R. 1364</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20210225">February 25, 2021</action-date><action-desc><sponsor name-id="N000188">Mr. Norcross</sponsor> (for himself, <cosponsor name-id="C001069">Mr. Courtney</cosponsor>, <cosponsor name-id="F000466">Mr. Fitzpatrick</cosponsor>, and <cosponsor name-id="K000382">Ms. Kuster</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HED00">Committee on Education and Labor</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Employee Retirement Income Security Act of 1974 to strengthen parity in mental health and substance use disorder benefits, and for other purposes.</official-title></form><legis-body id="HF2ED8E66206D4BCF8CB2786B0AD2484E" style="OLC"><section id="H099D9DDA16464715A9F4C5BBEB3600B0" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Parity Enforcement Act of 2021</short-title></quote>.</text></section><section id="H249335373812453186AF68487A6AE7C1"><enum>2.</enum><header>Authorizing enforcement authority for mental health and substance use disorder benefits</header><subsection id="H92F921D9CF7144DEBCA5852D2DBAA0EE"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 502(c)(10)(A) of the Employee Retirement Income Security Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/29/1132">29 U.S.C. 1132(c)(10)(A)</external-xref>) is amended by striking <quote>for any failure</quote> and all that follows through <quote>in connection with the plan</quote> and inserting</text><quoted-block display-inline="yes-display-inline" id="HB9EC10B6F4E64253B91DEA5C9E732913" style="OLC"><text>for any failure by such sponsor or issuer, in connection with the plan—</text><clause id="HE119F005DB9B40E5A067FB23F49C5641"><enum>(i)</enum><text display-inline="yes-display-inline">to meet the requirements of subsection (a)(1)(F), (b)(3), (c), or (d) of section 702 or section 701 or 702(b)(1) with respect to genetic information; or</text></clause><clause id="HB164E2298C9F43DE88034FF7347E410A"><enum>(ii)</enum><text display-inline="yes-display-inline">to meet the requirements of subsection (a) of section 712 with respect to parity in mental health and substance use disorder benefits.</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H224196A6583D4C32BB945695534D8E2F"><enum>(b)</enum><header>Technical and conforming amendments</header><text>Section 502 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/29/1132">29 U.S.C. 1132</external-xref>) is amended—</text><paragraph commented="no" id="H109F06CFBE0F4ABAB58F6DA0813DAF3E"><enum>(1)</enum><text>in subsection (a)(6), by striking <quote>or (9)</quote> and inserting <quote>(9), or (10)</quote>;</text></paragraph><paragraph id="HD0C3E6C1A73C4151A044B147C0E977A0"><enum>(2)</enum><text>in subsection (b)(3)—</text><subparagraph id="HF05C0744BF09485B8D72B3CF3E98B8C7"><enum>(A)</enum><text>by striking <quote>subsections (c)(9) and (a)(6)</quote> and inserting <quote>subsections (c)(9), (c)(10), and (a)(6)</quote>;</text></subparagraph><subparagraph id="HD25F4342F47B425AA2EC68F871FF9AAF"><enum>(B)</enum><text>by striking <quote>under subsection (c)(9)</quote> and inserting <quote>under subsections (c)(9) and (c)(10)</quote>; and</text></subparagraph><subparagraph id="H5B89D44370BA4EB7AF155C42E80441AC"><enum>(C)</enum><text>by striking <quote>706(a)(1)</quote> and inserting <quote>733(a)(1)</quote>; and</text></subparagraph></paragraph><paragraph id="H6FA8CC636C8C40A896EEF40AE4545FF0"><enum>(3)</enum><text>in subsection (c)(10) in the heading, by striking <quote><header-in-text level="paragraph" style="OLC">use of genetic information</header-in-text></quote> and inserting <quote><header-in-text level="paragraph" style="OLC">use of genetic information and parity in mental health and substance use disorder benefits</header-in-text></quote>.</text></paragraph></subsection><subsection id="H2F277F03677C4060B60962DC51766055"><enum>(c)</enum><header>Effective date</header><text display-inline="yes-display-inline">The amendments made by subsection (a) shall apply with respect to group health plans for plan years beginning after the date that is 1 year after the date of enactment of this Act.</text></subsection></section></legis-body></bill>
