated as specified family members if such individuals would be treated as one person under the rules of section 1361(c)(1) if the applicable date (within the meaning of subparagraph (B)(iii) thereof) were the latest of—</text><clause id="H5938484B2F024D60B2D6BF7AA839BD40"><enum>(i)</enum><text>the date of the establishment of the partnership,</text></clause><clause id="H51D2CCDB02B84491815ED94C6F4BD151"><enum>(ii)</enum><text>the earliest date that the common ancestor holds a capital or profits interest in the partnership, or</text></clause><clause id="H94420A0F42CA42A5B4C734E1E7B66D75"><enum>(iii)</enum><text>the date of the enactment of this section.</text></clause></subparagraph></paragraph></subsection><subsection id="HE9DB1B97C8A64664852F93469B5D0B8D"><enum>(e)</enum><header>Other income and gain in connection with investment management services</header><paragraph id="HB8C646061D6D4DEC865B73829A623C94"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">If—</text><subparagraph id="HA8B9B7EBCA7842C5AEF702DDFB7549BD"><enum>(A)</enum><text>a person performs (directly or indirectly) investment management services for any investment entity,</text></subparagraph><subparagraph id="HE3623532C0324FAE9950EBDDC296F6F3"><enum>(B)</enum><text>such person holds (directly or indirectly) a disqualified interest with respect to such entity, and</text></subparagraph><subparagraph id="HEA22046FA39F43FF81EE0028C6F70FCE"><enum>(C)</enum><text display-inline="yes-display-inline">the value of such interest (or payments thereunder) is substantially related to the amount of income or gain (whether or not realized) from the assets with respect to which the investment management services are performed,</text></subparagraph><continuation-text continuation-text-level="paragraph">any income or gain with respect to such interest shall be treated as ordinary income. Rules similar to the rules of subsections (a)(5) and (d) shall apply for purposes of this subsection. </continuation-text></paragraph><paragraph id="H068D05D921F34E8494BFCDF46B1A0AB5"><enum>(2)</enum><header>Definitions</header><text>For purposes of this subsection—</text><subparagraph id="H6EA7F98BE6C748908EFFC1718D63C5CB"><enum>(A)</enum><header>Disqualified interest</header><clause id="H75E44B1C5B8A41DAA9442A9AA2B13314"><enum>(i)</enum><header>In general</header><text>The term <term>disqualified interest</term> means, with respect to any investment entity—</text><subclause id="H78B71914A3424ECBB2C6D6F3864F3114"><enum>(I)</enum><text>any interest in such entity other than indebtedness,</text></subclause><subclause id="HCE4A6E676DEA49DCBBEF1328257D58E6"><enum>(II)</enum><text>convertible or contingent debt of such entity,</text></subclause><subclause id="H6C18882E86C74C8DBC319B1A227DE66B"><enum>(III)</enum><text>any option or other right to acquire property described in subclause (I) or (II), and</text></subclause><subclause id="H06E5824AA075421E938268DA7C3C882B"><enum>(IV)</enum><text>any derivative instrument entered into (directly or indirectly) with such entity or any investor in such entity.</text></subclause></clause><clause id="H2C5F6244B6DA4DF58C86503BECD3B794"><enum>(ii)</enum><header>Exceptions</header><text>Such term shall not include—</text><subclause id="HD5E4127906FF41AE837179BCF938F2B4"><enum>(I)</enum><text>a partnership interest,</text></subclause><subclause id="H289AD7C081474B3A9497EC4D2D93C057"><enum>(II)</enum><text>except as provided by the Secretary, any interest in a taxable corporation, and</text></subclause><subclause id="H9720F9DED9AC4BF3AAAA35B155910C14"><enum>(III)</enum><text>except as provided by the Secretary, stock in an S corporation.</text></subclause></clause></subparagraph><subparagraph id="HAD31F4118FA34830BB23883CF469DC23"><enum>(B)</enum><header>Taxable corporation</header><text>The term <term>taxable corporation</term> means—</text><clause id="H1899CECF4D894D18895DEF59DF9D0FB6"><enum>(i)</enum><text>a domestic C corporation, or</text></clause><clause id="H44FB2D9EA80848338B212AFCDD9AA85C"><enum>(ii)</enum><text>a foreign corporation substantially all of the income of which is—</text><subclause id="H9B2876F51F5B41C8846872185592AA71"><enum>(I)</enum><text>effectively connected with the conduct of a trade or business in the United States, or</text></subclause><subclause id="H42ED7084B6824ACF9C994790BF069100"><enum>(II)</enum><text>subject to a comprehensive foreign income tax (as defined in section 457A(d)(2)).</text></subclause></clause></subparagraph><subparagraph id="HD548C0143026491E9C961598F7796523"><enum>(C)</enum><header>Investment management services</header><text>The term <term>investment management services</term> means a substantial quantity of any of the services described in subsection (c)(2).</text></subparagraph><subparagraph id="HA88FBD00EE904299A3AD0D1F2316560F"><enum>(D)</enum><header>Investment entity</header><text>The term <term>investment entity</term> means any entity which, if it were a partnership, would be an investment partnership.</text></subparagraph></paragraph></subsection><subsection id="H3BE4CD38C63746A495728A60FD1BAAEB"><enum>(f)</enum><header>Exception for domestic C corporations</header><text>Except as otherwise provided by the Secretary, in the case of a domestic C corporation—</text><paragraph id="H0F9550DD98B24853804CA40BF9ADBB51"><enum>(1)</enum><text display-inline="yes-display-inline">subsections (a) and (b) shall not apply to any item allocated to such corporation with respect to any investment services partnership interest (or to any gain or loss with respect to the disposition of such an interest), and</text></paragraph><paragraph id="H3E677992917746C78DE60A7ECE22BF26"><enum>(2)</enum><text>subsection (e) shall not apply.</text></paragraph></subsection><subsection commented="no" id="HC3FC0606BA814EAA9F5AF835ABD7C345"><enum>(g)</enum><header>Regulations</header><text>The Secretary shall prescribe such regulations or other guidance as is necessary or appropriate to carry out the purposes of this section, including regulations or other guidance to—</text><paragraph id="H16152D3938804BAC927858122B7529AE"><enum>(1)</enum><text display-inline="yes-display-inline">require such reporting and recordkeeping by any person in such manner and at such time as the Secretary may prescribe for purposes of enabling the partnership to meet the requirements of section 6031 with respect to any item described in section 702(a)(9),</text></paragraph><paragraph commented="no" id="H2073EF0BE8FB4EF8A216CB3E3EAB9C0B"><enum>(2)</enum><text>provide modifications to the application of this section (including treating related persons as not related to one another) to the extent such modification is consistent with the purposes of this section,</text></paragraph><paragraph id="HC7FB20EC040141DE80B373BBDC076610"><enum>(3)</enum><text display-inline="yes-display-inline">prevent the avoidance of the purposes of this section (including through the use of qualified family partnerships), and</text></paragraph><paragraph commented="no" id="H0D5F90EDE9174C97A1DF0AA9BDEFDD5A"><enum>(4)</enum><text>coordinate this section with the other provisions of this title.</text></paragraph></subsection><subsection commented="no" id="H07179ED23A5649039947448997159BF1"><enum>(h)</enum><header>Cross reference</header><text>For 40-percent penalty on certain <quote>partner.</quote> and inserting <quote>partner (other than a partnership in which it holds an investment services partnership interest).</quote>.</text></subparagraph></paragraph><paragraph id="HE4876F5E95144094AA570174D28A921B"><enum>(4)</enum><header>Investment services partnership interests; qualified capital interests</header><text><external-xref legal-doc="usc" parsable-cite="usc/26/751">Section 751</external-xref> is amended by adding at the end the following new subsection:</text><quoted-block display-inline="no-display-inline" id="H5F6D9A7B8F8140C38DB8E7FD1A9B3EE2" style="OLC"><subsection id="H29628448018B476190A1C80487CCABA6"><enum>(g)</enum><header>Investment services partnership interests</header><text display-inline="yes-display-inline">For purposes of this section—</text><paragraph id="HB5A044570C2443DEA786E9129BB0218D"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The term <term>investment services partnership interest</term> has the meaning given such term by section 710(c).</text></paragraph><paragraph id="H3F973D66333B4740AAA0A0501A1F66CD"><enum>(2)</enum><header>Adjustments for qualified capital interests</header><text>The amount to which subsection (a) applies by reason of paragraph (3) thereof shall not include so much of such amount as is attributable to any portion of the investment services partnership interest which is a qualified capital interest (determined under rules similar to the rules of section 710(d)).</text></paragraph><paragraph id="H2DDB1CBF658E4A4BB8B4336698771DF6"><enum>(3)</enum><header>Exception for publicly traded partnerships</header><text>Except as otherwise provided by the Secretary, in the case of an exchange of an interest in a publicly traded partnership (as defined in section 7704) to which subsection (a) applies—</text><subparagraph id="HF4BD3705029044FE9F2488EE72E5DD62"><enum>(A)</enum><text>this section shall be applied without regard to subsections (a)(3), (b)(1)(A)(iii), and (f)(3), and</text></subparagraph><subparagraph id="H826FCDF8D3AE4D10835E9E467E5D42EC"><enum>(B)</enum><text display-inline="yes-display-inline">such partnership shall be treated as owning its proportionate share of the property of any other partnership in which it is a partner.</text></subparagraph></paragraph><paragraph id="H0D3522F9CE8C4FD58368DB8299DB239B"><enum>(4)</enum><header>Recognition of gains</header><text>Any gain with respect to which subsection (a) applies by reason of paragraph (3) thereof shall be recognized notwithstanding any other provision of this title.</text></paragraph><paragraph id="H0D7AFB520C294F8B81C239592BF39E4C"><enum>(5)</enum><header>Coordination with inventory items</header><text>An investment services partnership interest held by the partnership shall not be treated as an inventory item of the partnership.</text></paragraph><paragraph id="HAC39EB4DF741428A993B04CCA09A8997"><enum>(6)</enum><header>Prevention of double counting</header><text display-inline="yes-display-inline">Under regulations or other guidance prescribed by the Secretary, subsection (a)(3) shall not apply with respect to any amount to which section 710 applies.</text></paragraph><paragraph id="HAE2420E0D8FC4D4C9972E36013648D7E"><enum>(7)</enum><header>Valuation methods</header><text display-inline="yes-display-inline">The Secretary shall prescribe regulations or other guidance which provide the acceptable methods for valuing investment services partnership interests for purposes of this section.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="HAD3555F3286049859DA03C98B52E960F"><enum>(c)</enum><header>Treatment for purposes of section 7704</header><text>Subsection (d) of section 7704 of such Code is amended by adding at the end the following new paragraph:</text><quoted-block display-inline="no-display-inline" id="H444C7B2B0A83447BAB2873764B3A78A8" style="OLC"><paragraph id="H603E98C5EA4B49C1BEE231A15D5EA631"><enum>(6)</enum><header>Income from certain carried interests not qualified</header><subparagraph id="HCDC3876507FF4B3EA1F495DED2D96824"><enum>(A)</enum><header>In general</header><text>Specified carried interest income shall not be treated as qualifying income.</text></subparagraph><subparagraph id="H8B793166370840269CCB5069876A917C"><enum>(B)</enum><header>Specified carried interest income</header><text>For purposes of this paragraph—</text><clause id="HC1C812279FFD40E989A7D5C9E2FC3A7A"><enum>(i)</enum><header>In general</header><text>The term <term>specified carried interest income</term> means—</text><subclause id="H5463EC09F0744D03A30DE70150459553"><enum>(I)</enum><text>any item of income or gain allocated to an investment services partnership interest (as defined in section 710(c)) held by the partnership,</text></subclause><subclause id="H955AAED2F9FA48EBB55228915C3DB53C"><enum>(II)</enum><text>any gain on the disposition of an investment services partnership interest (as so defined) or a partnership interest to which (in the hands of the partnership) section 751 applies, and</text></subclause><subclause id="HC5967361010B42AB87E7D6E835715765"><enum>(III)</enum><text>any income or gain taken into account by the partnership under subsection (b)(4) or (e) of section 710.</text></subclause></clause><clause id="H6CCBDF62A9384BF7B88E8D039BAD81D8"><enum>(ii)</enum><header>Exception for qualified capital interests</header><text>A rule similar to the rule of section 710(d) shall apply for purposes of clause (i).</text></clause></subparagraph><subparagraph id="HA5FE831FF7774FF498CFCC91EDC87EFF"><enum>(C)</enum><header>Coordination with other provisions</header><text>Subparagraph (A) shall not apply to any item described in paragraph (1)(E) (or so much of paragraph (1)(F) as relates to paragraph (1)(E)).</text></subparagraph><subparagraph id="H7C81FD55681D4356B5203E4222BE4381"><enum>(D)</enum><header>Special rules for certain partnerships</header><clause id="H5B651F6CA53A4C71AB3063E5C529BF6E"><enum>(i)</enum><header>Certain partnerships owned by real estate investment trusts</header><text>Subparagraph (A) shall not apply in the case of a partnership which meets each of the following requirements:</text><subclause id="H2B1A0A78E35141209F946A59C4277B58"><enum>(I)</enum><text>Such partnership is treated as publicly traded under this section solely by reason of interests in such partnership being convertible into interests in a real estate investment trust which is publicly traded.</text></subclause><subclause id="HD7B6BC6960B44F71979FFF109A6ACB1C"><enum>(II)</enum><text display-inline="yes-display-inline">Fifty percent or more of the capital and profits interests of such partnership are owned, directly or indirectly, at all times during the taxable year by such real estate investment trust (determined with the application of section 267(c)).</text></subclause><subclause id="H8707C42C342F47C3B3BDBA4C12520443"><enum>(III)</enum><text>Such partnership meets the requirements of paragraphs (2), (3), and (4) of section 856(c).</text></subclause></clause><clause id="H6534B9ACC9D0407D8C2B1E28FF7D07A5"><enum>(ii)</enum><header>Certain partnerships owning other publicly traded partnerships</header><text>Subparagraph (A) shall not apply in the case of a partnership which meets each of the following requirements:</text><subclause id="H63AD397ECADE4D7FA71DC51A18BB8332"><enum>(I)</enum><text>Substantially all of the assets of such partnership consist of interests in one or more publicly traded partnerships (determined without regard to subsection (b)(2)).</text></subclause><subclause commented="no" id="H50C8032FC80847178E19E94E1A44DC7C"><enum>(II)</enum><text>Substantially all of the income of such partnership is ordinary income or section 1231 gain (as defined in section 1231(a)(3)).</text></subclause></clause></subparagraph><subparagraph id="H0223332258F245FF974C31F07DDCFAAA"><enum>(E)</enum><header>Transitional rule</header><text>Subparagraph (A) shall not apply to any taxable year of the partnership beginning before the date which is 10 years after the date of the enactment of this paragraph.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HA5F390511E4342928A704F2C0D09FC6D"><enum>(d)</enum><header>Imposition of penalty on underpayments</header><paragraph id="H46767FC2A48B4C959F543E541EDA100C"><enum>(1)</enum><header>In general</header><text>Subsection (b) of section 6662 of such Code is amended by inserting after paragraph (7) the following new paragraph:</text><quoted-block display-inline="no-display-inline" id="HD0581B0754CE4B83BDE360B2FFB2755A" style="OLC"><paragraph id="HE70FC4746B874F95876D8108B1D542E7"><enum>(8)</enum><text>The application of section 710(e) or the regulations or other guidance prescribed under section 710(g) to prevent the avoidance of the purposes of section 710.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="H86B1D08043014A5BBD7C0D39F1B38FF0"><enum>(2)</enum><header>Amount of penalty</header><subparagraph id="H9F9B3B05F68D45B98BFD313172572F26"><enum>(A)</enum><header>In general</header><text>Section 6662 of such Code is amended by adding at the end the following new subsection:</text><quoted-block display-inline="no-display-inline" id="HCDB5F4A2DF9B4346A8B6DCBA053519C0" style="OLC"><subsection id="H7642FB494D724D599E27308EF9B71BB7"><enum>(k)</enum><header>Increase in penalty in case of property transferred for investment management services</header><text>In the case of any portion of an underpayment to which this section applies by reason of subsection (b)(8), subsection (a) shall be applied with respect to such portion by substituting <quote>40 percent</quote> for <quote>20 percent</quote>.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph><subparagraph display-inline="no-display-inline" id="HFD812C28EBFB4A6196BB25E31935D9E8"><enum>(B)</enum><header>Conforming amendment</header><text>Subparagraph (B) of section 6662A(e)(2) of such Code is amended by striking <quote>or (i)</quote> and inserting <quote>, (i), or (k)</quote>.</text></subparagraph></paragraph><paragraph display-inline="no-display-inline" id="H8EF1E389E76F4E8FB8387FB5E15DC30A"><enum>(3)</enum><header>Special rules for application of reasonable cause exception</header><text>Subsection (c) of <external-xref legal-doc="usc" parsable-cite="usc/26/6664">section 6664</external-xref> is amended—</text><subparagraph id="H8245E45D6E3C49169BFA2631297F6010"><enum>(A)</enum><text>by redesignating paragraphs (3) and (4) as paragraphs (4) and (5), respectively;</text></subparagraph><subparagraph id="HD433D40F2D2249C68CD136E6ED474193"><enum>(B)</enum><text>by striking <quote>paragraph (3)</quote> in paragraph (5)(A), as so redesignated, and inserting <quote>paragraph (4)</quote>; and</text></subparagraph><subparagraph id="H4EE2F7E16A1F42CDB025EDAC95822744"><enum>(C)</enum><text>by inserting after paragraph (2) the following new paragraph:</text><quoted-block display-inline="no-display-inline" id="HA6FC44BEA2F443C18682167A667EEC18" style="OLC"><paragraph id="HF73AECF986E74ECDBD19ADFBFE50E2A7"><enum>(3)</enum><header>Special rule for underpayments attributable to investment management services</header><subparagraph id="H587FE26B204E4C0CB1307EAA3848451D"><enum>(A)</enum><header>In general</header><text>Paragraph (1) shall not apply to any portion of an underpayment to which section 6662 applies by reason of subsection (b)(8) unless—</text><clause id="HF2E3F7E7F81C4D44BF9BD29F2FED2D17"><enum>(i)</enum><text display-inline="yes-display-inline">the relevant facts affecting the tax treatment of the item are adequately disclosed,</text></clause><clause id="HE7E4B4F3D2174547BD1E2E9C0224243F"><enum>(ii)</enum><text>there is or was substantial authority for such treatment, and</text></clause><clause id="HB1AEE6C3F0484EDAAE85D6D19D721DF0"><enum>(iii)</enum><text>the taxpayer reasonably believed that such treatment was more likely than not the proper treatment.</text></clause></subparagraph><subparagraph id="HFE5867C2641440ECA0D04B61CB2C485C"><enum>(B)</enum><header>Rules relating to reasonable belief</header><text>Rules similar to the rules of subsection (d)(3) shall apply for purposes of subparagraph (A)(iii).</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection><subsection id="H5B3A3E59C0574F609EC215A81CF174CB"><enum>(e)</enum><header>Income and loss from investment services partnership interests taken into account in determining net earnings from self-Employment</header><paragraph id="H4AF1EBA48D8D4F3FB905EC89F5BB39A4"><enum>(1)</enum><header>Internal Revenue Code</header><subparagraph id="H150EA0C9842B4F34A1C0EE876658324B"><enum>(A)</enum><header>In general</header><text>Section 1402(a) of such Code is amended by striking <quote>and</quote> at the end of paragraph (16), by striking the period at the end of paragraph (17) and inserting <quote>; and</quote>, and by inserting after paragraph (17) the following new paragraph:</text><quoted-block display-inline="no-display-inline" id="HDBA51BDEC8D9498B9316EBF11E4679B9" style="OLC"><paragraph id="H0DC0CE1E9E33463E87A0D05F801B7C45"><enum>(18)</enum><text display-inline="yes-display-inline">notwithstanding the preceding provisions of this subsection, in the case of any individual engaged in the trade or business of providing services described in section 710(c)(2) with respect to any entity, investment services partnership income or loss (as defined in subsection (m)) of such individual with respect to such entity shall be taken into account in determining the net earnings from self-employment of such individual.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph><subparagraph id="H85842E397DD04345A96067207978BAD3"><enum>(B)</enum><header>Investment services partnership income or loss</header><text>Section 1402 of such Code is amended by adding at the end the following new subsection:</text><quoted-block display-inline="no-display-inline" id="H3FF285F0027543B09C2F36AD4FFA223B" style="OLC"><subsection id="HF81D6C95BA714E55A9AE627F92641F4D"><enum>(m)</enum><header>Investment services partnership income or loss</header><text display-inline="yes-display-inline">For purposes of subsection (a)—</text><paragraph commented="no" id="H2EDEC2A817534A3D8400CCB280810D12"><enum>(1)</enum><header>In general</header><text>The term <term>investment services partnership income or loss</term> means, with respect to any investment services partnership interest (as defined in section 710(c)) or disqualified interest (as defined in section 710(e)), the net of—</text><subparagraph commented="no" id="HDA2A6E7D2AE34EFF85BCF0FA7BC67787"><enum>(A)</enum><text>the amounts treated as ordinary income or ordinary loss under subsections (b) and (e) of section 710 with respect to such interest,</text></subparagraph><subparagraph commented="no" id="HA2BA644AF4454AFE979F2DAD73D574B9"><enum>(B)</enum><text>all items of income, gain, loss, and deduction allocated to such interest, and</text></subparagraph><subparagraph commented="no" id="H81F40C92F90D49968C3632EC2141B80A"><enum>(C)</enum><text>the amounts treated as realized from the sale or exchange of property other than a capital asset under section 751 with respect to such interest.</text></subparagraph></paragraph><paragraph id="H6313C6F374364D74937511934D49CE7B"><enum>(2)</enum><header>Exception for qualified capital interests</header><text>A rule similar to the rule of section 710(d) shall apply for purposes of applying paragraph (1)(B).</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph display-inline="no-display-inline" id="H5769843D17154E68B97C62B5AB587DCC"><enum>(2)</enum><header>Social Security Act</header><text>Section 211(a) of the Social Security Act is amended by striking <quote>and</quote> at the end of paragraph (15), by striking the period at the end of paragraph (16) and inserting <quote>; and</quote>, and by inserting after paragraph (16) the following new paragraph:</text><quoted-block display-inline="no-display-inline" id="H5D2F016861884AA49554EBD0DB16E4FC" style="OLC"><paragraph id="H4CC7BADE40EA43BDA23CA2F43D1C5ACE"><enum>(17)</enum><text display-inline="yes-display-inline">Notwithstanding the preceding provisions of this subsection, in the case of any individual engaged in the trade or business of providing services described in <external-xref legal-doc="usc" parsable-cite="usc/26/710">section 710(c)(2)</external-xref> of the Internal Revenue Code of 1986 with respect to any entity, investment services partnership income or loss (as defined in section 1402(m) of such Code) shall be taken into account in determining the net earnings from self-employment of such individual.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="HA5F8BDFCA0FC4A1E96DE696163422299"><enum>(f)</enum><header>Separate accounting by partner</header><text><external-xref legal-doc="usc" parsable-cite="usc/26/702">Section 702(a)</external-xref> of the Internal Revenue Code of 1986 is amended by striking <quote>and</quote> at the end of paragraph (7), by striking the period at the end of paragraph (8) and inserting <quote>, and</quote>, and by inserting after paragraph (8) the following:</text><quoted-block display-inline="no-display-inline" id="HDD6ED79BE67B4B0ABAC23D965AA2B027" style="OLC"><paragraph id="H78151427AC6048368F48B14C438B6765"><enum>(9)</enum><text display-inline="yes-display-inline">any amount treated as ordinary income or loss under subsection (a), (b), or (e) of section 710.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H5E30887F23314F4FACAA4D4D66D92CCA"><enum>(g)</enum><header>Conforming amendments</header><paragraph id="H6F9C2446207B4EAA918ABC44E5A6E981"><enum>(1)</enum><text>Subsection (d) of section 731 of such Code is amended by inserting <quote>section 710(b)(4) (relating to distributions of partnership property),</quote> after <quote>to the extent otherwise provided by</quote>.</text></paragraph><paragraph id="H2F1C4EBEA9694464AF10E7BA045C8C0A"><enum>(2)</enum><text>Section 741 of such Code is amended by inserting <quote>or section 710 (relating to special rules for partners providing investment management services to partnerships)</quote> before the period at the end.</text></paragraph><paragraph id="HBB45A4BAFA3D4ADAA3B63B9FB2B4F983"><enum>(3)</enum><text display-inline="yes-display-inline">The table of sections for part I of subchapter K of chapter 1 of such Code is amended by adding at the end the following new item:</text><quoted-block display-inline="no-display-inline" id="H98957168BBAD45F9B7037D294085A915" style="OLC"><toc container-level="quoted-block-container" idref="HA1F4D05C66694F689CF6583DB396AC1E" lowest-bolded-level="division-lowest-bolded" lowest-level="section" quoted-block="no-quoted-block" regeneration="yes-regeneration"><toc-entry idref="H881A9384E61F4D34B4D5D55B8FD4AF14" level="section">Sec. 710. Special rules for partners providing investment management services to partnerships.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="H79E9748C20A74421A0965B92AC1ABC8C"><enum>(4)</enum><text display-inline="yes-display-inline">Part IV of subchapter O of chapter 1 of such Code is amended by striking section 1061, and the table of sections for such part is amended by striking the item relating to section 1061.</text></paragraph></subsection><subsection id="HC75E302DE65844AB97A1D99520CE0788"><enum>(h)</enum><header>Effective date</header><paragraph id="H64251E7BF9CF47A58B285EA7293E4D75"><enum>(1)</enum><header>In general</header><text>Except as otherwise provided in this subsection, the amendments made by this section shall apply to taxable years ending after the date of the enactment of this Act.</text></paragraph><paragraph id="H93E543F4F03E4F059E8FFFB83A3E6FB2"><enum>(2)</enum><header>Partnership taxable years which include effective date</header><text display-inline="yes-display-inline">In applying <external-xref legal-doc="usc" parsable-cite="usc/26/710">section 710(a)</external-xref> of the Internal Revenue Code of 1986 (as added by this section) in the case of any partnership taxable year which includes the date of the enactment of this Act, the amount of the net capital gain referred to in such section shall be treated as being the lesser of the net capital gain for the entire partnership taxable year or the net capital gain determined by only taking into account items attributable to the portion of the partnership taxable year which is after such date.</text></paragraph><paragraph id="H1DB91733764941B08C64B0BD2555851B"><enum>(3)</enum><header>Dispositions of partnership interests</header><subparagraph id="HE91D468662EF483F89E5962C3109F26D"><enum>(A)</enum><header>In general</header><text>Section 710(b) of such Code (as added by this section) shall apply to dispositions and distributions after the date of the enactment of this Act.</text></subparagraph><subparagraph id="H31120038767647B6B5B80D73D4D3CC49"><enum>(B)</enum><header>Indirect dispositions</header><text>The amendments made by subsection (b) shall apply to transactions after the date of the enactment of this Act.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HDAEFE67E5903485B89155C15FE1A262E"><enum>(4)</enum><header>Other income and gain in connection with investment management services</header><text display-inline="yes-display-inline">Section 710(e) of such Code (as added by this section) shall take effect on the date of the enactment of this Act.</text></paragraph></subsection></section><section id="HFCDCBA85875D4802B0852109F6604ECF"><enum>403.</enum><header>Return to pre-2018 estate and gift tax basic exclusion amount</header><subsection id="H2F06E28D2CA640599B0D08915E8DCE41"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/26/2010">Section 2010(c)(3)</external-xref> of the Internal Revenue Code of 1986 is amended by striking subparagraph (C).</text></subsection><subsection id="H602E26DC28A74303A6F2536E070A1090"><enum>(b)</enum><header>Effective date</header><text display-inline="yes-display-inline">The amendments made by this section shall apply to estates of decedents dying and gifts made after the date of the enactment of this Act.</text></subsection></section></title></legis-body></bill>
