which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To establish a strategic uranium reserve.</official-title></form><legis-body id="H8414D8DD9F2149D09631123F577ABB13" style="OLC"><section id="HA08E934286754162AFA84997623CB58D" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Nuclear Prosperity and Security Act</short-title></quote>.</text></section><section id="H4CB5BE9977044902A1548E52E28E4843"><enum>2.</enum><header>Strategic uranium reserve</header><subsection id="HBAD1265999EE468C8E33D23C60951803"><enum>(a)</enum><header>Establishment</header><paragraph id="H8966C4556FA042FE965C68D2C869170E"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 60 days after the date of enactment of this section and subject to the availability of appropriations, the Secretary of Energy shall establish and operate a uranium reserve (in this section referred to as the <quote>Reserve</quote>) in accordance with this section.</text></paragraph><paragraph id="H79DB0198A240404D81AF0B85BB00BB9C" commented="no"><enum>(2)</enum><header>Other authority</header><text display-inline="yes-display-inline">In establishing and operating the Reserve, the Secretary of Energy shall use the authority granted to the Secretary of Energy under sections 53, 63, and 161 g. of the Atomic Energy Act of 1954 (<external-xref legal-doc="usc" parsable-cite="usc/42/2073">42 U.S.C. 2073</external-xref>, 2093, and 2201(g)).</text></paragraph></subsection><subsection id="H6B9BF0066F9C4C51B18160F71AA526F9"><enum>(b)</enum><header>Purposes</header><text display-inline="yes-display-inline">The purposes of the Reserve are—</text><paragraph id="H07AE4F484A89454D88B000A17B3EC6C0"><enum>(1)</enum><text display-inline="yes-display-inline">to ensure the availability of uranium mined in the United States in the event of a market disruption; and</text></paragraph><paragraph id="H6210125217E643D4B916D936335BF239"><enum>(2)</enum><text display-inline="yes-display-inline">to support strategic fuel cycle capabilities in the United States.</text></paragraph></subsection><subsection id="H6C4B3212B5ED435EA01A533F3C2D27CE"><enum>(c)</enum><header>Exclusion</header><text display-inline="yes-display-inline">The Secretary shall exclude uranium that is mined in the United States by an entity that is owned or controlled by the Government of the Russian Federation or the People’s Republic of China or is incorporated in the Russian Federation or the People’s Republic of China from the reserve.</text></subsection><subsection id="H79E3754AB5E7400CB12B0B54CBE7F847"><enum>(d)</enum><header>Request for information</header><text display-inline="yes-display-inline">Not later than 90 days after the date of enactment of this section, the Secretary of Energy shall publish a request for information that shall be used by the Secretary of Energy to evaluate—</text><paragraph id="H6DD2CA65F5044846859AB09B9AC7690A" commented="no"><enum>(1)</enum><text display-inline="yes-display-inline">how to operate and manage the Reserve;</text></paragraph><paragraph id="HC20EB8CA42F048E19AA624A3AC115C09" commented="no"><enum>(2)</enum><text>how to acquire uranium for the Reserve, including the method of transportation and storage; and</text></paragraph><paragraph id="HFAE4BCEB880C4D71892556A54E2D18B1" commented="no"><enum>(3)</enum><text>the quantity and form of uranium to acquire for the Reserve.</text></paragraph></subsection><subsection id="HBEFB4939774045D7986CF27506ABDB38"><enum>(e)</enum><header>Budget request</header><text display-inline="yes-display-inline">For each fiscal year beginning after the date of enactment of this section, the Secretary of Energy shall include in the budget materials submitted in support of the budget of the President (submitted to Congress pursuant to section 1105 of title 31, United States Code)—</text><paragraph id="H3DDAA58D57D648F8AEFB914A3468D267"><enum>(1)</enum><text display-inline="yes-display-inline">a request for amounts for the acquisition, transportation, or storage of uranium in the Reserve; or</text></paragraph><paragraph id="HA2BCD384CBC042A4BB84B7FD3918229E"><enum>(2)</enum><text>if such request is not included, an explanation for why such amounts are not requested.</text></paragraph></subsection></section></legis-body></bill>
