R. 1369</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20210225">February 25, 2021</action-date><action-desc><sponsor name-id="P000599">Mr. Posey</sponsor> (for himself and <cosponsor name-id="C001111">Mr. Crist</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HWM00">Committee on Ways and Means</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Internal Revenue Code of 1986 to provide bonus depreciation for certain space launch expenditures, and for other purposes.</official-title></form><legis-body id="HC6F45FA51A764C94BECFECC30A79AE2B" style="OLC"><section id="HAC1A1E028C5A41379822D10E54599759" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>American Space Commerce Act of 2021</short-title></quote>.</text></section><section id="H8A350900ACC044599E8196587F520406"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following: </text><paragraph id="HC8DD0011453644F3960DAAD341D688DA"><enum>(1)</enum><text display-inline="yes-display-inline">The United States is the only nation with a competitive commercial space launch industry.</text></paragraph><paragraph id="HAD9200E7AF444978AB58EF70F3A815CA"><enum>(2)</enum><text display-inline="yes-display-inline">A robust domestic launch industry and capability is crucial to the United States’ continuing economic, national security, scientific, and exploration leadership.</text></paragraph><paragraph id="H1D304B457742456C9DBDFF2B880AC2F3"><enum>(3)</enum><text display-inline="yes-display-inline">Commercial space launch vehicles manufactured and launched in the United States by United States launch service providers benefit national security and the national economy, earth and space science, and human spaceflight, and are enablers of the global space economy.</text></paragraph><paragraph id="H3B0B93FDC6FA4203B2A79369F7EBAA8D"><enum>(4)</enum><text display-inline="yes-display-inline">Commercial space launch vehicles manufactured and launched in the United States by United States launch service providers are used for virtually all United States national security payloads, and therefore, are indispensable to the security of the United States, as well as its allies and friends.</text></paragraph><paragraph id="H443D55B4EED744278000394CC95047AF"><enum>(5)</enum><text display-inline="yes-display-inline">Multiple American companies are developing small launch vehicles to compete in the domestic and international commercial launch market. These companies are financed predominately by private capital, are independently developing capabilities, and are primarily serving commercial customers.</text></paragraph><paragraph id="H97B47D7C27BF46A388A9582722D148A0"><enum>(6)</enum><text display-inline="yes-display-inline">Several foreign governments have taken notice of U.S. market growth and have begun to fund their own vehicles to compete within the same market. While some of these international vehicles are putatively “private,” most benefit from subsidies or developmental support from their national governments.</text></paragraph><paragraph id="H4FECFA1A551D4D6BBFBB130F52596AFA"><enum>(7)</enum><text display-inline="yes-display-inline">The 2019 Report to Congress of the United States-China Economic and Security Review Commission stated, <quote>China is taking steps to establish a commanding position in the commercial launch and satellite sectors relying in part on aggressive state-backed financing that foreign market-driven companies cannot match</quote>.</text></paragraph><paragraph id="H5F4110EA2EDF4FD8A7BEC293E835E437"><enum>(8)</enum><text display-inline="yes-display-inline">The report further adds, <quote>China has already succeeded in undercutting some U.S. and other foreign launch and satellite providers in the international market, threatening to hollow out these countries’ space industrial bases</quote>.</text></paragraph><paragraph id="H9EAB59638E58441997D078F73E3BF501"><enum>(9)</enum><text display-inline="yes-display-inline">China announced a plan to advance its Space ambitions by creating a Space Economic Zone to generate $10 trillion annually.</text></paragraph><paragraph id="H1A9330307E17420FBAF845BF7030AD88"><enum>(10)</enum><text display-inline="yes-display-inline">The U.S. commercial launch industry, whose viability the National Aeronautics and Space Administration and the Department of Defense depend on to launch critical national assets, is forced to compete with state-backed launch enterprises across the globe whose launch providers are not required to be profitable.</text></paragraph><paragraph id="H1D2B6D8144C34A8B9E5C57B8E9B81676"><enum>(11)</enum><text display-inline="yes-display-inline">A strong domestic space launch industry is in the national security interest of the United States.</text></paragraph><paragraph id="HB1ABD9ED5DDE44A69D1AF4E498B0AC3A"><enum>(12)</enum><text display-inline="yes-display-inline">Foreign launch providers are heavily subsidized by their governments and use these subsidies to intentionally price below cost in an effort to undercut American competition, materially harming the American industrial base.</text></paragraph><paragraph id="H6AFFC5B08A9446B3B457EB53252B7F52"><enum>(13)</enum><text display-inline="yes-display-inline">Increased use of United States-manufactured commercial launch vehicles launched in the United States by United States launch service providers should be encouraged.</text></paragraph><paragraph id="H7248194E220D4FFEA99173A3C2E11798"><enum>(14)</enum><text display-inline="yes-display-inline">Congress supports continued United States leadership in space. </text></paragraph></section><section id="HA7DC5AEF12DC43F58DB2274F6F254BE1"><enum>3.</enum><header>Special allowance for qualified domestic space launch property</header><subsection id="HA2C513C7E0E744F9A165D476DD23CE2C"><enum>(a)</enum><header>Allowance of bonus depreciation for qualified domestic space launch property</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/26/168">Section 168(k)(2)(A)</external-xref> of the Internal Revenue Code of 1986 is amended in clause (i), by striking <quote>or</quote> at the end of subclause (III), by striking <quote>or</quote> at the end of subclause (IV), by adding <quote>or</quote> at the end of subclause (V), and by adding at the end the following new subclause: </text><quoted-block style="OLC" id="H30FDE167483A44CEA9FC9940F0E9A569" display-inline="no-display-inline"><subclause id="H746F222C84CE443CA63E20735C377B59"><enum>(VI)</enum><text display-inline="yes-display-inline">which is qualified domestic space launch property (as defined in paragraph (11)), </text></subclause><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HC4F0D4BCC3A0493F861B5875835DBB63"><enum>(b)</enum><header>Extension of termination of bonus depreciation for qualified domestic space launch property</header><paragraph id="HAC2A612A7F994ACC83F03008C22E767B"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/26/168">Section 168(k)(2)(A)(iii)</external-xref> of the Internal Revenue Code of 1986 is amended by striking <quote>before January 1, 2027.</quote> and inserting <quote>before January 1, 2027 (in the case of qualified domestic space launch property, before January 1, 2033).</quote>.</text></paragraph><paragraph id="H5710EEA1FE4547DD9FDEA3C282B82A36"><enum>(2)</enum><header>Application of applicable percentage</header><text>Section 168(k)(6) of such Code is amended by adding at the end the following new subparagraph:</text><quoted-block style="OLC" id="H53B2433E863D48AEA7F7668194CB5527" display-inline="no-display-inline"><subparagraph id="H2F5CE9B57771478E9956821605048D9B"><enum>(D)</enum><header>Rule for qualified domestic space launch property</header><text display-inline="yes-display-inline">Notwithstanding any other provisions of this paragraph, in the case of any qualified property which is qualified domestic space launch property, the term <quote>applicable percentage</quote> means, in the case of property placed in service after December 31, 2023, and before January 1, 2033, 100 percent. </text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H522D4AF643AE4CC491644C787FAC4D0F"><enum>(c)</enum><header>Qualified domestic space launch property defined</header><text><external-xref legal-doc="usc" parsable-cite="usc/26/168">Section 168(k)</external-xref> of the Internal Revenue Code of 1986 is amended by adding at the end the following new paragraph: </text><quoted-block style="OLC" id="HAF97067FDB5C4A7193577C3D364F3229" display-inline="no-display-inline"><paragraph id="HE05C26269C4749A881672A946843DD29"><enum>(11)</enum><header>Qualified domestic space launch property defined</header><text display-inline="yes-display-inline">For purposes of this subsection—</text><subparagraph id="H0674B8A48D8C4BB9AB0AABC046BC7367"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The term <quote>qualified domestic space launch property</quote> means property placed in service before January 1, 2033, that is—</text><clause id="HA43909A1C8AE4DC88EBEF9197CF5C931"><enum>(i)</enum><text>a space transportation vehicle or payload (as such terms are defined in section 50101 of title 51, United States Code) that is launched from the United States, or </text></clause><clause id="HDDB6BB34A3D94AC99C03291BBABED90F"><enum>(ii)</enum><text display-inline="yes-display-inline">other property or equipment placed in service for the purpose of facilitating a space launch from the United States.</text></clause></subparagraph><subparagraph id="HF17B2898926541188D53E2CF8C7B4CAC"><enum>(B)</enum><header>Special rule for space launches from aircraft</header><text>A space transportation vehicle or payload that is launched from an aircraft shall be considered to be launched from the United States if, and only if, such space transportation vehicle or payload is—</text><clause id="H35AA35260559498EAADC2602B59A509C"><enum>(i)</enum><text>substantially manufactured within the United States, as determined by the Secretary, and</text></clause><clause id="H09ED24CB538C474FA3A6F36C8DE89E46"><enum>(ii)</enum><text>launched from an aircraft on a flight that originated from United States soil. </text></clause></subparagraph><subparagraph id="HE6683791A4434DD7937DC62EDB915C15"><enum>(C)</enum><header>United States</header><text display-inline="yes-display-inline">The term <quote>United States</quote> includes the possessions of the United States. </text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection display-inline="no-display-inline" id="HC22887DEF8CB425AA7ADC9595C118DCC"><enum>(d)</enum><header>Effective date</header><text display-inline="yes-display-inline">The amendments made by this section shall apply to property placed in service after December 31, 2023.</text></subsection></section></legis-body></bill>
